Prosecution withdraws appeal against Tian Chua’s sedition charge acquittal

PUTRAJAYA: The prosecution today withdrew its appeal against Batu member of parliament Tian Chua’s sedition charge acquittal.

Court of Appeal Judge Datuk Tengku Maimun Tuan Mat who chaired a three-member panel, struck out the appeal after deputy public prosecutor K. Mangai informed the court that the prosecution had withdrawn its appeal against Tian Chua.

The other two judges on the panel were Justices Datuk Ahmadi Asnawi and Datuk Zabariah Mohd Yusof.

With this development, Tian Chua or Chua Tian Chang’s acquittal remains. The Court of Appeal is the last avenue for the prosecution to appeal as this case had originated from the Sessions Court.

On March 2, this year, the Kuala Lumpur High Court upheld the Sessions Court’s decision to acquit Tian Chua of sedition after rejecting the prosecution’s appeal.

Judicial commissioner Datuk Nordin Hassan ruled that the prosecution had failed to prove that Tian Chua had uttered seditious words in regard to the Lahad Datu intrusion, in a news portal article.

On Nov 14, 2014, Sessions Court judge Norsharidah Awang discharged and acquitted Tian Chua, 52, without calling for his defence.

Tian Chua was accused of sedition by stating that the intrusion in Lahad Datu was a conspiracy planned by Umno to divert attention and to frighten the people.

He was alleged to have committed the offence at Fraser Business Park, Jalan Metro Pudu, off Jalan Yew here around 11 am on March 1, 2013.

Activist Hishamuddin Rais found guilty of sedition

Social activist and former journalist Hishamuddin Rais is the latest in the post GE13 sedition crackdown to be found guilty of sedition.

This follows the Kuala Lumpur Sessions Court today expressing satisfaction that the prosecution has successfully proven it’s case beyond reasonable doubt.

“The accused did not deny he uttered the statement asking people to take to the streets to protest and bring down the BN government,” said the judge Azman Mustafa

Hishamuddin was charged with sedition over a remark made at the Kuala Lumpur and Selangor Chinese Assembly Hall between 8.55pm and 11.15pm on May 13, 2013.

To date student leaders Adam Adli Abdul Halim and Mohd Safwan Anang have been found guilty of sedition by the KL Sessions Court in a similar talk held at the Kuala Lumpur Selangor Chinese Assembly Hall in May 2013 following the conclusion of the 13th general election.

An MCA leader reminds Ikatan Muslimin Malaysia (Isma) president Abdullah Zaik Abdul Rahman’s wife that extremists cannot be community heroes.

Ong Chong Swen said Nor Saleha Mohd Salleh had further insulted Chinese Malaysians by pouring accolades on her husband.

The Wanita MCA vice-chairperson also questioned where Abdullah and Nor Salleha’s ancestors hailed from.

“My grandfather came from Southern China a hundred years ago to do business and resided here; subsequently my parents, my children and I were all born on this land.

“Thus, I would like to ask Nor Saleha where and when did her husband and her ancestors come from?

“How many generations have they resided in the peninsula? Malaysia is a multiracial country and I advise this husband-and-wife team to re-study their national history,” she added.

Ong said it was regrettable that Nor Saleha, as a wife and woman in this age, was not able to differentiate between truth and falsehood.

“A modern woman should be independent-minded and rectify those inappropriate remarks about her husband, instead of rendering him blind support.

“But she further said that charging her husband in court is an attempt to refrain him from telling the truth.

“As a lecturer of Kolej Universiti Islam Selangor (Kuis), I am worried for the students taking her course. How she can guide the students to see the truth?” Ong asked.

If others made similar discriminatory remarks about the Malays, Ong added, how would Nor Saleha have reacted.

“Such remarks only expose their lack of thought and shallow minds,” she added.

Isma chief to face sedition charge tomorrow

Ikatan Muslimin Malaysia (Isma) president Abdullah Zaik Abdul Rahman will be charged with sedition at the Kajang Sessions Court tomorrow.

This is in relation to his controversial remarks that Chinese Malaysians are “intruders”.

In a statement, Abdullah said he has received the police warrant and will be present at the court tomorrow.

Abdullah will answer the charge for an article he published on Isma’s website on May 6, which  claimed  that “the Chinese came together with the British as invaders”.

The article, which contained these questionable sentences was picked up by many mainstream and alternative media:

“Who gave them (the Chinese) the right to citizenship and riches until their wealth are protected to this day and age?

“This is all the work of British in cahoots with the Chinese to trample on and bully the Malays.”

Malay rights NGO Isma has been unrepentant on the matter, saying Abdullah merely spoke out against non-Muslims who protested against the implementation of hudud in Malaysia.

Abdullah considers them to be “lacking self-awareness and had wrongfully tried to meddle in Islamic affairs”.

Isma said lawyer Haezreena Begum Abdul Hamid from Lokman Reena & Co would defend Abdullah in court.

Rayer to be charged over ‘celaka’ remark

DAP’s Seri Delima assemblyperson RSN Rayer is expected to be charged with sedition tomorrow for his “Umno celaka” remark.

It is learnt that police have asked the politician to turn himself in at the Northeast District police station on Jalan Pattani.

In an immediate reaction, Rayer said: “I hope I can post bail by tonight or else I would have to sleep here.”

Rayer was earlier investigated under the 1954 Election Offences Act for promoting ill-will and hostility by allegedly repeating the words “Umno Celaka” (damn Umno) outside the state legislative assembly.

Accompanied by his wife, his father and Penang executive councillor Jagdeep Singh Deo, Rayer posted bail at 5.25pm.

He declined to comment on his charge, saying he did not wish to prejudice the case, and did not want to state whether he was shocked or scared by the latest development.

Jagdeepsaid Rayer was formally arrested, had posted bail and would appear in court tomorrow.

Rayer’s lawyers would go through the charge for preparation before the sessions court in the morning, added Jagdeep, who is Dato Keramat assemblyperson.

When met again later, Mior Faridalatrash said that Rayer would be charged under Section 4.1(b) for uttering seditious words.

“The attorney-general instructed us to charge him and so we have,” he added.

Asked again about the clause on immunity, Mior said, “Let the court decide whether he has immunity or not.”
