Federal Court orders Parliament to pay Gobind’s salary

The Federal Court today ordered the Parliament to pay the salary and remuneration withheld from Puchong MP Gobind Singh Deo during his one year suspension in 2009.
The court, in upholding the decision of the High Court and the Court of Appeal, held that there was no law which allowed Parliament the power to do so.
Saying that he was pleased with the decision, Gobind added that this was the last civil case argued by his late father Karpal Singh before he died in a road accident in April.
“Mr Karpal Singh said to me that if we won this case, it will be his hope that Parliament will review all other previous suspensions of elected representatives and reimbursed them accordingly,” Gobind said.
He hoped that Dewan Rakyat speaker Tan Sri Pandikar Amin Mulia would consider the matter, adding that there were many MPs who were full-time politicians who depended wholly on their salaries to sustain themselves and provide for their families.
“Any order which takes away that source of income is most draconian and oppressive,” Gobind said in a statement.

Penalty set aside for man who flashed obscene gestures at Queen

GEORGE TOWN: A quantity surveyor, who was jailed and fined for flashing obscene gestures at Tuanku Permaisuri Agong Tuanku Hajah Haminah last year, succeeded in his appeal for the penalty to be set aside at the High Court here today.
High Court Judicial Commissioner Wong Teck Meng also ordered Leong Pei Koe’s case to be retried before a different magistrate at the Balik Pulau magistrate’s court.

In allowing Leong’s appeal for a revision, and subsequently the prosecution’s appeal against the inadequacy of the sentence, Wong noted that while the facts stated the acts of the accused, and that all have been labelled as obscene, the facts did not say why the gestures were obscene.
“It may be offensive, rude, but is it obscene? The facts are not there to show that the acts done by the accused are obscene.
“The prosecution should produce facts to show the meaning of showing the middle finger, as well as hitting his clenched left fist on his right palm.
“How were the gestures shown? Upwards? Downwards? Sideways? These were not shown,” Wong said.
Wong further stated that the magistrate then should have rejected the guilty plea, as the facts did not disclose obscene gestures.
Wong, at the end of proceedings yesterday, also ordered Leong’s passport to be returned to him.
Counsels R.S.N. Rayer and Ramkarpal Singh appeared for Leong. Deputy Public Prosecutor Lim Cheah Yit prosecuted.

Cops’ appeal dismissed, court upholds RM300,000 award to lorry driver – Bernama
The Court of Appeal in Putrajaya today upheld a High Court decision ordering the government and police to pay RM300,000 in damages to a lorry driver who claimed he was assaulted during an interrogation by the police six years ago.
A three-member panel led by Justice Datuk Zaharah Ibrahim dismissed the appeal brought by sergeants Mohd Shafiee Abdul Halim, Mohd Diah Sulaiman, corporal Abdullah Musa, lance corporals Matila @ Saudi Ismail and Nizam Abd Wahab and the government to overturn the High Court decision.
Meanwhile, the same panel allowed the appeal by sergeant Zulkiplly Taib, corporal Zamrin Zaid and former Brickfields police chief ACP Wan Abdul Bari Wan Abdul Khalid to set aside the High Court’s decision on liability and the quantum of damages.
The other two members of the panel were Justices Datuk Abdul Aziz Ab Rahim and Datuk Zawawi Mohd Salleh.
The nine appellants were appealing against the July 5, 2013 High Court decision which had allowed B. Prabakar’s civil suit against them and ordered them to pay RM300,000 in damages to him.
The High Court awarded Prabakar, 33, RM150,000 for exemplary and punitive damages, RM100,000 in aggravated damages and RM50,000 in general damages.

DBKL ruled wrong to pull down Bar Council banners
The Court of Appeal today upheld the High Court decision that Kuala Lumpur City Hall (DBKL) trespassed and acted illegally in pulling down banners put up by the Bar Council.
The banners were put up at the Bar Council’s Jalan Lebuh Pasar premises on Human Rights Day seven years ago.
The three-member panel led by Justice Abdul Wahab Patail, also upheld the RM12,000 general damages and the RM320 special damages to the Bar Council for the banners that were taken down.
Besides Justice Abdul Wahab, the others were Justice Azahar Mohamed and Justice Hamid Sultan Abu Backer. They did not make any order as to costs.
Lawyers Ranjit Singh, Razlan Hadri Zulkifli (left) and Jaime Ong appeared for the Bar Council, while B Thangaraj appeared for DBKL.
The decision by the High Court in Kuala Lumpur last year was seen as a victory for human rights.
Human Rights Day is celebrated around the world on Dec 10 every year. The Bar Council had filed its action against DBKL in 2009.

