Hindraf takes Jais raids issue to S’gor palace

The Malaysian Hindraf Association has complained to the Selangor palace over a series of raids by the Selangor Islamic Affairs Department (Jais) involving non-Muslims.

The movement submitted a memorandum at Istana Alam Shah this morning, calling for the Selangor sultan’s intervention in this matter.

“The Islamic bodies in Selangor seem to have crossed their boundaries and embarked on actions which infringe the rights of the non-Mulim community.

“This has caused much uneasiness and distrust by the non-Muslims in the government adminstration of its agencies which appear to be acting out of control.

“If this matter is not addressed, we fear it would cause great disharmony amonst your subjects,” the memorandum read.

Some 30 people had converged at the entrance of Istana Alam Shah in Klang as as early as 11am but had to wait for over an hour as no representative was available to receive the memorandum.

In the meantime, Hindraf supporters, clad in orange, held up banners reading: “Hindraf submits appeal to Sultan Selangor for equal protection on religious freedom under the constitution for non-Muslims”.

A police vehicle later arrived to observe the group but no action was taken.

Sultan’s intervention urged

The group had wanted to meet Mohammad Munir Bani, private secretary to the Selangor Sultan, only to be informed by security guards that he was in Shah Alam.

However they insisted on submitting the memorandum in Klang and after an hour of back and forth discussions, the palace supervisor who  introduced himself as Abd Kadir received the document.

“I have spoken to Datuk Munir and he asked me to receive it on his behalf, I promise it will be passed to him by Monday,” he told the Hindraf supporters,” he said.

Bride and Selangor Islamic agencies make peace

The bride whose Hindu wedding was disrupted by the Selangor Islamic Affairs Department (Jais) today appeared to have buried the hatchet over the incident which sparked uproar in the state.

In a statement, the Selangor Islamic Affairs Council (Mais) said that Zarina and her family members met with Mais and Jais officials over the matter today.

“In the meeting Zarina’s side expressed gratitude to Mais and Jais for taking the initiative of calling the meeting to verify the real facts.

“Arun Doraisamy, who represented Zarina’s family also said that the investigations was conducted respectfully,” the statement reads.

The statement was signed by Mais chairperson Mohamad Adzib Mohd Isa and Zarina.

It also noted that Zarina’s family “regrets” the use of the word “raid” by media in describing what had happened on June 2 at, as it caused “public tension”.

Jais also thanked the family for giving full cooperation in the investigation.

‘Help with Zarina’s syariah court application’

Mais and Jais also urged Zarina to file an application with the syariah court to declare herself non-Muslim, and said it will assist in expediting the matter.

Jais is an agency under Mais’ purview, while Mais is answerable to the Selangor sultan.

Also appended with the press statement was a photograph of the religious body officers with what appears to be Zarina and her family members.

Zarinah’s dad won’t allow children to renounce Islam, says paper

The father of Zarinah Abdul Majid said he will never consent to his daughter renouncing Islam, following the raid by Selangor Islamic authorities on her wedding to a Hindu man last week, the Star reported today.

Abdul Majid Gulam Kader, a security guard, said Zarinah and her siblings were Muslims as both he and his wife were Muslim when their children were born.

“They were born to Muslim parents and that makes them Muslim, too,” Majid was quoted as saying by the daily.

He said he would not sign any documents needed for his children, Zarinah 32, Shahull Salleh, 30, Zaleha, 28, and Abdul Gulam, 24, to change their names by the National Registration Department (NRD).

Majid also denied Zarinah’s claims that her parents were Hindus when they married in 1980, and that he was converted to Islam later by a relative while her mother remained Hindu.

Majid’s own parents were Pakistani and Indian Muslims, according to the Star.

He told the daily his father brought him and Zarinah’s mother, Vasantha, to non-governmental organisation Muslim Welfare Organisation Malaysia (Perkim) to convert her and wed them in 1979.

“Vasantha’s Muslim name is Zainab and that is the name in all the children’s birth certificates,” Majid was quoted saying.

Suddenly, officials from the Selangor Islamic Affairs Department (Jais) came and stopped the wedding. They took her away!

Jais sources were reported by Sinar Harian as saying that it used a 1988 law, to prevent Muslims converting out of the faith, to justify its actions for taking the bride away from the wedding in Petaling Jaya.

Isma lauds Jais’ Hindu wedding gate-crash

Ikatan Muslimin Malaysia (Isma) has lauded the Selangor Islamic Affairs Department’s (Jais) action of gate-crashing a Hindu wedding to take away the bride which it suspected was a Muslim.

According to Isma’s official website, the NGO’s ulama council chairperson Aznan Hasan said Jais’ action was an attempt to prevent vice from happening.

“In this case, Jais’ action was ‘saddu-al-zarai‘ (preventing vices),” he said, adding that the move was in accordance with ‘syarak’ (Islamic law).

