Four DAP leaders file defamation suit against Azwanddin

Finance Minister Lim Guan Eng and three other DAP leaders filed a defamation suit against Jaringan Melayu Malaysia (JMM) president Azwanddin Hamzah over allegations of purported anti-Malay agenda under the Pakatan Harapan administration.

DAP Secretary-General Guan Eng, his Finance Ministry political secretary Tony Pua, senior party adviser Lim Kit Siang and Deputy Defence Minister and Johor party chief Liew Chin Tong are suing Azwanddin (photo)  over a Youtube video titled “Ucapan Penasihat Gagasan Tiga Dato Azwanddin Hamzah” uploaded on Nov 21 last year.

The four plaintiffs, through legal firm Messrs Karpal Singh & Co, filed the Writ of Summons at the Kuala Lumpur High Court Registry on Sept 6.

Jaringan Melayu Malaysia president Azwanddin Hamzah today apologised in open court for statements against Minister in the Prime Minister’s Department P Waythamoorthy during a rally last year and agreed to pay RM90,000 in compensation.

Azwanddin (on left in photo above) had during the Christmas Day rally in Klang last year, among others, used the word “p****h”, a word deemed derogatory by the Indian community, on Waythamoorthy.

Waythamoorthy subsequently filed a defamation suit against Azwanddin in the High Court in Kuala Lumpur.

The hearing for the defamation suit was due to start today before judicial commissioner Rohani Ismail but both parties agreed to a settlement before proceedings began.

As part of the settlement, Azwanddin also agreed to publish an apology in Berita HarianMakkal Osai and on his Facebook page.

As for the payment of RM90,000, it must be made within 30 days via a bank draft or by online banking.

The terms were recorded as consent judgment at the High Court in Kuala Lumpur.

Waythamoorthy, who was present in court, later told journalists that he hopes the matter will now be brought to a close.

“I suppose it has come to an end, after almost one year.

“He has apologised and agreed to the terms and the matter is closed,” he said.

Waythamoorthy was represented by lawyers Annou Xavier and Tristan Ng while Azwanddin was not represented as his lawyer had been discharged.

The rally last year was intended for the late firefighter Muhammad Adib Mohd Kassim, who succumbed to his injuries on Dec 17 last year after being attacked by rioters near the Seafield Sri Maha Mariamman Temple in Subang Jaya a month earlier.

Organisers of the rally had criticised Azwanddin for his controversial speech in blaming certain government leaders for Adib’s death.

Teresa Kok gets nod to cite Malay rights group leader for contempt

KUALA LUMPUR: The High Court here has allowed Primary Industries Minister Teresa Kok to begin contempt proceedings against a Malay rights group leader for failing to honour an out-of-court settlement in a defamation suit against him.

Judge Rohani Ismail gave Kok the green light to cite Azwanddin Hamzah after allowing her an ex-parte application to initiate proceedings for showing disrespect to the court.

Lawyer SN Nair said the application was filed last week as Azwanddin, who is president of Jaringan Melayu Malaysia, had not fulfilled the terms of settlement for the defamation action which did not go to trial.

“A hearing has been fixed on Oct 21, and Azwanddin can now participate in the proceeding,” he told reporters after the judge gave the order in chambers.

On July 29, Kok settled her suit against Azwanddin regarding his claim at a gathering for fireman Muhammad Adib Mohd Kassim that she was involved in the land dispute over the Seafield Sri Maha Mariamman temple.

Nair told reporters then that the case would not go on trial as both parties had settled the suit by way of consent order, with Azwanddin to pay Kok an undisclosed sum of money.

The lawyer said his client was forced to return to court as Azwanddin failed to comply with the court order within 45 days of the settlement.

He said an apology was also recorded before Rohani in her chambers.

Under the court’s consent order, he said, Azwanddin must publish an apology within a week in three newspapers: The Star, Sin Chew Daily and Sinar Harian.

He must also retract his statement about Kok which he made on social media.

Kok filed the suit in January, saying Azwanddin’s allegation was baseless.

She said she was never involved in the temple riots which took place in November last year, and that Azwanddin’s statement was “clearly motivated by bad motive and malicious intentions”.

She sought an unspecified amount of damages as well as an injunction forbidding Azwanddin or his agents from repeating the statement in question.

KUALA LUMPUR: The defamation suit filed by Deputy Defence Minister Liew Chin Tong against Jaringan Melayu Malaysia (JMM) president Datuk Azwanddin Hamzah has been settled out of court.

Liew filed the suit defamation suit against Azwanddin on Dec 27 last year (2018) following Azwanddin’s Facebook posting alleging that Liew intentionally wore a “communist uniform” to a military event.

The post is said to have been uploaded on Oct 30 last year and contained an image accompanied by Azwanddin’s remarks.

The RM20mil suit also mentioned an article Azwanddin wrote on Nov 19 last year titled “Kementerian Pertahanan Kini Berada Dalam Tekanan Dan Ancaman” (The Defence Ministry is under pressure and threat).

When met outside the court, Ramkarpal who was representing Liew said that Azwanddin had apologised for the posts.

“The defendant (Azwanddin) has expressed his apology and has stated that the allegations made by him in the postings were without basis and untrue,” he said.

He added that among the terms was that Azwanddin had to publish his apology in six publications, including The Star Online, within 14 days.

Azwanddin also had to pay RM40,000 to Liew within 90 days from Wednesday (Aug 28), he said.

“The defendant is also prohibited, via his own self, an agent, or his employees, from expressing, writing, or publishing speeches or words that are deemed defamatory as stated in the statement of claim dated Dec 27,2018,” he added.
