THE FACTS OF THE CASE

According to the EAIC’s investigations, Syed Mohd Azlan had been arrested on November 3, 2014 near Pengerang, Johor over possible involvement in an armed altercation involving two groups on September 14 the same year.

He had been detained by a team of 13 police officers and held at the Sungai Rengit police station, where he had been interrogated over the attack.

Syed Mohd Azlan was later transferred to the Kota Tinggi district police headquarters to be remanded, but died while in transit.

A post-mortem determined the cause of death to be blunt force trauma to his chest, while 61 defensive wounds were discovered on his face, torso, and both legs.

Puchong MP Gobind Singh Deo is going to file a civil suit at the Johor Baru High Court next month against the police and the government for the custodial death of Syed Mohd Azlan Syed Mohamed Nur.

“(To the government) in this case, do not dispute it. Do not defend it.

“Show that we are serious. Show that in this case, action will be taken against those who are guilty,” Gobind said at a press conference in Kuala Lumpur today.

He will be filing the suit in the first week of December and will reveal more about this later, he added.

The suit will be filed by Gobind on behalf of the family of the deceased

The deceased’s father, Syed Mohamed Nur , said that the family was shocked and saddened by Syed Azlan’s death.

“Until now, the police has failed to prove that my son committed any crime.

So we will take legal action to get justice for my son,” he said.

EAIC: Charge them with murder

The commission found several “serious breaches” to the police arrest procedure, including:

  • The use of a personal, and not standard issue, handcuffs on the deceased, resulting in injuries;
  • Abetment to willfully cause physical harm to the deceased, leading to his death; and
  • Mismanagement of the seized items;

The EAIC said the personnel involved had committed crimes under Sections 302 (murder) and 325 (causing grievous hurt) of the Penal Code, and that they should be charged in a court of law.

No protection for officers in custodial death case, says IGP

The inspector-general of police has vowed that no police officer would be shielded from criminal charges after an Enforcement Agency Integrity Commission (EAIC) report said there was foul play in a custodial death case.

In a statement, Tan Sri Khalid Abu Bakar said police were in the midst of concluding investigations into the death of Syed Mohd Azlan Syed Mohamed Nur, 25, who died in police custody at the Sungai Renggit police station on November 3, 2014.

“Police are in the midst of concluding the investigation into the case and will be forwarding it to the attorney-general for further instructions.

“We assure the public that those involved will be brought to justice as we do not shield any member of the police force who is liable for criminal charges,” he said.

On Monday, federal lawmaker Gobind Singh Deo demanded action against police officers involved in the custodial death case after the EAIC found foul play involving police violence.

‘Cops who killed man in lock-up must face justice’

The police personnel, who the Enforcement Agencies Integrity Commission said “murdered” a man in custody, must face justice, human rights movement Suaram is demanding.”We urge that those responsible for this case – the police personnel – be brought to court to face action.

“The Attorney-General’s Chambers must act urgently in order to bring justice to those accused of causing the death of Syed Mohd Azlan, as found by the EAIC,” Suaram said in a statement to Malaysiakini.

The EAIC in its investigations found Syed Mohd Azlan Syed Mohamed Nur, 25, was “murdered” by police personnel, who beat him up in the police station lock-up in Sungai Rengit, Johor, on Nov 3, 2014.

Syed Mohd Azlan (photo) suffered 61 injuries to his face, body and legs, some of which were consistent with “defensive wounds while protecting himself from physical attack by police personnel”, the EAIC found.

The EAIC also found evidence that police personnel cleaned the scene of the beatings before the medical officers arrived to check on Syed Mohd Azlan.

The police also disposed the rubber mat and carpet believed to have been stained with the blood of the deceased.

The personnel also “hid away eye-witnesses” from the scene, the EAIC said.

KUALA LUMPUR, Oct 30 — The use of physical violence by police during arrest and questioning was the cause of Syed Mohd Azlan Syed Mohamed Nur’s 2014 death in custody, the Enforcement Agency Integrity Commission (EAIC) said today.

According to the enforcement watchdog, its investigations also found attempts to obscure evidence from the 25-year-old’s interrogation that resulted in 61 separate injuries on various parts of his body.

The police officers involved also engaged in a “serious breach” of standard operating procedures concerning the handling of detainees, material seizure, and the integrity of statements.

“There was an element of crime in the attacks involving common intent or abetment by PDRM officers, including the arresting team, to intentionally use physical violence on the deceased to cause death or injury,” the EAIC said in a statement today.

It added that the action was a criminal offence, specifically under Section 302 and 325 of the Penal Code read with Section 34 of the same Act.

Section 302 pertains to murder while Section 325 involves voluntarily causing grievous bodily harm; Section 34 deals with voluntarily causing hurt.

The EAIC then recommended that the Attorney-General’s Chambers to prosecute the officers involved for the crimes identified in the agency’s investigations.

It added that it was regrettable that custodial deaths continue to occur repeatedly in the country, saying that the matter should be viewed seriously.

Police deny foul play in detainee’s death

The police have denied allegations that foul play was involved in the death of a 25-year old detainee in Pengerang, Johor recently.

Instead, Johor CID chief Hasnan Hassan said it was sudden death.

Syed Mohd Azlan Syed Mohamad Nur died while being transferred from the Sungai Rengit police station to the Kota Tinggi police headquarters.

The deceased’s family yesterday claimed that the unemployed youth’s body was covered in bruises and “hole shaped puncture marks”.

Hasnan, however, alleged that Syed Mohd Azlan was a drug addict with prior criminal records and sustained injuries when resisting arrest.

He was arrested in Kg Simon, Pengerang, at 3.30am on Nov 3, on suspicion of being involved in an armed riot with seven others at Kota Tinggi on Sept 19.

The police believe that Syed Mohd Azlan had brandished a gun during the incident, in which two people were seriously injured.

“When the arrest was being carried out, the deceased (Syed Mohd Azlan) acted aggressively to escape. This caused a struggle between the deceased and the police.

“A police report has been lodged regarding the arrest and the injuries sustained by the deceased and police,” Hasnan said in a statement late last night.

Syed Mohd Azlan was then brought to the Sungai Rengit police station for further investigations.

Police then claimed that he had trouble breathing while being transferred to Kota Tinggi, and was rushed to the Bandar Penawar Clinic where he was pronounced dead on arrival.

“A post mortem was carried out at the Sultan Ismail Hospital in Johor Bahru. The investigation has been classified as ‘sudden death’,” Hasnan said.
