DAP lawmaker Tony Pua says the image of a tweet allegedly posted by him calling Indian Malaysians “pariah” and “thugs” is fake.

The DAP Selangor chairman said the fake image, which is being circulated widely via WhatsApp within the Indian community, was probably in response to the recent controversy over the Deepavali bazaar in Sungai Way, Petaling Jaya.

Pua had last week referred to those who prevented licensed Indian traders from setting up their stalls and who disrupted his press conference at the bazaar site in Sungai Way as “thugs”.

In a statement today, the Petaling Jaya Utara MP said the fake image was clearly designed to inflame racial sentiments against him but added that it would not stop him from carrying out his duties to serve his constituents.

“I have never used the word ‘pariah’ to describe anyone and I most certainly do not believe that Indians ‘behave like thugs’.

“However there are those among us – Chinese, Indians, Malays – who do behave like thugs.

“The person or persons who made the above image is certainly a shameless ‘thug’, regardless of his race,” he said.

I would like to express my complete shock and disappointment that Petaling Jaya City Council (MBPJ) Mayor Mohd Azizi Mohd Zain announced the reversal of the council’s decision to relocate the Deepavali Bazaar at Sungai Way village (SS9A).

This comes after the mayor himself issued statements on Oct 1 and 8, 2015 where he stated that the new location was better as it was more spacious and has been the site of other markets including the Ramadan bazaar and pasar malam.

In effect, MBPJ succumbed to the display of thuggery led by several PKR grassroot leaders, Kelana Jaya deputy chief, Saminathan Kitchan, the division secretary Murali Subramaniam, and several PKR councillors from other districts.

The mayor further added that the reversal decision was also due to the submission of a memorandum by PKR councillors. It now appears that the unanimous decision at the full board of MBPJ on March 27, 2015 to shift the market to the better and more appropriate location can be changed with a mere memorandum.

The fact that the local residents, the village committee, the local councillor for Sungai Way, the state assemblyperson for Kg Tunku and the Member of Parliament for Petaling Jaya Utara all objected to the former bazaar location mattered little to the mayor and these PKR councillors. There were no meetings called, no discussions held, just a decree by the mayor to undo years of hard work put in by the local councillor and state assemblyperson.

This seemingly trivial decision over the location of a Deepavali bazaar sets a terrible precedent for MBPJ and the state government in the future. Now, any disgruntled group that is not happy with MBPJ or the state’s decision can resort to thuggery and crony politics with the right political party to get the decision reversed.

Sungai Way Deepavali bazaar now in 2 locations, says mayor

After an acrimonious dispute over the location of this year’s Deepavali bazaar in Sungai Way, the Petaling Jaya City Council (MBPJ) has agreed to hold it in two places – at its original site in Jalan SS9A/13 and the new site in Jalan SS9A/12.

The decision was made based on the requests of the majority of the MBPJ councillors and the welfare of the residents, said mayor Mohd Azizi Mohd Zain.

“We have received the memorandum signed by the majority of the MBPJ council members and we have decided to keep the old place of the Deepavali Bazaar and the new one,” he said.

Azizi said that if the bazaar were to carried out in two places, traders would have to undergo more stringent rules before being able to apply for the permits.

This is because the council had received complaints of traffic jams within the vicinity of Jalan SS9A/13.

“For those who want to maintain and do their business at Jalan SS9A/13, they would have to sign an agreement with the council before opening their stalls there,” he said.

Among others, the agreement requires stall owners to have tents measuring 10 ft x 10 ft, the tents have to be in a row as set by the MBPJ and for the stall owners to appoint three Rela officers to manage the traffic flow to avoid congestion.

“The council would not hesitate to withdraw any of the permits if these rules are not adhered to,” Azizi said.

Hostile reception for DAP reps in pre-Deepavali visit

What was meant to be a regular visitation on the job turned into a rowdy confrontation for a group of DAP elected representatives as angry traders gave them a hostile reception.

Some traders who were angry at having to move to the new bazaar from the adjacent street blocked the elected representatives and local councillors who were accompanying them, demanding that the issue be resolved.

