A Malay NGO has called on a lawyer and an aide to the PM to clear the air over the claim that they conspired against Anwar Ibrahim.
GEORGE TOWN: A local NGO has urged the two people linked to an alleged conspiracy to destroy Opposition Leader Anwar Ibrahim’s political career to break their silence.
Penang Malay Congress president Rahmad Isahak said the onus was on Saiful Bukhari Azlan’s lawyer Zamri Idrus and Prime Minister Najib Tun Razak’s special officer Khairil Annas Jusoh to answer the allegations raised by Saiful’s father Azlan Mohd Lazim.
He said Azlan’s allegation that Anwar was a victim of conspiracy in the Sodomy II case had shocked Malaysians.

In August 2008 a fifty-five-year old man who graced a politician’s so-called second sodomy trial, appeared alongside his son who was holding a copy of the Holy Qur’an at a mosque in a bustling city in the country.

The son in an earnest mood but with a tranquil look splashed all over his face sat beside his stern-looking father during a ceremony to swear by the Holy Book that it was true that he was “sodomised” by a politician.
The father looked rather disheartened and was crestfallen. He was naturally not happy to hear the “agony” that his son had to go through.

The “victim” became a celebrity of sort. Pressmen interviewed him and he was not at all traumatised by the event. Instead, he was proudly responding to questions – so very unlikely of a person who has been raped or sodomised. Rarely would a sodomy or rape victim would wish to be paraded in public or auspiciously talk to the press of what happened to him or her.
…Never would a father want his son to be in the limelight for a wrong reason that would invite scorns and derisions from among family members and the community.

KUALA LUMPUR, March 12 — Last week’s revelation by Saiful Bukhari Azlan’s father has compounded doubts over the Sodomy II charges against Datuk Seri Anwar Ibrahim, former senior police officer Datuk Mat Zain Ibrahim said today, adding that in light of other alleged discrepancies, the case should no longer be pursued.

“In my view, although there were no exposes made by Azlan Lazim (Saiful’s father), the hearing of Sodomy II can no longer proceed,” the now-retired Mat Zain said.
The former top policeman has been penning countless letters to Najib over the past few years, repeatedly claiming abuses in the police force and making damning allegations of corruption implicating Abdul Gani and former IGP Tan Sri Musa Hassan, largely in cases involving Anwar.
“Gani Patail, as the person who gave the final word to charge Anwar in Sodomy II, and who filed the appeal when the High Court acquitted him, can be proven as having committed so many falsehoods and fabrication of fake evidence simply to convict Anwar of criminal charges since 1998,” Mat Zain said today.
“In short, it can be proven that Gani has been having ill intentions towards Anwar since 1998,” he wrote in the letter.

PETALING JAYA – A small but noisy altercation broke out between the pro-Umno media and a pro-Pakatan Rakyat blogger over Azlan Mohd Lazim’s shock revelation his son was used in an “evil conspiracy” concocted by Prime Minister Najib Razak’s office to smear Opposition Leader Anwar Ibrahim.
Clearly divided in their views, the blogger and a reporter from Agenda Daily engaged in a shouting match outside the press room at the PKR headquarters in Tropicana, Petaling Jaya.
Upset at the line of questioning taken by the pro-Umno media during the press conference, which he alleged continued even after the session was over, Abdul Rahman, who blogs at Tulang Besi, and the reporter accused each other of making fools of the Malays.
“I was upset because they keep talking about ‘sumpah laknat’. It is not part of our Muslim beliefs in the first place. This is why I accused those people of ‘memperbodohkan orang Melayu’ (making fools of the Malays). What type of reporting is that,” Abdul Rahman told Malaysia Chronicle after cooling down along the verandah of the PKR office.

KUALA LUMPUR, March 9 — PKR’s Johari Abdul has claimed that Saiful Bukhari Azlan’s father was the one who sought him out to help reveal that his son’s sodomy complaint against Datuk Seri Anwar Ibrahim was allegedly a “political conspiracy”.
The Sungai Petani MP organised a press conference for Azlan Mohd Lazim yesterday who claimed his son’s claims as a plot by a special officer in the Prime Minister’s Department but Saiful later refuted the claims.
“Greetings, Saiful’s father (was the one who) approached me.
“He’s the one who ask us to reveal all this, it can’t be that his father is so stupid until he can be influenced,” Johar told The Malaysian Insider when contacted after Saiful denied the conspiracy.
The federal lawmaker said Saiful’s denial was an insult to his father.

Mar 8: The father of the man who sparked the Anwar Ibrahim’s so-called second sodomy trial has today turned around to admit that his son had been involved in a political conspiracy by cooking up false claims that he had been sodomised.

