GEORGE TOWN: DAP secretary-general Lim Guan Eng today slammed the Registrar of Societies (ROS) director-general Abdul Rahman Othman of acting like a “king” by refusing to explain reasons to call for fresh party polls.
He also said that ROS must provide the reasons on why it was not satisfied with DAP’s explanation on the alleged internal irregularities that took place in last December’s party polls.
He said the party would not re-convene the party polls for 20-elected positions in central executive committee (CEC) until ROS rendered an official written reply explaining the reasons.
“Please don’t tell us you (ROS) need not give us a reason.
“If they can do this now, what assurance is there that they would not do it again? This is not acceptable. This is against natural justice, democracy and due process of the law. We want a proper explanation.
“Abdul Rahman cannot wake up one morning and simply say he was is satisfied with our clarification.
“He cannot simply ask us to hold fresh elections without giving us a reason and the law for it.

An individual named ‘Father Augustus Chen’, who purportedly wrote an anti-DAP booklet during the party polls late last year, has been described as a “figment of imagination”.
The DAP’s Lim Kit Siang claimed in a statement today that the person does not exist.
“The allegations of DAP election irregularities by the fictitious ‘Father Augustus Chen’ in his booklet are nothing more than a regurgitation of many lies and baseless allegations,” he said.
Lim (right) also said the booklet – which resurfaced after the 13th general election – was written to ‘justify’ the decision of the Registrar of Societies (ROS) to get the DAP to hold fresh polls.
“I was at first perplexed why the booklet of lies … appeared last month (since) the 13th general election is over, but now I understand its appearance – to provide a semblance of justification for Umno/BN and the ROS to act against the DAP,” he said.

DAP should hold party re-election soon, says Registrar
The DAP should hold its central executive committee (CEC) re-election immediately as this is what the party grassroots want, says the Registrar of Societies (ROS), Datuk Abdul Rahman Othman.
In a statement today, he said this was the best decision and which would also show transparency on the part of the party leadership, which had promised the public that it would implement whatever decision announced by ROS.
Abdul Rahman said all matters related to any body was handled in accordance with the Societies Act 1966 and ROS made the decision on the CEC election issue based on the statements given by the parties involved.
He said the act did not provide the need for ROS to explain the matter to the public, adding that ROS took a humanistic approach with regard to the DAP leadership although it (ROS) had been slandered many times, especially during the recent general election campaign.
On July 30, the ROS ordered DAP to hold a CEC re-election and informed that he was not satisfied with the explanation given by the party on the issue of manipulation of votes during the CEC election.
A day later, DAP secretary-general Lim Guan Eng questioned the legal provisions used by ROS in making the decision.
Lim was also reported to have said that DAP would not abide by the directive given by ROS issued via a notice for the CEC election be reconvened as long as the order was not fully explained.

DAP facing de-registration?
Unfair of ROS to accuse DAP of trying to form a new party through de-registration and being insincere in handling the whole issue.
The DAP saga continues and looks set to drag on indefinitely. Although the Registrar of Societies (ROS) has instructed DAP to hold its central executive committee (CEC) polls again, the party has does not see the need to do so.
Besides the above issue, ROS director-general Abdul Rahman Othman has made a misrepresentation on DAP when he said that DAP members hoped to form a new party.
He had also told DAP members that any hope of ROS approving the registration of the new party is virtually nil as ROS did not even entertain 29 applications to set up new parties submitted over the last five years.
This was reported in an English daily dated July 26, 2013 under the title: ‘Don’t harbour false hopes’.
It is clear that Abdul Rahman is very antagonistic towards DAP and his antagonism shows through in the false accusation that DAP members want to form a new party.
DAP is now mulling over taking legal action against the ROS director-general pertaining to this statement.
This columnist wishes to inform all readers that no one in DAP wants to set up a new party.
It is beyond any logic why Abdul Rahman wants to make such a baseless accusation. Is there any malicious intent behind the accusation?

