Lawyer denies Charles is missing, no info on pen drive
Lawyer Americk Sidhu today denied that his client, Charles Suresh Morais, has gone missing.
Americk told Malaysiakini that he last contacted Charles, the brother of murdered senior deputy public prosecutor Kevin Anthony Morais, “a couple of days ago.”
“No, he has not gone missing, as far as I am aware,” Americk said in response to inspector-general of police Khalid Abu Bakar, who said yesterday that police have yet to receive any news from Charles on the alleged pen drive in his possession.

However, Americk said no reference was made to the pen drive during his last communication with Charles.
“He did not tell me and neither did I ask him. We were discussing other issues,” said Americk who was involved in the drafting of Charles’ SD.
He had also previously said he was not aware of the contents of the pen drive.
Asked whether Charles was preparing to respond to Khalid’s demands, Americk said he did not know.
Americk also said he is not aware of whether there has been any progress in Charles’ plans to seek legal advice before deciding on whether to expose the pen drive.

The Morais siblings are locked in a heated and public family feud, with two brothers battling it out in the media, both purportedly in the name of their slain brother Kevin.
Charles claims his damning statutory declaration (SD) implicating high profile figures is to give Kevin, a deputy public prosecutor (DPP) with the Attorney-General’s Chambers, justice.
The youngest brother Richard however, is challenging his brother’s SD saying he wants to defend not just Kevin, but also Prime Minister Najib Abdul Razak.
“I want to defend Kevin and my prime minister’s dignity […] because he (Najib) is also implicated in his (Charles’) SD.
“And he (Charles) is saying that Kevin gave it (evidence against Najib) to him.
“It is a sin to implicate other people,” Richard told Malaysiakini.
The businessman previously had said he would meet Najib over Charles’ SD. However he denied having any connections to the premier.

Charles Morais’s lawyer hits out at Khalid over ‘coward’ remark
Charles Morais’s lawyer has hit out at Tan Sri Khalid Abu Bakar for calling his client a coward, saying he is not on the run as claimed by the inspector-general of police (IGP).
Lawyer Americk Sidhu told The Malaysian Insider he emailed a copy of the statutory declaration to the police yesterday for them to know its contents.
“Just read the first paragraph of the declaration and the IGP will get Charles’s address in the USA. He need only send his officers there to record a statement,: he said.
He added that a special task force should be set up to investigate the contents of the declaration released by the brother of murdered deputy public prosecutor Anthony Kevin Morais.
Americk said the declaration was intended to reopen investigations on everything that Charles had alleged.
“It if is false, then decide what to do next. Don’t jump the gun before completing investigations,” he said.

Charles Morais fled the country after revealing his explosive statutory declaration (SD) because he knew it was false, claimed his brother Richard.
Speaking to Malaysiakini, the youngest Morais brother added that Charles only dared to make his SD because he could leave the country.
“Why did you (Charles) run away like a chicken? […] Because you know that you’re telling lies.
“You don’t have to listen to me; the fact that he (Charles) ran away is proof enough,” Richard said.

Charles Morais says financially secure, not paid for SD claims
KUALA LUMPUR, Nov 28 ― The brother of slain prosecutor Anthony Kevin Morais today disputed another sibling’s suggestion that financial incentive may have been the motivation behind the allegations he made in the statutory declaration (SD) he signed and released earlier this week.
According to Charles Suresh Morais, the reported claim by Datuk Richard Morais does not hold water as he is financially sound, Malaysiakini reported.
“I am extremely financially secure and was not paid by any party for the SD.
“I spent two months at the Hilton in Kuala Lumpur on my dime waiting for the autopsy results,” he was quoted telling the news portal in an email today, referring to the autopsy on his brother Kevin.
Malaysiakini also reported Charles Suresh as disputing Richard’s claim about Kevin’s will not mentioning his name.
He told the news portal that Richard was referring to an older 2004 will and that a new will has since been prepared.
“Please confirm with the executor of Kevin’s will. (My lawyer) Americk Sidhu can attest to it.
“Richard and his lawyers are both aware of it but chose to use what is beneficial to them. Unlike Richard, I am not after Kevin’s money,” he was quoted saying.
Charles Suresh also called Richard a “disgrace” the family in his email to Malaysiakini, and claimed that the latter is broke and has been in and out of jail in numerous places including here, in Ipoh and in Hong Kong.
“That’s the reason why Kevin and I have distanced ourselves from him. Very unfortunate but true,” he said.

IGP calls Charles Morais ‘coward’ for hit and run SD
Police chief Khalid Abu Bakar confirmed today that Charles Morais, whom he labelled a “coward”, has left the country through the Causeway.
This was after Charles made a statutory declaration (SD) alleging high-level conspiracy in the murder of his elder brother, former deputy public prosecutor Anthony Kevin Morais, at a press conference on Wednesday.
“He has left the country. We checked… he crossed the Johor Bahru Causeway at about 1.30am that same evening he made the press conference at his lawyer’s office,” said Khalid after attending the inspector graduation ceremony in Kuala Lumpur today.
According to Khalid, the police are investigating Charles under Section 202 of the Criminal Procedure Code (CPC) for withholding information, and under Section 124L of the Penal Code for attempting to commit sabotage.
“He (Charles) is a very irresponsible man. After he gave his press conference at his lawyer’s office, he immediately left Malaysia via Johor Bahru, and we are currently tracing where he is right now.
“He makes an accusation and then he runs away. Coward. What kind of human is this?” said Khalid.

