KOTA KINABALU — A Johor prince’s suggestion that the state could leave the federation sparked new discourse on secession, but the nebulous definition of the subject under the Sedition Act 1948 has left the public in doubt of what can and cannot be said.
While Johor crown prince Tunku Ismail Sultan Ibrahim was overt in his remarks, others navigated carefully around the topic, whose inclusion under the colonial-era law was reinforced through amendments to the Sedition Act this year.
But despite the decision to “make clear” that seeking a state’s withdrawal from the federation was a crime under the Sedition Act, the government has left the exact definition of actions that could be construed as demanding secession open-ended.
Lawyers for Liberty executive director Eric Paulsen, who is personally under multiple sedition charges, said the ambiguous nature of the Sedition Act meant that whether a particular discourse on secession is seditious may be determined arbitrarily by the authorities.
“It is too unclear to define; we are looking for answers that cannot be given. Secession may not fall under seditious tendencies but, ultimately, it is up to the Attorney-General’s Chambers to decide,” he told Malay Mail Online.

Sabah-based civil liberties lawyer Tengku Fuad Ahmad took the position that talk of secession per se is not seditious or capable of having seditious tendencies, basing this on the fact that the Federal Constitution protects an individual’s freedom of speech and expression.

KUALA LUMPUR — The Federal Constitution does not provide for the secession of any state from Malaysia but legal experts are torn over what this means, following a Johor royal’s suggestion that the state’s place in the federation was not immutable.
Constitutional law practitioner New Sin Yew also stressed that the Federal Constitution does not specifically address the topic of secession one way or another, and that constitutional amendments were not impossible.
“Secession (in this case) is more political than legal,” he told Malay Mail Online when asked to comment on Johor crown prince Tunku Ismail Ibrahim’s recent remarks about the state’s right to secede from Malaysia.
“Because it is silent in the Federal Constitution, unlike in Sabah where it specifically mentions in the Malaysia Agreement that it (the state) cannot secede,” he said, referring to the 20-point memorandum signed between Malaya and Sabah for the formation of Malaysia in 1963.

Nur Jazlan: Johor crown prince talking about football, not secession
KUALA LUMPUR, Oct 18 — Tunku Ismail Sultan Ibrahim’s remarks were twisted to suggest he was saying that Johor was entitled to leave Malaysia, Deputy Home Minister Datuk Nur Jazlan Mohamed said.
According to a report by Malay language daily Sinar Harian, Nur Jazlan said the Johor crown prince was only speaking about football in the original interview published at FourthOfficial, which formed the basis of subsequent reports.
“The prince gives his view on the current football scene but his statements were manipulated by several media, especially on news portals,” Nur Jazlan was quoted as saying in the local Malay daily.
“I have read the original source and found the Johor prince was not referring to said matter (secession) and he did not touch on the Federal Constitution.”

For Johor crown prince Tunku Ismail Sultan Ibrahim, his state comes before Malaysia and therefore is unperturbed about the impact of his messages on social media.
“I am going to be the future Sultan of this state and my main responsibility goes towards the people of Johor. Malaysia is important to me, but Johor and JDT (state football team) will always come first.
“People deserve to know, that the mess we have in the country right now, should in no way be associated to the Johor royal family.
“Over the years, we’ve always been strong and independent as well as resourceful,” he said in an interview with sports publication Fourth Official, which was reproduced on the Southern Tigers Facebook page.
Tunku Ismail also pointed out that Johor joined the Federation of Malaya after both parties agreed to several basic terms.
“And if any one of those terms are breached, we have every right to secede from this country.
“You can accuse me of instigating state-based sentiments, but to me, I’m merely doing my duty to the people of Johor, and reminding them of the history and heritage behind this great land,” said the crown prince, who apart from his father, cited Fidel Castro as his biggest idol.
Castro, he added, might have been a Communist, but the former Cuban leader earned the prince’s respect because he stood for the principles he believed in.

Responding to Johor crown prince Tunku Ismail Sultan Ibrahim, who warned that Johor had every right to secede from the country if any of the terms in the agreement between Johor and the Federation of Malaya were breached, Mr Nur Jazlan said he respected the prince’s personal view.
However, the Pulai lawmaker said 60 years of effort to unite Malaysia should not be hampered by state-based sentiments, which could jeopardise the country’s harmony.
“We have managed to develop as a nation over the years despite our former colonisers predicting that we would fail because of our multi-ethnicity and multi-religious background.
“Living harmoniously is part of Malaysia’s pride. If such a thing happens (Johor secedes), even Sabah and Sarawak might want to follow Johor’s footsteps,” he was quoted as saying in the English daily’s report.

- There is still a little ambiguity on the whole “Johor can secede from Malaysia” thing, and while the experts claim that Johor cannot leave Malaysia, it is not entirely impossible.How?Well, similar to the 2014 Scottish Independence Referendum, the Sultanate of Johor may simply ask the people of Johor what they really want in a Johorean Independence Referendum. However, there is no formal word on it from the Johor government.
