Businessman agrees to out-of-court settlement over Ahmad Zahid assault case

The much awaited court battle between Home Minister Datuk Seri Ahmad Zahid Hamidi and businessman Amir Bazli Abdullah, who claimed he was assaulted. has fizzled out.

This follows an out-of-court settlement between both parties during a mediation exercise at the Shah Alam High Court today.

Datuk Shamsul Bahrain Ibrahim, a member in Ahmad Zahid’s legal team, told reporters  that compensation was to be decided without intervention of lawyers.

“Both have agreed to withdraw their action against each other,” he said.

His lawyer, Karpal Singh, said the mediation was conducted by Sessions Court judge Rohani Ismail in the presence of Zahid and Amir Bazli.

“I had insisted that the mediation be done together with lawyers sitting in but she decided otherwise,” the veteran lawyer said.

In his statement of claim, Amir said Ahmad Zahid punched and threatened to kill him. He also claimed he was held in wrongful confinement at Ahmad Zahid’s home in Country Heights.

How I sought police help first – by man suing Home Minister

A question surrounding the case of the businessman who was allegedly assaulted by Home Minister Datuk Seri Ahmad Zahid Hamidi is why did the police take no action.

That is the question that even led to a shouting match in Parliament two days ago between opposition member for Puchong, Gobind Singh Deo and the Home Minister.

Businessman Amir Bazli Abdullah, the man suing Ahmad Zahid, laid out his version of the events after the alleged assault in 2006, to The Malaysian Insider: “I first lodged a report at the Dang Wangi police station the day after I was assaulted but was referred to Kajang police.

“I met a chief inspector where my statement was recorded over three days.”

Three police officers, he said, went to see him in Kelantan and they obtained his medical report.

“Some three to four months later, the chief inspector informed me that my case was classified ‘no further action’. I questioned him why this was happening as he had promised he would investigate fairly.

“The officer was apologetic and said his hands were tied as the instructions came from above.”

Amir says the IGP refused to see him. “I was instead referred to the IGP’s secretary. And even she did not want to see me.”

Then on the advice of other police officers, Amir put his complaint on paper and personally sent it to the IGP’s office.

“All I got was an acknowledgement that the IGP’s office received my letter.”

When there was no further action from the police, Amir filed his suit in July 2007 against Ahmad Zahid, alleging that the then deputy minister punched him in the face on Jan 16, 2006, at the Country Heights Recreational Club in Kajang, Selangor.

Ahmad Zahid riled up over ‘assault’ claim

PARLIAMENT A shouting match erupted in the Dewan Rakyat today after a DAP member of parliament raised the issue of a police report against Home Minister Ahmad Zahid Hamidi.

Gobind Singh Deo (DAP-Puchong) mentioned the police action in relation to a complaint of assault against Ahmad Zahid, while the latter was winding up on points related to his ministry that had been raised during the debate on the royal address.

Although speaker Pandikar Amin Mulia said this had been asked in bad faith, Gobind attempted to rephrase his question several times.

This prompted a visibly agitated Zahid to accuse Gobind of having asked the question out of personal interest.

Gobind is the lawyer for the complainant in the ongoing civil case against Zahid.

“If I am kaki pukul, then Puchong (Gobind) is a bigger kaki pukul than me,” Zahid said.

Karpal challenges AG to prosecute Home Minister for assault, attempted murder

Lawyer Karpal Singh has challenged the Attorney-General to prosecute Home Minister Datuk Seri Dr Ahmad Zahid Hamidi for assault and attempted murder.

Karpal, who is also the Bukit Gelugor member of parliament, said there is a clear case of assault by the minister against former businessman Amir Bazli Abdullah.

Speaking to reporters today in Putrajaya, Karpal said Ahmad Zahid is obviously not fit to be a minister.

Meanwhile, counsel Gobind Singh Deo, who is also representing Amir Bazli, urged the AG to relook the police report.

Gobind then read extracts of the police report: “I (Amir Bazli) was dragged to a bench and held by two of Datuk’s men. Datuk scolded me and hit me mercilessly. A man called Hans then threatened to chop off both my hands and he also punched me in the face.

“I was hit by a hard object until my forehead skull fractured. I couldn’t see who did this but I suspect it was Hisham, Datuk Ahmad Zahid’s son-in-law.

“Then, Datuk Ahmad Zahid said ‘get a gunnysack, put him in the sack’.

His wife, Datin Hamidah came and tried to calm the situation.”

Amir, in his police report, had also claimed that Ahmad Zahid wanted to bury him.

Karpal urges AG to charge the home minister

Veteran lawyer and Bukit Gelugor MP Karpal Singh has urged the attorney-general (AG) to charge Home Minister Ahmad Zahid Hamidi with assault and battery, and attempted murder of his client, businessman Amir Bazli Abdullah, in 2006.

NONEKarpal (left in photo) said that there is no time frame for the AG to prosecute, and that it could do so.

“If you look at the nature of Amir Bazli Abdullah’s injuries and the police report lodged against Zahid, one is left wondering why no prosecution was done. These are very serious injuries and this is a serious matter.

