The sacking of a Malaysia Airlines flight attendant who is being held in a Paris detention centre for alleged sexual assault on a passenger is not an isolated case, the national flight attendants union said, claiming that the national carrier has similarly fired other employees without due process.
National Union of Flight Attendants Malaysia (Nufam) president Ismail Nasaruddin told The Malaysian Insider that in 2009, a MAS chief steward was also dismissed from employment without due process while he was in the custody of United Arab Emirates police.
“MAS human resources department summarily dismissed him without giving him the right to be heard,” he said.
The former employee, Adrian Varghese, took his case to the Industrial Court, claiming unlawful dismissal. The case is still being heard by the court.
According to Ismail, Varghese was arrested and detained for allegedly stealing a mobile phone at the Dubai airport and was subsequently held in the United Arab Emirates for three months.
However, he was not charged with the crime.
Ismail said MAS, however, dismissed Varghese for misconduct without an inquiry two months after the incident when he was still in detention in Dubai.
“Varghese’s case is similar to the harrowing experience that has befallen the cabin crew member who is now being held in Paris. Such incidents also cause pain and misery to their families,” he said.

Ismail said MAS ignored the rules of natural justice like innocent until proven guilty and the right to be heard by aggrieved parties before making arbitrary decisions regarding their employment.
Ismail claimed there were at least a dozen cases of air crew members who also lost their employment for alleged breach of the airline’s code of conduct.
“These employees have to go through the hassle of challenging their sacking and it takes a long time for them to know whether justice will finally be done,” he said.

Under the French system, the maximum detention period can go up to 10 years, without a charge, with an average timeline of up to four years.

SUBANG JAYA, Nov 15 — The family of a former Malaysia Airlines (MAS) steward currently detained in France for the alleged sexual assault of a female passenger is appealing for the man’s release and for his case to be tried in Malaysia.
The 54-year-old former MAS employee’s son-in-law, Muhamad Faiq Ilham, 24, told reporters today that it was unfair of MAS to have left his father-in-law in a lurch when the alleged incident had occurred aboard one of its planes.
“We are also deeply concerned that with the French authorities conducting the investigations for so long, we may lose the opportunity and window of filing an application under the Tokyo Convention 1963.
“We were informed that (under the convention) the trial can be done on Malaysian shores and we want him to be tried here,” Muhamad told a press conference here today.
This is the first time the family has made a public appearance since news of the steward made international headlines.

“We plead with the relevant authorities in Malaysia to help our father and that an application be made by Malaysia to secure the release of our father and have him sent back to Malaysia,” Muhamad added.
He said that the family’s lawyers together with the National Union of Flight Attendants Malaysia (NUFAM) have also written to Prime Minister Datuk Seri Najib Razak seeking assistance.
“We approached MAS several times for assistance, and had even written twice to them, but no response was received.”

Shailender Bhar, the family’s lawyer, said the onus is on Malaysia to extradite the detained steward, as both Malaysia and France are signatories to the Tokyo Convention.
Shailender said that Malaysia had also introduced the Tokyo Convention by integrating it into the Aviation Offences Act 1984.
“MAS is also a company registered in Malaysia and being so, this (Malaysia) is the correct jurisdiction for any initiation of legal action.”
Shailender however, said that it is up to the state to apply and secure the steward’s release and not the family.

MAS confirms it sacked employee for alleged sexual assault
Malaysia Airlines (MAS) today confirmed that it terminated the services of a flight attendant who had been held in a Paris detention centre since August for alleged sexual assault on a passenger.
But, in a statement to The Malaysian Insider, the national carrier said it was not at liberty to discuss the matter further as the case was under the judicial purview of the Industrial Relations Department (IRD).
”Malaysia Airlines is not at liberty to comment on the matter as it is currently under the judicial purview of the authorities and we confirm that the person is no longer an employee of the company,” the statement read.

KUALA LUMPUR (AFP) – Malaysia Airlines has sacked a steward for allegedly sexually assaulting a passenger who was scared of flying with the disaster-prone airline before any hearing into the incident had taken place, a union body said Thursday.
The crew member has been stuck in a detention centre at Paris’ Charles de Gaulle airport since August, after the passenger told French authorities that the steward has sexually assaulted her on a flight from Kuala Lumpur to the French capital.

Ismail Nasaruddin, president of the National Union of Flight Attendants Malaysia, said the 57-year-old steward was sacked by a letter on August 22 just two weeks after the purported incident took place.
“What Malaysia Airlines (MAS) did is a clear violation of natural justice. There has not been any hearing so far for the crew who is being held in Paris,” Ismail told AFP.
“MAS fired the crew based on the allegation,” he said. “They judged him guilty before the trial. This is injust.”

Ismail urged French authorities to allow the MAS crew member to return home immediately if there was insufficient evidence since his wife and three children are under severe emotional and financial stress.
“We have to ensure this crew gets some justice. Why punish the crew when he is not found guilty?” he said.

