Teoh’s body cremated according to Taoist rites
GEORGE TOWN: The body of alleged convert Teoh Cheng Cheng has been cremated at the Batu Gantong crematorium. Her funeral was conducted according to Taoist rites.
Teoh’s mother Tan Mah Suan, 64, her boyfriend, children and other family members were present at the ceremony.
A court order for the body to be released had been issued earlier by the Penang Syariah High Court on Thursday.
Lawyer Wan Faridulhadi Mohd Yusoff, representing the family, said the Penang Islamic Council (Maipp) would not be filing for an appeal over the decision.
Teoh’s body was claimed at 5pm at the Penang Hospital mortuary.

Syariah Court rules Teoh not Muslim at time of death
GEORGE TOWN: The Syariah High Court here has ruled that alleged convert Teoh Cheng Cheng was not a Muslim at the time of her death.
Syariah High Court Justice Zaim Md Yudin, in his judgement on Thursday, ordered the parties currently holding Teoh’s body to release it to her family and, for the police to assist in the matter.
He also allowed Teoh’s family to claim her body and to perform funeral rites in accordance with their religious beliefs.

Islamic authorities sued over bodysnatching

The mother of Teoh Cheng Cheng, whose body was seized by religious authorities on Monday, has filed at the Penang High Court today to declare her daughter non-Muslim.
Tan Mah Suan’s lawyer Ramkarpal Singh said the declaration of relief filed names three respondents – Penang General Hospital, State Islamic Affairs Department (JAIPP) and State Islamic Affairs Council (MAIPP).
Tan is filing case according to Order 29 of the Rules of the High Court, 1980.
Ramkarpal (centre in photo) said the suit seeks to declare Teoh, whose alleged Muslim name is Nora Teoh Abdullah, a non-Muslim as she has been a practising Buddhist.
He added that the mother is also seeking an injunction to prevent the body from being disposed of by the hospital or other authorities.
“An order will be issued to the Penang General Hospital to release the body,” Ramkarpal told reporters at the High Court today.
“We are also seeking an injunction to order the defendants and their agents and their staff to release the body to Tan and her family members or their agents,” he added.
“There would also be an injunction to prevent the defendants from claiming Teoh’s body in any way, intervene or disrupt the surrender of the body to Tan and to finalise the funeral rites according to Buddhism or Taoism,” he stressed.
Tan is also filing for compensation and costs and any other order to be determined but the courts.

Deceased never Muslim, Penang court hears

Medeyln Teoh, the daughter of the deceased whose Taoist funeral was disrupted by the Penang Islamic Affairs Department (Jaipp), today testified that her mother never converted to Islam.
Medelyn told the Penang Syariah High Court in a closed hearing that Teoh Cheng Cheng never embraced Islam as she never uttered the syahadah (Muslim proclaimation of faith).
This was conveyed to reporters by Penang Islamic Affairs Council (Maipp)’s counsel Wan Faridulhadi Mohd Yusoff.
He added that Medelyn said her mother, who is alleged to have taken the Muslim name Nora Teoh Abdullah, also did not live as a Muslim.
According to Wan Faridulhadi, although Teoh made an application to convert to Islam in 1997, she never professed the syahadah, nor did she get a response from the religious affairs department.
He also said Teoh, 38, was then planning to marry a Muslim man but she never did. She had three children with her Muslim partner.
Jaipp named Medelyn as the respondent, while the court heard testimonies of four witnesses – two represented the family and two others represented Maipp.

Yesterday, Maipp, which oversees Jaipp, filed an application to obtain a declaration to ascertain Teoh’s religious status by the Penang Syariah High Court.
The court will decide on the status of the religious status of the deceased, whose body was taken by Jaipp from her funeral, at 2pm tomorrow.

