Phone seller remanded as cops probe alleged fraud at Kota Raya

Police have opened two investigation papers in connection with the fraudulent sale of handphones at the Kota Raya shopping complex after a report was filed by the victim, Bernama reported.

Kuala Lumpur police chief Datuk Tajudin Md Isa said a handphone seller had also been detained and remanded until tomorrow to help in the investigations, while another is still being traced.

Commenting on a statement by the Malaysian Muslim Consumers’ Association (PPIM) on a news portal on why the cheating traders were not arrested, Tajudin said police would continue to investigate the matter and prepare the investigation papers.

PPIM had also said that the failure to arrest the cheating traders gave the impression that there might be a conspiracy.

“A raid was conducted at the complex on March 27 and 500 handphones suspected to be fakes were confiscated.

“I want to stress and advise the public not to make any speculation which could jeopardise the investigations,” Tajudin said in a statement yesterday.

Why aren’t cheating traders arrested, asks consumers body

Consumer rights NGO Malaysian Muslim Consumers Association (PPIM) has questioned why none of the Kota Raya traders who allegedly cheated their customers have been arrested.

Instead, PPIM chief activist Nadzim Johan said, his fellow activist Muhammad Yusuf Azmi was the one arrested for trying to help the victims.

“I want to ask the police: why is it that the one arrested was someone who was trying to help?

“This is a very weird thing that shouldn’t have happened,” Nadzim said at a press conference in Kuala Lumpur today.

There is a plot behind this lack of arrests, he believes. “I really believe it. It’s true. But at which level I don’t know,” Nadzim said.

Yusuf, who is PPIM’s special action unit chief, said they have all given their statements to the police and yet no Kota Raya trader has been arrested.

“I want to ask the inspector-general of police, why is it that until now not a single person (Kota Raya trader) has been arrested?

Yusuf was initially called to the Dang Wangi district police headquarters on Dec 24 to give his statement on the Kota Raya brawl earlier last week.

After he gave his statement, he was arrested under Section 506 of the Penal Code for criminal intimidation.

Seven-day demand request rejected

The police requested a seven-day remand, Yusuf said, adding that he was also told that seven-day remands are usually reserved for those charged with serious crimes.

The judge, however, rejected that request.

Yusuf (photo) said he was at the Kota Raya complex to accompany a dissatisfied customer who had got a refund order from the Domestic Trade, Cooperatives and Consumerism Ministry.

He insisted he remained civilised when dealing with the Kota Raya traders and managed to help several of the dissatisfied customers get a total refund of RM11,900 in return for 12 mobile phones.

Muslim consumer group must pay price for illegal Kota Raya raid, lawyers say

PETALING JAYA, Dec 29 — Lawyers yesterday condemned Persatuan Pengguna Islam Malaysia (PPIM) over its raid on a handphone shop at the Kota Raya Complex in Kuala Lumpur, saying it has no authority to carry out independent raids on those suspected of cheating.

Malaysian Bar criminal law committee member Datuk Baljit Singh Sidhu said it was a case of the association taking the law into its own hands.

“There should be proper procedure for consumer groups to address the situation, such as to pass a memorandum to the authorities for the next course of action instead of carrying out its own raid,” he said.

Baljit called for action to be taken against the group to send a clear message to others that such an act should not be condoned.

“They should respect the law … you take the law into your own hands, you have to pay the price,” he said.

He said the case should be investigated under Section 505 of the Penal Code where the penalty is two years’ jail, a fine or both.

Another lawyer, Haijan Omar, agreed that issues on consumer rights should be channeled to the relevant enforcement agencies such as the Domestic Trade, Cooperative and Consumerism Ministry.

“The authorities must then take action,” he said. “Barging into a business outlet in a group is intimidation. Demanding refunds    (in such a manner) seems more like extortion, in my opinion.”

Lawyer Yusmadi Yusoff said consumer activists were allowed to carry out their duties but not to extent of taking the law into their own hands.

PETALING JAYA, Dec 28 — Thirty eight complaints have been lodged against errant handphone traders at the Kota Raya Complex, while the Domestic Trade, Cooperatives and Consumerism Ministry has not received any complaints at their counters set up at two other malls in the city.

The ministry’s Kuala Lumpur branch deputy director Rosli Ahmad said the complaint counters at Pertama Complex and Low Yat Plaza would be closed as they did not register any complaints since they were opened on December 21.

