PETALING JAYA: A video of the late Karpal Singh has surfaced, where he voices his disappointment that fellow Opposition leaders did not stand with him in opposing PAS’ hudud.
“When it came to hudud laws, nobody supported me. Neither Lim Kit Siang, Lim Guan Eng, or anybody else. It’s a shame. They should also bertaubat (repent),” said the veteran lawyer, in the 2009 video.
The Bukit Gelugor MP remained a vocal opposer of hudud – which metes out punishments under the Syariah law – until his death last year.

DOCTORS WHO AMPUTATE FOR HUDUD WILL FACE THE WRATH OF THE MMA.

KUALA LUMPUR, April 25 — The Malaysian Medical Association (MMA) said it will refer those who are not doctors but carry out amputations on criminals under Kelantan’s hudud law to the police.
MMA president Datuk Dr NKS Tharmaseelan said the association will not only seek to de-register doctors who dare to carry out the operation but will also lodge police reports against any other individual not from the medical fraternity.
“We will report to the police to take action against him because it is against medical practice and we have to complain to the police because he is not a doctor,” he told The Malay Mail Online here when asked what action the MMA can take against those who are not doctors and carry out amputations.
MMA represents 14,000 out of 37,000 doctors in Malaysia.

Gerakan urges Muslim MPs to vote against Hudud Bill

Gerakan has urged the 135 Muslim parliamentarians to uphold the federal constitution instead of supporting PAS’s Private Members Bill to obtain approval to implement hudud law in Kelantan.
Gerakan legal and human rights bureau chief Baljit Singh said voting against the Bill must not be construed as being un-Islamic.
He urged the 88 BN, 21 PAS, 16 PKR and two DAP Muslim MPs to put the people’s interest above politics.
“We want to prevent the Bill being passed in Parliament because if it happens, it cannot be challenged in court,” Baljit said at a press conference in Penang.
Accompanying him at the media event was Gerakan’s deputy secretary-general Dr Thor Teong Gee.
He said to amend the federal constitution, a two-thirds majority is needed but it takes only a simple majority to amend an Act of Parliament, namely the Criminal Procedure Code and Penal Code related to criminal proceedings.
He added that PAS wants to amend the constitution and Parliament Act so that the law cannot be challenged in court

Doctors, remember your hippocratic oath
Bamboo: Umno and PAS are both destructive. Hudud is just the bogeyman put forward by PAS to court Malay votes. For the same purpose, Umno has to respond likewise and not oppose hudud. The cycle goes on.
The Malaysian Medical Association (MMA) has raised a pertinent issue on the implementation of hudud (that the Kelantan government’s plan to order surgeons to conduct amputations of limbs if it succeeds in implementing hudud goes against medical ethics). I hope PAS will fight for a more equitable, welfare country instead of hudud.
RATBATBLUE: In the late 70s and early 80s, there was a similar push by the Kelantan government for the implementation of hudud, and the question of who was going to perform the amputations arose.
The Health Ministry did state that it categorically banned its doctors from doing such surgery under such laws. Now, this has resurfaced. Personally, as a surgeon, I am totally and vehemently against the performance of surgery for these purposes. These laws were enacted in times where the only “surgery” done was the mere chopping off of the affected parts.
Nowadays, we are breaking our backs trying to reattach limbs and also salvaging them, so telling us to revert to “removing a limb in a humane manner” is totally unacceptable. Why do it, in the first place? Imagine, using 21st Century technology and facilities to perform a seventh century punishment.
This is absolutely insane! I say that any doctor who partakes in this barbaric act should be jailed and permanently struck off the register.
Aryan: As a medical doctor professing the religion of Islam, I condemn this proposal to engage medical doctors to carry out this seventh century punishment. God says in Quran that He is all forgiving and merciful after pronouncing these laws and when God can be forgiving and merciful, why can’t we do that as well?
Hudud is the ultimate punishment and should not be carried out until there is social justice, impartial judiciary and syariah courts with empathetic, intelligent and knowledgeable judges, equality for all people and till poverty has been eradicated. Even than the amputee becomes a burden to the community and amputation is therefore not acceptable.
PAS should work to establish social justice for all the people, engage in eradication of poverty, banish superstitious practices and raise the level of education and competence of not only the Muslims but the entire populace. PAS is going the wrong way and has fallen into the trap set by Umno. It will pay a huge price for the folly.