At the end of the day, ROS seems to be a political tool of the BN federal government as it is evident by its reluctance to register Pakatan despite requesting the opposition coalition to submit its application time and again and then rejecting the application due to technical error.
Going by this premise, DAP must be prepared to face de-registration very soon. It could even happen as early as Friday, Aug 16when no word is forthcoming from DAP on when it will hold its CEC polls again.
DAP leaders should take heed of this date and mark it out on their diary.

Is this a part of Prime Minister Najib Tun Razak’s national reconciliation plan? Is the motive to get rid of DAP just because MCA is weak and is in dire need of Chinese support?
Do the BN strategists think that if DAP ceases to exist, the Chinese will go back to supporting MCA?
If that is what they think then they are plain stupid as they have again failed to read the thinking of the majority of the Chinese voters.
This columnist dares to say that even if DAP is wiped out, the Chinese support for Pakatan will be much stronger because the Chinese can still vote for PKR or PAS.
The majority of the Chinese voters will stand firm against BN’s bullying tactics.

Lim also refuted allegations in an anonymous booklet by one Fr Augustus Chen, who wrote in detail about the alleged irregularities of the internal polls, which was held in Penang, in December last year.

English language daily The New Straits Times (NST) has landed itself in the soup, inciting the anger of DAP over its report on the Registrar of Societies’ (ROS) invalidation of the party’s central executive committee (CEC) polls results.
Its secretary-general Lim Guan Eng said the “BN media” leaves the party no choice but to take legal action as its report on Aug 1 entitled ‘Accept invalidation of CEC polls’ was a “rumour and a malicious lie.”
In the report, the NST had stated without attributing anyone that “a total of 753 DAP members had complained of being denied their right to attend as delegates, the party’s congress where the CEC election was held”.
Lim denied that the claim, stating it was a “complete lie and no such thing” as there had been no such complains from that many delegates.
“There were (complaints) from a disgruntled few but not from 753 delegates.

The Registrar of Societies (ROS) has acted beyond its jurisdiction by ordering DAP to hold fresh party elections, said its secretary-general Lim Guan Eng.
He pointed out that nothing in Section 16(1) and Section 16(2) of the Societies Act empowers the ROS to make such an order.
“Therefore, your (the ROS) order to hold fresh elections for the DAP central executive committee is beyond your power and is not legally binding.
“Legal principles such as reasonableness in the exercise of powers, natural justice and due legal process should be respected and not flouted,” he said in a letter to the ROS today, a copy of which was also distributed to the media.
The two legal provisions deal with disputes over a society’s office bearers, and states that the ROS may take steps to de-register the society if no satisfactory explanation is forthcoming.

PETALING JAYA: The DAP has received a formal letter from the Registrar of Societies (ROS) yesterday demanding them to hold fresh party polls, a directive which is expected to anger the party.
In the one-paragraph letter dated yesterday, ROS says that they are dissatisfied with the explanation given by the party over the counting mistake they committed in the party polls last December, and instructed them to hold a fresh poll in accordance to its party constitution.

DAP has received the letter issued by Registrar of Societies (ROS) informing the party of its decision to invalidate the party’s central executive committee (CEC) election, however, the letter omits any reason for the decision.
The letter was sent by hand to the DAP headquarters in Kuala Lumpur at 5pm yesterday, said party organising secretary Anthony Loke.
Loke said the letter was signed by ROS senior assistant director Desmond Das.
In a statement today, party secretary-general Lim Guan Eng said DAP’s “worst fears” the directive was politically-motivated were realised when once it viewed the ROS’ “short letter”.
“RoS only stated in their letter dated 30 July 2013 that they were not satisfied with DAP’s explanations, without stating the grounds and the reasons why.
“Such a brief letter by ROS stating the directive but not the reasons why, as well as providing evidence that supports the ROS decision is most unprofessional, flagrant misuse of their exercise of power resulting in a great injustice to the DAP,” he said.