“I have written to the AG over this as it is a serious matter that requires prosecution. However, he declined. It is still not too late. This shows the nature in this country (in not taking action) when people in high places are involved,” he added.

He said this is a clear-cut assault and battery case as there was enough evidence from Amir Bazli.

Federal Court rejects Zahid Hamidi’s plea

Umno vice-president and Home Minister Ahmad Zahid Hamidi’s bid to strike out an assault suit filed against him by a businessman was thrown out by the Federal Court today.

Court of Appeal president Justice Md Raus Sharif, who headed a five-member bench, dismissed Zahid’s application for leave to appeal before hearing submissions from Zahid’s lawyer Shamsul Bahrin.

Shamsul Bahrin pointed out that the issue at hand refers to trespassing against a person. However, Karpal Singh, then the lawyer acting for Amir Bazli, interjected and pointed out that the points of law were not filed via a notice of motion.

The judges found that the points of law that were to be presented to the court were not done properly, for this was not done through a notice of motion but through submission.

“The matter has not gone through trial at the High Court in Shah Alam and you are not deprived of an appeal process. Let the trial proceed in the High Court.

“If we were to allow such application before the appeal proper, it will hold up other cases,” Justice Md Raus said.

Go on leave, Zahid told

Jun 13: Home minister Ahmad Zahid Hamidi has been told to go on leave until two cases involving him were settled.

According to veteran DAP leader Lim Kit Siang, Zahid (pic) had caused major embarrassment to the Barisan Nasional government over his involvement in an assault case as well as the revelation that he spent more than the spending limit during his election campaign in Bagan Datoh.

“Ahmad Zahid Hamidi should go on leave as Home Minister until two cases causing major embarrassment to the Barisan Nasional government had been settled,” said Lim today.

In 2006, Zahid was accused of causing hurt to Amir Abdullah Bazli, and the Appeal Court had ordered him to answer charges by Amir.

The case drew concern from former Kuala Lumpur CID director Mat Zain Ismail, who questioned why the police had failed to take action against Zahid.

More recently, Zahid was found to have spent over RM2 million – ten times the limit allowed for a candidate’s campaign expense.

Video clips posted by him on his official website confirmed this, in which he admitted giving RM100 and 5kg bag of rice to some 24,000 people in his constituency.

Zahid recently drew condemnations after he told Malaysians who were not satisfied with the country’s electoral system to migrate.

Then a deputy information minister, Zahid had denied the allegation and applied to the Kuala Lumpur High Court for the case to be thrown out. The application was dismissed by the same court on April 21, 2010.

He later filed a countersuit against Amir, 41, claiming to have suffered humiliation and emotional trauma as a result of the accusation.

But last year, a three-judge Court of Appeal panel unanimously ruled against Zahid’s bid to strike out the assault charge and ordered the minister to pay RM5,000 in costs.

Zahid is being sued by a businessman for allegedly punching him in January 2006, causing the latter to suffer a nasal bone fracture and a swollen left eye. — File picKUALA LUMPUR, June 6 — New Home Minister Datuk Seri Ahmad Zahid Hamidi may be a “criminal”, Lim Kit Siang suggested today, reminding Malaysians that the Umno leader had yet to clear his name against allegations of assault in 2006.

The DAP adviser agreed with Puchong MP Gobind Singh Deo who said last week that it was improper to place Zahid in a position where he has great influence over enforcement bodies like the police and prisons when the latter still had such charges hanging over him.

“A response from Najib to Gobind’s query is in order,” Lim said in a statement, referring to Prime Minister Datuk Seri Najib Razak, “… especially as he is the first prime minister to specifically appoint a minister in the Prime Minister’s Department to be specifically responsible for integrity and good governance.”

Former Transparency International Malaysia (TI-M) president Datuk Paul Low was recently appointed to Najib’s Cabinet and placed in charge of corruption and integrity.

“Paul Low… should also declare whether he agrees that Zahid should stand down as home minister until he has fully cleared himself of the serious charges of assault going back to January 2006 when he was deputy information minister,” Lim said.

Who is Zahid Hamidi? Do we have a criminal as the new Home Minister?

I thank Malaysians who have expressed their outrage at the arrogance and cockiness of the new Home Minister, Datuk Seri Ahmad Zahid Hamidi, who was shown on television on Tuesday questioning: “Who is Lim Kit Siang? I don’t know who he is.”

What is important is not “Who is Lim Kit Siang” but “Who is Ahmad Zahid Hamidi” who has become the new Home Minister.

This has become particularly important following the call by the Chairman of the DAP Legal Bureau and MP for Puchong, Gobind Singh Deo, to the Prime Minister, Datuk Seri Najib Razak to suspend Zahid from the Cabinet to prove the Prime Minister is serious about government reform.

Gobind has told the Prime Minister that it is “improper” to put a man who has been ordered to answer a civil suit for assault to be in charge of the powerful home ministry where his actions and conduct could invite conflict, which would reflect on his Barisan Nasional (BN) government.

What is Najib’s response to Gobind’s contention that putting Zahid in charge of the Home Ministry, which is responsible for the police, is to create a position of conflict as the Home Ministry is one of the most powerful ministries, with significant influence over various bodies including the police and prisons.