PETALING JAYA: The Kelantan state government’s plan to use surgeons to amputate limbs of criminals under hudud law, has drawn fire from the Malaysian Medical Association (MMA).
“This would certainly be against medical ethics and medical practice,” said MMA president Datuk Dr N.K.S. Tharmaseelan, who expressed shock over the plan.
“The aim of the medical profession has always been to care, treat and cure … not take lives of people or amputate limbs of criminals under hudud law,” he added.

Doctors balk at ‘surgeon-assisted’ hudud plan
The Malaysian Medical Association (MMA) has expressed “shock” over a report that the Kelantan government will order surgeons to conduct amputations of limbs if it succeeds in implementing hudud.
Its president, Dr NKS Tharmaseelan (right), said amputating the limb of any convicted criminal under goes “against medical ethics and practice”.
Tharmaseelan said doctors have also been advised by the World Health Organisation not to witness or certify caning or the whipping of criminals, and amputations are “far more serious”.
“I implore upon the Kelantan government to rethink getting surgeons to do the ‘menial’ task of implementing a law that goes against medical ethics and practice.
“Personally, I am totally against any law that requires disfigurement…
“Asking a surgeon to perform amputation is far more serious and definitely is opposed by the MMA,” he told Malaysiakini.
‘Doctors trained to treat and cure’
Tharmaseelan said that doctors are trained to care, treat and cure, and must obtain consent from patients, even if they are criminals. Failure to do so will be a breach of ethics.
As such, he said, MMA will lodge a report against any doctor who participates in hudud amputation by lodging a report against him or her with the Malaysian Medical Council for breach of ethics.
“This may lead to him or her being expelled from the medical register as a doctor. The MMA will also take action against the doctor, and expel him or her from the association,” Tharmaseelan said.

Specific provisions about Islam and the lack of the word “secular” in our federal constitution notwithstanding, Malaysia has been officially declared as a secular state, argued a veteran lawmaker.
“A five-man bench of the Supreme Court (equivalent of the present Federal Court which replaced the Privy Council) presided by the then head of the judiciary Tun Salleh Abbas in 1988 in Che Omar bin Che Soh vs Public Prosecutor, clearly stated the law in the country was secular.
“That being the position declared by (the) high authority, it must follow inevitably that the country was a secular state and not an Islamic state, as a country having secular laws could not be an Islamic state,” argued DAP national chairperson Karpal Singh.
He believe, as such, that Malaysia has been “judicially pronounced to be a secular (country)”.

2013 Calendar

Dec 28: A bi-lingual wall calendar for 2013 containing images and messages reflecting those uttered by MCA leaders recently in their campaign against PAS and Islamic values has been condemned by Selangor PAS Youth, who urged the authorities to investigate.
The calendar, in Chinese and English, bears the title “Do not think that hudud law does not affect you, it will”, followed by images to show that non-Muslims would be subjected to various rules curtailing their freedom. The rest of the calendar is based on the standard local ‘kuda calendar’ template, containing details of public holidays and race dates to guide horse racing punters.
Selangor PAS Youth chief Hasbullah Mohd Ridzwan said those behind the production of the calendar were cowards.
“The act is insolent and shows the cowardice of people with unsound mind,” he said, urging the police and Islamic department to act.
Without naming, Hasbullah said it was possible that a certain party aligned with the ruling coalition was behind the production and distribution of the calendar.

Review hair salon rules, says Kelantan Pas official

State Local Government, Tourism and Culture Committee chairman Datuk Takiyuddin Hassan yesterday held a meeting with the Kelantan Federation of Chinese Associations and state Chinese Chambers of Commerce on the issue.
The one-hour meeting, which ended about 11am, was held at the state secretariat here.
The federation was represented by chairman Oie Poh Choon while the chamber was led by its president Goh Tee Chew.
Takiyuddin said the meeting, which he described as a “friendly gathering”, was to find a suitable solution to the controversy.

Anwar’s lawyer offers to help hair salon
Sankara Nair believes the by-law is unconstitutional and is willing to challenge it.
PETALING JAYA: A lawyer who was involved in Opposition Leader Anwar Ibrahim’s sodomy trials is now offering himself to challenge the Kota Baru Municipal Council’s by-law, which prohibits a female to cut a man’s hair and vice-versa.
Sankara Nair said he was willing to take up the case as “I believe the by-law is clearly unconstitutional”.
Last week, E-Life Salon, a hair dressing salon based in Kota Baru, was issued a fine by the Kota Baru Municipal Council when one of its female hairdressers “was caught cutting” the hair of a male client.

