THE MINISTRY OF TOURISM AND CULTURE WANT LAND THAT IS CURRENTLY USED BY THE SJK (C) CHIN WOO IN PASAR ROAD, KUALA LUMPUR.
The Tourism and Culture Ministry has acquired 1,393.55 sq metres of the school’s compound for the construction of a government-owned restaurant. The school was informed of the matter in September last year.
The ministry wants to use the land as part of its RM32.5 million Kota Warisan Kuala Lumpur project as a cultural village.
The Kota Warisan project involves building an auditorium, a six-storey complex and a restaurant, was approved in concept by the Cabinet.

The Cabinet had earlier decided to allow Chin Woo to continue to use the land for another 20 years by leasing it, on four conditions:
1. Acknowledge that the land belongs to the ministry;
2. No permanent structure to be erected at the occupied land, i.e. the status quo be maintained;
3. Agree to a 20-year lease at RM1,000 a year; and
4. To show proof that the school’s pupil population does not decrease from the 15th year of the lease onwards.
On Nov 20, the ministry gave the school one month to accept the offer or face eviction.

KUALA LUMPUR (Dec 3, 2013): Tourism and Culture Minister Datuk Seri Mohamed Nazri Aziz has told SRK(C) Chin Woo to accept the land lease offer or surrender the ministry’s land it is on.
China Press reported today that Nazri had reiterated that a plot of state land the school is occupying belongs to the ministry and that the school had encroached on it.
He said this at a ministry’s function here on Monday when asked by the media to comment on Chin Woo’s request for the ministry to rescind the term “encroacher” it used to describe the school as well as for more time to consider the offer to lease the land.
Nazri said the issue had dragged on for two years and the ministry will not extend the deadline. “What they can do now is to accept our offer, or leave.”
A day earlier at a meeting with representatives of Chinese groups, Chin Woo’s directors felt that the conditions set by the ministry were contentious and wanted the Dec 20 deadline to accept the offer to be extended by 60 days.

Tourism and Culture Minister Mohd Nazri Abdul Aziz has warned SJK (C) Chin Woo in Pudu not to lay claim to the land belonging to the ministry, or it can expect trouble.
“You fight with me, I fight you, I kill you. I take back the land, don’t mess around with me. It’s government, it’s my land,” he told a press conference in Kuala Lumpur today.
He was referring to the school which is adamant about keeping a plot of land belonging to the ministry after it built a basketball court there 30 years ago.

Chin Woo school board chairperson Oo Tin Fuan told reporters that the deputy director of Unit Kerjasama Awam Swasta of the Prime Minister’s Department, Tan Yew Chong, told him that the proposal for a restaurant plan on the school land has been cancelled and moved to another site in Wangsa Maju.

The land dispute between SJK (C) Chin Woo and the Ministry of Tourism and Culture gained some new progress today, towards a possible amicable settlement.
Representatives of the school board met with the Chief Secretary to the government Ali Hamsa and various government representatives at the Kuala Lumpur City Hall (DBKL) headquarters this morning.
During the meeting, the federal government offered to lease the school land for 20 years at RM1,000 a year.

The offer today means that government has also temporarily ceased its move to acquire a part of the school compound.
After the 45-minute meeting, Chin Woo general affairs director Chew Kee Hui told the media that the rental offer was just a preliminary solution.
“Although the lease duration is 20 years, but after 15 years, we still can negotiate with the authority on how to use the land,” Chew said.

However, Dong Zong president Yap Sin Tian was cautious about the situation.
He told reporters after attending the meeting that they all requested the authorities to make their offer in black-and-white, so that the school could give the matter a closer study.

Some 300 people today held a protest against the impending land acquisition and demolition of a portion of Chinese primary school SJK (C) Chin Woo by the Tourism and Culture Ministry.
The government has delayed the demolition, which had been scheduled for today.
The protesters gathered at the basketball court located in the compound of the school on Jalan Pudu, Kuala Lumpur.
Addressing those present, school board chairperson Oo Tin Fuan said the government had only delayed the demolition and not cancelled it.
“If the government is sincere, it should cancel the land acquisition and demolition work,” Oo said.
Several representatives from different Chinese education NGOs, including United Chinese Schools Committees Association (Dong Zong) chairperson Yap Sin Tian also took part in the protest.