“We will maintain the counter at Kota Raya until January 3,” he told Malay Mail yesterday, adding that complaints received  were mainly about price disputes.

Upon receiving the complaints, the officers on duty would query the shops involved as part of their investigations.

Ministry teams up with other agencies to pursue Kota Raya cheats

PETALING JAYA, Dec 28 — The Domestic Trade, Cooperatives and Consumerism Ministry is going the extra mile to bring unscrupulous traders to book. In an unprecedented move, it is working with the Companies Commission of Malaysia (CCM), National Registration Department (NRD) and other government agencies to track down errant traders.

Several handphone shop sales staff who were accused of cheating customers at the Kota Raya Complex in Kuala Lumpur have been playing a cat-and-mouse game with officers from the ministry. They have closed their shops temporary to avoid being investigated or slapped with compounds over their dealings.

However, the ministry is tracking them down with the help of CCM and NRD. Its secretary-general Datuk Seri Alias Ahmad said the ministry was determined to weed out errant handphone traders.

“We will also get the local councils to cancel their trading licences and seal their premises. Don’t take us lightly. We mean business,” he said.

“Major handphone suppliers are advised to blacklist such traders. We know traders who closed their shops in Kota Raya own other outlets elsewhere.

“We will check the identities of those who have shut their shops in Kota Raya and see if they were also involved in other cheating cases. Those who are genuine should continue operating. There is nothing to fear.”

He said the ministry was in the midst of collecting evidence after reports were lodged against several traders at Kota Raya recently.

Mall brawls symbol of a fractious Malaysia

Matter made worse by activists turning mobile phone disputes into race issue and fuelled by lack of govt action

One of Kuala Lumpur’s older malls, Kota Raya, is seeing few customers this week, a change from the usual throng of migrant workers who fill the place. At Mara Digital Mall with its Malay-only traders 2km away, the place is just as deserted.

These two venues are linked by recent violent mall brawls – Kota Raya became empty after a fight, and the Mara mall was born following an earlier dispute.

The fights between Malay men using sticks and helmets and Chinese phone sellers have become the latest symbol of Malaysia’s fractious society. The matter is made worse by activists turning disputes over cellphones into a race issue, and fuelled by the authorities’ lack of action and seemingly slow intervention from top politicians.

“There is an undercurrent of distrust between races. Put that together with a slowing economy, a weaker ruling government, it all adds to a layer of insecurity,” said Mr Ibrahim Suffian, director of independent pollster Merdeka Centre.

In July, a group of several hundred descended upon popular gadget mall Low Yat Plaza in a gathering that nearly turned into a riot against Chinese traders, after social media rumours of a Malay man being sold a counterfeit phone.

And on Sunday, some 20 Malay men attacked cellphone sellers in Kota Raya after allegations that a store had cheated a Malay customer.

Analysts say the racially charged incidents are symptomatic of Malaysia today, as the multiracial country becomes more divided and the government is seen as slow to react. “There is a view that those in power can’t punish those whom they share a common belief with, those speaking up for Malays,” said Mr Ibrahim.

The fractious society was partly caused by a government plan to grow a Malay middle class following race riots in 1969. The bumiputera policy of promoting Malay rights grew the pool of educated Malays and Malay businessmen. But analysts say the policy also created a culture of entitlement among some Malays.

Other Malay groups have now jumped in and are blaming Chinese traders for “cheating”. They include Islamic group Isma and the Muslim Consumers Association. This could worsen the multi-ethnic cracks, analysts say. “Of course, if left unchecked it would certainly escalate,” said Dr Oh Ei Sun, senior fellow at S. Rajaratnam School of International Studies in Singapore.

There are worries that the more aggressive Malay voices are becoming louder, as mainstream Umno leaders keep to the sidelines.

“Whenever there’s a power struggle at the highest level, you’ll see racial politics being played,” said Dr Oh. “It distracts people from the political troubles at the top.”

Magistrate Saiful Akmal Said sentenced Khairuddin Arbi to four days jail from the date of arrest, December 20, and fined him RM1,800, in default four months jail.

 

KUALA LUMPUR: A parking attendant was charged at the Magistrate’s Court with criminal intimidation for allegedly threatening five mobile phone salesmen at the Kota Raya shopping centre here.

