Interfaith group: Why no national security policy in NSC Bill?

The drafters of the recently-passed National Security Council (NSC) Bill seem to have neglected to include a requirement for a national security policy, an interfaith religious group said.

“It (NSC Bill) has over-focused on empowering the prime minister and the drafters of the Bill appear to have completely forgotten to require the NSC to produce a national security policy.

“It is understood that the government has not produced any document on national security policy until today,” said the Malaysian Consultative Council of Buddhism, Christianity, Hinduism, Sikhism and Taoism (MCCBCHST) in a statement yesterday.

The statement was signed by six office-bearers of the group, that is Venerable Jit Heng, RS Mohan Shan, Bishop Sebastian Francis, Sardar Jagir Singh, Daozhang Tan Hoe Chieow and Prematilaka Serisana.

If the NSC Bill is not suspended and a national security policy is not produced, they suggested that the NSC be expanded to include representation from other BN component parties.

This should also include ministers from Sabah and Sarawak so that the national security policy is inclusive of all interests, they said.

BN strategic communication director Abdul Rahman Dahlan deserves to be sacked for his tweet about a bomb explosion in Kuala Lumpur, said an opposition leader.

Describing the tweet as “shockingly insensitive”, Lim Kit Siang said a “strict and no-nonsense” prime minister would have given the minister the marching orders for using such an example to justify the National Security Council (NSC) Bill.

The DAP leader also dismissed Abdul Rahman’s defence of the proposed legislation, which he termed as “monstrous and pernicious”.

“Firstly, the bill confers wide and untrammeled powers on the prime minister and National Security Council headed by him not only to deal with extraordinary situations arising from a bomb blast, but also more mundane circumstances having bearing on ‘political stability, economic stability, national unity’.

“How does Abdul Rahman’s ‘bomb explosion’ argument apply in these cases?” he asked.

Secondly, Lim said even in extraordinary situations such as those arising from a bomb blast, if ordinary police and security forces are incapable of dealing with the exigencies of the situation, Article 150 of the Federal Constitution on the proclamation of emergency by the Yang di-Pertuan Agong can be invoked.

“Why should there be a new law in the form of the National Security Council Bill which usurps the powers of the Agong and cabinet in such circumstances?” he asked.

Adding more ingredients into his cocktail of criticism such as “deplorable” and “reprehensible”, Lim flayed Abdul Rahman for displaying a “cynical and sadistic” attitude.

“As if he would not mind seeing a bomb blast in Kuala Lumpur when all Malaysians must be united in ensuring that peace and harmony prevail throughout the country….

“Abdul Rahman should apologise for such an insensitive and outrageous tweet, which is most unbecoming of a minister,” he said.

Critics of the National Security Bill will likely change their minds if Kuala Lumpur is bombed, said cabinet minister Abdul Rahman Dahlan.

“If a bomb exploded in KL, then perhaps you guys would have a different view. But sadly that would be too late,” he said on Twitter.

He was responding to Twitter user Rais Hussin who told the minister that the bill affords powers which could be easily abused by the prime minister.

Security law won’t be used against critics and politicians, says Paul Low

Asked about potential abuse as claimed in the use of other laws like the Security Offences (Special Measures) Act (Sosma), as well as the possibility of powers under the NSC law being used against civil society rallies such as Bersih, Low said: “Personally, I don’t think so. If you want to gain the trust you don’t use it in that way, they don’t have to worry.”

The National Security Council Bill will not be used against government detractors and politicians, Minister in the Prime Minister’s Department Datuk Paul Low said today, adding that criticism against the bill was because of the trust deficit towards Putrajaya.

“We do recognise we must gain the trust of the people because there are issues, new powers that are given to government which (are) necessary, but how they use these powers, it will depend.

“Unless they are terrorists, but using against dissidents? No, I don’t think so,” he told reporters who questioned him on the use of the bill which the opposition and civil society fear gives the prime minister wide-ranging powers in security issues.

Low said the law would only be used for acts of terror but added that the government had to work on addressing the people’s trust deficit.

Low said critics and opposition politicians should not worry about potential abuse of power by the NSC bill when it became law as it was created specifically for security issues, citing the Lahad Datu incursion in Sabah on 2013.

“We are talking about insurgency. We are not talking about piracy or ad hoc terrorism that can be dealt with by other acts.

“And I believe for Malaysia, we don’t like to see good lives lost, so at times for certain areas, the act says you need to declare a security zone, to impose curfews, because at that time you are fighting an enemy, a non-state actor.”