Home Minister abused power in DAP’s ROS issue, says Guan Eng
The Home Minister abused his power by announcing a decision taken by the Registrar of Societies to invalidate the DAP Central Executive Committee elections even before the party’s secretary-general could be formally notified.
DAP secretary-general Lim Guan Eng described Datuk Seri Ahmad Zahid Hamidi’s announcement as an act of political vengeance and victimisation as the DAP was not informed beforehand, either verbally or in writing, of a directive to hold fresh elections.
“Furthermore, the letter by ROS to be sent to DAP has not even been prepared or sent,” Lim said in a statement today.
He said when DAP national organising secretary and Seremban MP Anthony Loke visited the ROS headquarters this morning, he was informed that the letter was not ready.

DAP is up in arms over Home Minister Ahmad Zahid Hamidi’s announcement of the Registrar of Societies’ (ROS) decision to order the party to invalidate its central executive committee (CEC) election.
The announcement was made yesterday at a breaking of fast event in Putrajaya, even before the ROS has informed the party of this writing.
The ROS’ letter to the DAP had yet to be finalised as at this morning, when CEC member Anthony Loke (right) went to the headquarters to seek clarification.
“We have yet to receive any notice in black and white. We only came to know of this through the newspapers,” he said.
Loke refused further comment, apart from revealing that the matter would be deliberated by the CEC tomorrow night.
According to Sin Chew Daily, Ahmad Zahid had told reporters that the ROS was not satisfied with the party’s explanation of glitches that had cropped up during the CEC election.
He also stressed that he had not interfered with the ROS decision.

The DAP wants the Registrar of Societies (ROS) to show proof that its members are harbouring hopes of forming a new party, as it is reported saying by the MCA-owned English language daily The Star yesterday.
DAP has instructed its lawyers to look into this “latest lie” by ROS director Abdul Rahman Othman, its secretary-general Lim Guan Eng said in a statement today.
The lawyers have also been instructed to look into the possibility of filing for defamation against Abdul Rahman and The Star for lying about the DAP harbouring hopes of setting up a new party.
Lim wants Abdul Rahman to back his claims or be exposed in court as behaving “maliciously and prejudged to de-register DAP by hook or by crook with false fabrications and made-up lies”.
He added: “This is outrageous as DAP leaders have neither considered nor raised the suggestion of forming a new party in or outside our regular central executive committee(CEC) meetings.

DAP adviser Lim Kit Siang said there are no plausible grounds for the Registrar of Societies (ROS) to de-register the party.
This matter, he said had never been raised by anyone in DAP, whether the leadership or its members.
Calling the statement by ROS director-general Abdul Rahman Othman of members wanting to set up a new political party in order to purge political enemies as “fictitious”, Lim said it is a baseless scenario concocted by Umno and BN propagandists to character-assassinate the DAP leadership.

Abdul Rahman also said the DAP case should not be compared with Umno’s experience in the late 1980s when the party was registered as Umno Baru following a court order banning the party.

Little chance of setting up new party if DAP de-registered, says RoS
If the Registrar of Societies (RoS) decides to de-register DAP, its members have been told not to harbour hopes of setting up a new party, The Star reported today.
RoS director-general Datuk Abdul Rahman Othman said they would not likely entertain requests for a new party.

Abdul Rahman was commenting on a plan by DAP members to set up a new party if DAP was de-registered, following complaints of election fraud in the party’s central executive committee (CEC) election in December.
The director-general, when asked, said it was up to the party members to determine if the party should call for a fresh CEC election, adding that the party was now in limbo as the CEC was not recognised.
“It is better for the party members and leaders to take the initiative to save the party rather than harbour false hopes of setting up a new one,” he added, the daily reported.
Abdul Rahman also called on delegates who claimed they did not receive meeting notices to lodge reports, noting that only a handful of members had lodged complaints alleging discrepancies.
“Keeping mum will not help make the problem go away,” he said, according to The Star.
He added that the RoS investigation was almost completed based on evidence gathered, and that a decision would be made in due time.

The RoS is investigating the alleged irregularities which cropped up when a recalculation revealed that DAP secretary-general Lim Guan Eng’s political secretary Zairil Khir Johari, who had initially received 305 votes, clinched 803 votes.
