12年前北方大学毕业生朱玉叶遭奸杀案终审今日下判,联邦法院维持高庭2015年的原判,裁定被告沙里尔嘉法(Shahril Jaafar)谋杀罪成,面对死刑。
根据网媒《自由今日大马》,以联邦法院首席大法官劳勿斯为首的五司今早一致驳回被告的上诉。
报道引述劳勿斯说:“这是我们的一致裁决。根据旁证,我们裁定,被告必须为死者之死负责。”
现年37岁的沙里尔嘉法是一名“拿督”商人的儿子。报道称,被告闻判时,只是点了点头。
另外,《星洲日报》报道,今日也是朱玉叶的父亲朱亚寿生日。朱亚寿在获悉法院判决后,感到非常欣慰。

Court upholds guilty verdict in murder of marketing executive
Three-man Court of Appeal bench rules no intervention is needed in this case as the trial judge did not commit any error.

PUTRAJAYA: The Court of Appeal today affirmed the death sentence of a 35-year-old businessman who murdered a marketing executive near a club in Sungai Petani 10 years ago.
A three-man bench. chaired by Justice Mohd Zawawi Salleh, in dismissing Shahril Jaafar’s appeal, said the guilty verdict was supported by strong evidence.
“The trial judge did not commit any appealable error and this court need not intervene,” Zawawi said.
Last year, trial judge Mohd Zaki Abdul Wahab sentenced Shahril to death for the murder of Chee Gaik Yap.
Shahril murdered Chee, then aged 25, near the Cinta Sayang Club in Taman Ria Jaya, Sungai Petani, on Jan 15, 2006.

Businessman sentenced to death for 2006 murder
ALOR SETAR: A 34-year old businessman, Shahril Jaafar was sentenced to death this Sunday for the 2006 murder of Chee Gaik Yap.
Shahril remained calm when the judgement was delivered by Judicial Commissioner Datuk Mohd Zaki Abdul Wahab.
Mohd Zaki said the defence failed to raised reasonable doubt in the case.
“I have no choice but to sentence you with the death penalty, the only punishment as stipulated in Section 302 of the Penal Code,” he said.

法官也择定6月2日,由控辩双方进行结案陈词,陈词要点也包括是否弹劾被告父亲拿督嘉化的第3证人资格。
被告父亲拿督嘉化今早因为口供书与供词有出入而被重召作出解释时,再次否认换车的理由是因为涉案,而是载客量,至于其余2项问题,即是否与妻子陪同被告沙里尔弃刀及在哪里弃刀,他同样的矢口否认。

Cop: Datuk not held because no arrest order was given
ALOR SETAR: A police officer did not arrest a Datuk whom he believed to be an accomplice in a crime because he had not received any orders from his superior officer, a High Court was told.
Asst Supt Zainal Omar Mahmud, 54, said he had recorded a statement from entrepreneur Datuk Jaafar Jamaludin that he, together with his wife and son, had disposed of a knife in a dustbin near a night market on Jan 15, 2006.
Jaafar, he said, had also indicated in the police interrogation statement that he sold off his Naza Ria because it had been involved in a murder case.
ASP Zainal said he recorded the statement on Jan 22, 2012 at the Kuala Muda district police headquarters in Sungai Petani.

Cross-examined by Shahril’s counsel Shamsul Sulaiman, ASP Zainal said he was aware that Jaafar’s statement meant that he was a possible accomplice of a crime.
He agreed that although he had the authority to detain Jaafar, he did not do so as his chief – the then Kedah Criminal Investigation Department chief ACP Mohd Zakaria Ahmad did not instruct him to proceed with the arrest.

Court to decide today whether to impeach Datuk over testimony in son’s murder trial

The Alor Star High Court will decide today whether to impeach a Datuk for giving inconsistent testimony in defence of his son, who is being tried for murdering a jogger almost nine years ago.
Kedah prosecution unit head Salim Soib had asked for entrepreneur Datuk Jaafar Jamaludin to be impeached following the discrepancies in his police statement and his testimony in court, The Star reported.

The accused: Shahril being led into the Alor Setar High Court.
ALOR SETAR: A businessman, charged with the murder of a jogger eight years ago, told a High Court that he had sex with the victim on the day she was murdered.
Shahril Jaafar, 33, in his defence statement in court, said at about 3pm on Jan 14, 2006, he had called a man named “Wayne” to get him a girl to fulfil his sexual urges after he watched a pornographic video earlier that day.
“I had told him my requirement for the girl to be a non-Malay in her 20s.
“At about 4pm, Wayne called me back and said he had arranged for the girl to meet me near the Cinta Sayang Club.
“He said the girl would look for me and at about 5pm, while I was waiting in my car near the club, the deceased Chee Gaik Yap suddenly appeared and knocked on my window.
“After introducing ourselves, I asked her to move to the back seat. She demanded RM350 and without further delay, we had sex,” Shahril said in his defence yesterday.