The three banners pulled down by DBKL stated ‘Stop the Patronage, Stop the Rot’, ‘As I Believe? Freedom of Expression through Art, Music, Culture and Conscience…’ and ‘Rakyat Hakim Negara’ (The people are nation’s judges).
DBKL’s enforcement men came about noon seven years ago and ordered the banners be taken down on grounds they were advertisements within the meaning of a by-law, and hence a licence was required to put them up.
The Bar Council was told that since it did not have a licence for the banners, City Hall could remove them.
However, Judicial Commissioner SM Komathy Suppiah, who ruled in favour of the Bar Council, held that the banners did not fall under the realm of advertisements.
“By-laws do not apply to non-commercial advertisements,” Komathy said in awarding costs to the Bar Council.

Penang CM and deputy send legal notice to English daily over alleged defamatory article
GEORGE TOWN: Penang Chief Minister Lim Guan Eng and Deputy Chief Minister II Dr P. Ramasamy have sent a legal notice to an English daily and its reporter over an alleged defamatory news article.
Dr Ramasamy said a legal notice was sent on Dec 6 with several demands that included a retraction and apology on the news titled ‘Indian-interest group claims thugs interrupted meeting’ published on Dec 4.
“Failing to do so, we will initiate legal proceedings,” he said at a press conference in Komtar on Sunday.

Guan Eng to sue English daily for linking him to thugs

Penang Chief Minister Lim Guan Eng is suing Umno-controlled English daily New Straits Times for linking him to thugs.
He said that the daily’s online report, titled “Indian-interest group claims thugs interrupted meeting”, on Wednesday alleged that he and his deputy Dr P. Ramasamy sent thugs to stop a non-governmental organisation’s meeting.
Lim described the report as unprofessional, unethical and immoral, and told a press conference at his office in Komtar saying:
“We have consulted our lawyers. As the report is defamatory, we ask the daily to issue an open apology, and pay the necessary damages and costs. It was malicious of the NST again.
“How can the paper publish something it knows to be false? The NST has a motive of deliberately spreading lies to tarnish our reputation.

Indian-interest group claims thugs interrupted meeting
GEORGE TOWN: An Indian-interest group here is claiming that the state’s top leaders have resorted to thugs to stop them from sending a petition on Indian crematoriums.
Concerned Citizens of the Indian Community spokesperson N. Ganesan claimed that ‘few thugs’ had interrupted their meeting on Saturday, screaming expletives and had threatened to hurt them.
“One of them screamed and demanded that we remove ‘YAB Lim Guan Eng’ (The most honourable Lim Guan Eng) from our petition.
“Based on what was said by these thugs, we believe these thugs were sent in by Chief Minister Lim and his deputy P. Ramasamy,” he said in a press conference in Bayan Lepas earlier.

Persatuan Hindraf Malaysia national adviser N Ganesan has been warned not to repeat claims that thugs linked to Penang’s top politicians had allegedly disrupted an NGO meeting.
Restaurant owner Ragindran Sivasamy, 58, who was implicated in the matter when the media was shown a photo of him with Deputy Chief Minister II P Ramasamy yesterday, said he was seeking legal advice on whether to sue Ganesan.
Ganesan had displayed the photo and identified Ragindran during a press conference in Penang yesterday, alleging he was linked to Ramasamy and Chief Minister Lim Guan Eng.
Lim had declined to comment, leaving the matter to Ramasamy, who chairs the Penang Hindu Endowment Board (PHEB).
“That photo with Ramasamy (and several others) was taken after he came to settle a temple issue in Sg Ara, which was facing some problems,” Ragindran explained.

