Kampung Chubadak Tambahan residents not squatters, Court of Appeal rules

KUALA LUMPUR, Nov 13 — The Court of Appeal today declared today the residents of Kampung Chubadak Tambahan are not squatters, saying any attempt to displace them must come with adequate compensation.

The appellate court also reinstated the villagers’ suit in the Kuala Lumpur High Court that was struck out earlier this year.

“The Court of Appeal’s bench unanimously allowed the appeal of the residents to bring back their case for a hearing,” the residents’ lawyer Ahmad Zamri Asa’ad Khuzaimi told Malay Mail Online in a phone call.

“The main issue in this case is that the court recognises that the residents are not squatters. If they are squatters, they will not be eligible for anything,” said Zamri, who is also the chief of the Land and Urban Development Bureau for PAS Youth.

“They are licence holders in equity, and they deserve to reside there as they have been for tens of years.”

The case will now be heard in the Kuala Lumpur High Court on November 24.

Previously, the High Court Justice Datuk Nik Hasmat Nik Mohamed ruled that the villagers have no right to claim ownership over the land as they are “squatters” on a state-owned land, citing a Federal Court ruling in 1982 that declared the latter as having no right either in law or in equity.

The High Court has ruled in favour of DBKL and ordered the villagers to move out.

The 58 villagers involved were offered a chance to be evicted to Bukit Jalil and compensated with RM1,000 by the government and RM7,000 by the developer.

Protesters spray developer with graffiti

A group of villagers, politicians and activists demonstrated against the demolition of Kampung Chubadak Tambahan, near Sentul in Kuala Lumpur.

They marched from the Bandar Baru Sentul mosque to the developer’s office, about 1.5km away.

The protesters spray painted the developer’s office with insults such as ‘kapitalis bangsat’ (capitalist bastard) and “pengkhianat bangsa+t” (bastard traitor).

One demonstrator was wrapped in white cloth with the word ‘Chubadak’ in red, while uttering the words “I want my house back”.

According to the protesters, the activist shrouded in white cloth symbolised how Kampung Chubadak Tambahan is “dead and buried”.

Students arrested in village eviction at Kampung Chubadak

Two student activists were arrested today for allegedly interfering in the Kuala Lumpur City Hall (DBKL) eviction of squatters at Kg Chubadak Tambahan.

The arrested activists were Gabungan Mahasiswa Islam Se Malaysia (Gamis) committee member Ahmad Fahmi Mokhtar and Pro-Mahasiswa Nasional president Abdul Muqit Muhammad.

Fahmi is from the International Islamic University whereas Abdul Muqit is a Universiti Malaya student.

They were both arrested and brought to the Sentul Police Station.

KG CHUBADAK

According to media reports, the Kuala Lumpur High Court in 1998 had ruled that the area belonged to the city’s settlers and the parties concerned had to compensate them if they wanted to develop the area.

But in the year 2000, the Court of Appeal was reported to have decided that Kampung Chubadak was a squatter village, and residents were only allowed to occupy the area as licensees with the consent of the state.

The current status of the village will depend on the hearing in the High Court to be held on June 27.

Why pandas worth more, Chubadak villagers ask

About 80 disgruntled villagers from Kampung Chubadak Tambahan today staged a protest against the Kuala Lumpur City Hall’s (DBKL) move to tear down their houses.

Together with PAS deputy president Mohamad Sabu, Batu MP Tian Chua, PSM secretary-general S Aruthchelvan and NGO Anak chairperson Mazlan Aliman, the protesters stood outside the DBKL headquarters, jostling placards for attention.

They were waiting to hand over a memorandum to Mayor Ahmad Phesal Talib, asking that he respects a High Court order to hold off any more demolition.

Minister wants Kg Chubadak villagers to be reasonable

The 50-year-old Kampung Chubadak in Sentul is once again in the news.

Although the Lands and Mines Office (PTG) had given permission for the development of low-cost housing, the residents have refused to vacate the village.

Federal Territories Minister Tengku Adnan Tengku Mansor said the villagers had been asked to be rational over the development of low-cost housing in the area.

He said the housing project comprising 500 units of affordable homes would provide significant benefits and opportunities for more people who could not afford to stay in Kuala Lumpur.

“The truth is, the notice of withdrawal has been issued by the Federal Territory Land Office, and the land belongs to the PTG.

“The PTG gave the land to develop low-cost houses in the area, and I appeal to the (Kampung Chubadak) residents, especially the four or five people who are only thinking of themselves, to be reasonable.

“When we develop the low-cost housing, many more people can live there,” he told a press conference after launching a dengue-free programme for the Federal Territory organised by the Foundation for Urban Wellbeing and PPR Seri Semarak Residents Association today.

Chubadak village to be turned into graveyard, says minister

KUALA LUMPUR, June 19 — The land where Kg Chubadak Tambahan sits will be used as a graveyard, Federal Territories Minister Datuk Seri Tengku Adnan Tengku Mansor said today.

Tengku Adnan said that the villagers who had been living on the land for decades have to leave, adding that talks on their resettlement was still ongoing.

“They have to move because firstly it’s not their land. It’s not DBKL’s (Kuala Lumpur City Hall’s) land as well.

“The land is owned by the Land and Mines Office and is supposed to be given to the religious department to build a graveyard,” he told reporters.

On Tuesday, Kuala Lumpur mayor Datuk Seri Ahmad Phesal Talib was reported as saying that the Kuala Lumpur City Hall will tear down remaining homes in Kg Chubadak Tambahan despite a High Court injunction prohibiting such action until June 26.

“This is what they have filed, (but) we will continue demolition work,” the mayor was quoted saying by news portal Malaysiakini, referring to the villagers’ injunction obtained on June 12.

Tengku Adnan said today the authorities will not tear down the houses until the injunction expires.

“We will hold it until the time comes. We won’t do anything, we will follow whatever the court ordered,” he said.

The status of the land in Kg Chubadak Tambahan is still pending on  a High Court case due to be heard on June 27, with villagers insisting that they own the land as urban pioneers.

A Court of Appeal decision in 2000 had previously refuted claims that the villagers were squatters and trespassers, insisting that they occupied the land as licensees and with the consent of the state authority.

However, DBKL went ahead and demolished three houses on Monday last week as part of a clearing process that had started in 2013 in order to make way for future development.

The demolition was temporarily halted on Thursday, however, after activists and PAS representatives managed to obtain a High Court injunction, staying the demolition until the case is heard.
