MUDA has won its lawsuit in the High Court today, securing an order for Home Minister Hamzah Zainudin to register it as a political party within two weeks.

But for those who are interested in @partimuda's submissions before the Court, below is a summary of why we say the Minister's decision to reject MUDA's registration was unlawful:
2. His justification?

a) Saddiq was charged in Court
b) Saddiq & some founders joined peaceful assemblies at Dtrn Merdeka & the Lawan Rally – this promoted "budaya demonstrasi jalanan"
c) MUDA used party logo (eg: on a public statement) before it was registered
4. On peaceful assemblies, we submitted:

– In 2019, Peaceful Assembly Act 2012 was specifically amended to remove "street protests" as an offence. It is hence ridiculous & totally against the law for the Minister to rely on this as an excuse
6. – Morever, PEJUANG was also warned by ROS because it had used their party logo before it was registered.

But Minister went on to register PEJUANG anyway.
Again, double-standards & bad faith on the Minister.
8. Finally, there were no reasons given by the Minister when it issued its decision to reject MUDA on 12.8.2021.

Providing reasons is the bare minimum which public bodies should strive for, as it promotes accountability & good governance.
10. The freedom of association also includes freedom to establish political parties.

Political parties are vital because under Msian law, u can only use a party's logo if it's registered. We all know how important a logo is for elections.