He said Chee left his car when his mother called him to pick her up after a golf tournament at the Cinta Sayang Club.
He claimed that when Chee left, she was still alive and had no injuries on her.
“It was the first and last time I saw her. I only got to know about a body being found outside the club the following day, and discovered that Chee had been murdered after reading about it in a newspaper the next day,” Shahril said, adding that “Wayne” could not be reached on the phone.

Eight years on, dad still seeking justice for murdered daughter
Every Sunday since that fateful day in 2006 when his daughter was murdered, Chee Ah Sau would head for the police station to get updates on investigations into her death.
No distance was too far for the 58-year-old construction worker from Sungai Petani, Kedah, as he spends his only day off, year after year, looking for answers and clues to her rape and murder. And he became a familiar sight at the Kuala Muda district police station.
He would also ride his motorcycle to Alor Star, almost 70km away, to talk to the Kedah police chief at the state police headquarters about his daughter’s case.
“No, it is not too far (to travel by motorcycle)… for my daughter, the distance is short,” Ah Sau told The Malaysian Insider recently.
Ah Sau also went to the Cinta Sayang Club, in Sungai Petani, where his daughter Chee Gaik Yap, 25, was jogging before she was kidnapped and killed, with hopes of finding clues.
“I only visited the police three or four times a month, and mostly I went to the district police headquarters here in Sungai Petani.
“I did that until the police caught the suspect two years ago,” he said.

While the killing was being investigated, a suspect wanted for the murder left Malaysia for Perth, Australia. The police reportedly watched all entry points into the country for the man, who is the son of a businessman with the honorific Datuk.
Finally on January 17, 2012, the suspect, Shahril Jaafar, 33, was caught by police at the Kuala Lumpur International Airport. He was charged with Gaik Yap’s murder two weeks later.
But Ah Sau’s hopes for justice was short-lived. On June 25 last year, Shahril was acquitted and discharged by the Alor Star High Court without his defence called.
The court ruled that the prosecution had failed to prove a prima facie case, as there was no clear evidence to implicate Shahril in the murder.
Distraught by the court’s decision, Ah Sau tried to jump off the balcony of the two-storey court complex, shocking pressmen, who managed to grab him in time.

Despite the setback, Ah Sau vowed to carry on with his quest for justice, no matter how long it took. Days after the acquittal, he begged the late Karpal Singh for help.
Within a week, rallies were held in Sungai Petani and Penang to demand justice for Gaik Yap and to collect thousands of signatures for a petition urging the court to order a retrial.

Alor Star High Court judicial commissioner Datuk Mohd Zaki Abdul Wahab set December 28 to 31 for the trial of Shahril Jaafar, a 33-year-old businessman, who faces the death penalty upon conviction.
Shahril was charged with killing Gaik Yap between 5.30pm on January 14, 2006, and 3.05am the next day, near the Cinta Sayang Club in Taman Ria Jaya, Sungai Petani.

Deputy public prosecutor Kee Wei Lon said it was now up to the defence to prove its case.
“The prosecution will not call any witnesses. We have proven a prima facie case. It is now up to the defence to rebut,” he said outside the courtroom.
Shahril’s lawyer, Shamsul Sulaiman, asked the court to defer the trial dates to January as Shahril’s wife would be in confinement then. He told the court she was expected to deliver in mid-December.
Zaki rejected the request. He also said that Shahril, who is held at the Alor Star prison, would remain in detention during his wife’s delivery.
Shamsul then asked the court to transfer the case to the Sungai Buloh prison so that Shahril’s wife could visit him, but the court rejected the request.
Shamsul later said the defence would call about 10 witnesses, including the Shahril’s father, police and Road Transport Department officers, a reporter, a car dealer and an officer from the Australian High Commission.

PUTRAJAYA: The man accused of the death of Chee Gaik Yap, who was found raped and murdered in Alor Setar eight years ago, will now face a full trial before the High Court there.
The Court of Appeal panel led by Justice Linton Albert unanimously set aside car salesman Shahril Jaafar’s acquittal and discharge, and ordered he enter defence.
“We order that he (Shahril) also be placed in remand forthwith,” said Justice Linton on Monday.
The three-man panel, which included Justices Mohtarudin Baki and Abdul Rahman Sebli set Oct 19 for mention of the case before the Alor Setar High Court.
Gaik Yap’s father Chee Ah Sau, who attended the proceedings, told reporters he was relieved that the case would finally be heard in full.
On June 25, the Alor Setar High Court acquitted and discharged Shahril of murdering Chee after finding that the prosecution had failed to prove a prima facie case.

SUNGAI PETANI: A large crowd turned up at the Wat Damrong Ratanaram (also known as Wat Siam) in Kampung Raja here for a gathering to remember Chee Gaik Yap, a 25-year-old who was raped and murdered in 2006.
Those gathered there also listed five demands, including for the police to find and punish the culprit.

SUNGAI PETANI: Hundreds turned up on Saturday at the Wat Siam in Sungai Petani, Kedah here to seek justice for Chee Gaik Yap, a marketing executive who was raped and murdered in 2006.
The demands put forth by them include appealing to the Attorney-General to provide updates on the case development and to add a rape charge on the suspect.
Among those present are Gaik Yap’s father, Chee Ah Sau as well as Berapit assemblyman Lydia Ong and State Speaker Datuk Law Choo Kiang.