Khairuddin Arbi, 38, pleaded guilty before Magistrate Saiful Akmal Said to the charge under Section 506 of the Penal Code for alleged criminal intimidation and threatening salesmen Chiaw Wai Kit, Lim Wai Hong, Wong Weng Kong, Liew Wai Chung, and Yong Haw Nam, on Sunday.

According to the facts of the case, police from the Dang Wangi police district headquarters received a call in the late afternoon on Sunday regarding a fight at Kota Raya.

The police subsequently arrested Khairuddin in a carpark along Jalan Tun Tan Siew Sin.

From the investigation, the police found that Khairuddin had uttered threatening words against the salesmen.

Magistrate Saiful sentenced Khairuddin to four days jail from the date of arrest, December 20, and fined him RM1,800, in default four months jail.

‘Boycott Low Yat and Kota Raya, go to Mara Digital’

An Umno Youth exco has urged the boycott of both the Low Yat Plaza and Kota Raya shopping complexes following a brawl which occurred last Saturday.

Armand Azha Abu Hanifah suggested that consumers should instead opt for Mara Digital in buying electronic goods.

“I think it’s better that we go to Mara Digital as it is safer for consumers, insyaAllah,” he said in a Facebook posting.

He also did not agree with the arrest of Mohd Ali Baharom, better known as Ali Tinju, after last week’s demonstration calling for a boycott of traders at the Kota Raya complex.

Police, said Armand, should instead focus on alleged fraud committed by traders against consumers.

“The authorities should take stern action not only to the workers but the company in question as well as the management of the Kota Raya complex for allowing elements of gangsterism in business conduct,” he said.

Lawyer: Probe Ali Tinju under penal code, not sedition law

Army veteran Ali Tinju should have been investigated under Section 505 of the Penal Code rather than the ‘outdated’ Sedition Act 1948, said Lawyers for Liberty executive director Eric Paulsen.

This is because a charge under the Penal Code provision would require the prosecution to show the court the intent (mens rea) behind the alleged offence, and that the offence had indeed caused public alarm or amounts to public mischief.

In addition, Ali Tinju, whose real name is Mohamad Ali Baharom, would have an opportunity to explain the reason behind his actions in court.

In contrast, the provisions under the Sedition Act 1948 are so broad that the prosecution merely needed to prove that the accused had indeed made the allegedly seditious statement.

“It makes a difference (under Section 505 of the Penal Code) if Ali Tinju said it in Kota Raya while being backed up by a large group of men, rather than a nobody saying it on Facebook from some rural area somewhere.

“Under the sedition law right now, both would be equally be guilty, because as long as you have said it, it is an offence.

“Under the penal code, the offence is much more well-defined. There are a lot of case laws about it, but when it comes to sedition, it is very open ended. So there are good reasons why the Penal Code is a more appropriate charge than sedition,” he told Malaysiakini when contacted today.

Paulsen, who himself faces a sedition charge, maintains that the Sedition Act should be abolished.

KUALA LUMPUR, Dec 22 — Accusing MCA of defending “cheating Chinese”, Mohd Ali Baharom told leaders in the Barisan Nasional (BN) party to stop shifting the blame and to take responsibility for the actions of the ethnic group it represents.

The former soldier whose Merah 1Malaysia movement claims to champion Malay rights told the ruling Chinese party to “school” its people first, after the leaders pointed out that race has nothing to do with dishonest merchants in the wake of an alleged handphone scam at the Kota Raya shopping complex in the city last week.

“I am warning MCA leaders. Shut your mouth, don’t question other races. School your own race first. Your race are cheaters,” he said to ProjekMMO, the sister publication of Malay Mail Online in Bahasa Malaysia.

The self-styled leader of a group calling itself the “red shirts” was responding to calls from MCA leaders to turn a deaf ear to Mohd Ali’s statements that have taken on a racial tone as the latter singled out the Chinese community for dishonesty in business.

“Are MCA leaders defending their race who cheat, blackmail, intimidate the rakyat?

“Do they agree with the Chinese trader’s action? Do MCA leaders have nothing better to do than to blame other races when their own race kicks up a fuss, is insolent and cheats?” he quizzed over the phone when contacted yesterday.

Mohd Ali, better known as Ali Tinju, said MCA should be more aware of its weaknesses as a party that was using the BN as a crutch.

He said the MCA should leave the ruling coalition and instead team up with federal opposition party, DAP and make it easier for critics to attack them.