‘Charles not in Kevin Morais’ will as he was already rich’
Charles Suresh Morais was not included in the will of murdered deputy public prosecutor Anthony Kevin Morais’ because he was already a wealthy businessman.
A source close to Charles said this in response to younger brother Richard Dilaan Morais who cited the will as evidence that Charles and Kevin were not close as claimed.
“What Richard is saying is rubbish. Kevin’s will was made in 2005 and he left Richard only 7.5 percent of his estate.
“He didn’t leave Charles anything simply because Charles was a rich man,” the source told Malaysiakini.
The source added that despite Charles already knowing he would get nothing from Kevin’s will, he went out of his way to dig up the truth about the eldest brother’s murder.

KUALA LUMPUR, Nov 27 ― DAP veteran Lim Kit Siang called for the set-up of an international inquiry panel into the slaying of former deputy public prosecutor (DPP) Anthony Kevin Morais after one of the latter’s brothers alleged a link to high-ranking government officials.
The opposition lawmaker described it as a “golden opportunity” for Malaysia to rebuild its reputation, which he said had been dented by a number of recent controversies that concerned the rule of law in the country.
“If there is no basis whatsoever to the shocking allegations in Charles’ statutory declaration in connection with the equally shocking murder of Kevin, an independent international inquiry into the killing of Kevin would clear and go a long way to rehabilitate Malaysia’s good name and integrity, especially in the important areas of law enforcement and the upholding of the rule of law,” the Gelang Patah MP said in a statement.
He urged the federal government to push for the international inquiry to “restore national and international confidence in the Malaysian system of justice”.

Charles Morais has gone back to the US, lawyer says as police seek interview
KUALA LUMPUR, Nov 27 ― Charles Suresh Morais ― who claimed his elder brother Anthony Kevin Morais likely died as he “knew too much” about those in power ― has left Malaysia for the US, his lawyer confirmed today.
Americk Sidhu, who represented Charles Suresh in a news conference here yesterday, also said the police have called him for an interview.
“Yes police have contacted me and want to interview me,” the lawyer told Malay Mail Online in a Whatsapp message when contacted today.
“Charles has returned to the USA,” he said, confirming the US-based businessman is no longer in Malaysia.

Kevin Morais’ youngest sibling attacks credibility of Charles’ SD
A brother of the slain Attorney-General’s Chambers officer Anthony Kevin Morais has been reported questioning new revelations by one of their siblings.
Umno-owned daily Utusan Malaysia today reported Richard Morais, the youngest of the four brothers, casting doubt on the explosive statutory declaration (SD) made by Charles Suresh Morais, 52.
Charles had alleged a conspiracy in the murder of Kevin, a former senior deputy public prosecutor with the AG’s Chambers, whom he claimed was working on a case involving the prime minister and his wife.
However Richard, 49, was reported doubting the credibility of Charles Suresh, whom he said had appeared suddenly with the information as though he was very close to Kevin, to the extent the latter had sent the confidential information to him.
“Isn’t it weird if Kevin sent important information to him (Charles Suresh), but his name isn’t even listed on Kevin’s will, and furthermore Charles didn’t pay a single cent for the funeral that was fully borne by me?
“Kevin was a strict person and didn’t share information, especially regarding his work, including to his family. I doubt how he could have sent the information (to Charles),” Utusan quoted Richard saying.

Who is Charles Suresh Morais?

A check by Malaysiakini revealed that Charles serves as the chief executive officer of Kronos Hotels and Resorts, which had been acquiring hotels in the US since 1999.
In 2007, Bernama reported that Charles’ Atlanta-based hotel chain had, in June 2006, bought a portfolio of 16 hotels with 3,100 rooms.
The chain already had 26 hotels under it, and had also in the same year announced plans to acquire 12 other properties outside the US, including two hotels in Malaysia.

Charles’ financial problems surfaced in April 2008 when mortgage-backed securities issued to finance the 2006 Lodgian deal were transferred to a special servicer.

Charles’ court cases have also emerged on certain blogs with the motive of discrediting him, following his SD which has been dismissed as “wild” and a “charade”, among others.

A-G rejects claim linking Kevin Morais murder to 1MDB charge sheet

The attorney-general (A-G) has dismissed the claim that the murder of deputy public prosecutor Kevin Morais was linked to a charge sheet the latter had been preparing against a “high-ranking government official”.
“What was claimed by the brother of the late Kevin is preposterous. Kevin was never involved in the 1MDB investigations,” Tan Sri Mohd Apandi Ali told The Malaysian Insider in a text message from Nanning, China, referring to the controversial state-owned 1Malaysia Development Berhad (1MDB).

