PETALING JAYA: A woman who claims to be a companion of former MIC president S Samy Vellu will apply to be a party in a suit brought by Vell Paari to get an order that his father is mentally unsound.

E Meeriam Rosaline’s lawyer RSN Rayer said the application to intervene in the suit, filed in a High Court in Kuala Lumpur, would be made in a day or two.

“My client wants to intervene as she is of the opinion that Samy Vellu’s mental health is good and he is able to carry out his responsibilities,” he told FMT.

Rayer said the suit in Kuala Lumpur would be heard on Tuesday.

Meanwhile, Rayer, who is appearing together with Ramesh Sivakumar, said Meeriam’s application for an interim order from the High Court in Ipoh to have unrestricted access to the former MIC president has been adjourned.

He said Vell Paari’s lawyers wanted a stay of the hearing in Ipoh pending the outcome of the decision whether Samy Vellu, who was former works minister, is mentally unsound.

Judge Hashim Hamzah has fixed Jan 17 to hear the stay application.

FMT yesterday reported that Meeriam, who has named Samy Vellu, 82, and Vell Paari, as respondents, wants a court order that she have unrestricted access to the former MIC president.

She also wants her monthly RM25,000 maintenance payment to be continued pending the outcome of her main suit.

The RM25,000 is for her personal needs, as well to cover the salary of her housemaid and maintenance costs for her home, which she said was gifted to her by Samy Vellu.

In the suit filed last August, Meeriam wants a declaration that she be given due recognition and accepted as part of Samy Vellu’s family.

She also wants to contact and visit Samy Vellu with no restrictions imposed by any other family members, including Vell Paari.

She said Vell Paari has disempowered Samy Vellu financially and taken control over his finances since 2017 and completely denied payment of maintenance to her.

Meeriam, in her affidavit in support of the suit, said she had entered into a quasi-spousal union with Samy Vellu since 1981 and has documentary evidence to support her claim.

Ramesh told Bernama that Meeriam and Samy Vellu had a customary marriage at a hotel in Kuala Lumpur in 1981, and that the marriage was valid according to the law because it took place before 1982 when all non-Islamic marriages were required to be registered.

Meeriam told reporters she last met Samy Vellu six months ago in Kuala Lumpur and said he was in a good condition, including mentally.

“I met him for about one hour and he advised me not to worry, not to go to Kuala Lumpur and that he would come to Ipoh,” she said.

Samy Vellu’s ‘mistress’ seeks RM20m, declaration over ‘union’

KUALA LUMPUR: The purported mistress of former MIC president Tun S Samy Vellu wants the Ipoh High Court to declare that she has been in a quasi-spousal union with the former long-time works minister and engaged in an ala-matrimonial relationship since Aug 23, 1981.

Meeriam Rosaline a/p Edward Paul is also seeking unpaid living costs from Samy Vellu and his son Datuk Seri S Vell Paari amounting to RM191,107.35, which she claimed was owed to her when it was cut off since July last year.

She also wants a court order for her to be allowed to see the former minister. Following that, she is seeking a one-off payment of RM20 million as lifetime living costs as well, besides a monthly stipend of RM25,000.

Meeriam is also seeking a declaration that she was cared for and supported by Samy Vellu for almost 40 years, an injunction against Vell Paari or his agents where she was prevented from seeing the former senior minister, and an injunction to prevent Vell Paari from controlling his father’s finances resulting in payments to her being stopped.

The 59-year-old woman claimed Samy Vellu had loved her during their 38-year relationship, and they frequently travelled to London, Paris, Germany, Switzerland, the US and Singapore over those years.

Meeriam claimed they had a matrimonial situation where she acted as a wife to Samy Vellu, and on the former minister’s instructions, she stopped working at a government hospital in Perak since 1993.

She further claimed Samy Vellu gave her a driver and bought a separate house for her in Ipoh. In 2005, the former minister built a bungalow for her. She claimed that throughout her relationship with Samy Vellu, she was allowed to contact and meet the former minister without any restrictions.

However, Meeriam claimed that recently, she was threatened by Samy Vellu’s wife Toh Puan R Indrani and prevented by her from seeing the former minister. She further claimed the monthly funds were limitedly paid by Vell Paari as well.

For this reason, she filed an originating summons at the Ipoh High Court on Aug 15 this year.

A copy of the summons, where Meeriam named Vell Paari and Samy Vellu as respondents in the action, was sighted by theedgemarkets.com through a file search yesterday.

On Monday, it was reported that Vell Paari filed an originating summons on his father for the court to determine if Samy Vellu is a mentally disordered person and whether the former senior minister can give instructions to his solicitors, and when he could be incapable.