“The Kota Baru Municipal Council’s by-law is clearly unconstitutional because it takes away the freedom of non-Muslims. I am willing to pursue this case pro bono,” he told FMT.
“The issue is abominable and PAS should keep to its words; it should not impose such rulings on non-Muslims,” he said.
He hoped the owner of the hair salon involved would contact him as he is willing to work with the owner to challenge the by-law.
Sankara shot to prominence by being one of the leading spokesmen during the two sodomy trials Anwar faced. The first was in 1999 while the second was early this year.

The Islamic morality by-laws implemented by the Kota Baru Municipal Council are not meant to be expanded and implemented on non-Muslims, PAS president Abdul Hadi Awang said today.
This is clear in the Kelantan Syariah Criminal Offences Enactment (II) 1993, which is not applicable to non-Muslims, Hadi said in a statement.
The party, he added, views seriously the concerns voiced by the non-Muslims.
“At the same time, Kelantan has to enforce its responsibilities after getting the mandate given by the people to ensure that the good behaviour of Muslims is safeguarded,” the PAS president said.
“Hence, PAS believes that the purpose of this by-law is towards that objective.”

Hair salon operators react to Kelantan’s gender-segregation regulation

PETALING JAYA: Hairdressers here are aghast at Kelantan’s gender-segregation regulations for hair salons in the state while another Kelantan-based salon operator has decided to move his business to Johor.
The salon operator apparently is moving to Johor to set up business, after the local authority in Kelantan started to apply gender-segregation rules to non-Muslims.
Describing the ruling forbidding female stylists to cut non-Muslim male customers’ hair as “ridiculous”, Malaysian Hairdressing Association (MHA) president Billy Lim said that it would adversely affect the industry and would eventually cause the salons to shut down.
It was reported that hair salon operators in the PAS-ruled state were being fined by the state government for breaching municipal council by-laws which prohibit a woman from cutting the hair of a man and vice versa.
“This is an industry that caters to both genders, and obviously there isn’t an equal number of male and female workers in each salon. The salons will not be able to survive if each worker is only allowed to cut the hair of customers of the same gender,” he said.

Kelantan plagued by gender-segregation controversies
PETALING JAYA: The Kota Baru hair salon fiasco is not the only gender-segregation controversy that has emerged out of the PAS-led Kelantan Government since the party took control of the state in 1990.
Supermarkets in Kelantan were known to have separate counters for men and women, a rule that was enforced back in the 1990s.
In 1995, the state ruled that men and women were not allowed to sit next to each other in the cinema. The state government also said lights must be switched on during screenings.
There has not been any operating cinemas or cineplexes ever since the ruling came into place, although there is no actual ban on such outlets and operators are allowed to open cinemas provided that the guidelines are adhered to.
Female Muslim workers are also subject to Kelantan’s strict dress code rulings.
The Kota Baru Municipal Council goes on regular checks at businesses and fines employers if their female Muslim workers do not wear the tudung (head scarf) or wear short sleeve shirts.

MCA has called on DAP to quit Pakatan Rakyat over PAS’ “repeated provocations” in order to “preserve the dignity” of the Chinese and non-Muslims communities.
“I urge DAP to withdraw from Pakatan as DAP has no strength to fend off the repeated provocations and oppression from PAS which impede the dignity of Chinese and non-Muslim voters,” said MCA central committee member Loh Seng Kok in a statement today.
He was likely to be referring to the media reports of a non-Muslim female hairdresser in Kota Bharu who had allegedly been summoned by the municipal council for cutting a male customer’s hair.
“Although Lim Guan Eng and PAS claim that PAS’ hardline policies will not pose a threat to the cultural practices of non-Muslims, if DAP does not want to pawn away the rights of the Chinese and non-Muslim communities, DAP should withdraw from the Pakatan coalition and declare firmly that they do not support PAS hudud enactments in order to quell the concerns of the Chinese and non-Muslim communities about the effects of PAS hudud enactments will have on them,” said Loh.

