Vivian Lee gets six months’ jail for ‘Bak Kut Teh’ Ramadan greeting

Blogger Vivian Lee has been jailed for six months by the Kuala Lumpur Sessions Court after being convicted under the Sedition Act 1948.

Lee was convicted for a Ramadan greeting where she and her then-boyfriend Alvin Tan told Muslims to break fast with pork (bak kut teh), according to Bernama.

The sentence was passed down by Sessions Court judge Abdul Rashid Daud, who said it is to serve as a deterrent.

However, Lee will only need to serve five months and 22 days in prison as she had spent eight days in a lock-up, from July 18 to July 25, when she was first arrested in 2013.

The prosecution had pressed for up to two years’ jail for Lee but her lawyer cited good behaviour and clean prior record in asking for a lower sentence.

Lee could have faced a maximum fine of up to RM5,000 or three years in prison or both.

The sentence was stayed pending Lee’s appeal to the High Court.

Alvin Tan uploaded ‘bak kut teh’ picture for fun, says ex-girlfriend

“We fought. I was sad, unhappy and angry with his action. I told him to delete it but he refused to do so and said it was just for fun and to see the reaction of the public,” Lee said in her defence during the examination-in-chief by her lawyer Chong Joo Tian before Judge Abdul Rashid Daud.

Blogger Alvin Tan’s ex-girlfriend told the Sessions Court in Kuala Lumpur today that the man had uploaded the controversial picture of them with a caption that insulted Muslims simply for fun and to see the reaction of the public.

Vivian Lee or Lee May Ling, 27, said Tan told her so after she edited the picture and the caption which read: ‘Selamat Berbuka Puasa (with Bak Kut Teh… fragrant, delicious and appetising).’

Lee said Tan then uploaded the picture and its caption into their Facebook page without seeking her permission even though she was one of the administrators of the page.

She said Tan had initially refused to delete or change the caption, but after being reprimanded and badly criticised by various quarters, he edited the caption and came out with a new caption that read: ‘Ampunkanlah kami. Selamat berbuka puasa dengan rendang ayam’. (Please forgive us. Selamat berbuka puasa with chicken rendang).

“The new caption was put out after sensing all the negative sentiments from the public which could simply lead to anger. It was hoped that the new caption could straighten things out and make the situation better.

Infamous blogger Alvin’s ex to enter defence for sedition

Vivian Lee, the former girlfriend of controversial blogger Alvin Tan, was ordered by the Kuala Lumpur High Court today to enter her defence on a charge of insulting the Muslims by making an offensive posting on their Facebook.

Judge Abdul Rashid Daud made the ruling after finding that the prosecution had succeeded in establishing a prima facie case against Lee, whose full name is Lee May Ling, at the end of the prosecution’s case.

The court set two days, from May 10, for Lee, represented by lawyer Chong Joo Tian, to do so.

Bak kut teh not halal in Jakim website, sex bloggers trial hears

KUALA LUMPUR: Bak kut teh is not listed as halal in Jakim’s website or in Halal Malaysia’s official portal, a Sessions Court, hearing the case involving sex bloggers Alvin Tan and Vivian Lee, was told.

Former deputy director-general of the Department of Islamic Development Malaysia (Jakim), Dr Lokman Ab Rahman, said none of the websites listed bak kut teh (pork ribs soup) as halal.

Lokman was the last witness for the prosecution which closed its case on Wednesday involving Tan and Lee over the alleged bak kut teh posting and buka puasa greetings on Facebook.

Sessions judge Abdul Rashid Daud fixed March 28 for submissions.

Lee appeared to be in jovial mood during proceedings on Wednesday. Tan has jumped bail and is believed to be in the United States.

On July 18, 2013, Tan, 27, and Lee, 26, were jointly charged under Subsection 5(1) of the Film Censorship Act, Section 4(1)(c) of the Sedition Act and Section 298A(1) of the Penal Code.

They were charged with displaying pornographic images on their blog between July 6 and 7 that year.

For the second charge, they were accused of uploading content that could possibly stir hostility among those with different beliefs between July 11 and 12. They also face a charge of publishing a seditious photograph and inviting Muslims to break fast with bak kut teh, together with a halal logo.

