EXCLUSIVE | The government will form a tribunal to investigate various allegations plaguing the Election Commission.
This includes purported misconduct by the EC and some of its commissioners, particularly during the running of the last general election.
The move is seen as part of an effort to clean up the EC and put into place electoral reforms, and possibly remove some commissioners suspected of misconduct.
Sources indicated today that several former Federal Court judges would be appointed to sit on the tribunal to investigate the commission.
A source told Malaysiakini that a high-powered team has been formed by the Attorney-General’s Chambers to assist the tribunal.
It is understood former solicitor-general II, Yusof Zainal Abiden, who has gone into private practice, and lawyer M Puravalen will be brought in as co-counsel to represent the chambers at the tribunal.
A tribunal has to be formed as election commissioners, like Federal Court judges, can only be removed by a tribunal. The commissioners are appointed until their retirement at age 66.
During the 14th general election, the EC was led by its then chairperson Hashim Abdullah. Hashim cut short his tenure, with permission from the Yang di-Pertuan Agong, and left on July 1. He was replaced by lawyer Azhar Harun this month.
The other commissioners are EC deputy chairperson Othman Mahmood, and members Mohd Yusop Mansor, Abdul Aziz Khaldin, Sulaiman Narawi, K Bala Singam and Leo Chong Cheong.

KUALA LUMPUR: Electoral watchdog Bersih 2.0 plans to appeal to Prime Minister Dr Mahathir Mohamad to establish a tribunal to investigate the “misconduct” of the seven-member Election Commission (EC) in the 14th general election (GE14).
The seven are former chairman Hashim Abdullah, deputy chairman Othman Mahmood, commissioners Yusop Mansor, Abdul Aziz Khalidin, Sulaiman Narawi, K Bala Singam and Leo Chong Cheong.
Speaking at a press conference outside Parliament, Bersih 2.0 acting chairman Shahrul Aman Mohd Saari said it was crucial that the tribunal be formed as soon as possible to ensure future elections would be clean and fair.
“The six who are still in office now need to be held accountable for what they did prior to, and during, GE14.
“Their misconduct violated the basic rights of the citizen to choose a new government and threatened the very foundation of our democracy.
“The commissioners, if they have lost public confidence, should no longer hold office,” he said.
The appeal letter would be submitted to the PM as soon as possible, he added.
Among others, one major “misconduct” detected by Bersih 2.0 and ENGAGE, another NGO, is that 3,525 retired police officers were still classified as advance voters, including two former inspectors-general of police.
“This was despite the regulation stating that only serving members qualify as advance voters.
“Apart from that, there were also issues of ballot secrecy and safe custody of ballots for advance voting by police officers and military personnel who voted five days in advance of normal voters,” said Shahrul.
Another violation was over GE14 observers, where the observers from overseas had only arrived two days before polling day, he said.
“The EC did not provide any further update or information with regards to the scope, terms of reference, and status of the observers.
“Accredited domestic observer Majlis Belia Malaysia (MBM) was seen conducting nationwide campaigns for Barisan Nasional,” he alleged.
Shahrul pointed out that five EC commissioners appointed between 2013 and 2018, including the chairman and deputy chairman, were previously civil servants.
“Worst, Hashim was personal aide to Umno information chief Annuar Musa from 1990 to 1999, while Othman was senior deputy chief secretary in the Prime Minister’s Department during the former prime minister’s tenure in office (2011 to 2017).
“While Hashim resigned on July 1, the six other commissioners still remain as part of the EC. They should all be removed from the commission,” he said.

KUALA LUMPUR – Kota Melaka MP Khoo Poay Tiong will table a motion in the Dewan Rakyat calling for six Election Commission (EC) officers to resign due to alleged irregularities, which occurred during the 14th General Election (GE14).
He said the officers are the EC’s deputy chairman Tan Sri Othman Mahmood, Datuk Md Yusop Mansor, Datuk Abdul Aziz Khalidin, Sulaiman Narawi, Datuk K. Bala Singam and Datuk Leo Chong Cheong.

KUALA LUMPUR, June 13 — Tan Sri Mohd Hashim Abdullah will leave his position as Election Commission (EC) chief on July 1, 2018.
In a statement, the EC said the decision to cut short his services has received the assent of the Yang di-Pertuan Agong Sultan Muhammad V on June 7, with Prime Minister Tun Dr Mahathir Mohamad informed of this on Monday.