Let me invite YB Sivarasa to visit Deepavali bazaar

I am surprised by the Member of Parliament (MP) for Subang, Sivarasa Rasiah’s media statement today entitled ‘Some friendly advice for my friend YB Tony Pua’.

Why then, was there a protest? As the local councillor in-charge of Sungai Way, Sean Oon can attest to, during the past years, the bazaar was effectively controlled and monopolised by certain parties who charged unauthorized middleman rentals to the traders. The shift to the new site denied such profiteering opportunities as licences were issued directly by individual applications to MBPJ.

The new location and system ensured that there was no corruption, no crony middleman and no room for abuse.

Unfortunately, Sivarasa did not have the courtesy to give my colleagues – Lau Weng San and Sean Oon, who have been working tirelessly to resolve this issue over the past two to three years, a call to clarify the situation. He didn’t even have the courtesy to give me a call to ask about what took place last Thursday before issuing his statement to lecture me how I should do my job as the Member of Parliament with his “friendly advice”.

He said “my advice to both Weng San and Tony is that such matters are best left to the best judgment of the Datuk Bandar of Petaling Jaya and his councillors.”

…Sivarasa didn’t even have the courtesy to speak to the councillor, the local assemblyperson or the local MP, he got his facts completely wrong and egg on his face.

He claimed that “Tony and Weng San would also know that a majority of the MBPJ councillors have in fact already proposed to the Datuk Bandar a win-win solution where the Deepavali bazaar for Sg Way would be conducted, for this year anyway, at both the original site and the new site”.

After doing my fact checks, I can now correct Sivarasa that the above is a figment of his imagination, or of whoever who sold him the story. As far as the council is concerned, the new site was approved unanimously during the full board meeting on March 27, 2015. There has been no meeting since then by any councillor or official to reverse this decision.

The mayor himself has stated that he believed that there would be a better response for the Deepavali bazaar at the new site. And if it is any consolation to the MP for Subang, I was never involved in any of these decision-making processes.

Hence, the state exco member, the MP, the assemblyperson and the councillor were not in any way challenging the decision of MBPJ but were in fact abiding by it. It was the group of thugs, most of whom do not even trade in the area who were challenging the decision of the council.

Which leads me to my final point. The council should not negotiate with and bow to thugs who use force and intimidation to get their way. It does not matter if these lot – which included a PKR division deputy chief, a PKR division secretary and various PKR councillors from other districts, they should not receive any preferential treatment just because of their party status.

I can give the Subang MP the assurance that if any DAP grassroot leader demands preferential treatment for licences in his constituency, stern action will be taken against him or her. I will certain not defend their actions, whatever their justification. We can forget about ever replacing Barisan Nasional if we practise cronyism and thuggish politics just like them.

Some friendly advice for my friend YB Tony Pua

From his recent Facebook postings I can see that my friend and colleague in Parliament, YB Tony Pua, member of Parliament for Petaling Jaya Utara, seems quite upset, in particular, with two division level leaders of PKR from Kelana Jaya division, naming them as “a Samy” and “a Murali” and calling them “gangsters” and “disgraceful thugs”.

My advice to both Weng San and Tony is that such matters are best left to the judgment of the Datuk Bandar of Petaling Jaya and his councillors. We should not interfere unless the decisions made at the Petaling Jaya City Council (MBPJ) are clearly unreasonable or obviously wrong or against stated policies of the Pakatan coalition.

Tony and Weng San would also know that a majority of the MBPJ councillors have in fact already proposed to the Datuk Bandar a win-win solution where the Deepavali bazaar for Sg Way would be conducted, for this year anyway, at both the original site (where it has run for 15 years at least) and the new site near Easwary Temple (as a trial run for evaluation ). This would also be known to many of the traders involved.

Therefore, my advice would be, rather than make controversial public pronouncements on the matter, let us leave this to the Datuk Bandar of MBPJ and his councillors to resolve.

