Lawyer pleads not guilty to molesting university students
During mitigation, defence counsel Datuk Jerald Gomez said the proposed bail set at RM12,000 for both charges was excessive as the accused has a clean record.
“The accused has never before been arrested or charged for any offence. He is a happily married man with a clean record,” he said.
He also argued that the complainants had resorted to “trial by the media” by posting video clips, homemade videos and had given interviews to the press even before the police completed their investigation.
Gomez further argued that based on the police report, there was no allegation of violence used or injury sustained by the complainant.
“Secondly, the complainant was unaware that she was being touched by the Indian man, until she turned around and saw an Indian man behind her,” he said.
According to him, the accused had also voluntarily gone to the police upon being notified, and did not turn himself in as widely reported.
“The accused did what any law-abiding citizen would do and that is to go to the police station voluntarily and cooperate with the police,” he said.
Gomez then requested the court to order the complainants not to publish any evidence relating to the case on social media as the accused has not even faced trial.
“The accused has not been proven guilty, but the trial by media has not given him a chance to tell his side of the story. Damage has already been done to his life and career,” he said.
Magistrate Fadzilatul Isma Ahmad Refngah then set bail for the two charges at RM4,000 and RM3,800 respectively, with one surety.
She also agreed to order the complainants not to publish any material relating to the case on the Internet.
Lawyer claims trial to outraging modesty charges |
KUALA LUMPUR: A lawyer claimed trial at the Magistrate’s Court in Kajang today to a charge of outraging the modesty of a university student.
Michael Anthony, 33, was charged under Section 354 of the Penal Code with touching the buttocks of Chua Year Jing (Cristal), 22.
He also claimed trial to another charge of allegedly attempting to outrage the modesty of another university student at the same place and time. He is accused of trying to touch the breasts of 20-year-old (Tammy) Ong Hui Yee.
Both offences were alleged to have happened at Cypress Condo, Bandar Sg Long, on Nov 1.
Magistrate Fadzilatul Isma granted RM4,000 bail on the first charge and RM3,800 bail for the second.
The magistrate fixed Dec 9 for next m.ntion of the case.

KAJANG: A 33-year-old lawyer has claimed trial to two molest charges involving two university students at a Bandar Sungai Long condominium last week.
Clad in a white shirt and slacks, Michael Anthony pleaded not guilty when the charges were read out to him at the magistrate’s court here, Tuesday.
He was charged under Section 354 of the Penal Code for assault or use of criminal force on a person with intent to outrage modesty, where he allegedly touched the buttocks of Cristal Chua, 22.
The other charge was under Section 511 of the Penal Code for attempting to commit the same offence on 20-year-old Tammy Ong.
Both incidents were alleged to have happened at about 3.30pm on Nov 1.
PETALING JAYA: A lawyer who is alleged to have molested a university student earlier this month, will be charged in court today, The Star reported.
According to Kajang OCPD Asst Comm Othman Nanyan, the 33-year-old suspect had surrendered himself on Friday following the outrage caused by the video clip taken by a friend of the victim.
Othman added that the suspect had also been positively identified by the victim.
The offence is alleged to have taken place at a condominium in Bandar Sungai Long, which serves as the residence for students of Universiti Tunku Abdul Rahman (Utar) in Sungai Long.

Suspect in molest case of Kajang varsity student remanded till Wednesday
KAJANG: Police have extended the remand of a 33-year-old lawyer in the molest case of a university student at a condominium in Bandar Sungai Long here last week.
Kajang OCPD Asst Comm Othman Nanyan confirmed that the suspect, who gave himself up on Friday and was remanded after he was positively identified by the victim, would be held until Wednesday to help in the investigations.

PETALING JAYA: A 33-year-old civil lawyer was arrested for molesting a university student at a condominium in Bandar Sungai Long, Kajang.
Kajang OCPD Asst Comm Othman Nanyan said the suspect surrendered himself to the police on Friday.
“The victim has positively identified the suspect. He has been remanded until Sunday (today),” he said.

KUALA LUMPUR: A lawyer has been detained by police on suspicion of having molested two women outside a condominium block in Bandar Sungai Long, Kajang last Tuesday.
The man, aged 33, turned himself in at Kajang police headquarters yesterday and has been placed in remand for two days.
Kajang OCPD Othman Nanyan said a man had followed the two women, both students, on their way home to a rented house at about 3.30pm on Tuesday.
The man was said to have fondled the buttocks of one of them and groped the breast of the other woman.

No more going out without pepper spray
PETALING JAYA: Varsity student Cristal Chua is not taking any more chances with her safety. The newest addition to her purse is pepper spray.
Chua is still shaken over a recent incident in which she was groped in front of her rented condominium unit near Universiti Tunku Abdul Rahman (Utar) in Sungai Long, Kajang.
The 22-year-old mass communications student said she never leaves home without her pepper spray now.
“I felt uneasy when I walked to the campus alone today (yesterday).
“I have no plans to move out yet but my parents are quite worried about me,” she said.

Varsity student allegedly molested on way back to hostel
PETALING JAYA: It was a horrifying experience for two varsity students when one of them was allegedly molested on their way back to the hostel.
Cristal Chua and Tammy Ong, both in their 20s and students of Universiti Tunku Abdul Rahman (UTAR) in Sungai Long, Kajang, said they were walking back to Chua’s hostel at a nearby condominium when a man crept up behind them and “grabbed” Chua’s buttocks.
Ong also claimed that the man tried to grab her breasts but she shouted and he fled.
The girls uploaded a video on Facebook to relate the ordeal and advised others to be more vigilant.
“I thought it was Tammy (touching my buttocks). I was shocked to see a man behind me. He then turned towards Tammy and tried to molest her when she shouted,” said Chua, describing the man as plump and quite short, wearing a black jersey with the name “Mike” and the number “10” at the back.
“If there is anyone suspicious around you, tell the security guard. Also, please shout to get attention if the situation turns ugly,” Chua said in Mandarin.
Chua also uploaded a 16-second video clip she recorded of the man fleeing the scene.