“Are you supporting those who do wrong? MCA must be more self-aware, look into the mirror. MCA is sitting on a free chair gifted by Malays. Wake up MCA.

“That chair in Cabinet is also a free seat. If MCA does not take care of its race, better to get out of BN. Go join DAP. Easier for us to attack,” he said.

KUALA LUMPUR, Dec 21 ― Former soldier Mohd Ali Baharom told the ethnic Chinese community not to respond to yesterday’s brawl at the Kota Raya mall here, saying his group of Malays will “rise” if they do so.

The self-proclaimed leader of Merah 1Malaysia, a movement purporting to champion Malay rights, denied that its red-shirted members were involved in the scuffle that sent two handphone sellers to hospital, but said they would oppose any Chinese entity that dared to question the incident.

“We will observe first. If there’s any sign of the Chinese rising, we will oppose. We will rise to defend.

“Don’t blame other races; the Chinese or MCA, if their people are unethical in business,” the army veteran better known as Ali Tinju told ProjekMMO, Malay Mail Online’s sister publication in Bahasa Malaysia, when contacted.

KUALA LUMPUR: Police arrested Mohd Ali Baharom, better known as ‘Ali Tinju’, over alleged racial sentiments made at Kota Raya complex on Friday.

Dang Wangi district deputy police chief Superintendent Habibi Manjiji when contacted said Ali was arrested at the district police station at about 7pm today.

“He was arrested following police report lodged against him,” he said when contacted.

Kotaraya phone shops stay shut after Sunday melee

Most of the mobiles phone shop situated at Kotaraya shopping complex opposite Chinatown in Kuala Lumpur remained closed today following yesterday’s altercation which saw a group storm one particular shop and attack its employees.

A visit to the mall today which is a popular mobile phone hub found that four phone shops were open out of the more than 10 on the premises.

However, other outlets selling clothing and jewellery were open for business as usual.

Many of the shop assistants interviewed today said they were not clear on what caused the fight. Some workers refused to be interviewed outright.

A phone shop assistant who wanted to be known only as Wong, 34, said he was attending to customers in his shop when the fracas broke put.

“Yesterday, there was many customers here. When the brawl broken out, all the customers got scared and they rushed into the nearest shops.

“We decided to close our shop when we saw this. We don’t know what happened,” said Wong.

However, Wong said yesterday’s incident had not affected business at his outlet which was open today. “There is nothing to fear,” said Wong confidently when interviewed while having his lunch.

Cops arrest Kota Raya brawl suspect

KUALA LUMPUR: Police have arrested a suspect in connection with a brawl that broke out between workers at a mobile phone shop in the Kota Raya shopping complex and a group claiming to have been scammed by them.

Dang Wangi deputy police chief Supt Habibi Majinji said the 38-year-old man, a parking attendant, was arrested at the shopping complex on Sunday, after the 5pm fracas was brought under control.

“The suspect was part of the group involved in the assault on the shop workers.

“He works as a parking attendant in one a shopping complex,” adding he will be remanded on Monday.

When asked, Supt Habibi said police are investigating whether the suspect was one of the individuals allegedly swindled by the traders.

“The mobile phone worker was injured in the assault and has lodged a police report.

“We will release the images of the suspects in due time,” he noted.

Supt Habibi said those who claimed to have been cheated did not lodge a police report prior to the fracas.

“They only lodged a report after the incident on Sunday. From what I understand, they responded to a call on Facebook to band together and claim a refund.

“We have identified the Facebook user behind the posting and will take action as necessary.

“I would like to stress that NGOs and individuals should refer the matter to the police instead of taking the law in their own hands,” he said.

Supt Habibi said that police would be increasing the security around Kota Raya to prevent untoward incidents.

He added that the traders suffered losses amounting to RM15,000 in stolen items and damage to the premises.

It is learnt that the 4.30pm incident occurred when several customers, backed by a non-government organisation, went to the complex to seek a refund from several sellers who had allegedly cheated them.

A representative of the group Roslan Ismail told Harian Metro that a heated argument started when one of the business operators behaved rudely and tried to chase them out.

Scuffle forces complete shut down of Kota Raya Complex

One trader who was less than satisfied with having to make refunds started a commotion resulting in security personnel ordering the complex to be shut down.