EC chief: We were transparent, fair and just
The Election Commission has maintained that it had carried out the 14th general election in a transparent, fair and just manner.
In a statement today, EC chairperson Mohd Hashim Abdullah (above) said that the transition process was peaceful and orderly.
“(The transition of power) to PKR showed that the country’s democracy was mature and flourishing.
“Although the EC was accused of many things, we are still an independent and neutral body that ensures that democracy is maintained,” he said.
Meanwhile, Mohd Hashim revealed that the voter turnout on May 9 was 82.32 percent which mean 12,299,514 out of 14,940,624 eligible voters had cast their ballot

PETALING JAYA: Voters do not have to dress according to government office attire at polling stations on May 9, the Election Commission (EC) has confirmed.
A viral message had been circulating alleging that voters must wear government office attire or they will be denied entry.
In a statement on Monday (April 30), the EC disputed the message, saying it is fake news.
The EC has never set a dress code for polling day, chairman Tan Sri Mohd Hashim Abdullah said.
“The EC has not and will not prevent a voter from entering a polling station as long as the voter is appropriately dressed,” he said.
However, voters must not wear clothes, carry an umbrella or any other items that bear a party logo.
“Section 26(1)(g) of the Election Offences Act 1954 states that a voter is not allowed to enter the polling station if the voter wears any clothes or carry items that display the name of candidates, their symbol or a party logo,” Mohd Hashim added.

GE14 | In about a minute, enforcement officers had cut out Pakatan Harapan chairperson Dr Mahathir Mohamad’s image from a giant billboard in the parliamentary seat of Ayer Hitam.
“We were told that our billboard cannot carry Mahathir’s picture and the Election Commission’s decision was to cut out Mahathir’s picture,” said Harapan’s candidate Liew Chin Tong.
It could not be ascertained if the enforcement officers were from the EC or local council.
The Johor DAP chief said the EC had instructed him to remove all the posters and banners which featured Mahathir’s image.
Around noon, enforcement officers in yellow vests arrived at Jalan Utama 1 in Yong Peng, where the billboard was located. It featured Mahathir with Liew and DAP’s candidate for the Yong Peng state seat, Chew Peck Choo.
The officers then cut out Mahathir’s image in the presence of Liew and his team.

Don’t be judge and jury, election officials told
After disqualification of oppostion candidates, lawyers urge officials not to deny voters the choice of whom they want as MPs and assemblymen.

PETALING JAYA: Returning officers should not have disqualified a number of opposition candidates on disputable issues as that was depriving them the constitutional right to offer themselves to their constituents, lawyers said.
They said the objective of the returning officers, who were appointed by the Election Commission, should also be to assist candidates in filing their nomination papers.
The lawyers said the officers should not at any time play the role of a judge and jury by rejecting nomination papers and depriving prospective candidates of the chance to participate in the general election.
Lawyer S N Nair said the officers should have played a neutral role, especially as this was a highly charged election.

In any case, he said a bankrupt candidate who won the election could be punished by the election court to pay a high cost to the petitioner and the results revoked.
Yesterday, Pizi Jihat and Yaakob Osman, nominated by Parti Pribumi Bersatu Malaysia were disqualified from contesting Bukit Pasir, Johor, and Penaga, Penang, for being undischarged bankrupts.
PPBM legal bureau member Muhammad Rafique Rashid Ali said party lawyers had checked their status with the Official Assignee on the eve of nomination day and had been told the two were not bankrupts.
PKR’s Tian Chua was disqualified from seeking re-election in Batu, Kuala Lumpur, on the grounds that he had a criminal conviction that carried a fine of RM2,000. He said the decision to reject his papers was made by the returning officer.
Nair said this officer appeared to have played the role of prosecutor, judge and jury in making a judgment call
“This is a gross abuse of power and inconsistent with the terms of reference (of his appointment),” he said.
PKR candidate Dr Streram Sinnasamy was refused entry to the Rantau nomination centre in Negeri Sembilan for not having a candidate pass issued by the EC. He was quoted as saying he had not been informed about the need for a pass.
BN candidate Mohamad Hasan, the Negeri Sembilan Menteri Besar, was declared as being returned unopposed.
Lawyer Ragunath Kesavan questioned why Streram was not issued a pass by an EC staff after he paid the deposit.
“The election rules keep changing and it was the duty of the EC to hand over all documents, including the pass, to potential candidates once deposit is paid,” said Ragunath, a former Malaysian Bar president.
He said the pass was not the important criteria for entry as Dr Streram had evidence to show he was the candidate.

Eleven people have been disqualified from contesting in both parliamentary and state assembly seats nationwide.