Azlan Mohd Lazim, who in 2008 appeared alongside his son Saiful Bukhari holding a copy of the Qur’an while swearing that the allegation was true, today held a press conference accompanied by PKR’s Sungai Petani member of parliament Johari Abdul.
Azlan now claimed that his son was used by a special officer close to prime minister Najib Razak to accuse Anwar, confirming widescale suspicion of Najib’s involvement in the affair.
He also named one of the officers as mastermind of the plan.
“I have a right to explain. If asked to appear in court, I am willing to repeat all this,” said Azlan.
Saiful however shot back by saying that it was his father who was now being used.
“Am thinking about the next move. Not fussing,” he was quoted as saying by Malay daily Sinar Harian.
The court acquitted Anwar of the charge last year, but the attorney general’s chambers has appealed against the verdict with the case fixed for hearing in July.

The appeal is legally insupportable and an act of pure political malice by Prime Minister Najib Tun Razak and UMNO-BN. Contrary to his duty to act impartially, Attorney General Tan Sri Abdul Gani Patail is pursuing this baseless appeal purely for the benefit of his political masters UMNO-BN.

INTERVIEW Justice Mohamad Zabidin Mohd Diah was described as initially open when conducting the Anwar Ibrahim Sodomy II trial, but as soon as his ruling on ordering the prosecution to provide the witness list and other key documents was overturned by the upper courts, he appeared to have changed his stand.
Queen’s Counsel Mark Trowell, the author of ‘The Trial of Anwar Ibrahim Sodomy II’, said he found Zabidin to be fair after giving the ruling in favour of the defence, unlike (former Federal Court judge) Augustine Paul, who presided on Anwar’s abuse of power trial.

Zabidin made the ruling in favour of Opposition Leader Anwar at the pre-trial stage, resulting in the prosecution appealing the decision. The Court of Appeal subsequently overturned the decision and this was upheld by the Federal Court.

However, the Federal Court overruled the High Court’s interpretation of section 51 and section 51A of the Criminal Procedure Code, saying it was flawed. Federal Court judge Abdull Hamid Embong said the section did not provide the wide-ranging application for the defence to obtain documents at the pre-trial stage.
“Its scope is restricted in law. In our view, the High Court judge went overboard in deciding to expand section 51 and had effectively changed the law by ordering the prosecution to provide the documents.
“Changes in the law is for Parliament to decide, not the judiciary. Judges interpret the law, and judges under the guise of interpretation should not provide their own preferred amendments to the statutes,” Abdull Hamid had ruled.
The ruling, said Trowell, had resulted in Zabidin going “into a shell”. According to the Australian lawyer, the decision of the upper courts was only binding at the pre-trial stage.
“When the trial starts and witnesses are called, the defence has the right to get the documents. It is because when the trial starts, it is he (Zabidin) who runs the show and no one else.”
However, he said the Federal Court ruling had an adverse impact on the trial judge, resulting in rulings against the defence, time and again, forcing Anwar’s lawyer Karpal Singh to attempt to remove the judge on three occasions over allegations of bias.
Right decision to acquit
Trowell said despite this, Zabidin made the eventual decision to acquit Anwar.
“To tell you the truth, I was expecting that Anwar would be convicted on Jan 9 following the many rulings made by the judge against the defence. Anwar also told me that he had expected the worst and ready to be incarcerated for another six years”.
“However, justice Zabidin, unlike his decision to order Anwar to enter his defence, announced his verdict within five minutes. I don’t think people in the public gallery quite understood – or that it had sunk in – as after delivering it, the judge left (the courtroom) immediately.”

For Mark Trowell, an experienced Australian criminal lawyer, alleged sodomy victim Mohd Saiful Bukhari Azlan does not strike him as a “normal” sexual assault victim.
The author of ‘The trial of Anwar Ibrahim Sodomy II’, which has been on the bookshelves since last week, said it appeared Saiful loved to hog the media limelight and he did not mind it – not at all like any other sexual assault victim.
Trowell, who is also an observer for the Inter-Parliamentary Union (IPU) and LawAsia in courts around the world, said it was also not normal for a sexual assault victim not to have a bath for two days.
“I am made to understand that a Muslim, after sexual intercourse, is required to have the ritual bath before he or she can perform prayers. So, the question remains as to how Saiful did his prayers.
“In my 25 years of experience in criminal law, I have never seen someone not bathing for two days to preserve forensic evidence.
“On the contrary, I feel the victim would want to quickly have a shower to remove the perpetrator’s body smell.
“In some cases of sexual abuse, the victims would scrub their bodies until nearly wounding themselves, to remove the smell,” said Trowell, who is a Queen’s Counsel.

KUALA LUMPUR: A book recounting the Sodomy II trial of Opposition Leader Anwar Ibrahim and issues surrounding it will hit local bookstores in September.