A response from Najib to Gobind’s query is in order, especially as he is the first Prime Minister to specifically appoint a Minister in the Prime Minister’s Department to be specifically responsible for “integrity” and “good governance”.

Najib should specifically explain whether he knew of the serious allegations of assault against Zahid when the latter was deputy information minister, and whether the Prime Minister had inquired why the police had not charged Zahid for criminal assault in 2006, and the answers that he received.

And what says ‘integrity’ minister Paul Low?

Paul Low, who is the Minister with the specific briefs of “integrity” and “good governance” should also declare whether he agrees that Zahid should stand down as Home Minister until he has fully cleared himself of the serious charges of assault going back to January 2006 when he was deputy information minister.

The case raises the pertinent question why Zahid had not been charged by the Police for the criminal offence of assault.

This raises the further question whether Malaysia has a criminal as the new Home Minister.

Is Zahid or Najib prepared to answer this issue, on Zahid’s suitability as Home Minister with the serious allegation of criminal assault hanging over Zahid when he was deputy information minister and the failure of the police then to charge Zahid, on the first working day of Parliament on June 26?

Zahid: Why is DAP so scared of deregistration?

Home Minister Ahmad Zahid Hamidi has denied a claim by DAP veteran Lim Kit Siang that he is out to de-register the DAP.

NONEZahid (left) instead chided Lim for making such allegations and being so jumpy about the matter.

“Who is Lim Kit Siang? I don’t know who he is,” he joked.

When reminded that Lim is also Gelang Patah MP, he said: “No (I’m not threatening deregistration). Why is he so scared?

“Face me in Parliament and ask me more questions. I’m willing to reply. And don’t make allegations on Facebook. It’s not a brave thing (to do).”

The DAP is being investigated by the Registrar of Societies – an agency under the Home Ministry – over the validity of its December party leadership elections.

Hello: Home Minister Ahmad Zahid Hamidi claims the government is not threatening DAP with de-registration, but his methodology implies he is about to do so.

DAP has every right to be afraid, not because of the threatened de-registration, but the abuse of the investigation procedures in the manner the Registrar of Societies (ROS) is going about it.

If it is an honest straightforward transparent investigation, DAP will have been given a clean slate.

FellowMalaysian: Zahid is fast gaining notoriety as the home minister whose words do not match what he does. He said last week that the police force is independent from his ministry and he was not involved in police’s actions.

Now, he is speaking on behalf of ROS on their stand relating to DAP’s possible de-registration.

Jaguh: To talk like Zahid shows that our ministers have no class and finesse. It’s more like gangsters picking a fight with someone.

It’s the old saying of whoever is in power has the will to take revenge in whatever manner one chooses and this minister, for sure, is doing just that. Except, he is always in denial mode.

Justice Pao: Zahid, when Umno contracts out their dirty work to ROS, police, Election Commission (EC) and even Malay rights group Perkasa, then it is time we need to start protesting against these fraudulent tactics.

Sinner: Zahid, DAP leader Lim Kit Siang is a citizen of Malaysia and MP for Gelang Patah. If you do not like him, you may emigrate.

The Mask: Zahid asked who was Lim Kit Siang? Of course, you don’t know him. You were still running round in your diapers when Lim was already in the forefront of the political arena. In view of your past history, you better talk less, otherwise all your dirt will be exposed.

Confused: It is a well-known fact that in Malaysia, the people that are chosen for minister’s posts are cronies or friends. It has nothing to do with intelligence or capabilities. Just compare our ministers with those from other countries.

Ours have no flair and no tact at all when facing the media or public. However, I must say that the only minister that somehow has impressed me is Youth and Sports Minister Khairy Jamaluddin Abu Bakar.

Mr KJ John: Dear minister, you have no power to de-register the DAP. Even the ROS cannot do it, even if they were found to have not followed due process at their last annual general meeting (AGM).

The point is, all the ROS can do is to order a fresh AGM to be held. So, let us be educated about all this, and Lim, let us not make a mountain out of this mole hill. DAP got full mileage from the fiasco and you should all move on.

Suspend Zahid Hamidi till assault case cleared, PM told

KUALA LUMPUR, June 2 – Datuk Seri Najib Razak was today challenged to temporarily remove from his Cabinet Datuk Seri Ahmad Zahid Hamidi – who has been sued for assault – to prove he is serious about government reform.

Opposition lawmaker Gobind Singh Deo told the prime minister that it is “improper” to put a man who has been ordered to answer a civil suit for assault in charge of the powerful home ministry where his actions and conduct could invite conflict, which would reflect on his Barisan Nasional (BN) government.

“[Leading] the Home Ministry now, which is responsible for the police would to my mind, put Zahid in a position of conflict.

“The Home Ministry is one of the most powerful ministries, with significant influence over various bodies including the police and prisons,” the Puchong MP said, adding in his statement that its minister must be seen as one who is “above and beyond these agencies as he needs to maintain independence”.

“Will the Prime Minister remove him pending the outcome of the trial or will he resort to the same old indifferent attitude and silence proving yet again that he is incapable of the change he promises?” the DAP man asked.