Some of these traders are having great difficulty understanding why Tony and Weng San are insisting that the bazaar move to the new site when the majority of the MBPJ councillors have now proposed the win-win solution that it can operate in both sites. When one insistently waves the proverbial red flag at an angry bull, it is naïve to expect the bull to sit patiently and watch.

MBPJ’s clarification on Deepavali bazaar move

I would like to clarify the phrases published in your news article yesterday titled ‘Traders irked at not being consulted on Deepavali bazaar move’.

“… Forced to move from Jalan SS9A/13 in Sungai Way to the adjacent Jalan SS9A/12, the traders are also angry that they were not consulted on plans to relocate their trading area…”

The relevant official meetings at MBPJ conducted in 2014 and 2015 mention as follows:

During the last week of Deepavali (13 Oct 2014 to 20 Oct 2014), Mayor Datin Paduka Alinah Ahmad accompanied by MBPJ’s officers visited the Deepavali Bazaar after receiving numerous complains from the public.

During this visit, Mayor Datin Paduka Alinah informed the traders that 2014 will be the last year that the Deepavali Bazaar will be held at SS9A/13. The traders agreed with both the move and the new location.

1) Note that in ‘Minit Mesyuarat Penyelarasan Pengeluaran Permit Deepavali Tahun 2014′ on Sept 9, 2014,

“2.12 Ahli Majlis Encik Azri mencadangkan agar pada tahun hadapan (2015) lokasi bazar permit Deepavali di kawasan Sg Way di tukar ke lokasi baharu yang lebih sesuai dan selamat dan tidak melibatkan gangguan kepada orang awam.” This meeting was chaired by Ahli Majlis Encik Suriase and this was agreed and adopted by MBPJ’s Full Board sitting on Sept 30, 2014.

2) On March 10, 2015, in ‘Mesyuarat Jawatankuasa Kawalan Perniagaan dan Kesihatan’, the meeting agreed to the following:

“Puan Pengarah, Jabatan Pelesenan memaklumkan Banner Notis makluman pemindahan tapak bazar Deepavali dari SS9A/13 kepada SS9A/12 telah disediakan oleh Bahagian Perhubungan Awam.

Encik Oon Chong Ling memaklumkan tindakan pemasangan banner Notis pemindahan perlu dipasang lebih awal untuk makluman peniaga bagi peniaga membuat persiapan awal berhubung perpindahan lokasi bazar ini.”

On March 27, 2015, in MBPJ’s 3rd Full Board sitting for 2015, the above was adopted without any objection from any councillors.

“… K Samynathan, who is also the chairperson of the Sungai Way Small Traders Association, said they were only informed about this two weeks ago…”

On June 8, 2015, MBPJ Council received a letter titled ‘MEMOHON MENGEKALKAN TAPAK PERNIAGAAN MUSIM PERAYAAN DEEPAVALI DI JALAN SS 9A/13 SUNGAI WAY’.

This letter was signed by Mr Samynathan as Pengerusi Persatuan Peniaga Kecil Sungai Way. It means Mr Samynathan was engaged much earlier than what he claimed.

It is clear from the above that the traders are aware of the problems with the ‘old’ site, were engaged at the highest level from MBPJ in discussion and is fully aware of the council’s decision.

We don’t bow to disgraceful thugs.

Honest Indian traders with license from MBPJ were not allowed to commence trading. No Indian who applied for a license from the local council was denied a license.

And these thugs instead called me a racist, and posted many images accusing me of calling the Indian traders “samseng”.

No, I called these thugs who stopped the traders from setting up shop “samseng”. Just because they can no longer collect protection money and profit from the stalls, they are now disrupting the business of genuine traders trying to make a living.

Several PKR grassroots leaders have lodged a police report against DAP’s Petaling Jaya Utara MP Tony Pua for allegedly defaming them by calling them gangsters.

“I was chosen by the people, how can I be a gangster?” said K Samynathan outside the Petaling Jaya police district headquarters today.

Samynathan is the deputy chief of Kelana Jaya PKR division and was accompanied by PKR’s Kelana Jaya division secretary S Murali, Selayang division deputy chief G Gunaraj and Kuala Selangor division chief S Manikavasagam.

