No Jail Time For Malaysian Rapist Who Married His 14-Year-Old Victim
The court stopped case proceedings after the alleged rapist submitted a marriage certificate.

According to a Borneo Post Online report dated 4 November 2015, the accused committed the first offence sometime in the middle of October and the second on 16 October.
Under Section 376(1) of the Penal Code, anyone convicted of statutory rape (sexual intercourse with individuals aged 15 and below, regardless of consent) faces a maximum of 30 years’ jail and whipping.

Malaysian rapist avoids jail after marrying victim
KUALA LUMPUR — A Malaysian man who raped a 14-year-old girl avoided being thrown in jail after he married the young victim, sparking calls from angry activists for legal reforms on Thursday (Aug 4).
A court in the Malaysian state of Sarawak on Borneo island ruled last week there was “no necessity to proceed further with this case” following evidence that the two were married, the Borneo Post news website reported.
The victim, now 15, was allegedly raped twice by Ahmad Syukri Yusuf, in his twenties, last year. Rape in Malaysia carries a penalty of up to 30 years in prison and whipping.
Activists say such cases are not uncommon in the conservative Muslim-majority country, where sometimes victims’ families would rather a girl marry her rapist instead of her name being tarnished in court.
But this loophole in the system can give the wrong signal to others that there are no serious consequences for rape, they say.
“Over the years we have handled many such cases where the man marries the victim and then divorces her and pays some money to her family,” Ms Aegile Fernandez of Tenaganita, an NGO in Malaysia, told AFP.
“A rape is a rape. There needs to be better education on this,” she added, calling the case an “injustice”.

Gov’t will prevent rapists from marrying underaged victims, minister @hjhrohanikarim vows
The Women, Family and Community Development Ministry will intervene before any individual charged with rape is given the approval to marry the victim, said its minister Rohani Abdul Karim.
Referring to the case of a 22-year-old man whose rape charges were dropped after he married his 14-year-old victim, she said the matter should not have happened as rape was a serious offence and the offender should be sentenced if found guilty.
“Marriage of underage girls must have the permission of the family, Syariah Court and the chief minister or menteri besar of the state.
“As such, the ministry through the social welfare department will intervene to prevent such marriages,” she told a press conference in Putrajaya today.

Rohani said the ministry was informed that the deputy public prosecutor would request that the High Court review the case.
“A rape case is still a rape case, the offender must be sentenced if he is found guilty, the case cannot be dropped by marriage,” she said.
The ministry is concerned over this matter and the public should be aware of children’s rights, she added.

MP: Marrying victim shouldn’t spare rapist from prosecution
DAP Kulai parliamentarian Teo Nie Ching argues that the courts should not let rapists of underaged girls off the hook just because they marry their young victims.
“Statutory rape is a very serious offence. Section 376 of the Penal Code defines statutory rape as sexual intercourse with a girl under the age of 16 whether or not she has given consent.
“The marriage of the accused and victim does not have the retrospective effect to ‘right the wrong’.
“Therefore, how could the court use it as a reason to drop the prosecution proceeding?” said Teo in a statement today.
The DAP assistant national publicity secretary was commenting on a recent case that saw a man, charged with raping a 14-year-old girl, spared from being sent to prison and possible whipping after he married her.
According to reports, the prosecutor in the case, Ahmad Fariz Ahdul Hamid, said the accused, Ahmad Syukri Yusuf, 22, was charged with statutory rape of the girl late last year and faced up to 30 years in jail and whipping for the offence, but was let off the hook after he married the teenager.

“This is not the first time that a rapist is allowed to marry his underage victim, and this is surely not going to be the last,” she said.
Teo related the 2013 case when Riduan Masmud, 40, a restaurant manager from Sabah, was allowed to take his 13-year-old victim as his second wife, despite the fact he already had four children aged between three and 18.
Though in that case, unlike the accused in the present case, Riduan was still sentenced to serve 12 years jail and whipping.

Why no appeal for heavier sentence in rape cases?
Why does the prosecution seem less interested in appealing for heavier sentences in rape cases than they do in sedition cases?
That is the question asked by lawyer Michelle Yesudas, commenting on the man who escaped his rape charge after marrying his 14-year-old victim.
“Why in sedition cases, even after conviction, the prosecution always appeals for a heavier sentence but not so interested in rape?” she asked in a series of Twitter postings today.
Yesudas also described it as “deeply disturbing” that a marriage certificate can absolve a man from rape charges.
Marriage is not the answer to statutory rape, she insisted, because a child is not able to consent to sex the way adults do.
“(It’s) unacceptable that 21st century Malaysia has a provision to prevent rape and it is then ‘ended’ by having the perpetrator marry the child,” she said.