KUALA LUMPUR: The Kota Raya shopping complex was shut down this evening after a scuffle of sorts erupted when one handphone trader expressed his anger at having to refund customers for handphones they claimed to have been overcharged for.

It is believed he was particularly displeased that self-proclaimed activist Roslan Haji Ismail, had “led” a gathering of scam victims to the complex to demand a refund for handphones they had overpaid for.

The scuffle lasted for about five minutes before Kota Raya security personnel ordered the complete shut down of the shopping complex.

Prior to the incident, a group of handphone scam victims, accompanied by Roslan, gathered at the complex to receive refunds for prior purchases they had been over-charged for.

The activist said the scams were a regular occurrence, yet had gone unreported all this while.

“This has been happening for the longest time. However no one dares report any of this as most of them don’t even know how to as they are foreigners,” Roslan told reporters outside Kota Raya complex today.

    Memang penjual tu menipu. Dia kata samsug galaxy 6 harga 5ratus. Lepas ambi duit suruh sain. Lepas sign baru ckp itu harga hp kosong tanpa software. Software dgn anti virus kena tambah lagi few hundred yg akhirnya harga jadi 2200. AP saja pula tu. Klu purchase cancel, duit yg dah di ambi tak bagik balik. Samada rugi 500 atau tambah duit utk dpt kan hp tu. Klu memang tak de duit nak tambah, melayang lah duit tu.

      Exactly …and this happened longtime ago but the foreigners did’nt do police report coz they are scared and i feel so kasihan everytime i saw new clients especially bangladesh myanmar nepal..they (chineses traders) loved to cheat those people coz most of them dont have proper documents……im just wondering why the kotaraya management allowed their tenants to cheat their costomers,the security guards was there all the time so they know what is happening on there everyday and every week end but they are ignoring…..

      Kakak says pun pernah kena tipu dengan cara sama. Konon harge tu murah, tapi suruh sain. Lepas tu baru bagitau ada banyak lagi cost kena bayar sekali. Kalau cancel duit yang dah bagi dia simpan. Apa logik kedai macam ni? PENIPU.

      Cina sendiri pun tak pergi ke Kota Raya untuk beli HP…. Peniaga di sana ada naungan kongsi gelap punya. Di Singapura, penipu di Sim Lin Square telahpun dipenjarakan. Walaubagaimanapun, penggunaan kekerasan seperti ditunjukkan dalam video clip ini adalah amalan tidak baik

        People always believe they are too smart to get conned, and when they find an unbelievable cheap deal, they have a sense of achievement, but fail to see that they are actually the main reason y they get conned. Of course, I’m not siding the shop that cons people. I would rather take action that are detrimental to that shop and not to myself. In a refusal to admit their own stupidity and ignorance, they gang up and find a reason to justify their act, and ultimately make it a racial issue. To say that the Chinese are “penipus” shows how immature people are. If thats how u want to see other msian as “penipus” by all means boycott them….but i can 100% tell u, u will fail

Sayapun juga pernah ditipu duly,nak beli Samsung tab,cakap harga rm350, lepas tuh suruh sign tuk buat plan lepad sain disuruh bayar lagi sampai RM 1840, pendek cerita bayar sampai 3 bulan,day bayar sesuai masa tempoh malah dibagi china tab yang harga dibawah rm500, so padamlah muka kalao ada Yang naik angin

    It is definitely the problem with the seller if he is cheating the buyer with that “trick”. Of which should be punished!!! … but yet still, why you wanna buy from these kind of stalls when there are other options (authorized dealers) … before you buy, you should have also checked the prices around … and it is common sense for not paying until u get what u buying, grab hold on the phone and test … why pay to him when he just asking you to sign …

    In other words, errant traders should be punished for their misdeed… buyers should be wiser when purchasing tech gadgets, look for authorized dealer and get the original product… Those who involved in the brawl should be penalized too … put them to probation service and serve the community for 6 months.

    End of story … nothing about race!

    Finally the authorities have any eye on this damned cp dealers.i was among thier victims back in 2013.a modern waybof holdup.they take my 1mo.old samsung to trade with galaxy tab.and 300rm as deposit.after some explanation contrary from d first agreement i was not dismayed and wanted to cancel the transaction but they told me i already signed the agreement.due to time constraint(next day my flight schedule bk to PI),i was not able to complain.i feel cheated and throw a curse to every sellers that offered “half price”and best offer”.i hope that the authorities will do a firm action to address this problem.