NGOs call for probe into thugs who disrupted forum
Hindraf activist assaulted by one of the uninvited goons during a meeting on Hindu cemeteries over the weekend
GEORGE TOWN: A group of Indian NGOs has urged the police to investigate the disruption of a forum on Hindu cemeteries held at the Caring Society Complex last weekend.
The group’s spokesperson, N Ganesan, said that at least four local thugs attended the forum uninvited, caused a ruckus and assaulted one man, forcing the organisers to call off the forum.
Ganesan identified one of the thugs as S Ragendran, commonly known as Weld Quay Tambi and another as Segaran.
Ragendran and his cohorts had disrupted the forum by constantly raising their voices, interrupting speaker Ganesan’s speech and talked on irrelevant matters.
Eye witnesses said Ragendran had at least thrice punched a Hindraf activist, Selvam on his face causing his mouth to bleed.
“The forum was attended by people on invitation. These thugs attended the forum uninvited. They also refused to leave the forum when told to do so.

Counsel Fitri Asmuni told The Malaysian Insider that Nizar was awarded general and exemplary damages after judge Rosnani Saub found the paper liable for defamation.
Fitri said that Nizar is in Australia and had been informed by text message of the verdict.
The lawyer added that in her decision, the judge found that the report was not a true publication but had been spun, adding that it was defamatory to Nizar.

In recent times, Utusan has lost several defamation suits filed by Pakatan Rakyat leaders: twice to Lim Guan Eng, and once each to Karpal Singh, PAS vice president Mahfuz Omar and central committee members Khalid Samad and Nizar Jamaluddin, and Anwar Ibrahim.
Utusan, owned by UMNO, was commended for its good work recently by Prime Minister Najib Razak.

Sept 17: Kuala Lumpur High Court today orders Umno-owned Utusan Malaysia to pay RM40,000 in cost to PAS vice president Husam Musa and retract a defamatory article against the latter.
According to news portal The Malaysian Insider, the settlement was read in front of judge Siti Khadijah S Hassan Badjenid.
Mingguan Malaysia, the Sunday version of Utusan Malaysia, had agreed to publish the retraction on the articled titled “Menilai hujah Husam” (Evaluating Husam’s arguments) this coming September 22.
Husam had named Utusan Malaysia, columnist Zulkiflee Bakar and the group chief editor Abdul Aziz Ishak as defendants.
The article had painted Husam as someone not loyal to PAS, not trustworthy and a threat to PAS before the 2011 PAS Muktamar.
“Today it is concluded. I hope that such accusation will not happen again,” said Husam.

DAP adviser Lim Kit Siang will take legal action against two Umno politicians and newspaper Utusan Malaysia for an article which implied that he had indeed urinated in front of the Selangor menteri besar’s home during the May 13 riots in 1969.
The article, which appeared in the daily on Saturday, quoted former deputy minister Dr Mohd Puad Zarkashi as saying that the DAP had strongly criticised the controversial movie, Tanda Putera, to “hide Lim’s rudeness” when he had allegedly urinated on a flag during the incident.
The DAP veteran has denied the allegations and the movie director Datin Paduka Shuhaimi Baba has confirmed that she had used her “creative licence” in coming up with the urinating incident.

Court orders Ibrahim Ali to pay Anwar
The defamation suit was related to articles published by the defendants on Anwar Ibrahim’s interview by the British Broadcasting Corporation (BBC).
KUALA LUMPUR: The High Court has dismissed an application by Perkasa president Ibrahim Ali to set aside a court order allowing opposition leader Anwar Ibrahim, to commence committal proceedings against him.
Justice John Louis O’Hara ordered Ibrahim to pay RM5,000 in costs to Anwar.
In his decision, Justice O’hara ruled that Anwar had established a prima facie test to initiate contempt proceedings against Ibrahim.
“I rule against the application and dismiss it,” he said.
The court also fixed Aug 26 for case management.

On Jan 17, Anwar filed the application, alleging that the article posted on the Perkasa website on Jan 7, had tarnished the image of the High Court judge who presided over the opposition leader’s defamation suit against Utusan Melayu (Malaysia) Bhd and its editor-in-chief, Abdul Aziz Ishak.
The defamation suit was related to articles published by the defendants on Anwar’s interview by the British Broadcasting Corporation (BBC).
The judge had on Jan 21, last year ruled that the two articles published by Utusan Melayu (Malaysia) Bhd on Anwar’s interview by the BBC, regarding homosexual laws, were defamatory.
Anwar, in his application for committal proceedings, alleged that the article on the Perkasa website contained personal attacks against the judge that amounted to contempt, and published before the latter made his ruling.