Their charge under Section 298A(1) was later dropped by the Court of Appeal on grounds that it did not apply to non-Muslims.

‘Bak Kut Teh’ Hari Raya greeting was not enough to incite racial controversy: Witness

KUALA LUMPUR: A racial spat did not ensue following former sex bloggers Alvivi’s “Bak Kut Teh” Hari Raya greeting photo, the Sessions Court heard today.

Malaysian Communications and Multimedia Commission (MCMC) enforcement and investigation officer Akmal Hamdy Baharudin, 32, told the court that after the photo of former lovers Tan Jye Yee or Alvin Tan and Lee May Ling or Vivian Lee was uploaded on their Facebook page, no racial disputes between Malaysians had arisen.
He was testifying as the 18th prosecution witness in the trial of the duo’s sedition case.
In cross-examination by counsel Choong Joo Tian who represented Tan and Lee, Akmal agreed that the picture was not enough to incite racial controversy in Malaysia.

“After the photos were uploaded, the Malays and Chinese who commented were expressing anger to the Facebook user (Alvivi) and not at each other,” he said.

Offensive picture came from sex bloggers’ computer, testifies former MCMC analyst

KUALA LUMPUR: The third day of the trial of sex bloggers Alvin Tan Jye Yee and Vivian Lee May Ling saw a former Malaysian Communication and Multimedia Commission (MCMC) analyst giving testimony that he had found the infamous bak kut teh picture in their notebook computer and that it was the same picture that was uploaded on their Facebook page.

On Wednesday, Hafizullah Fikris Rahman, a former digital forensics analyst with the MCMC, had analysed a number of digital products related to the duo during an investigation conducted in June 2013 and told the Sessions Court that during his analysis, he had found both the unedited and captioned bak kut teh pictures in a Samsung notebook computer seized from them.

He then gave testimony that the same computer was used to log into the bloggers’ Facebook page and post the photo.

Hafizullah added that during his analysis of the digital items, including the notebook computer, cameras and USB flash drives, he had also found 84 obscene images and videos.

Bak kut teh posting by sex bloggers a joke in poor taste, court told

KUALA LUMPUR: The bak kut teh Facebook posting by sex bloggers Alvivi was meant as a joke though in poor taste, the Sessions Court was told.

The Star Online editor Philip Golingai testified Tuesday that Alvin Tan Jye Yee told him it was meant to be a joke although there was no obvious reason why he posted such a controversial picture.

“No reason. Just a joke, I guess,” Golingai told the court when asked to describe Tan’s reaction to his question on why he posted the photo.

Golingai was testifying based on a phone interview he had done with Tan back in 2013 that the latter wanted to see how people would perceive the bad joke.

“It seems not everybody is in the same page as us,” testified Golingai as he was telling the court what exactly Tan had said to him during the interview.

Golingai also told the court that people did not see the humour but were mostly angry and upset over the post judging from the comments received.

“That time, the political climate is very raw after the 13th general election as well as the so called Chinese tsunami,” Golingai said, adding that the posting could cause a riot.

He was responding to Deputy Public Prosecutor Wan Shaharuddin Wan Ladin during the examination-in-chief.

He was later crossed-examined by Lee’s lawyer Chong Joo Tian.

Chong said, “I put it to you that there are bak kut teh that are halal,” to which Golingai replied, “I disagree. There can never ever ever ever be a halal bak kut teh as it contains pork. You can’t slaughter a pig and make it halal.”

Apart from Golingai, Jakim chief assistant director Dr Lokman Abd Rahman and assistant registrar Noraini Yusof also testified at the same court.

‘Bak Kut Teh’ picture and caption can lead to controversy, says witness

KUALA LUMPUR, Nov 24 — The Sessions Court here was today told that a picture and caption posted by a couple in their Facebook page could potentially lead to controversy among the communities in the country.

Malaysian Islamic Religious Development Department principal assistant director Dr Lokman Ab Rahman who was testifying in the trial of Alvin Tan and Vivian Lee, said their action was “dangerous and might mislead Muslims”.

He said the picture and caption posted during Ramadan was offensive to Muslims who regarded the fasting month as holy.