“In fact, it is the responsibility of (Islamic) religious institutions to ensure incidences that go against ‘syarak‘ do not happen (and in this case) the marriage of a Muslim woman to a non-Muslim,” he said.

Aznan conceded that it was better if Jais had conducted its investigation prior to the wedding but said the agency may have only received information at the last minute therefore the action was “correct and necessary”.

‘Marriage, not conversion, so Jais has no standing’

COMMENT

The Malaysian Consultative Council of Buddhism, Christianity, Hinduism, Sikhism and Taoism (MCCBCHST} is appalled to read that Jais had gone into a Hindu temple and stopped a marriage ceremony from taking place, on the grounds that the bride to be was a Muslim as she had a Muslim name Zarina Abdul Majid.

Going by the facts, the action of Jais was high handed and lacked understanding. Why barge into a wedding, when if there was any contravention of law, Jais could have taken action later.

Jais’s claim that it acted under the Non-Islamic Religious (Control of Propagation Against Muslims) Enactment 1988 which makes it an offence to persuade, influence or incite any Muslim to change their faith, is flawed and illegal, as follows:

  1. Act is inapplicable as the ceremony was a marriage ceremony and not conversion to or from an Islam ceremony. The legality of the marriage is another matter.
  2. Jais has only jurisdiction, under Schedule 9 of the federal constitution over persons professing the religion of Islam.
  3. “Professing religion” here means by repute, that is, what the person holds him or herself to be, and what faith he is practising according to his neighbours and society. Here clearly the bride has only practised Hinduism since birth until today.
  4. The freedom of religion guarantee provided under Article 11 has been violated by Jais, as her case did not fall under exception in Article 11(4) (i.e. propagation of other faiths to a Muslim)
  5. The bride’s purported conversion is illegal because she was never present and did not utter words of conversion.

Jais must act rationally and with compassion and learn to follow the rule of law. Jais should not have interfered with the marriage ceremony but could have taken legal steps after such occurrence, if it felt it had a reasonable case.

Right thinking Malaysians must deplore this action of Jais as interfering with the affairs of other religions.

‘Jais wrong to stop wedding ceremony’

The former prime minister said Jais should study the Quran on how to handle situations like this.

KUALA LUMPUR: Former prime minister Mahathir Mohamad said Jais action in disrupting a Hindu wedding ceremony at a temple went againt the teaching of the Quran.

“Selangor Islamic Affairs Department (Jais) should study the Quran and find out how to handle the situation.

“This type of incidents originates from not adhering to the teachings of the Quran,”  Mahathir told a press conference at the International Islamic University Malaysia in Gombak.

“The Quran gives us full guidance on how to lead our lives. That is why Islam is described as a way of life.”

Jais action an ’embarrassment’, decries S’gor MB

Selangor Menteri Besar Abdul Khalid Ibrahim said the disruption of a Hindu wedding by the Selangor Islamic Affairs Department (Jais) was “embarrassing” and had “spoiled” the festivity.

“According to Jais it is not a raid, according to press it is a raid, and according to us, it is an embarrassment,” he said.

SHAH ALAM: The Selangor Islamic Religious Department’s (Jais) raid on a Hindu wedding was not in accordance with procedure and is an embarrassment to the state government, said Mentri Besar Tan Sri Khalid Ibrahim.

Verify facts before raiding wedding, PAS leader tells Jais

KUALA LUMPUR, June 3 ― The Selangor religious authorities should have researched their facts thoroughly first before disrupting a Hindu wedding ceremony last Sunday on suspicion that the bride is Muslim, PAS’s Dr Dzulkefly Ahmad said.

He said he disagreed with the move by the Selangor Islamic Religious Department (Jais) as the issue involves racial sensitivities and would likely invoke tension.

“I do not agree nor endorse it,” the Research Centre executive director said. “Jais must ascertain that the information is correct and verified… [the raid] must be based on solid evidence.”

Dzulkelfy added that even if it was confirmed with “absolute certainty” that the woman had been unilaterally converted into Islam as a child though raised in the Hindu faith, Jais must still approach the matter in an “appropriate, tactful manner.”

“This is to avoid any tension and the best way to ensure peace for everyone,” he said.

Jais tells bride to change status of religion

Jais admits that the bride detained at her temple wedding is only a Muslim in name but not in practice.

PETALING JAYA: The Selangor Islamic Religious Department (Jais) has told the bride who was detained at a raid on her Hindu temple wedding on Sunday to use the legal channels to change her religious status on her identification documents.

The department’s deputy director Ahmad Zaki Arshad told Malay daily, Harian Metro that the bride, identified as Zarena Abdul Majid, should appoint a lawyer and submit an application to change her name and religion, while they investigate the case of her unilateral conversion made by her absent father.

Ahmad clarified that the case has not been classified as apostasy but has been filed under Section 10 of the Syariah Criminal Enactment (Selangor) 1995 citing it as an offence to insult or bring disrepute to Islam.