The High Court today ordered the government and police to pay more than RM350,000 to a lorry driver who was hurt during interrogation by the police, about five years ago.
In allowing B Prabakar’s suit, High Court judge John Louis O’Hara held that the plaintiff had established his case against the government and eight policemen.
In his ruling, O’Hara said seven of the policemen were liable to the suffering and pain of the plaintiff; the other, ACP Wan Abdul Bari Wan Abdul Khalid, who was Brickfields police chief at that time, was responsible for misfeasance of public office, while the government was liable for vicarious liability.
“I find from the evidence, liability was proved on seven defendants, and the grievous nature and the pain and suffering he (plaintiff) had endured during the interrogation…,” he said, adding that therefore, the defendants had to pay damages to the plaintiff.
O’Hara awarded Prabakar, 32, RM150,000 for exemplary and punitive damages, RM100,000 for aggravated damages and RM50,000 for general damages.
He also ordered the defendants to pay RM50,000 in costs, RM1,500 for loss of income, RM150 for medical bill and RM75 for photographs of plaintiff’s injuries.

KUALA LUMPUR, April 2 — Tan Sri Khalid Ibrahim today filed contempt proceedings against Datuk Seri Ahmad Said Hamdan, accusing the former anti-corruption chief of defying a court ruling over remarks the latter made in 2009 surrounding a corruption probe on the Selangor mentri besar.
Khalid had last month settled his defamation suit against the Malaysian Anti-Corruption Commission (MACC) and its former chief Ahmad Said but both defendants in the case had failed to adhere to the court’s order that they place front-page apologies to the Selangor Mentri Besar in two mainstream dailies — The Star and New Straits Times.
Following this, the PKR leader, through his lawyer Sankara Nair, filed an ex-parte application for leave to cite Ahmad Said and the Malaysian government for contempt of court at the High Court registry this morning.
In his supporting affidavit, Khalid pointed out that it was not a legal impossibility for the defendants to publish their apologies in the two newspapers.
“It is not a legal impossibility, they have done it before, they can do it and they didn’t do it,” Sankara told reporters here.

MARCH 30 ― What can we say about Datuk Seri Ahmad Said Hamdan and the Malaysian Anti-Corruption Commission (MACC) defying a court ruling over the Selangor mentri besar’s 2009 corruption case?
Disappointing.
Tan Sri Khalid Ibrahim settled his defamation suit against the MACC and its former chief two weeks ago but is now accusing both defendants in the case of breaching the terms of their agreement by refusing to publish their apology, which Ahmad Said had tendered in open court.
So what happened?
How is it that there was an apology in court but it isn’t in the newspapers?
We are talking about reputations here, that of the chief minister, Ahmad Said and the MACC.
Without the apology in print, what can one assume except that it wasn’t sincere?
Or that other forces are blocking the apology from being published?
Ahmad Said must explain this anomaly or we are forced to assume that there was no sincerity in the apology.
That would be a pity and, most of all, very disappointing.

KUALA LUMPUR, March 30 ― Tan Sri Khalid Ibrahim has instructed his lawyer to file contempt proceedings against Datuk Seri Ahmad Said Hamdan and the Malaysian Anti-Corruption Commission (MACC) for defying a court ruling over the Selangor mentri besar’s 2009 corruption case.

He pointed out that Ahmad Hamdan and the anti-graft body had both been ordered by High Court judge, Datuk Lau Bee Lan, on March 18 to apologise in open court and to publish their apology on the front page of two English-language papers, The New Straits Times and The Star within four days of the order.
While Ahmad Hamdan had made his apology in open court on March 19, the former MACC chief commissioner had yet to publish his apology in the two dailies as ordered by the court despite the four-day deadline having lapsed.

KUALA LUMPUR, March 19 — Former Malaysian Anti-Corruption Commission (MACC) chief commissioner Datuk Seri Ahmad Said Hamdan apologised to Tan Sri Khalid Ibrahim today over remarks the former made in 2009 surrounding a corruption probe on the Selangor mentri besar.
“I, Datuk Seri Panglima Ahmad Said bin Hamdan, sincerely apologise to Tan Sri Khalid bin Ibrahim, over my statement on February 21, 2009, that was published by the media,” he said as he read out the apology the parties had agreed on yesterday.
“The statement was made in my capacity as MACC chief at the time. It was made in response to a question that was asked of me by media representatives about the progress of MACC’s investigations on Abdul Khalid,” he added.
“I made the statement without any ill-intentions and without any intention to jeopardise the reputation, image and integrity of the plaintiff.”