DAP national chairperson Karpal Singh described the latest controversy over a ban by Kelantan on hairdressing salons forbidding the cutting the hair of the opposite sex as an “unkind cut” for Pakatan Rakyat.
“I am surprised that Kelantan has decided to extend such rulings to non-Muslims,” said Karpal, at a press conference in Penang.
“Time and again, the PAS state government has publicly declared that Islamic laws are not extended to non-Muslims, just as the party has also stated that hudud is not for non-Muslims,” added the Bukit Gelugor MP.
Karpal said many Malaysians are worried that the same ruling would be imposed in other Pakatan-held states and whether if hudud would include non-Muslims as well.

A female hairdresser of a salon in Kota Bharu has been summoned by the municipal council for cutting a male customer’s hair.
Kota Bharu municipal council secretary Mohd Anis Hussein explained that unisex service is banned in the town’s hair salons.
According to a Sin Chew Daily report, the incident happened to Ong Lee Ting, a hairdresser with E-Life hair salon located in the KB Mall shopping complex.
Ong reportedly said that while she was working on the hair of a male customer at around 9pm on Tuesday night, a municipal council enforcer in plainclothes suddenly appeared and issued her a summons for cutting the hair of a member of the opposite sex.
She claimed that her brother, also a hairdresser, was also banned from serving female customers, significantly reducing his commission. To make ends meet, he was forced to leave Kota Bharu two months ago to work in Johor.
“This is a shopping mall. The monthly rental is more than RM10,000. The operating cost is very high. The lady boss chose to open the salon here because of its crowd.

The MCA’s tirade over hudud (Islamic criminal law) has exposed UMNO as a party that does not truly champion the cause of Muslims and Islam. Why is UMNO tolerating and allowing the insults hurled by the adulterer Chua Soi Lek at hudud and Islam?
Is UMNO so weak that it cannot defend Islam against MCA, a party that supports adultery?
At least the Islamist PAS has no pretences about defending Islam for Muslims. And it is their right to do so. Unlike in the 60s, 70s, 80s and 90s, the Malaysian Chinese community is no more fearful of PAS and Islam.
As Malaysians, made up of various races and religious faiths, we are aware of the need to be tolerant and to respect each other faiths.
Hudud is just one aspect of Islam. It is an Islamic criminal law and applies to Muslims only. Any fear of the law being extended to non-Muslims is merely speculative, inapplicable and unrealistic.
MCA’s continuous harping on the hudud only shows its political immaturity in the modern digital era. The people are now more informed due to the borderless Information, Communications and TechnoloSoi Lek: Greater fear of hudud among Chinese todaygy (ICT) network.

KUALA LUMPUR, Oct 20 – Datuk Seri Dr Chua Soi Lek appeared to suggest today that MCA’s anti-hudud campaign has been successful, saying that there is greater awareness and fear among the Chinese community today over the possibility of the Islamic law being being implemented should Pakatan Rakyat (PR) wrest federal power.

Harder to show proof under hudud
The current criminal law is better because it is easier to prove a case beyond reasonable doubt, says DAP’s Karpal Singh.
GEORGE TOWN: Potential criminals will not fear the Islamic hudud law because its burden of proof was harder than current criminal law in the country, DAP chairman Karpal Singhs said today.
Hence, he said hudud law could not serve public interests well because if it was applied, virtually no one could be convicted of crime.
Under hudud, it would be practically impossible to prove a case against an accused without a shadow of doubt.
Comparatively, he suggested that it could be easier to prove a case beyond reasonable doubt under the current criminal law.
For instance, he said the requirement that there must be four witnesses to prove a rape case under hudud would make it impossible to convict a person.
Thus, it would not be able to deter crime and criminals, he said.