Govt postpones acquisition of land at SJKC Chin Woo
KUALA LUMPUR: The government has postponed the acquisition of 0.169 hectares of government land in SJKC Chin Woo here.
Chief Secretary to the Government Tan Sri Dr Ali Hamsa said the parcel was to be taken over by the Tourism and Culture Ministry on Sept 24.
“We are posptoning acquisition of the land and after that date, no form of enforcement action will be taken,” he told reporters after officiating Dewan Bahasa dan Pustaka’s (DBP) 57th anniversary.

..Ali asked the parents to no longer worry about the issue and instead hold negotiations with the authorities.
“We still have room for negotiations involving the parents, the school’s management and the Federal Territory Land and Mines Office,” he said.
He added that the negotiations could be held promptly but gave no timeline for a resolution.

KUALA LUMPUR (Sept 19, 2013): Tourism and Culture Minister Datuk Seri Mohd Nazri Aziz says the facilities of SJK(C) Chin Woo Kuala Lumpur which are built on government land will definitely be demolished.
Nazri said as owner of the encroached land, the ministry has the right to take it back and will not make any compromise.
“You want to have a sit-down protest or go to court, go ahead. The law must be abided by. Part of Chin Woo’s facilities must be removed. It is just a matter of time,” he said on Wednesday.
“We want the school to know that demolition will be carried out on the school facilities (which include a perimeter wall, car park and two basketball courts) that have encroached on government land,” he was quoted as saying in a Sin Chew Daily report today.

Despite an assurance by MCA that no demolition work will be carried out at parts of the school compound of SJK (C) Chin Woo, this does not convince school board chairperson Oo Tin Fuan, as he hopes for a promise in writing on the matter.
Oo (right) told Malaysiakini today that although MCA leaders had promised and guaranteed many things verbally, there has been no black-and-white to prove that.
MCA deputy president Liow Tiong Lai had, through the Tourism and Culture Ministry, informed the Land Office not to carry out the demolition, but Oo said there had been no response from the Land Office.

Although final instructions have been issued to demolish parts of SJK (C) Chin Woo on Sept 24 as part of a land acquisition exercise, these will not be carried out as scheduled at the 84-year-old school in Pudu, Kuala Lumpur.
MCA deputy president Liow Tiong Lai said Culture and Tourism Minister Mohd Nazri Abdul Aziz has promised him that the demolition has been suspended until a meeting is held between the ministry and the school.
“I have an assurance from Nazri and the school has been assured that no demolition will be done pending negotiations,” Liow said when contacted today.

MCA has been slammed for being inefficient in handling a land acquisition matter, resulting in the demolition of parts of the school compound of SJK (C) Chin Woo in Pudu, scheduled to take place on Sept 24.
The school’s board chairperson Oo Tin Fuan said the Chinese-based political party should bear the biggest responsibility as the school was told not to blow up the issue.
Oo claimed that MCA deputy president Liow Tiong Lai and MCA Youth chief Wee Ka Siong, had in August, promised assistance and requested the school to keep a low profile.
“They (Liow and Wee) had also required us not to let a third party intervene… We waited for MCA for almost three weeks, but now, we can’t keep a low profile any more!” he lamented.

PETALING JAYA (July 18): The government will continue to reclaim the land of SJK (C) Chin Woo for the Kota Warisan project despite MCA’s protest against it, Utusan Malaysia reported today.
Tourism and Culture Minister Datuk Seri Nazri Aziz said the land reclamation process will begin in the near future for the purpose of building a Cultural Village through the project.
At the same time, Nazri said, the ministry is preparing a team of lawyer to face any possibility to resolve the issue in court.
“The land is gazetted for culture, that is to build the Kota Warisan. I don’t intend to negotiate with any party including the MCA and am only prepared to meet them in court,” Nazri said.
Nazri said this in response to MCA’s call for the government to reconsider its decision to take back the 0.13 hectare land from Chin Woo School.
MCA deputy president Datuk Seri Liow Tiong Lai had said the government must take into account that the land, which is now a basketball court, has been used by the school since it was established 1938.
Commenting on the matter, Nazri said the reason is weak and irrelevant.

The MCA has urged the Tourism and Culture Ministry to reconsider its plan to take back part of the land in Sekolah Jenis Kebangsaan (Cina) Chin Woo, Pudu for the construction of the Kota Warisan project.
Its deputy president, Liow Tiong Lai, said the ministry’s plan to use 1,393.55 sq meters of the 0.81ha school land for the construction the Seri Melayu Restaurant had been apposed by various quarters, including non-governmental organisations (NGOs) and the school’s board of directors.
“The land sought for the project was the site of a newly-completed basketball court.
“If the land is taken away, it will not only disrupt lessons but also shrink the school’s area,” he told reporters after visiting the school in Kuala Lumpur yesterday.

