ROS declares elected DAP central leadership legal

The existing DAP central executive committee (CEC), the election process for which has been disputed by the Registrar of Societies since December 2012, has now been declared legally elected.

This follows the ROS announcing in the High Court in Kuala Lumpur today the withdrawal of its holding of the recognition of the party’s CEC.

Following this, the CEC which was re-elected on Sept 29 last year, “may carry out all its functions and duties”.

The matter came up before Justice Zaleha Yusof, who recorded the settlement of the judicial review application that was initiated by the DAP.

Settlement statement by DAP and ROS in the DAP legal suit against ROS on the legality of the DAP CEC on 23 September 2014:

There are three parts of concern in the letter of the ROS to DAP Secretary General Lim Guan Eng dated 6.12.2013.

The first relates to a request for documents under s14 of the Societies Act 1966. There is no problem with this request. The DAP has complied with it and will continue to assist the ROS in any queries it has relating to the affairs of the DAP.

The second relates to a statement made by the ROS in the said letter to the effect that the ROS is yet unable to recognize the re-election of the CEC of the DAP on 29.9.2013 and;

The third relates to advice given to Lim Guan Eng that the new CEC which “belum disahkan” cannot make decisions for and on behalf of the DAP until further notice from the ROS.

The ROS now takes the position that those statements do not amount to any decision in law. As such, those orders are not legally binding and remain merely advice to the DAP and the ROS recognises that the DAP CEC elected on 29.9.2013 may carry out all its powers, functions and duties in the administration of the daily affairs of the DAP in accordance with the Constitution of the DAP.

 A LETTER FROM LIM KIT SIANG

March 18, 2013 had been the most heart-rending day in my life, the day when the Registrar of Societies dispatched a letter to the DAP to knock out the Rocket symbol from the 13GE, with the Nomination Day less than 48 hours away, completely without any legal basis or plausible ground.

I was not the only one to shed tears yesterday as all over the country, many DAP stalwarts and supporters who are Malaysian patriots whose home and sole object of loyalty is Malaysia and do not know or recognize another country as their motherland, also cried at the injustice, oppression and iniquity of the ROS action , clearly at the behest of the political masters in UMNO/Barisan Nasional.

The ROS action, on the directive of the political masters in Putrajaya, to knock out the Rocket symbol from the 13GE is the most dastardly, oppressive, undemocratic and dishonourable acts of the 56-year Umno/Barisan Nasional rule, an act no Malay gentleman-political leaders like Dato’ Onn Jaffar, Tun Hussein Onn, Tunku Abdul Rahman, Tun Ismail, Tun Razak would would have countenanced or be a party to as it runs against the very grain of civility and being a gentleman or Jun Zhi.

MCA’s crocodile tears

Now, we have the MCA President shedding crocodile’s tears, asking that the DAP should be allowed to use the Rocket symbol in the 13GE. I will not be surprised if the MCA leadership is the main culprit behind the RoS decision, appealing for help from the UMNO “Big Brother” to give a fatal blow to DAP, in the same way that the MCA leadership had surrendered Gelang Patah seat to UMNO so that Johor Mentri Besar Datuk Ghani Othman could be fielded to “kill” me in Gelang Patah.

NEXT VICTIM OF BN CHEATING: Tian to be ‘suddenly’ disqualified by EC tomorrow?

KEADILAN intends to re-nominate Vice President Tian Chua (Chua Tian Chang), incumbent Member of Parliament (28 April 2008 – 3 April 2013) to stand as a candidate in the parliamentary seat of Batu (P115), Wilayah Perseketuan.

KEADILAN takes the view Tian Chua is well qualified to stand as a candidate notwithstanding a RM2000 fine meted out to him in an earlier criminal prosecution arising out of a public assembly. In the High Court judgement by Justice Haji Ghazali Cha, he decided categorically that Tian Chua was NOT disqualified.

On Monday, 15 April, Tian Chua’s lawyers submitted a letter to the Election Commission (EC) to ask them to confirm categorically in writing Tian Chua is not disqualified to stand in Batu. The letter also requested a meeting on Wednesday 17 April 2013 at 10 am.

On Wednesday, Tian Chua, together with his lawyers met with the Legal Advisor to the EC, En Mohd Azhar bin Mohd Yusoff, and were told that the matter was still being discussed and a response would be sent later.

Why no written until NOW?

Today PKR has received verbal confirmation from En Azhar that the RM2000 fine handed out to Tian Chua by Justice Ghazali Cha does not disqualify him. The EC will abide by the ruling made by the said High Court Judge. En Azhar has also confirmed that the position taken by the EC is after receiving legal advice from the Attorney General’s Chambers.

However KEADILAN has still not received the above confirmation from the EC in writing. If it is still not received in writing by 2 pm Friday 19 April, then we will have no option but to conclude that there is an intent to prevent Tian from submitting his nomination papers.

The party will review the situation and respond accordingly.

Opposition Leader Anwar Ibrahim called on Chinese voters not to be tricked by Prime Minister Najib Razak’s  “dirty politics”, accusing the ruling Umno-BN coalition of trying to cheat by making it impossible for the DAP to use its Rocket logo in coming general election.

He also advised the DAP, one of the 3 Opposition parties that make up the Pakatan Rakyat coalition, not to be demoralized but to continue to fight even it if it meant having to contest under the logos of the other 2 Pakatan parties – PKR and PAS.

