Najib told to file defence in Dr M’s lawsuit
KUALA LUMPUR: Datuk Seri Najib Tun Razak has to file his defence by June 9 to a lawsuit brought by Tun Dr Mahathir Mohamad and two others against him for alleged misfeasance in public office after his stay bid was denied by a High Court.
High Court judge Justice Abu Bakar Jais said Najib, who was represented by lead counsel Tan Sri Cecil Abraham, had not included facts to support the stay application.
“The argument by the defendant is that they did not allude to facts pertaining to a stay as it is concerns a question of law. A question of law only relates to a striking-out application and not a stay,” said Justice Abu Bakar, after hearing lengthy submissions by both parties.
Najib applied to stay the filing of defence over the civil suit pending disposal of his bid to strike out the suit.

Embattled Malaysian Prime Minister Najib Razak suffered another jolt on Wednesday with former prime minister Mahathir Mohamad filing a lawsuit accusing him of corruption and abuse of power.
In his latest effort to remove Najib from office, Mahathir cites the corruption scandal plaguing 1 Malaysia Development Berhard and the personal donation Najib received from overseas.
Mahathir says Najib misused his power by trying to smother investigations into both these scandals.
The lawsuit alleges that Najib took various deliberate steps in bad faith to “obstruct, interfere, impede and derail” various investigations and inquiries.

Kuala Lumpur (AFP) — Hundreds of millions of dollars that ended up in the personal bank accounts of Malaysia’s prime minister must be handed to the government, a lawsuit filed by his predecessor demanded Wednesday.
Najib Razak, 62, has been under fire for months over allegations that perhaps billions of dollars were stolen from a state investment company he founded, and his own admitted acceptance of a mysterious $681 million overseas payment.
Both Najib and the now debt-stricken company, 1Malaysia Development Berhad (1MDB), strongly deny wrongdoing and reject accusations that the money paid directly into his personal accounts in 2013 involved 1MDB funds.
The suit by Mahathir Mohamad, Malaysia’s strongman leader from 1981-2003, demands that Najib compensate the Malaysian government for the $681 million, according to a copy of the complaint.
The former leader, a prominent critic over the affair, also accused Najib of abusing his position “to undermine, subvert and compromise the various respective institutions” investigating the scandals.
It remains to be seen whether the case will have any effect against Najib, who has taken a number of heavily criticised steps to tamp down the affair.