The legal application filed by Vell Paari is also aimed at discovering properties owned by Samy Vellu and highlighted Meeriam’s legal action too.

Vell Paari, in a statement issued on Monday, said the application was filed to protect his father’s interests.

Meanwhile, at the Ipoh High Court yesterday, Vell Paari and Samy Vellu’s application for a stay of this proceeding pending the disposal of Vell Paari’s originating summons involving his father came up before Justice Datuk Hashim Hamzah.

However, Justice Hashim did not want to hear the application and has fixed Jan 17 to hear the application. Meeriam was represented by lawyer Ramesh Sivakumar yesterday.

Mahkamah tetapkan 17 Januari dengar permohonan interim difailkan isteri kedua Samy Vellu

IPOH: Wanita yang mengakui isteri kedua Tun S Samy Vellu, mendakwa keadaan suaminya itu baik dan mahu menemuinya.

E Meeriam Rosaline mendakwa kali terakhir bertemu Samy Vellu di sebuah restoran di ibu negara pada Jun lalu dan ketika itu bekas Menteri Kerja Raya itu memberitahunya supaya tidak bimbang dan semua urusan akan berjalan seperti biasa.

“Saya hanya mahu berjumpa dengan suami saya kerana sebelum ini saya boleh bertemu dengannya. Saya mahu suami menjaga saya sebagaimana janjinya sebelum ini,” katanya yang ditemui pemberita di perkarangan Mahkamah Tinggi Ipoh di sini, hari ini.

Mahkamah Tinggi di sini, hari ini sepatutnya mendengar permohonan interim difailkan Meeriam Rosaline selepas beliau tidak dibenarkan bertemu dengan bekas Presiden MIC itu dan tidak lagi dibayar nafkah sebanyak RM25,000 sebulan seperti mana sebelum ini.

Permohonan berkenaan difailkan pada Mac lalu dan hari ini, ia didengar di dalam kamar di hadapan Hakim Datuk Hashim Hamzah, yang menetapkan 17 Januari ini bagi pendengaran permohonan interim difailkan Meeriam Rosaline yang diwakili peguam RSN Rayer.

Sementara itu, Rayer berkata pihaknya sepatutnya memfailkan permohonan interim mengekalkan pembayaran nafkah ke atas anak guamnya.

Bagaimanapun katanya, ia ditangguhkan kerana mahkamah mahu mendengar keputusan permohonan saman yang difailkan oleh anak lelaki Samy Vellu, Datuk Seri S Vell Paari yang dijadualkan pada 17 Disember ini.

Vell Paari memfailkan saman pemula terhadap bapanya di Mahkamah Tinggi Kuala Lumpur bagi menentukan sama ada bekas Menteri Kerja Raya itu mengalami kecelaruan mental dan tidak berupaya untuk menguruskan hal ehwal dirinya didengar terlebih dahulu.

Rayer berkata, Mahkamah Tinggi menetapkan 17 Januari ini bagi pendengaran permohonan interim difailkan anak guamnya.

Ditanya status anak guamnya, Rayer berkata beliau difahamkan perkahwinan anak guamnya dengan Samy Vellu adalah sah dan ia diadakan secara tradisi pada 1981 di sebuah hotel di Kuala Lumpur.

Katanya, sejak itu Samy Vellu sudah menyara serta tinggal bersama anak guamnya sebagai suami isteri.

The interim application, sighted by FMT, is scheduled to be heard before High Court judge Hashim Hamzah in Ipoh tomorrow (Dec 12).

FMT understands that Vell Paari has also filed an affidavit to claim that Meeriam, 59, had no legal standing to demand for the maintenance.

Lawyer RSN Rayer and Ramesh Sivakumar will be appearing for Meeriam, who is currently residing in Ipoh.

In the suit filed last August, Meeriam wants a declaration that she be given due recognition and accepted as part of Samy Vellu’s family.

She also wants to contact and visit Samy Vellu with no restrictions imposed by any other family members, including Vell Paari.

FMT also reported on Monday that Vell Paari is also seeking a declaration from the High Court that his father is mentally unfit to defend himself in the wake of two legal cases brought against him.

Vell Paari said his father, who served in the Cabinet from 1979 to 2008, had been diagnosed with dementia, due to Alzheimer’s disease, two years ago.

“My father has poor recall and registration of certain events. Consequently, he needs to be assisted in managing his personal and financial affairs,” he said.

Vell Paari also said his father’s condition is covered under the Mental Health Act 2001.
