PENANG TWIN DISASTERS: Yeo Yang Poh may head public inquiry panel

The state government has proposed former Malaysian Bar Council president Datuk Yeo Yang Poh as chairman for the state commission of inquiry into the disasters that happened recently on the island.

Chief Minister Lim Guan Eng said Gobind Singh Deo was also appointed to act as watching brief for the state government and the three family members involved in the collapse of the Second Penang Bridge ramp and the collapse of pole from Menara Umno.

Lim said Yeo, who is the state appeals board chairman, would hold a meeting next week to finalise proceedings for the inquiry.

He said the inquiry would enable the findings of both the tragedies to be make known and also what actually happened.

“We do not want it to be dismissed as an Act of God,” said Lim.

Penang to probe Menara Umno structure, bridge failure

The Penang government has proposed to form a state commission of inquiry to probe civil structures which had caused loss of lives and properties, especially in the last two weeks.

Chief Minister Lim Guan Eng said the state executive council which met today, decided to set it up based on Section 2 of the Commissions of Inquiry Act.

azlan“The commission will probe into the causes of the incidents and whether the structures had obtained the necessary approvals,” said Guan Eng, in a press conference today.

“Those found negligent will be punished accordingly, whether they are from departments involved or owners of the structures.

“We are proposing these steps so that incidents like these will not happen in the future,” he stressed.

The commission will probe the collapse of the ramp of the second Penang bridge along Batu Maung on June 6 which killed one former policeman, Tajuddin Zainal Abidin, 45.

It will also probe into the fall of the lightning arrestor from Menara Umno along Jalan Macalister last Thursday when strong winds hit Penang, causing several injuries and damage to properties.

THE POWERS OF THE COMMISION OF INQUIRY

The Penang chief minister added that ongoing probes by other quarters like the police and relevant authorities might overlap but would not interfere with the proceedings.

When asked about the powers of the commission, Lim said “the recommendations of the state government will be taken seriously and adopted if necessary”.

He added that internal inquiries conducted by the state alone may give rise to perception of “doubts and suspicions” and may affect public confidence.

“The members of the commission will be announced later but it would be an independent inquiry led by experts and professionals,” Lim said.

“We want the public to know the truth and nothing but the truth,” he added.

Menara Umno owner willing to go to court

The chief executive officer of JKP Sdn Bhd, the owner of Menara Umno, said the company was willing to be taken to court if it was found to be negligent in failing to submit a periodical building audit to the local council.

Adzmi Ariffin said the company was also conducting an internal investigation into the alleged failure to submit the report to the Penang Island Municipal Council (MPPP) in 2008.

“We are doing our own inquiry to see if there was any negligence on the part of our staff for failing to submit the periodical audit to MPPP. If MPPP finds that we made a mistake then we have no choice but to respect the law and be taken to court,” he said.