The Federation of Kuala Lumpur and Selangor Chinese School Alumni Associations held a protest at the SJKC Chin Woo today against the acquisition of part of the primary school’s land by the Tourism and Culture Ministry.
Led by Ng Chee Ping, the chairperson of the federation, 30 protesters unfurled banners depicting slogans ‘Save Education, Save Chin Woo Property’ and ‘We are against acquisition of Chin Woo school land’.
Most of them were the representatives of the alumni association and board members of the Chinese schools in Kuala Lumpur and Selangor.

PUTRAJAYA (June 12, 2013): The Tourism and Culture Ministry will take SRK (C) Chin Woo – located in Jalan Pasar, Kuala Lumpur – to court if it cannot get its land back from the school.
Its minister Datuk Seri Mohamed Nazri Abdul Aziz said the ministry has made a firm stand on the matter.
“It is our land, and it is the right of any land owner to take their land back. They would do the same if we encroached on their land,” he told a press conference today.
Nazri was commenting on a stalemate over a 0.13ha (15,000 sq ft) plot of government land, which has been occupied by the school since 1938.
“We have held many discussions and I have made the decision that if this issue is not resolved, we will take the school to court and let the court decide,” Nazri said.
The ministry wants to use the land as part of its RM32.5 million Kota Warisan Kuala Lumpur project as a cultural village.
The cultural village project, approved in concept by the cabinet in 2007, involves the building of an auditorium, a six-storey complex and a restaurant on 3.24ha of land.
The Kota Warisan project is a joint development venture between the Tourism Ministry and Enfiniti Productions Sdn Bhd.
However, the project met with strong objections from the school board on grounds that it would have to give up land for the project construction.
The Chin Woo board reportedly argued that the school had received the approval of the then British government of colonial Malaya to occupy the land on which stands its school walls, two basketball courts and its garden.
The ministry, however, claims the school was encroaching upon government land.
The school has been in talks with the Kota Warisan project developer since last year to resolve the issue.

An 83-year-old Chinese primary school was shocked to learn that the government plans to acquire about 15,000 square feet of its land for a development project under the Information, Communications and Culture Ministry.
This was revealed to the school board of SJK(C) Chin Woo by a group of representatives from three government agencies together with the developer at a meeting yesterday.

The group was led by Khairi Zaman Huri, the ministry’s Policy and Strategic Planning Division (Culture) chief secretary, and comprised the Information Ministry, Kuala Lumpur City Hall and Land Department officers.
At the meeting, Khairi told the board’s chairperson Oo Tin Fuan that some parts of the school occupy a piece of vacant government land next to the school, which has now been earmarked for a project named Kota Warisan.
According to him, the plan calls for the construction of an office tower for the Information Ministry and a restaurant.

He asked the school to vacant the land in order to make way for the project.
“We came here is to seek a win-win solution. We can consider if the school demands compensation from the developer,” he had said.
However, Oo had pointed out that the school had been there since well before the nation’s independence and had never once been informed by any authority that it had been sitting on government land.
“We will not concede our school land,” he vowed.
Media asked to leave meeting
At this point, Khairi said the meeting was supposed to be closed-door, not open to the media. The school board objected but eventually relented as Khairi threatened to put off the meeting should it continued in the presence of the reporters.

After the meeting, Oo told a press conference that the government plans to acquire about 15,000 square feet, which means the school car park and two basketball courts would be affected.

“The school is for the community and students, but the project is only for the benefit of one person (developer). There is no logic to make way for such project,” he said.

SJK(C) Chin Woo’s school board in talks to resolve land encroachment issue

In discussions: The school board is in a tight spot when it was told to return parts of the land it had inadvertently encroached upon.THE 83-year-old SJK(C) Chin Woo in Jalan Pasar is currently in talks with several government agencies and the developer of the Kota Warisan project to resolve its land encroachment problem.
Gerakan public service and complaints bureau chairman Wilson Lau Hoi Keong has been called in by the school board to assist in the negotiations as well as liaise with the relevant government departments.
Lau said everyone was willing to talk and help resolve the matter.
“The school was informed that part of its structure had encroached into the land next to it and must return it, but that will involve demolishing part of the structure and roofing of a basketball court

We must not give up what our grandfathers build for us, they work hard and build a place of education for us to learn not just our roots, we survive and adapt not like some parasites who wanted to destroy. I also hope those who promised to help don’t back away last second.
