KUALA LUMPUR: THE Inland Revenue Board is being investigated for Criminal Breach of Trust.
Its sitting and past board members are expected to be called in by the Commercial Crime Investigation Department to shed light on the RM14.56 billion overpaid by taxpayers that were unaccounted for.
To answer questions involving the massive “missing” sum that was to be refunded to 1,653,786 taxpayers is former Treasury secretary-general Tan Sri Dr Mohd Irwan Serigar Abdullah.
He was chairman of the Cash Management Committee in the Finance Ministry that was supposed to allocate enough money to the Tax Refunds Trust Fund (TRTF) as requested by the IRB to facilitate refunds.
The shortage of transfers from direct tax revenue to TRTF had been identified as the reason behind the huge amount of outstanding tax refunds due to taxpayers.
Bukit Aman Commercial Crime Investigation Department (CCID) director Datuk Seri Amar Singh, who confirmed this with the New Straits Times last night, said the case was being investigated under Section 409 of the Penal Code.
Attempts to get Irwan and a few members of the IRB board for comments were unsuccessful.

KUALA LUMPUR, Aug 22 ― The Pakatan Harapan government has agreed to allow taxpayers with outstanding tax refunds from the Inland Revenue Board (IRB) to offset the amount against the tax payable for the current year, Finance Minister Lim Guan Eng announced today.
The offset application needs to be submitted to IRB for verification before approval while the remaining tax refunds will be carried out based on the government’s fiscal ability, the finance minister said in a statement.
Lim said the consideration was made following revelation that the previous Barisan Nasional (BN) government had allegedly failed to refund the excess income tax and real property gains tax paid by taxpayers, which totalled RM16.046 billion as of May 31, 2018.
“We hope that the failure to return RM16.046 billion of tax refunds is the last mega exposé related to the misappropriation and misuse of taxpayers’ money by the previous government.

Tarik balik. Hours after issuing media statement admitting RM15.605b tax refund has been withheld, the IRB decided to withdraw it.
Reason? Only MoF, DG of Inland Revenue/CEO of IRB are authorized to do it.

KUALA LUMPUR, Aug 15 — The Finance Ministry will issue an official statement on reports stating that the Inland Revenue Board Malaysia (IRBM) owed the people RM10 billion tomorrow, said Deputy Minister Datuk Amiruddin Hamzah.
The statement would only be made after the ministry had confirmed the validity of the report and the amount mentioned.
“We must validate the report that the RM10 billion was not refunded is correct (or not) there could be a reason,” he said to reporters at Parliament lobby today.
Earlier, Amiruddin was asked to comment on reports published by an online portal and a local daily on Aug 14 and Aug 15, 2018 with the headlines “IRBM owes the people RM10 billion?” and “IRBM owing RM10 billion?” respectively.
IRBM, a unit under the Finance Ministry, said taxes overpaid will be refunded to taxpayers based on the Collection Framework dated April 20, 2016, which can be accessed through IRBM’s official portal at www.hasil.gov.my
“According to IRBM’s client charter, any refund not requiring tax audit checks will be processed within 30 working days for taxpayers who file their income tax return forms (ITRF) via e-filing, and 90 working days for ITRF submitted manually,” it said. — Bernama