Murali (right in photo), who said he was also offended by Pua calling him a gangster, was the one who lodged the police report.

They were referring to a Facebook post from Pua yesterday, after he visited the new Deepavali bazaar site in Sungai Way.

“I discovered that the traders who have obtained licences to trade from MBPJ were stopped from trading by a group of gangsters led by a Samy and a Murali,” Pua had said in the Facebook post.

Pua had also claimed that the traders were being extorted of money through exorbitant rental fees from “certain parties”.

The Majlis Bandaraya Petaling Jaya fee to obtain a trading license is only RM95, but traders were paying close to RM500 total.

However, Murali said the traders had receipts showing that all RM500 were paid to the city council.

I was visiting the new Deepavali bazaar site near the Sungai Way Sri Sakthi Easwari Temple yesterday evening together with my state assemblyman, Lau Weng San and state executive councillor, V Ganabathirao.

Instead, I discovered that the traders who have obtained licenses to trade from MBPJ were stopped from trading by a group of gangsters led by a Samy and a Murali. The video below shows them heckling while I was speaking to the Tamil press at the site.

These gangsters were protesting the relocation of the Deepavali bazaar from Jalan SS9A/13 to SS9A/12, just an adjacent street away. The relocation was carried out by MBPJ as the earlier site was at a tiny lane which also acts as the entrance to a low-medium cost flat in the Sungai Way village.

The new site however, is just 100 metres from the temple – which means more customers, had plenty of carparks and could cater to many more traders compared to the previous site without causing massive traffic jams. The move to the new site was was even agreed with the bazaar traders last year. There was hence no justifiable reason at all to object to the new site as it was a win-win situation for all parties.

However, this Samy and his gang protested violently because certain parties lost their rice bowl of charging exorbitant rentals to traders by monopolising the stalls at the old site. At the new site, licenses are obtained directly with MBPJ for a fee of only RM95 for 1 month of trading, or approximately RM3 per day. There is no crony middleman, no corruption and no room for abuse under the new arrangement.

They accused me of being anti-Indians. How can that be when the new site gives more opportunities for trade by the Indian community during Deepavali? They accused me of shutting down Indian stalls. But the only people to stop the stalls from being set up were they themselves! Not a single hawker has been denied a license to trade.

Samy and Murali are PKR Kelana Jaya Division Deputy Chief and committee member respectively. PKR Selayang councillor, Gunaraj and Shah Alam councillor, Ajai was also present with the group. I will be writing an official letter to Selangor PKR Chief, YAB Azmin Ali to lodge an official complaint against these PKR members. I am absolutely certain that the Selangor MB will not tolerate such gangsterism and unbecoming behaviour from his party.

Petaling Jaya city councillor Sean Oon Chong Ling has filed a police report against thugs who are stopping licensed Deepavali bazaar traders from doing business in SS9A/12 yesterday.

Oon, together with Petaling Jaya Utara MP Tony Pua, Kampung Tunku assemblyman Lau Weng San, Selangor exco V. Ganabatirau, were visiting the traders at the bazaar when they ran into the thugs who had prohibited the traders from opening shop.

“These people say they are traders but they are not, they were stopping licensed traders from operating. The group was led by Saminathan Kitchan and another man, Murali. We have checked our documents and both of them are not registered traders.

“Yesterday, around 5pm to 6pm,  we went to the bazaar and they started yelling at us. We have filed a report and the matter will now be handled by the police,” Oon said.

A video clip recorded by Oon showed a group of angry men yelling insults at the visiting councillors and Pua.

Oon said the group had been strongly against the relocation of the annual bazaar from SS9A/13 to SS9A/12.

Bukit Gasing assemblyman Rajiv Rishyakaran said the group had gone too far by disrupting licensed traders’ operations.

“They say they are standing up for Indian rights, yet they are destroying people’s livelihood. They should not have done that. We have always been open to hearing their opinions but they must be mature in how they do so,” he said.