“Umno-BN is not making sense.  Saturday is nomination day and today, suddenly they are saying DAP cannot use the Rocket. I told YB Lim Kit Siang not to worry.  Tuan Guru Nik Aziz has already said use the Moon (PAS logo), use Keadilan (PKR logo),” Anwar told a packed political rally at Wangsa Maju on Thursday night.

“Do you think the Chinese are afraid of using the Moon? Do you think they are afraid of Keadilan. Let’s teach them a lesson.”

Anwar also warned Umno-BN leaders that to poke fire in such a way would only backfire.

“What type of politics is this? Politics is for agenda, manifesto, policies. I say to DAP, if you can use the Rocket, use the Rocket, if you have to use Keadilan, use Keadilan, if you have to use the Moon, use the Moon. But fight we must, fight we must,” said Anwar to thunderous applause.

ROS letter brings Kit Siang to tears

“I must confess that I have shed tears.”

That was DAP veteran Lim Kit Siang’s response on how he felt about the prospect of not being able to contest under the “rocket” logo for the first time in his political career.

“That is how deeply I feel about it,” he added.

The Registrar of Societies (ROS) has sent DAP a letter yesterday evening informing the party that the current central executive committee was not recognised, pending a probe on a “technical glitch” over its election results.

This meant that authorisation letters to use the party logo by the party secretary-general to candidates for nomination day, were invalid.

Although the ROS and the Election Commission (EC) assured that this was not the case, the party is not taking chances and demanded that the ROS retract the letter first.

Unless the letter is revoked by 3pm tomorrow, DAP secretary-general Lim Guan Eng said that the party would be be using PAS’ logo in Peninsula Malaysia and PKR’s logo in Sabah and Sarawak.

DAP is resorting to this to avoid standing as independents in the event the ROS deregisters the party. The EC however says DAP can contest under its own banner.

KUALA LUMPUR:  DAP today decided that its candidates would stand under the PAS and PKR banners in the event they are not recognised by the Election Commission due to an ongoing investigation by the Registrar of Societies.

Speaking to reporters today, DAP secretary-general Lim Guan Eng said the party had obtained approvals from PAS and PKR for this purpose.

“I have discussed with (PAS secretary-general) Mustafa Ali and he is allowing us to use their moon. (PKR secretary general) Saifuddin Nasution Ismail has come to a same conclusion. We will ratify this at our CEC meeting today.

EC deputy chairman Datuk Wan Ahmad Wan Omar however believed that the DAP can still use the Rocket logo.

“Can use their logo because the problem with RoS is not a problem of deregistering the party. The only problem is that RoS did not recognise the CEC,” he told The Malaysian Insider over the phone.

“So the DAP leadership needs to meet with RoS whether today or tomorrow to resolve this problem and get an explanation as to which CEC list the RoS recognises,” he added.

KUALA LUMPUR, April 18 – The Registrar of Societies’ (RoS) decision not to recognise the DAP’s office bearers means one thing, no one can authorise its candidates to use the party’s recognisable Rocket logo and force them to run under allies PAS’s full moon or PKR’s eye logos.

This ruling is likely to affect DAP candidates’ chances in the 49 federal seats and slightly more than 100 state seats in the May 5 general elections as most of the contests are in Chinese-majority areas where the Rocket is popular but not the other logos.

“The RoS decisions means that no party officials is recognised as officials by the authorities. So, they can’t authorise the candidates to use party symbols,” a DAP official told The Malaysian Insider.

He said the party’s top officials are still discussing their options now although the Election Commission (EC) has said the Rocket logo can be used.

“We have to see the implications of this decision,” he added.

DAP will be able to field candidates as usual on nomination day, regardless of the Registrar of Societies’ (ROS) decision to suspend the party’s central committee.

This was confirmed by Election Commission (EC) chairperson Abdul Aziz Mohd Yusoff this afternoon.

NONE“It will not affect, they can contest,” Aziz said in a text message reply to Malaysiakini.

Abdul Aziz was asked on the ROS letter citing the suspension of DAP’s central committee , whether it would affect the party in placing its candidates in this election.

The ROS has just informed the DAP that it does not recognise the party office bearers elected late last year, following to a technical glitch in the tabulation of votes.

In view of this, the ROS ordered the DAP central committee to be frozen until its investigations are completed.

A copy of the ROS letter to DAP was sent to the EC.

Just two days to nomination day, the Registrar of Societies (ROS) has apparently sent a letter to DAP informing the party that ROS does not recognise DAP’s central executive committee (CEC).

DAP is expected to converge an emergency meeting 3pm today as it scrambles to deal with the repercussions of the ROS’ decision, and will most likely call for a press conference an hour later.

Party secretary-general Lim Guan Eng refused to comment further on the matter when asked during a press conference to announce its Selangor candidacy list at DAP headquarters in Kuala Lumpur.

Other DAP leaders, when contacted by Malaysiakini, confirmed receiving a letter from the ROS, but did not specify as to its content.

The letter, dated yestersay and supposedly by the ROS, is being circulated on the Internet. However, its authenticity has yet to be verified by DAP or ROS.

If true, this could tantamount to a major blow to DAP’ preparations for the coming May 5 general election, touted to be the tightest in Malaysian political history.

As of now, it is also unclear if this would affect the party’s candidates’ use of the DAP logo on nomination day.