He also admitted that the bride had never practiced Islam and was only a Muslim in name.

“What has happened is that the woman and her siblings are using Muslim names, but they have never practiced or been exposed to Islamic teachings as they should have,” he was quoted as saying.

Hindraf says the act by Jais is not only illegal but also contradicts Article 11 of the Constitution.

PETALING JAYA: The NGO Hindraf has accused the Selangor Islamic Religious Affairs Department (Jais) of conducting an unlawful and unconstitutional raid on a wedding reception that was being held in a Hindu temple.

“This action by Jais clearly shows disrespect to the sensitivities of non-Muslims and their place of worship. They clearly crossed the boundaries of their jurisdiction,” said Hindraf chief, P Waythamoorthy.

“The overzealous attitude by the Jais officers shows that they are given a free hand to interfere into the personal life of a non-Muslim individual and they seem to have impunity from the law.

“The absolute arbitrary power of these Jais officers to interfere into the non-Muslim affairs needs to be stopped immediately.

“There is a clear infringement of Article 11 of the supreme law of this country as seen in this matter.”

Yesterday Jais stopped a Hindu wedding in Petaling Jaya and detained the 32 year old bride.

She said that she had gone to the National Registration Department to change her religion status in her MyKad, once in 2007 and again last April. Both attempts failed as she could not obtain her father’s required signature.

Jais stops Hindu wedding, suspects bride is Muslim

Selangor Islamic Affairs Department (Jais) yesterday interrupted a wedding at a Hindu temple, taking away the 32-year old bride on suspicion that she is a Muslim.

Sinar Harian today reported the incident took place in Petaling Jaya at about 10am. It quotes Jais sources as saying that the bride’s identity card showed that she is a Muslim.

This prompted a Jais investigation under a 1988 Enactment (Control of Propagation Amongst Muslims), which makes it an offence to persuade, influence or incite any Muslim to change his or her faith.

“The woman did not know her father registered her and three of her siblings as Muslims.

“She only found out after the next of kin saw their birth certificate,” the unnamed Jais official is quoted telling the news daily.

The raid was carried out under “controlled conditions” and the bride and bridegroom’s family and guests co-operated with Jais officials, Sinar Harian reported, adding that the police were also on standby outside.

The bride was taken away to Jais office in Shah Alam for questioning. Sources said she testified later that her father, who had abandoned her a long time ago, had been responsible for registering her as a Muslim. She grew up as a Hindu.

Hindraf condemns the action of Selangor Islamic Affairs Department (Jais) yesterday in raiding and interrupting a wedding that was about to take place in a Hindu temple.

The raid was unlawful, unconstitutional and encourages unnecessary disturbance to the peace enjoyed between the communities. This action by JAIS clearly shows disrespect to the sensitivities of Non- Muslims and their places of worship. Their act is a clear crossing the boundary of their jurisdictions.

It was reported by Sinar harian and Malaysiakini that JAIS acted under a 1988 enactment (control and propagation amongst Muslims) which makes it an offense to persuade, influence or incite any Muslim to change their faith.

This act does not confer any kind of rights on the JAIS to raid the temple and stop a Hindu wedding from taking place. The act in itself is clear.

The wedding was taking place with the consent and knowledge of the difficult situation the bride was in ie that she had been converted when she was a child by her father without her knowledge and she had been practicing the Hindu faith since birth.

Further the bride had entered into the marriage on her own will without any coercion or incitement, therefore how is it possible that this enactment is applicable in this matter.

The overzealous attitude taken by the JAIS officers depicts such a free hand they have into interfering into the personal life of a Non-Muslim individual with impunity from the law.

The absolute arbitrary power of these JAIS officers to interfere into the Non-Muslim affairs needs to be stopped immediately when they clearly infringe Article 11 of the supreme law of this country as seen in this matter.

JAIS or any Muslim authorities should not take the religious sensitivities of other faiths for granted. As much as Muslims are sensitive to their religion, others have the same feelings too.
In this case it was fortunate nothing untoward happened in the temple and those present did not react to the unlawful and unconstitutional raid carried by Jais in the Hindu temple.

The controversy of religious status amongst many who claim that they have been converted without their knowledge and the reluctance by the National registration to act according to civil laws in giving the victims of those circumstances a remedy to correct the wrongs not caused by their fault is the main reason for the continuance of such controversies.

We have a serious problem in this country. The civil service is dominated by Malay and Muslim centric officers who bulldoze their personal belief in the supremacy of their religion in the Government administration.

Their behavior is nothing short of bullying assisted by the government organs and machinery in oppressing the Non- Muslim community and their beliefs.

Hindraf calls upon parliamentarians from both divide to move an act in Parliament (which is long due) to correct and amend the legal hurdles that has been in place in protecting the Religious freedom of individuals.