Former prime minister Mahathir Mohamad, who during his 22-year tenure had been responsible for ensuring that PAS-led Kelantan could not pass its Hudud bill enactment, has now invited the Islamic party to join hands with UMNO to implement the Islamic penal code.
According to Harakahdaily, Mahathir’s condition is that PAS leaves Pakatan Rakyat, the coalition led by his nemesis Opposition Leader Anwar Ibrahim. Many analysts rate the Pakatan as having a real chance to wrest the federal government from the BN in the next general election which is widely expected to be held within the next few months.
“UMNO will ensure a fully compliant Islamic state if PAS has a big heart to join UMNO. Other Islamic countries are also putting hope on Malaysia, but there are still people wanting to split the Muslims. That’s why our goal is not achieved,” Malay daily Sinar Harian had quoted Mahathir as saying.
The former UMNO president had once threatened to impose emergency in the form of ‘Mageran’ (National Operation Council) on Kelantan if the state went ahead and implemented hudud on Muslims convicted of serious crimes.
Mahathir had also previously remarked that if hudud laws were implemented, there would be many Muslims without limbs. He labeled the laws which include beheading, stoning to death, whipping as well as amputation of limbs as being outdated, adding that the Islamic laws’ requirement for solid evidence and witnesses meant it could not be applied in the modern context.
Willing to bypass all the other races & religions
Mahathir’s backtracking has put a cat among the pigeons. While it may rile DAP leaders, it also challenges non-Muslim component parties in the BN such as the MCA, MIC, Gerakan and the Christian-majority East Malaysian parties.
However, Pakatan leaders say it is the Muslims in PAS that Mahathir is really targeting.
“I think Mahathir has just told PAS members that if they really want hudud and an Islamic state, they should join hands with UMNO. This is the fastest way for PAS to have a realistic chance to get the two-thirds majority in Parliament it needs to pass hudud,” PKR vice president Chua Jui Meng told Malaysia Chronicle.
“It is also a most unethical statement as usual from Dr M. It suggests that he and UMNO are willing to bypass the non-Malays in the governing of this country. To retain power, UMNO is willing to shut out all the other races and all the other religions to form a monopoly with PAS. Of course, PKR is confident that PAS will rebuff such an underhanded move.”
Raison d’etre
Unlike UMNO and despite pressure from Pakatan partner DAP, PAS has never wavered from publicly stating hudud as one of its ultimate aspirations along with the creation of a ‘true’ Islamic state as the Muslim religion is its raison d’etre.
Nonetheless, party leaders from president Hadi Awang to Spiritual Adviser Nik Aziz Nik Mat have assured that any implementation of hudud would affect only Muslims and pledged they would respect the Federal Constitution, which means that they accept they will have to wait until they managed to swing the necessary majority in Parliament required to get the Bill passed.
“We are either Muslims, Christians, Hindus, Buddhists, Sikhs or others. Islam celebrates religious plurality and acknowledges the ‘claim of exclusivity to its belief and teachings’ and accords a respect to the ‘absolutist doctrine’ of all transcendental religions,” PAS strategist and MP for Kuala Selangor Dzulkefly Ahmad said in a recent blog posting entitled A political contest beyond Hudud.

Karpal: Hudud can’t be implemented in secular Malaysia
KUALA LUMPUR, Aug 8 — DAP national chairman Karpal Singh today addressed the issue that PAS is keen on pursuing its aim to implement hudud laws in Malaysia.
He said PAS secretary-general Datuk Mustafa Ali had mentioned that hudud may not be part of the Pakatan coalition’s Buku Jingga (Orange Book) agenda and that this did not mean PAS would drop that idea.
“Hudud can only be applied in an Islamic state. It cannot be implemented in a secular state like Malaysia. A secular state like Malaysia must, of necessity, have secular laws.
“This was decided as far back as at 1988 when former Lord President of the Federal (later Supreme) Court of Malaysia Tun Salleh Abas ruled that the country was governed by secular law which meant Malaysia was a secular state,” Karpal Singh said in a statement here, today.
Karpal Singh….. noted that PAS president, Abdul Hadi Awang, himself had said last year that the Quran did not provide for an Islamic state but a welfare state.

