(1) The QC will have to show special qualifications or experience of a nature not available among Malaysian lawyers i.e. accomplishment of an exceptional degree.

(3) The questions of law in this appeal appear to focus on the local provisions of the MACC Act, the Penal Code and AML laws. Will be interesting to see how a English QC will have the special qualifications to argue.

(5) Finally, the real zinger. Above case suggested that for such ad hoc admission, foreign lawyers would still need BM qualification. Above case did not rule on that definitively as not required to decide on that issue. Good luck to the possible QC.

KUALA LUMPUR: Datuk Seri Najib Razak will apply for a Queen’s Counsel (QC) from the United Kingdom to represent him for the appeal against his conviction and sentence involving SRC International funds at the Federal Court.

Deputy public prosecutor Mohd Ashrof Adrin Kamarul said Najib’s lawyer Tan Sri Muhammad Shafee Abdullah plans to write to the Federal Court by tomorrow to inform it of their intention.

“The court has fixed Jan 28 for next case management to determine the next step for the appeal.

While a Queen's Counsel can be brought in to argue in a Malaysian court, it is usually for cases where lawyers here have no expertise on the matter.