Meanwhile, Teoh’s mother Tan Mah Suan, 64, will also file an application to determine’s her daughter’s religious status at the Penang High Court.
Accompanying her was lawyer, Gobind Singh Deo who said the case will be filed at 9.30am tomorrow.
“We need to get certain documents, we need to look at a few other things before we finalise our papers,” Gobind told reporters when met at the court house.
The family was supposed to file the matter today but postponed it to tomorrow as there were developments at the syariah court which the lawyers need to ascertain before filing the matter at the High Court.

Woman challenges mother’s Muslim status
Nora Teoh never went through conversion formalities, says her daughter.
GEORGE TOWN: The daughter of a woman whose body was claimed by Islamic authorities on Monday is seeking a Syariah Court declaration on the religious status of the deceased.
Medelyn Teoh claims that the late Teoh Cheng Cheng, also known as Nora Teoh Abdullah, never formally converted to Islam, according to her lawyer, Wan Fariduhadi Mohd Yusoff.
In the affidavit she filed with the Syariah Court here yesterday, Teoh said her mother had only applied to convert to Islam in 1997 but never officially made the declaration of faith and never received an identity card showing her Muslim status.
She said the application form was filled by her Muslim lover when the two decided to get married. The deceased did not know Bahasa Malaysia well enough to have filled the form herself, she added.

Penang apologises for Islamic authority’s snatching of Chinese woman’s body
GEORGE TOWN, June 11 — Penang state executive councillor Datuk Abdul Malik Abul Kassim apologised today on behalf of the state’s Islamic department (Jaipp) for the manner in which its officials interrupted the Taoist-style funeral of Teoh Cheng Cheng on Monday to remove her body.
The state religious affairs committee chairman admitted the act had been insensitive towards those at the funeral, especially Teoh’s mother Tan Mah Suan and the rest of her family members.
He also offered the state’s assurance that the incident would not be repeated as Jaipp and the officer responsible have been informed of their mistakes.
“I’m apologising as the state executive councillor and also on behalf of Jaipp as it could have been handled professionally and amicably,” he told a brief press conference at Komtar today.
He said the Jaipp officer involved had acted in a rush as he was short of time and had also neglected to inform his superiors what his intended actions were.
“He did not inform me when, in the last five to six years, the procedure in such cases is that the Jaipp director’s enforcement unit, mufti department, district religious officers and I must be informed before anything is done,” he said.

Penang gov’t offers legal aid in Jaipp case

The Penang government will offer legal assistance to the family of alleged Muslim convert Teoh Cheng Cheng, whose body was seized by the State Islamic Affairs Department (Jaipp) yesterday.
This is to help the family file a case at Penang High Court tomorrow to determine if Teoh is Buddhist, although Jaipp insists she is Muslim.
Penang Chief Minister Lim Guan Eng, together with several state executive councillors, met the family this afternoon and agreed to offer legal help.
According to DAP’s Lau Keng Ee, who is handling the matter as the family are his constituents, said the legal team comprises DAP MPs Gobind Singh Deo (Puchong), Ramkarpal Singh (Bukit Gelugor) and former PKR Batu Uban assemblyman S. Raveentharan.
“The team is preparing the legal documents to be filed in the Penang High Court tomorrow,” Lau said, after arranging a meeting between the state leaders and Teoh’s mother Tan Mah Suan, 64, and her two sons.
“Madam Tan insists that her daughter has been a Buddhist all these years and not a Muslim. She brought along supporting documents like her identity card, and birth certificates of the children,” he added.
Teoh’s cousin, Teoh Choo Chew, confirmed that the Penang syariah court will decide the deceased’s Muslim status this Saturday.
The 52 year-old businessman however declined to reveal more information about the case.

Islamic dept faces suit over body snatch
Teoh Cheng Cheng’s family may be seeking custody of her children.
GEORGE TOWN: The family of Teoh Cheng Cheng, whose body was carted away by the Penang Islamic Religious Department yesterday, is seeking legal redress to resolve arising disputes.
Pengkalan Kota assemblyman Lau Keng Ee disclosed this to the press today, saying he had taken the deceased’s mother and two other relatives to see a lawyer.
He said a suit would be filed soon, but it was not clear whether the family was seeking to reclaim the body or to take custody of Teoh’s children or both.
Religious officers claimed Teoh’s body at Taman Pelangi Apartments here yesterday afternoon, telling her family she was a Muslim.
She had apparently converted 17 years ago when she was living with a Muslim lover. The family said they did not know of the conversion. The couple is said to have three children, aged between 17 and 20. It is learnt that she had an older child fathered by a Chinese man.

