Sessions Court acquits Sivarasa on MCMC charge

Sungai Buloh MP Sivarasa Rasiah was today freed by the Sessions Court in Kuala Lumpur of a charge under the Communications and Multimedia Act for tweeting a fake Time magazine cover.

Deputy public prosecutor from the Malaysian Communications and Multimedia Commission, Mohd Sophian Zakaria, informed the court that the prosecution has accepted the letter of representation.

Mahkamah Sesyen bebaskan Sivasara dari pertuduhan SKMM
Mahkamah Sesyen Kuala Lumpur membebaskan anggota parlimen Sungai Buloh Sivarasa Rasiah daripada pertuduhan bawah Akta Komunikasi dan Multimedia kerana memuat naik imej palsu majalah Time di Twitter.
Timbalan Pendakwa Raya dari SKMM Mohd Sophian Zakaria memberitahu mahkamah bahawa pihak pendakwaan menerima surat perwakilan daripada peguam tertuduh.
Dihubungi Malaysiakini, peguam Sivarasa, M Puravalen, mengesahkan penerimaan surat perwakilan itu.
“Dengan ini beliau dibebaskan dan dilepaskan daripada tuduhan,” kata peguam itu.

KUALA LUMPUR: Subang MP Sivarasa Rasiah was charged at the Criminal Sessions Court on Friday for uploading a “fake” Time Magazine cover featuring Prime Minister Najib Abdul Razak on his Facebook page.
Judge Ameruddin Ahmad allowed Sivarasa to be released on a RM2,000 personal bond without a guarantor, while the next mention date was fixed for May 27.
He was charged under Section 233 (1) (a) of the Communications and Multimedia Act for “creating and initiating transmission of false communication to annoy another person”. Section 233 (1) (a) of the Communications and Multimedia Act provides for a fine not exceeding RM50,000 or imprisonment of not more than one year or both.
Lead Deputy Public Prosecutor Mukhzany Fariz Mokhtar had earlier asked the court to set bail at RM4,000.
The defence team, led by lawyer N. Surendran, argued that it was not necessary to have bail. “It’s a summons case not a warrant. You don’t need bail. Please use your discretionary powers under Section 387 (2) of the Criminal Procedure Code,” said Surendran in pointing out that Sivarasa has been a practising lawyer for 28 years as well as an MP for two terms.
However, Mukhzany argued that Section 387 need not necessarily mean that bail was for arrest cases only.
Also present was prosecutor Norhani Adzhar.
Latheefa Koya and Eric Paulsen also appeared for Sivarasa along with Surendran.

From the bad type arrangement and inaccurate publication date, any casual observer can see that the purported magazine cover featuring Prime Minister Datuk Seri Najib Razak is a bad fake job but this did not stop netizens from forwarding the potentially slanderous image including opposition leaders.
This morning, an image capture of a fake magazine cover went viral on social media despite the very amatuerish attempt at faking a TIME magazine cover, helped in part by the sharing of the image by the opposition, including PKR lawmaker Sivarasa Rasiah amd former Temerloh MP Datuk Saifuddin Abdullah.
Regina Lee, aide to Youth and Sports Minister Khairy Jamaluddin, had shared the actual magazine cover on her Twitter feed and appealed to Malaysians common sense about the incredulity of that fake cover.
“These are the actual Time Magazine covers. COME ON LAH PEOPLE,” she wrote, sharing the latest actual magazine cover which features Apple CEO Tim Cook on the cover. This is verified by going to the TIME magazine subscription site which displays a similar cover.

The print edition of TIME magazine is published every Monday and the date on the fake cover is Tuesday, 22 March 2016.
However, there is an article in time.com online news portal that includes Malaysia in its discussion on global corruption written by Ian Brenner dated 17 March.
In the article, Malaysia is placed 2nd among 5 countries in a discussion on the link between politics and corruption scandals, which also includes Brazil, South Africa, China and Russia.
Sounds familiar, except for the exclusion of India, all the countries named besides Malaysia are members of the new monetary union BRICS. The name is an acronym of its member nations, Brazil, Russia, India, China and South Africa, whose economies are speculated to achieve global dominance by 2050, possibly at the expense of the United States of America. Part of the BRICS agenda is to reform global financial institutions after all.
The fact that the article compiled its ranking based on information reported in US media outlets like the much maligned Wall Street Journal, Bloomberg, The Economist, The Atlantic, CNBC and The Washington Post gives rise to an ulterior motive for the article given the US vested interest in ensuring it maintains the lead in economic growth globally and keeping its financial system and currency in a dominant position worldwide.

Sivarasa roasted over ‘Time’ magazine cover featuring PM
Subang MP posts Najib Razak’s image on a doctored magazine cover, linking him to corruption, and gets called out by Facebook users in return.

PETALING JAYA: A social media war has erupted between Pakatan Harapan (PH) and Barisan Nasional supporters after an Opposition lawmaker shared a doctored magazine cover portraying Prime Minister Najib Razak.
In a Facebook post earlier today, Subang MP R Sivarasa uploaded an image of Najib superimposed on the front cover of Time magazine, with a caption linking him to corruption.
“PM Najib Razak has made the headlines once again! For the wrong reason, sadly. This is a very serious title, rank, or even accusation directed towards him. Will he now ‘claim’ to sue Time magazine?” Sivarasa posted.
The posting garnered some 3,084 shares as of 12pm, with some of the politician’s colleagues from the Opposition, including Pakatan Harapan Chief Secretary Saifuddin Abdullah, tweeting the image and posting it on his Facebook page as well.
The image is noticeably fake with amateurish-looking graphics, grammatical errors and even an erroneous date printed on the “cover” (Time Magazine is published every Monday, which would make its latest edition March 21, and not March 22 as printed in the doctored image.)
The posting however prompted pro-BN blogger Lim Sian See to post his own rendition of the magazine cover, with Sivarasa’s image on it.
The headline on the retaliatory posting called Sivarasa a “Mangkuk” (idiot) and cautioned him against spreading fake covers.
“As a Member of Parliament, you must be responsible. YB must issue public apology on your page for being such a ‘mangkuk’” Lim posted on his Facebook page.