Umno Wanita chief Shahrizat Abdul Jalil today explained the stunt of rolling up her sleeves and pulling up her baju kurung slightly during her party’s annual general assembly last year was not intended to show she was picking a fight with PKR strategist director Rafizi Ramli.
“I have also rolled up my sleeves here (in court) several times, I am not spoiling for a fight. I’m a naturally aggressive woman,” she testified at the Kuala Lumpur High Court this afternoon when being cross-examined by Rafizi’s lawyer Ranjit Singh.
She explained her reaction was an expression of her anger and regret over Rafizi’s attacks against her. “Basically it is my reaction to the defamation I suffered.

Former Women, Family and Community Development Minister Shahrizat Abdul Jalil today told the Kuala Lumpur High Court that she took offense at being asked by PKR strategist director Rafizi Ramli to apologise over the National Feedlot Corporation (NFC) scandal.
She was responding to defense lawyer Ranjit Singh’s question on whether she was offended at this assertion which was raised in Rafizi’s press statement which is a subject of a defamation trial against the latter this afternoon.
Ranjit: You take offense?
Shahrizat: Yes.
Ranjit: Why?
Shahrizat: Why not?
Ranjit: Please explain.
Shahrizat: What do I have to apologise for? Apologising to Malaysians for the exposé that has angered Malaysians? I have to apologise to the rakyat for what?
Ranjit: For the trangressions of your family (in the NFC scandal).
Shahrizat: Do you ask (a) certain wife to explain what the husband does in a condo?
Ranjit: I don’t know what you are insinuating.
Shahrizat: Do you ask (a) certain wife to explain what the husband does in a condo, or several condos?
At this point, Ranjit told Shahrizat to stop making political statements before moving on to other questions.

Former Malaysian Anti-Corruption Commission (MACC) chief commissioner Ahmad Said Hamdan is expected to apologise to Selangor Menteri Besar Abdul Khalid Ibrahim tomorrow in the Kuala Lumpur High Court.
This relates to Ahmad Said’sstatement that there was possible abuse of power by Khalid, in donating 24 cows for slaughter during Hari Raya Haji in 2009.
The parties agreed to an out-of-court settlement today – negotiated since this morning – which will be recorded before Justice Lau Bee Lan tomorrow.
Khalid indicated today that he is likely not to seek damages, but the terms of settlement will only be known tomorrow.
He had named Ahmad Said and the government as respondents in the suit.

Kua wins defamation suit
Social activist Kua Kia Soong will know this Wednesday the damages to be awarded him in his legal victory against Dong Zong deputy chairman Chow Siew Hon.
PETALING JAYA: The High Court will rule this Wednesday the damages awarded to social activist Kua Kia Soong, who recently won his defamation suit against the deputy chairman of the United Chinese School Committees’ Association of Malaysia (Dong Zong).
Kua, who was former New Era College (NEC) principal, filed a suit in 2009 against Chow Siew Hon for insinuating that the college administration Kua headed suffered financial discrepancies that ran into millions of ringgit.
Kua charged that Chow’s defamatory statements had damaged his reputation, cost several colleagues their jobs and caused the Chinese community to lose confidence in the college, which he had managed from 2000 to 2008.

Anwar files RM100 mil libel suit against Utusan, TV3
KUALA LUMPUR: Opposition Leader Datuk Seri Anwar Ibrahim Friday filed a RM100-million defamation suit against Utusan Melayu (Malaysia) Bhd, Sistem Televisyen Malaysia Bhd (TV3) and three other defendants over news reports allegedly linking him to the armed intrusion in Sabah.
He filed the action at the civil court registry at 10.30 am through Messrs Daim & Gammy.
Anwar, 66, named Utusan and its editor Datuk Abdul Aziz Ishak as the first and second defendants, respectively, and TV3, its group managing editor Datuk Shahruddin Abdul Latif and its Bulletin Utama news editor Ing Boon Seng as the third, fourth and fifth defendants, respectively.
He also applied for an injunction to restrain the defendants from publishing or broadcasting defamatory words against him.