The more disheartening aspect of the sacking is that the steward is still in detention in Paris, having not even been charged or tried for the alleged offence yet.
Saying the sacking was unlawful, Ismail added that the union had now appealed to the Industrial Relations Department to re-instate the long-serving employee.
Speaking about the case, Ragunath Kesavan, a lawyer said, “The employee is deemed innocent until proven guilty by a court and MAS should have gone all the way to secure his freedom from the detention centre.”
Instead it is learned MAS distanced themselves from the incident and the only assistance the steward received was from Malaysian Embassy officials in Paris.
Shailender Bhar, who is representing the steward, said that under the Tokyo Convention, the steward should be sent home for investigation instead of being detained for months on end in Paris.
She added that the alleged incident did not even take place in France or their air space, thereby making his detention unlawful.

The National Union of Flight Attendants Malaysia (Nufam) today said there has been no admission of guilt by the Malaysia Airlines cabin crew member who had allegedly sexually assaulted a passenger.
Stressing that such media reports were untrue, the union also said that trial through the media “should be avoided at all costs”.
“Unsupported allegations are extremely painful for the family of the crew member and such allegations are also affecting the morale of other MAS crew members,” it said in a statement today.
As such, the union called on the authorities concerned to quickly carry out a thorough investigation into the matter and provide details to the public.
“The complaint should be expeditiously completed so that the truth will prevail.”
The union said this was especially necessary since the alleged victim had released a video of the incident and had made statements to the media even before the complaint has been fully investigated.

An Australian woman who had accused a Malaysia Airlines cabin crew member of sexually abusing her is set to go public to tell her side of the story, of how she was assaulted during a flight to Paris earlier this month.
News.com.au reported that the 26-year-old woman, known only as Laura, will also show footage of the assault which she had taken using her phone, on Seven’s Sunday Night show.
Laura said that she was sexually assaulted by the chief steward on board flight MH20 on August 4.
“I couldn’t stop it. I just froze. I was just scared,” she was seen telling Seven reporter Ross Coulthart in the promo video.

Laura, it was reported, had begun recording mid-flight after the assault had taken place.
A woman’s voice could be heard crying to a man sitting across the aisle.
She was heard saying: “You did, you did, you did, don’t lie. It’s what you did.
“I’m so scared. I just want to get off this plane… I don’t want to see you. Go away. You give me the creeps, you dirty old man.”
Laura made a report with the authorities upon reaching Paris’ Charles de Gaulle airport and the steward was detained two days later to assist in the investigations.
Laura said she was speaking out for the first time as she felt let down by the actions of the airline.

A Malaysia Airlines cabin crew member has been detained in France over allegations that he sexually assaulted an Australian passenger who was scared of flying with the disaster-prone airline.
French police have questioned a crew member following allegations by a female passenger of ‘inappropriate sexual behaviour’ on flight MH20 from Kuala Lumpur on August 4, the airline said in a statement on Thursday.
The Australian passenger complained to authorities about the incident after touchdown at Paris’ Charles de Gaulle airport, saying she had told crew at the beginning of the flight about her apprehension of flying with the airline in the wake of the two disasters.
The steward sat beside her and sexually assaulted her under the pretext of ‘comforting’ her, she said, according to a source close to the French probe.
Malaysia Airlines vowed to assist French authorities in their investigation, adding ‘the safety, comfort and well-being of our passengers is always our highest priority’.
‘Malaysia Airlines expects and accepts nothing short of the highest standards of conduct from its crew and takes any such allegations very seriously,’ it said.
The case, involving the chief steward of a Paris-bound flight, is the latest setback for the struggling national carrier, which was struck by twin tragedies this year when one of its passenger jets went missing and another was shot down over conflict-torn east Ukraine.
Malaysia Airlines Flight MH370 disappeared mysteriously in March with 239 people aboard, en route from Kuala Lumpur to Beijing. No trace has been found and the airline was widely criticised for its handling of the crisis.
On July 17, MH17 was shot down over Ukraine, with 298 people killed.
The airline stands on the financial brink after the disasters.

Three hours into the half-full flight to Paris, Laura Bushney, 26, said Mohd Rosli Bin Ab Karim sat beside her and allegedly began massaging her legs under the guise of “comforting her” and later put his hand down her pants.
She told Sunday Night, in an interview to air this week, she was terrified when the 54-year-old steward allegedly began touching her, but was “frozen in panic”.
“I just keep saying why didn’t I scream, why didn’t I shout? Why didn’t I stop it? I am a strong person because I can do that, I know I can.”
“When I was in the moment I couldn’t. I felt so scared, so petrified,” Ms Bushney said.
However, Ms Bushney recorded the alleged incident on the mobile phone wrapped in a scarf next to her pillow.

In the recording she can be heard whispering what Rosli was doing to her.
“He’s massaging my legs,” she can be heard saying.
“I’m so scared, I just want to get off this plane.”
After the passenger sitting in front of Ms Bushney, Canadian Sophie Lachance, 23, insisted Ms Bushney report what happened, the flight crew sat her down with the steward again.
She also filmed this confrontation, in which Rosli can be seen pleading with her and saying his “intentions were good”.
