The US has added Alibaba and Tencent to its “Notorious Markets List” of companies alleged to be involved in either selling counterfeit goods, or facilitating in the sale of them, the US Trade Representative’s office has said.

In a nutshell

The US Trade Representative’s office began its “Notorious Markets List” in 2006 with the aim of protecting American businesses from the impact of counterfeit products made outside the US.

Being included on the list does not carry any penalties, however it may be considered damaging to the reputation of the companies.

The list currently identifies 42 online sites and 35 physical stores that the two companies own that “engage in or facilitate substantial trademark counterfeiting or copyright privacy”.

US Trade Representative Katherine Tai said in a statement to the BBC that, “The global trade in counterfeit and pirated goods undermines critical US innovation and creativity and harms American workers,” adding that the companies are “two significant China-based online markets that reportedly facilitate substantial trademark counterfeiting”.

The companies, Baidu Wangpan, DHGate, Pinduoduo, and Taobao, as well as nine other physical markets “known for the manufacture, distribution, and sale of counterfeit goods,” are also part of the list.

Tencent has also disagreed with the measure releasing a statement where they said they were, “committed to working collaboratively to resolve this matter.”

The Alibaba group has said they will continue working with governments to address concerns regarding intellectual property protection on the sites that it controls.
