Graphic designer pleads not guilty to charge of insulting Johor Sultan

BATU PAHAT: A graphic designer yesterday pleaded not guilty at the Session Court here to a charge of insulting the Sultan of Johor Sultan Ibrahim Sultan Iskandar by showing a vulgar sign with his right hand.
Md Aris Husin, 40, made his plea after the charge was read to him in front of Judge Azuar Che Yusof.
He was accused of insulting Sultan Ibrahim by showing a vulgar sign using the middle finger of his right hand at KM95 of the North South Expressway at about 11.20am on December 20.
He was charged under Section 509 of the Penal Code for a word or gesture intended to insult the modesty of a person.

In what was believed to be the first case of its kind in the state, a 40-year-old man was arrested by police for showing a threatening and vulgar hand sign to the Sultan of Johor’s motorcade convoy along the North-South Expressway (NSE) yesterday.

The incident occurred when the state ruler Sultan Ibrahim Sultan Iskandar and his convoy was returning to Johor Baru after visiting the royal town of Muar at 11.20am along Km 95 (south-bound) of the expressway.

Johor police chief Datuk Wan Ahmad Najmuddin Mohd confirmed the incident and arrest of the suspect.

“The suspect is under police custody and will be investigated under Section 506 and 509 of the Penal Code for criminal intimidation and words or gestures intended to outrage the modesty of a person,” he told The Rakyat Post when contacted today.

It was learnt that the suspect, who was in a Perodua Viva car at that time had lowered his window and showed a fist and also a lewd sign at the passing royal convoy.

The suspect’s “disrespectful” behaviour was witnessed by Sultan Ibrahim who promptly ordered his royal security chief to take action.

Police then stopped the suspect in his car before arresting him.

The suspect and his car were then brought to the Ayer Hitam police station where his statement was recorded.

The suspect also underwent a urine test, but was negative for narcotics abuse.

‘Do Malaysians have to make way for VIP motorcades?’

KUALA LUMPUR: Do you really have to give way when a VIP motorcade is coming through?

This was the subject being hotly debated by Malaysians today after a road user, whose posting about him not giving way to a VIP’s convoy, went viral on social media.

Legal expert Datuk Jahaberdeen Mohamad Yunos opines that there is no such law stating that motorist are obliged to give way when VIPs pass by on the road.

However, he said the situation has to be examined on a case by case basis.

“We have to look at the situation in order for action to be taken. If the VIP concerned is going for an official meeting and the stationary motorist is preventing him from conducting his job, then yes, he (the motorist) can be forcibly asked to move” he said.

“But if the VIP is using the road in his personal capacity, then the motorist is not obliged to move and give way to him,” said Jahabardeen.

The lawyer’s comment followed a Facebook posting by user Fadzil Khairi, who related an incident that occurred while he was on his way to Sri Petaling recently.

Asked on whether any action would be taken against the motorist over his posting, KL traffic chief Asst Comm Mohd Nadzri Hussain declined comment.

He said he would have to verify the situation first before commenting on the issue.

IGP: Refusal to yield to police-led VIP convoys against the law

PUTRAJAYA: Road users who defy police instructions, particularly when asked to give way to VIP convoys, can be penalised under the law, says Tan Sri Khalid Abu Bakar.

The Inspector-General of Police said failure to follow instructions could result in road users getting penalised under three laws.

He added that such action could be considered an offence under the Police Act, Road Traffic Act and the Penal Code for obstructing a civil servant from carrying out his duties.

“There have been discussions encouraging the public to defy police, particularly on the road while escorting VIPs.

“VIPs are escorted mainly for safety reasons,” Khalid told reporters at the Putrajaya International Convention Centre on Saturday.

Khalid also lashed out at an unnamed news portal for allegedly encouraging lawlessness by “telling people not to obey police instructions”.
