Disciplinary action for Perak cops who stopped Orang Asli from lodging report

Perak criminal investigation department chief Datuk Goh Kok Liang today said police had no powers to stop members of the public from lodging police reports.

Police in the state have also opened an investigation into the complaints by Orang Asli villagers who were initially turned away when they attempted to lodge a report.

Goh said the state contingent would mount disciplinary investigations if any wrongdoing or breach in conduct was found, following a report lodged against Gerik police by Temiar Orang Asli in Kampung Sungai Papan Gerik on Tuesday.

“Gerik police were notified and opened a report for the case after a report was lodged in Subang Jaya at 11.45pm on Tuesday,” Goh said in a statement today.

Police probe gun fire incident in Grik

IPOH: Police are investigating an incident where a state assemblyman allegedly fired shots into the air at the Sungai Papan Orang Asli settlement in Grik on Jan 19.

Perak CID chief SAC Datuk Goh Kok Liang said the case is being investigated under Section 39 of the Firearms Act 1960.

He also said that a probe will be conducted if there are elements of abuse and indiscipline following allegations that police at Grik station refused to accept a report on the incident.

It was reported that Kenering assemblyman Datuk Mohd Tarmizi Idris had visited a water tank project in the village on that day.

The Orang Asli there claimed he took a pistol from his bodyguard and fired a shot into the air.

They also alleged Grik police refused to accept their report on the incident and eventually the community lodged a complaint with the disciplinary section of the Bukit Aman police headquarters on the matter on Tuesday.

They lodged the report on their third attempt after the police personnel refused to accept the report on the first two occasions.

According to Anjang Aluej, who represents the community, they were threatened with abusive language and discriminatory words.

The Orang Asli also claimed that they were not given a copy of the report.

KUALA LUMPUR: Frustrated with being given the runaround by cops when all they wanted to do was lodge a report about a violent assemblyman, a group of Orang Asli decided to bring the matter directly to Bukit Aman instead.

Speaking on behalf of the five was Jaringan Orang Asal SeMalaysia (JOAS) lawyer Shashi Devan, who said their report over the alleged misconduct was lodged with the police’s disciplinary division.

Shashi explained the five wanted to lodge a report against Kenering assemblyman Tarmizi Idris after he fired a pistol into the air during a visit to Kampung Sungai Papan, where he was following-up on aid applications for the Temiar community in the village.

He said the five from the tribe went to the Gerik police station but were directed to lodge their report elsewhere. “The policeman at the guardhouse turned them away and asked them instead to lodge a report at the Umno office, the party which Tarmizi represents,” Shahsi told reporters.

Meanwhile, Shashi said Bukit Aman police assured them they would look into the matter and conduct a separate investigation on the alleged firing of shots by the assemblyman.

Police in Perak allegedly refused to accept a police report by Orang Asli residents after an assemblyperson allegedly fired a pistol into the air during a dispute with the community.

Lodging a report against the police officers at Bukit Aman today, the complainants said the assemblyperson fired the pistol at their village at Temenggor, Perak.

The assemblyperson was allegedly upset that representatives from opposition parties had visited the community, the complainants said.

The pistol allegedly belongs to the assemblyperson’s bodyguard, the complainants said.

The complainants – Anjang Aluej, Jekeh Senangoh, Mohammad Lokman Jali, Muhamad Ghazali Jali and Ramli Aluej – lodged the report with the police disciplinary division.

“We are unhappy with the Perak police’s conduct. We only wanted to lodge a police report because what the assemblyperson did was criminal.

“Instead, we were threatened and verbally abused by the police,” the complainants said in their report to Bukit Aman today.

They said they tried to lodge reports three times at the Perak police station last week.

After being barred by Perak police from lodging a report, a group of Temiar Orang Asli from the state filed a complaint with the police disciplinary board at the Bukit Aman police headquarters in Kuala Lumpur today.

One of the Orang Asli, Anjang Aluej, said the villagers from Kampung Sungai Papan had wanted to lodge a report against an assemblyman for firing his gun into the air while on a visit to their village on January 19.

The assemblyman had gone to the village to observe the installation of a generator and had fired the shot without any provocation.

Five villagers, including three witnesses to the incident, then went to lodge a police report but were turned away at the Gerik police station and again at the Lenggong police station.

Anjang told reporters at Bukit Aman today that the Orang Asli were harassed and threatened with arrest.

“One officer said to me, ‘you are still young. Don’t follow in the footsteps of (those who are in lock-up). Do you want to go in? I can arrest you today. If I follow my heart, I will kick you in immediately’.”

He said the group felt it had no choice but to lodge a complaint with the police headquarters.

The Orang Asli today said that during the visit, the assemblyman had been accompanied by two bodyguards who were not in uniform. While there, he decided to look at a new water tank and became angry when he discovered it was installed under a project that involved opposition party DAP, Anjang said.

“Suddenly there was a gun in his hand and he fired a shot. I was frightened, we live in a kampung so I have never heard a gunshot before,” said villager Mohammad Lokman, who was a witness of the scene.

The assemblyman was also overheard saying as he walked back to his car, “Whose dog is this? I want to shoot”.

The assemblyman then put the pistol in his pocket and entered his car.
