Najib’s son Nazifuddin hit with RM37.6m tax suit

On the heels of Putrajaya seeking to recoup RM1.69 billion in unpaid taxes from former premier Najib Abdul Razak, his son Mohd Nazifuddin Mohd Najib has become the target of an RM37.6 million tax suit.

According to the writ of summons sighted by Malaysiakini, the lawsuit against the 36-year-old businessperson was filed by the Inland Revenue Board on behalf of the government at the Kuala Lumpur High Court Registry on July 24.

Nazifuddin is accused of failing to pay RM1,541,850.83, RM5,718,486.42, RM5,437,086.08, RM3,775,133.23, RM1,796,494.18, RM2,271,812.79, and RM12,052,046.26 as additional tax assessment for the years 2011, 2012, 2013, 2014, 2015, 2016 and 2017.

He was hit with 10 percent on the total due to his alleged failure to pay the back taxes within 30 days of receiving the assessment notice at the LHDN office at Kuala Lumpur on March 18.

For failing to pay up within 60 days, the defendant was slapped with a further five percent hike, bringing the total to RM37,644,810.73.

The government is also seeking five percent annual interest on the total from the date of judgement to the date of settlement, as well as costs and any other relief deemed fit by the court.

According to the website of the Federal Court Chief Registrar’s Office, the matter came up for e-Review case management before Kuala Lumpur High Court deputy registrar Normaizan Rahim this morning.

Under e-Review, parties conduct the case management through a form of teleconferencing and need not come to court.

Di tengah-tengah usaha kerajaan mendapatkan semula RM1.69 bilion cukai pendapatan yang masih belum dibayar bekas perdana menteri Najib Razak, anaknya Mohd Nazifuddin dihadapkan dengan saman tuntutan cukai berjumlah RM37.6 juta.

Menurut writ saman yang dilihat Malaysiakini, saman terhadap ahli perniagaan berusia 36 tahun itu difailkan oleh Lembaga Hasil Dalam Negeri (LHDN) bagi pihak kerajaan di Pendaftar Mahkamah Tinggi Kuala Lumpur pada 24 Julai lalu.

Nazifuddin didakwa gaga membayar cukai tambahan bagi tahun 2011, 2012, 2013, 2014, 2015, 2016 dan 2017, yang masing-masing berjumlah RM1,541,850.83, RM5,718,486.42, RM5,437,086.08, RM3,775,133.23, RM1,796,494.18, RM2,271,812.79, dan RM12,052,046.26.

Beliau dikenakan denda 10 peratus daripada jumlah keseluruhan kerana didakwa gagal membuat bayaran dalam masa 30 hari selepas menerima notis pentaksiran di pejabat LHDN di Kuala Lumpur pada 18 Mac.

Beliau juga dikenakan tambahan 5 peratus lagi kerana gagal membuat bayaran dalam masa 60 hari, menjadikan jumlahnya RM37,644,810.73.

Kerajaan juga meminta lima peratus faedah tahunan daripada jumlah tersebut, bermula daripada tarikh penghakiman kepada tarikh penyelesaian, serta kos dan ganti rugi lain yang dirasakan sesuai oleh mahkamah.

Menurut laman sesawang Pejabat Ketua Pendaftar Mahkamah Persekutuan, pengurusan kes e-Penilaian di depan timbalan pendaftar Mahkamah Tinggi Kuala Lumpur Normaizan Rahim berkenaan kes itu dibuat pagi ini.

Melalui e-Penilaian, pihak yang terlibat tidak perlu hadir ke mahkamah dan pengurusan kes dibuat melalui telesidang.
