The six, also known as EO6, are Sungai Siput MP Dr Jeyakumar Devaraj and PSM activists Choo Chon Kai, Sarat Babu, M. Sarasvathy, M. Sukumaran, and A. Letchumanan. They sued 82 individuals, mostly police officers.

Government to pay RM201,000 in damages for wrongful arrest of PSM leaders

A civil suit by Parti Sosialis Malaysia against 82 individuals for wrongful arrest and false imprisonment of six of its party leaders under the Emergency Ordinance in 2011 has been settled out of court.

The parties today agreed to an out-of-court settlement after the defendants agreed to pay RM201,000 in damages to the six plaintiffs.

Datuk Hue Siew Kheng recorded the consent judgment in open court today.

Under the terms of the settlement read out by the plaintiffs’ counsel Yudistra Darma Dorai, the government and six arresting officers listed as defendants were to pay RM201,000 to the plaintiffs in damages, interest and cost.

This was confirmed by senior federal counsel Siti Badariah Mohd Yusof.

PSM leaders to get RM200k from gov’t, police

 

Six Parti Sosialis Malaysia (PSM) activists have obtained a consent settlement in their civil suit against the government and 81 other respondents over wrongful arrest and false imprisonment in 2011.

The settlement was recorded today before Kuala Lumpur High Court judge Justice Hue Siew Kheng.

Based on the terms of settlement, the government – as the first defendant – and six arresting officers are required to pay RM200,000 and costs as damages.

The list of defendants who have to pay are:

1) The Malaysian government (the first defendant),
2) D Selvakumar (the 20th defendant),
3) YK Rajendran (the 23rd defendant),
4) Khairulamar Md Nawani (the 32nd defendant),
5) Boo Khoi Fong (the 39th defendant),
6) S Balamurali (the 45th defendant), and
7) Koay Seng Chai (the 63rd defendant).

EO6 sues IGP and home minister

KUALA LUMPUR, March 23 — Dr Michael Jeyakumar and five other members of Parti Sosialis Malaysia (PSM) are suing the Inspector-General of Police, Deputy IGP and home minister for their 28-day arrest under the Emergency Ordinance (EO) in July last year.

The claims made by the six plaintiffs, otherwise known as the “EO6”, are for wrongful arrest and false imprisonment, assault and battery, malicious prosecution, particulars of malice/absence of reasonable cause or grounds, abuse of process, and misfeasance in public office and breach of statutory duty.

Also named in the suit were 78 other police officers involved in their arrests.