Pakatan buries hudud idea
PAS says there is no question of implementing hudud as it is not included in Pakatan’s “Orange Book” or Common Policy Framework.
PETALING JAYA: Pakatan Rakyat leaders today said they would not implement hudud in the country should they take over Putrajaya in the next general election.
“We have solved this issue last year, and we are sticking to the common policy included in the Buku Jingga,” PAS secretary-general Mustafa Ali said at a press conference here.
Hudud, he said, was not included in the Buku Jingga or “Orange Book”, which is a document of Pakatan’s policies known as the Common Policy Framework.
“In the case of Kelantan, their enactment existed before Pakatan Rakyat did. Even then, they are setting up a committee to oversee its implementation,” Mustafa said after attending Pakatan’s secretariat meeting at PKR’s headquarters.
“On the other hand, there are no such plans to implement Hudud in Kedah,” he pointed out.
DAP chairman Karpal Singh had earlier said that any attempt by PAS to espouse hudud in the country would reflect poorly on the decisions made by the last PAS Muktamar – shifting its agenda for an Islamic state to a more inclusive “welfare state”.
Terengganu PAS Youth chief Mohd Nor Hamzah had, in turn, called for the senior politician’s retirement, claiming that the latter’s “outdated views” had become a liability to Pakatan Rakyat.
The ruling coalition played this up and said Pakatan’s split on hudud was irreconcilable and warned the electorate against voting in a pact that would rather sweep its problems under the carpet than solve it.
BN using Hudud to frighten the Chinese
But DAP Youth leader Anthony Loke accused the MCA and Barisan Nasional of using hudud as a scare tactic to frighten the Chinese community from voting for the opposition coalition.
“Once the general election nears, BN will paint DAP in a bad light, which will, by extension, affect PAS and PKR as well,” he told reporters.
“MCA is using hudud to frighten the Chinese. They are using their old strategy and scripts again,” he said.

DAP chairperson Karpal Singh has warned the MCA that it might face annihilation should it continue to exploit the hudud issue among Malaysians.
At a press conference today, Karpal expressed his dissatisfaction that MCA has persisted in playing up the issue of the Islamic jurisprudence in its media arm, The Star.
He urged MCA to stop its act as it was a waste of time, saying, “In any event, it is not going to work.”
When told that the newspaper would probably not stop in its act to report about the issue, Karpal said, “If they do not, then the people will stop you in the coming general election.”
“Just like how the people almost eliminated the MCA in the last 2008 polls. The people can do it again. At that time, the MCA was on the brink of elimination,” he warned.
Karpal was hitting out at MCA central committee member Loh Seng Kok who said that except for the veteran lawyer, DAP leaders were mere “yes men” for PAS.

The young ulama secretariat of Umno has declared its support for the proposal to implement hudud law in Johor on all races.
Its chairperson Fathul Bari Mat Jahaya, told Sinar Harian that the secretariat’s working committee had decided in a meeting to send an official letter on this to the Johor Umno in two or three days.
The letter will express its unanimous support for Umno’s Kemelah assemblyperson Ayub Rahmat (right) who raised the proposal during the Johor state assembly sitting on June 20, said Fathul.
It will also give views and suggestions on how hudud law can be implemented in the southern state.

PAS spiritual leader Nik Abdul Aziz Nik Mat has congratulated Umno on its assemblyperson’s proposal to implement hudud law in Johor for all races, and also invited the party to join hands with PAS in pushing the agenda.
“Congratulations, Umno. I’m so grateful over this awareness,” Nik Aziz is quoted as saying in a Sinar Harian report today.
The Kelantan menteri besar said whether Kelantan or Johor would be the first state to implement hudud law was not important and if Johor had the ability to the pioneer the move, “please do”.
“Kelantan faces obstacles (in implementing hudud) but if Johor can do it, go ahead. Please do,” he told the media in Kota Bharu yesterday.

MCA president Dr Chua Soi Lek has hit out at Umno’s Kemelah assemblyperson Ayub Rahmat for proposing that the Islamic hudud law be implemented for all – both Muslims and non-Muslims – in Johor.
In a Twitter posting last night, Chua said Ayub (left) was “out of his mind” for proposing such an idea.
“The Johor Umno Adun (state representative) must have run out of ideas and out of his mind to propose hudud in Johor including non-Muslims,” the post read.
He added that MCA would “definitely” object to such a move.

Umno’s Kemelah state assemblyperson Ayub Rahmat has proposed that hudud law be implemented in Johor for all races.
When contacted by Malaysiakini, Ayub said he wanted to see Johor to be the first state to implement “true hudud law” which he said differed from PAS’ version of the religious law.
The critical difference with PAS’s hudud law legislated in Kelantan, he said, was that there would be no discrimination as it would have to cover all races in the state.
“The Syariah Criminal Code (II) 1993 State of Kelantan does not reflect the true requirements of Islam. it creates discrimination in terms of execution (among Muslims and non-Muslims),” Ayub (left) said.
Kelantan had adopted the law in 1993, three years after PAS captured the state but provisions in the federal constitution prevented its enforcement.