Lokman replied when asked by deputy public prosecutor (DPP) Nur Faida Mohd Rasidee on what he understood about ‘Bak Kut Teh’, that the term originated from the Tibetan and Hokkien communities.

“Based on my understanding and my study, and a study done on the Chinese community, the term means pork, bone and tea,” said the witness.

Lokman dismissed the suggestion that Jakim was prejudiced against the Chinese community about ‘Bak Kut Teh’ and asserted, “though only a term, it is still categorised as non-halal”.

He told the court that Jakim had in accordance with Islamic law and jurisprudence, rejected many applications to use the ‘halal’ certificate and logo for ‘Bak Kut Teh’.

A witness in the trial of a blogger and his ex-girlfriend said the duo had insulted Muslims by posting on their Facebook page, a photograph and caption that ridiculed Islam.

Ikatan Relawan India Muslim Malaysia (Irimm) executive secretary Datuk Syed Al-Kadir Hassan, 49, said Alvin Tan and Vivian Lee’s actions had shocked and incurred the wrath of many parties, particularly Muslims.

He said he and his friends were at a food outlet on July 13, 2013, when he saw the allegedly offensive posting in the duo’s Facebook account and questioned the rationale behind the action.

He said, generally, everyone was aware that the “food” in the Facebook posting, “Selamat Berbuka Puasa (with Bak Kut Teh… fragrant, delicious and appetising)”, referred to pork bone soup.

“The pair should not have made such a caption in the month of Ramadan or even other months,” said the third prosecution witness on the first day of Tan and Lee’s trial.

Only Lee was present in court. She earlier claimed trial to an alternative joint charge with Tan of posting seditious material in their Facebook account, “Alvin and Vivian-Alvivi”, which allegedly had the halal logo.

They are accused of committing the offence at 9am on July 12, 2013, under the Sedition Act.

The duo are also facing another charge of posting a pornographic photograph in their Facebook between 9pm on July 6, 2013 and 2am on July 7, 2013, under the Film Censorship Act 2002.

Sex bloggers’ trial begins

KUALA LUMPUR: The trial of infamous sex bloggers Alvin Tan Jye Yee and Vivian Lee May Ling has begun with a lecturer testifying that he was upset with their bak kut teh posting and buka puasa greetings on Facebook.

Industrial Training Institute lecturer Datuk Syed Al Kadir Hassan told a Sessions Court here that the words used, as he understood it, was not referring to Muslim food.

“We all know that bak kut teh means sup tulang babi,” said Syed Al Kadir in the trial before judge Abdul Rashid Daud.

He was replying to Deputy Public Prosecutor Wan Shaharuddin Wan Ladin’s question during examination-in-chief yesterday.

“I was angry as the caption should not have been published at anytime since Muslims do not consume the dish,” he said.

Cross-examined by Lee’s counsel Chong Joo Tian on whether he agreed that bak kut teh referred to meat bone soup and not pig’s bone soup, Syed Al Kadir said: “I disagree.”

Malaysian Islamic Development Depart­ment (Jakim) assistant director Hisral Zirhan Md Zahari said bak kut teh was generally a type of Chinese dish containing ingredients that were non-halal to the Muslims.

Earlier, Sulaiman Khoo who was a Deputy Public Prosecutor attached to the commercial crime division and was also a convert, said the term bak kut teh came from the Hokkien dialect and that it was a pork based dish.

Sex bloggers freed over ‘insulting Muslims’ charge

Sex bloggers Alvin Tan and his former partner Vivian Lee have been freed over the charge of insulting Muslims with a Facebook posting showing the pair eating pork soup (bah kut teh) with the words “Selamat Berbuka Puasa” during the fasting month.

The Federal Court unanimously dismissed the prosecution’s appeal over the Court of Appeal’s decision in freeing the two of the charge under Section 298 A of the Penal Code.

“This follows the apex court allowing our preliminary objection that the Federal Court does not have the jurisdiction to hear the prosecution’s appeal.

“This is because the case originated at the Kuala Lumpur Sessions Court and hence, whatever decision and appeal should end at the Court of Appeal,” their lawyer Chong Joo Tian told Malaysiakini.