Meanwhile Oriental Daily News reported that both Kedah PKR and Kedah MCA Youth had called upon the police to reopen their investigations into the case and ensure that Gaik Yap gets justice.
Kedah MCA Youth had voiced their dissatisfaction with the judgment and mooted their demand through a police report, while Kedah PKR will launch a signature campaign urging the Attorney-general’s Chamber to file in an appeal in 14 days.
THE father of Chee Gaik Yap, who was raped and killed seven years ago, said no matter how long the legal process takes, or how difficult the road ahead, he will never stop seeking justice for his daughter, China Press reported today.
Chee Ah Sau said he will definitely appeal the high court’s decision to acquit the man charged with the crime, adding that he will make sure that Gaik Yap’s murderer will be sanctioned by law because “this is a father’s responsibility”.
He told the press that the prosecutor Datuk Razali Che Anitoo was not reconciled to the judgment and encouraged him to appeal to the Court of Appeal.
Alor Setar High Court acquitted and discharged car salesman Shahril Jaafar, 32, of murdering Gaik Yap on Tuesday as there was no evidence to show the accused killed the 25 year-old woman.
Despite Shahril’s semen being found on the victim, Judicial Commissioner Zaki Abdul Wahab said it did not completely match with his DNA, and there was a possibility that a third person contributed to that DNA profile.
Ah Hau, who had ridden a motorbike all the way from Sungai Petani to Alor Setar to listen to the judgment, broke down in tears after the decision was announced. The heart-broken father attempted to commit suicide and was stopped by the reporters covering the court case.

Dad tries to jump off court building

ALOR SETAR: The father of a woman who was raped and killed seven years ago was so distraught when the murder accused was acquitted that he tried to jump off the double-storey courthouse here.
Several pressmen managed to stop Chee Ah Sau from jumping over the corridor railing.
Guang Ming Daily journalist Elaine Teng grabbed Chee by the shoulder while TV9 cameraman Fadzilah Hashim wound his right arm around Chee’s neck to restrain him from jumping to his death around noon yesterday.
A few other press photographers spoke to Chee in Hokkien, urging him not to jump.
Chee was inconsolable and cried non-stop after he was rescued. Policemen and friends told him to calm down and not to act harshly.
He left the building about five minutes after the incident with his wife in a car driven by a friend.

Rape suspect arrested after six years in hiding
SUNGAI PETANI: A man, wanted in connection with a cruel rape and murder case of a marketing executive six years ago, was arrested by the police on Tuesday.
The 31-year-old man, who has been on the run since 2006, was ambushed and detained at the Kuala Lumpur In ternational Airport in Sepang, Selangor. It was learnt that the suspect is the son of a prominent “Datuk” in the state.
State Criminal Investigation Department chief, Assistant Commissioner Zakaria Ahmad, said the suspect had arrived from Perth, Australia when he was picked up by the police.
“We never closed the investigation file for the case. In fact, we had been updating new leads for the case every two weeks since the murder.
“The police have been working closely with our coun terparts in other countries to locate the suspect,” he told reporters.
Zakaria said police had also obtained a seven-day remand order from the Sungai Petani magistrate’s court here on Wednesday.
The suspect landed on the police wanted list for his suspected involvement in the murder of Chee Gaik Yap.

SUNGAI PETANI, KEDAH, Sun.Chee Gaik Yap feared for her younger sister’s safety when she wanted to go jogging alone yesterday. So she accompanied her sister on a jog around the neighbourhood, only to be abducted, raped and found dead nine hours later.Her semi-nude body was found by the roadside by a motorist near a country club about 1.5km from her house at the Paya Nahu flats in Taman Ria Jaya at 2.30am today.Gaik Yap, 25, worked as a marketing executive at a factory. Her neck was slashed and there was a 10cm wound on her head.It is believed that several men in a black Naza Ria MPV abducted Gaik Yap at a road bend about 7pm yesterday. Her younger sister, Gaik Choon, 24, who was some distance behind, recalled seeing an MPV drive past her and shortly after saw it coming back and speeding off.Her sister was nowhere to be seen, but one of her sneakers was lying on the road.Gaik Choon ran home and told their mother, Lim Kim Nai, 47. The family reported the matter at the Sungai Petani police station.”Gaik Yap left the house at 5pm to accompany her younger sister,” Lim said at the Sungai Petani Hospital mortuary. “She did not want her to go alone. How could anyone do this?”Sources said the Naza Ria was found near the country club, about 100 metres from the scene of the abduction early this morning. Police also found bloodstains on the ground near the vehicle.Gaik Yap, a graduate of Universiti Utara Malaysia, had worked for a snack manufacturer for the past four months. A fitness enthusiast, she held a black belt in taekwondo.

Something is wrong with the judgement. The circumstantial evidences are so strong and yet the those who preside over the case could not see it? By the way where are the gang of accomplices?It is indeed a laughing stock to our legal system. When men cannot be counted upon to deliver justice, we can only look to the Divine. Pray till justice is done for this case.