Family of Chinese woman in race to stop Muslim-style burial
GEORGE TOWN, June 10 ― The family of Teoh Cheng Cheng is now seeking legal loopholes to stop Penang’s religious authorities from burying the 38-year-old Chinese woman the Muslim way.
Teoh’s mother Tan Mah Suan and her sons met with state executive councillor Jagdeep Singh Deo and state assemblyman Lau Keng Ee at Komtar this morning, hoping for legal advice on what they could do to stop the burial.
Speaking to reporters, Tan said the family is very unhappy with how the state’s religious affairs department (Jaipp) had taken Teoh’s body from the wake yesterday.
She pointed out that her daughter had died early on Saturday morning and they were permitted to take her body home for a Taoist funeral, which included the three-day wake.
Jaipp should have claimed Teoh’s body on Saturday instead of waiting for the final day of the wake, she said.
“We spent close to RM20,000 on the wake and funeral arrangements and we also bought a niche for her ashes to rest so it is really uncalled for them to come and take her away in such a manner and even to insult us by telling us the Muslim burial will cost us nothing,” she said.

Yesterday, a policeman interrupted Teoh’s funeral rites and told them that the funeral could not go on as she was a Muslim convert and must be buried the Muslim way.
They loaded her coffin into the Jaipp hearse and took her body to the Penang Hospital mortuary at about 4pm yesterday.
Due to the dispute, Cheng Cheng was not buried yet and her body is still in the mortuary.

Islamic authorities seize body from funeral

The state executive councillor in charge of Islamic affairs, Abdul Malik Kassim (right), said the matter with Teoh’s family, leading to the removal of the body, was “settled amicably”.
Malik denied that the body was “seized” by the Jaip officers.
“If the family wants to take the matter to court, or settle it legally, they are at liberty to do so. It depends on the family,” he told Malaysiakini.
Ch’ng Chin Keat, a special assistant to DAP’s Pengkalan Kota assemblyman Lau Keng Ee, concurred with Malik.
Family did not know about her conversion
Ch’ng said the family was unhappy at not being able to carry out Teoh’s funeral rites, and they were also upset they did not know about her conversion to Islam.
He said Teoh had been living with her Muslim boyfriend and the couple had two daughters, aged 13 and six.
“She did not tell her family about her conversion. She has applied for a new identity card but did not get it yet. The old IC is still with her Chinese name,” Ch’ng said when contacted.
Ch’ng said the police stopped the funeral ceremony and it was fortunate that the Jaip officer arrived later to settle the matter amicably.
The family was shown documents pertaining to Teoh’s conversion Islam, noted Ch’ng.
“After discussions with the Jaip officer, the family accepted the situation, and allowed the body to be taken to the mortuary,” Ch’ng said.
On whether the family would pursue legal action to claim the body back, Ch’ng said this may not happen as “they want her to be in peace”.

Religious officers stop Chinese funeral to claim body of convert
GEORGE TOWN: A Chinese funeral was interrupted when Penang Islamic Religious Department officers appeared at an apartment in Macallum Street to “claim” the remains of the deceased.
The deceased, identified as Teoh Cheng Cheng, 38, apparently converted to Islam 17 years ago. Her Muslim name was Nora Teoh Abdullah.
Family members and relatives were stunned when the officers’ arrived at about noon while the funeral rites were being conducted. The funeral procession was scheduled for later in the day.
After several hours of discussion, Teoh’s family allowed the officers to claim the body. The coffin was moved into a van belonging to the religious department at about 3.50pm.
