Kelantan may resort to guillotine
KOTA BARU: A smaller form of the guillotine, similar to that reportedly used to behead French King Louis XVI and his queen Marie Antoinette during the height of the French Revolution in 1793, is set to emerge in Kelantan.
The PAS-led state’s hudud law technical committee, said to be facing problems finding suitable methods to amputate limbs of those convicted of stealing, is considering this “mini” form of the guillotine as an option.
Its chairman Datuk Mohd Amar Abdullah said he would suggest to the panel to use such a contraption, which would not need a surgeon to operate.

A motorcycle crash victim has amputated his injured hand with a homemade guillotine to end 16 years of unbearable pain only to find his arm still hurts.
Desperate Mark Goddard, 44, says he was driven to cut it off because the NHS refused to, and even burned his severed limb to ensure surgeons could not reattach it.
The father-of-one took a fortnight to build the guillotine using an axe, some springs and an old gate post, which took his left hand off ten days ago.
But unfortunately the DIY amputation in his garden, carried out without any anaesthetic, has failed to take away the pain that has tormented him since he was 28.

Amid hudud storm, Putrajaya says Malaysia not a secular state

KUALA LUMPUR, June 16 — Malaysia is not a secular state, the federal government said today as the country continues to debate the possible introduction of hudud, the Islamic criminal law.
While the assertion would diminish a key argument against the implementation of the controversial religious law, Putrajaya stopped short of declaring that Malaysia is an Islamic state.
Minister in the Prime MInister’s Department Datuk Seri Jamil Khir Baharom stressed that the formation of Malaysia was based on the Islamic administration of the Malay Sultanates and that the Malay Sultans were heads of Islam in their respective states.
“This was reinforced by Article 3 of the Federal Constitution which places Islam as the religion of the federal, though other religions can be practised peacefully anywhere within the federation,” he said in a written parliamentary reply.

Hudud debate in Selangor on the cards
Selangor speaker Hannah Yeoh is unlikely to reject a motion by BN asking for the state to look into the possibility of enforcing hudud in the state.
However, she stressed that the final decision had yet to be made.
“I am still considering (the motion) but it is unlikely (for the house) to reject as it is only a motion urging the state government to study the feasibility of hudud in Selangor,” she said in a text message to Malaysiakini today.
Yeoh added that it was stated in Standing Order 27 (5) that a speaker was given power to reject or allow any motion.
Umno’s Sungai Air Tawar assemblyperson Kamarol Zaki Abdul Malik, who mooted the study, was reported as saying that his proposal on hudud was submitted last week.

MCA has criticized Pakatan Rakyat for being in bed with PAS, which will, supposedly, introduced hudud law once it comes into power. Yet, what has MCA said or done in Johor, where it is not even hudud law but syariah that is practised?

Malaysians have always been proud of their multicultural society and they have no problem with Islam being the nation’s official religion. They fear that their secular state is insidiously being turned into a nation which models itself after Aceh, Afghanistan, Saudi Arabia, northern Nigeria or Somalia.
These religious bodies appear to act, for reasons known only to themselves.

Public whippings in Johore?
‘A vote for DAP, is a vote for PAS, is a vote for hudud’. Every time BN wants to weaken Pakatan and frighten the electorate, this trite phrase rattles off the tongues of MCA politicians.
Yesterday, MCA president Chua Soi Lek was again proven wrong. Last April, Chua warned Malaysians, principally the non-Muslims, that a vote for Pakatan would lead to the implementation of hudud law, by PAS, if the Opposition coalition were to win GE-13.
On 13 June 2013 Berita Harian reported that within the past two months, 39 people in Johore, of whom 22 were women, had each received six strokes of the rotan, for committing syariah crimes such as incest and sexual intercourse outside of marriage. Two women had their sentences postponed because one was pregnant and the other was in ‘confinement’.
One fact is obvious. More women, than men, are being punished. Why? Are there fewer men because the men had multiple women partners? Are the guilty men still on the run? Who were the witnesses and are they credible? Were the witnesses just seeking revenge?
The rakyat wants to know who represented these women? Were they aware of their rights? Are they first-time offenders?
Our main concern is that religious Islamic bodies fail to act with transparency. On 25 February 2010, it was announced that three Muslim women had been whipped, for committing illicit sex, two weeks earlier. Why was this announcement delayed? Did the government fear a backlash? The Federal Territory syariah court had issued the caning order on these three women, despite the fact that women are supposed to be exempt from caning under Section 289 of the Criminal Procedure Code.
The latest Berita Harian report revealed that the offenders ranged in age from 20 to 50 years old and that the first couple who received their punishment on 4 April, had been guilty of engaging in an incestuous relationship. On 17 May, seven men and nine women, all unmarried, were sentenced. The whippings had been carried out in the Kluang prison. Why was the public not informed earlier?

The senior assistant director of enforcement of the Johor Islamic Affairs Department (JAIJ), Mohd Zambri Kambari, said that the usual punishment was a fine of RM5,000 or a jail term of three years. He said that this was the first time whipping had been enforced in Johore. Zambri denied that whipping could be termed as punishment. He claimed that caning would make the person realise his crime and he believed that canings were effective in heightening public awareness.
Zambri is contemplating whipping offenders in public or in mosques.

Twenty-two women were among the 39 who received six strokes for syariah offences that included incest and intercourse among unmarried couples in Johor.
Two other women, as reported in Berita Harian, managed to get a deferment to their punishments – as one is pregnant and the other had recently delivered a baby – and are presently in confinement.
They are the first batch of syariah offenders in Johor handed down the sentence in the closed quarters of the Kluang prison.
The Johor Islamic Affairs Department (JAIJ) is weighing suggestions for sentences to be meted out in public or in mosques.
The punishments are in line with the Syariah Criminal Offences Enactment implemented nationwide, but had only just been implemented in Johor over the past two months, as reported by the daily in its front page today.
The offenders were men and women aged from 20 to 50 after undergoing trial for two years.
A man and a woman were the first to be punished on April 4 for incest.
It was also noted that seven men and nine women received the sentence, for having sex when single on May 17.
Senior assistant director of enforcement of the JAJ, Mohd Zambri Kambari, said this was the first time that such a punishment was meted out in Johor, as offenders in the past had been previously fined RM5,000, or jailed for three years.
Zambri emphasised that the strokes are to create self-realisation and awareness for the individuals concened as well as the public and not actually a form of punishment.
“That is why we are considering to have the punishment be done in the open or in mosques,” he said, adding that its observations showed that the punishments had created the desired awareness among the public.