Brother: There was conspiracy to rid of Kevin’s body
There was a conspiracy to rid of the body of murdered deputy public prosecutor Anthony Kevin Morais, claims brother Charles Suresh Morais.
In a statutory declaration (SD), Charles implicated an officer of the Attorney-General’s Chambers (AG Chambers).
He highlighted a text message which he claimed was sent by the officer to another of his brothers, David Ramesh Morais, around Nov 15.
The message: “Dearest darling Bro David. Just received message from Bro Richard. He wants to remove Kev’s (Kevin) remains and give a decent burial if time permits tomorrow. He asked me to find out from you if you would join him in getting the remains of Kev fr (from) the mortuary. Thank you”.
Richard is in reference to Richard Dilaan Morais. Both David and Richard are younger brothers of Charles while Kevin is the eldest of the four.
Charles said the message meant that there was an attempt to rid of Kevin’s remains even though he had made it clear that he wanted a second post-mortem and had communicated with the AG Chambers which said it was not opposed to such a move.
“The contents of the above SMS appear to indicate that there was a conspiracy to dispose of Kevin’s remains without my knowledge as no mention of my name has been made in that message.
“This is despite the numerous letters, meetings and requests made to all concerned parties that I was intent on having a second post-mortem done.
“This was common knowledge at the AG Chambers and an understanding between us had been reached, with the filing of an application to the court as agreed.
“It is therefore very surprising that an officer of that same department appears to be trying to circumvent this understanding by clandestine means,” he said.
Richard had claimed Kevin’s body at 11.30am on Nov 23 from the Kuala Lumpur Hospital mortuary.

‘Kevin worked on PM and wife’s case, initials on charge sheet’

The alleged draft charge sheet against Prime Minister Najib Abdul Razak released by whistleblower site Sarawak Report had carried the initials of the late deputy public prosecutor Anthony Kevin Morias, claimed his brother.
In a statutory declaration (SD) today, Charles Suresh Morais said when he saw the charge sheet that appeared on the website on July 30, he recognised his brother’s initials.
“After having looked at the (two-page) draft charge sheet once again, I noticed that one of them was amended and initialled.
“After studying that particular charge sheet in detail, I noticed that the initial next to the amendment made was that of my brother, Kevin. I am familiar with his signature and his initials,” he said in the SD.

Attorney-general Mohd Apandi Ali had previously dismissed the alleged draft charge sheet as false.

He also claimed that two to three months ago before Kevin’s murder in September, he said the deputy public prosecutor told him that he had been working on a case involving Najib and his wife Rosmah Mansor.
In the SD, the younger brother also claimed that Kevin, who was seconded to the Malaysian Anti-Corruption Commission (MACC), had described the pair in an unfavourable light.

Share murdered DPP’s secrets with us, says IGP
Inspector-general of police Khalid Abu Bakar has asked Kevin Anthony Morais’ brother to provide the details contained in a pen drive on the investigations which the deputy public prosecutor was working on prior to his murder.
“I suggest he share the contents with us for action to be taken.
“We can’t act if we have no knowledge about the late Kevin’s secrets,” he told Malaysiakini.
The police chief also stated that refusing to disclose a criminal act amounted to an offence.
“If he (the brother) knows that a certain offence has been committed but refuses to disclose it, he commits an offence as well,” he added.

KUALA LUMPUR, Nov 25 — Deputy public prosecutor Anthony Kevin Morais likely died because he knew too much about those in power, his brother Charles Suresh Morais claimed today in a signed statutory declaration (SD), amid a dispute over the deceased man’s body.
“I do not for one moment believe Kevin was killed because he was prosecuting a government pathologist for corruption,” the 52-year-old businessman said in the 18-page SD distributed to the media at his lawyer’s office here.
“Kevin was killed for other reasons and I believe these other motives were due to the fact that he knew too much about the criminal acts of those high up in the echelons of power in Malaysia and he needed to be silenced because of that,” he added.
Speaking to the media later, Charles Suresh also said that he believes there may be a plot by “high ranking” officials against his brother Kevin, although he declined to name those he suspected were involved.

Charles Suresh files court papers for second autopsy while Richard claims body from hospital mortuary.

KUALA LUMPUR: The brothers of murdered Deputy Public Prosecutor Kevin Morais seem to be in conflict over his remains, with one brother insisting on a second autopsy and another having already claimed the body from the mortuary.
In a report in The Star Online, Charles Suresh Morais’s lawyer Americk Sidhu, said his client had filed a court application for a second autopsy on Monday, the same day that Richard Morais claimed Kevin’s body from Hospital Kuala Lumpur’s mortuary.
“If there is no body, conducting a second post-mortem will not be possible. I have advised Charles on the next course of action. We may have to go to the police,” Americk said, adding that a court hearing date had not been fixed yet.
Sentul OCPD Asst Comm R Munusamy confirmed that the body had been claimed on Monday.
