Seorang bekas pemandu van yang sedang menjalani rawatan psikiatri, diperintah membela diri terhadap pertuduhan membunuh dua lelaki, dalam kejadian amuk di Stesen Transit Aliran Ringan (LRT) Taman Melati, Kuala Lumpur, dua tahun lepas.

Hakim Mahkamah Rayuan Datuk Aziah Ali yang mengetuai panel tiga hakim membuat keputusan itu selepas membenarkan rayuan pihak pendakwaan supaya Muhammad Zamri Yusof, 28, dipanggil membela diri terhadap dua pertuduhan membunuh itu.

Hakim Aziah yang bersidang bersama-sama Hakim Datuk Tengku Maimum Tuan Mat dan Hakim Datuk Ahmadi Asnawi juga mengetepikan perintah Mahkamah Tinggi supaya Muhammad Zamri ditahan di Hospital Bahagia Tanjung Rambutan, Ulu Kinta, Perak untuk menjalani pemeriksaan kesihatan mental mengikut Seksyen 348(1) Kanun Prosedur Jenayah.

Hakim Mahkamah Tinggi Kamardin Hashim membuat perintah itu pada 4 Mac 2015.

Muhammad Zamri didakwa membunuh penjual peralatan tulis, Lee Kah Ghee, 44, di hadapan stesen LRT Taman Melati antara pukul 11 pagi hingga 12 tengah hari, 24 Okt 2013.

Muhammad Zamri juga didakwa membunuh seorang pelajar Kolej Tunku Abdul Rahman (TAR), Kwan Chun Thai, 25, di tepi tiang LRT bernombor P 24/55, Kampung Wira Jaya Luar, Jalan Tumbuhan, Wangsa Maju, pada waktu dan tarikh yang sama.

Mahkamah Tinggi memerintahkan Muhammad Zamri ditahan di Hospital Bahagia untuk pemeriksaan kesihatan mentalnya di akhir kes pendakwaan tanpa memanggil tertuduh membela diri terhadap pertuduhan membunuh itu.

Terdahulu, Timbalan Pendakwa Raya Nurshafini Mustafha berhujah bahawa perintah hakim itu salah kerana tertuduh sepatutnya dipanggil membela diri untuk membuktikan dia tidak waras semasa kejadian.

Beliau berhujah hakim itu membuat perintah berkenaan berdasarkan laporan pemeriksaan psikiatri dari sebuah hospital yang dikemukakan melalui pegawai penyiasat semasa perbicaraan kes itu di akhir kes pendakwaan.

Katanya, sebanyak enam saksi pihak pendakwaan dipanggil memberi keterangan.

Peguam Jayananda Rao pula membantah rayuan pihak pendakwaan supaya anak guamnya dipanggil membela diri atas alasan perintah Mahkamah Tinggi itu adalah betul.

The High Court ordered Muhammad Zamri to be detained at Bahagia Hospital for his mental health examination at the end of the prosecution case without calling the accused to defend himself against the murder charge.

Earlier, Deputy Public Prosecutor Nurshafini Mustafha argued that the judge’s order was wrong because the accused was supposed to be called on to defend himself to prove he was insane during the incident.

He argued that the judge made the order based on a psychiatric inspection report from a hospital lodged by an investigating officer during the trial of the case at the end of the prosecution’s case.

He said six prosecution witnesses were summoned to testify.

Jayananda Rao’s counsel denied the prosecution’s appeal for his client to be called on to defend himself on the grounds that the High Court order was correct.

KUALA LUMPUR: A delivery man who allegedly went on a rampage in Wangsa Maju here last month has been charged with the murder of two of four people he allegedly attacked.

No plea was recorded from Muhammad Zamri Yusof when magistrate Erry Shahriman Nor Aripin read out the charges of murdering stationery shop employee Lee Kah Ghee, 48, and college student Kwan Chun Thai, 25.

The killings allegedly occurred at two separate spots near the Taman Melati LRT station between 11am and noon on Oct 24.

Muhammad Zamri, 26, is alleged to have fatally stabbed Lee in front of the station at Persiaran Pertahanan and Kwan near an LRT rail pillar at Jalan Tumbuhan near Kampung Wira Jaya Luar.

If convicted, he faces the mandatory death penalty under Section 302 of the Penal Code.

Police confirmed that the man did not suffer from mental illness and they are in the midst of ascertaining drugs used when he went berserk.

KUALA LUMPUR: The 26-year-old man who ran amok and killed two passer-by near the Gombak LRT station on Oct 24 would most likely be charged at the Jalan Duta court tomorrow.

Speaking to reporters today, Kuala Lumpur CID Chief Ku Chin Wah confirmed that the man from Felda Pemanis Segamat in Johor did not suffer any mental illness as earlier speculation suggested.

Ku then added that police were still waiting for a toxicology report to determine the type of drug used by the suspect prior to the attack, which took the lives of two men aged 25 and 48.

“He was carrying a big weapon, which could not be concealed, in full view of other people who were pot­ential witnesses to the attack,” said Dr Geshina, who is also a Universiti Sains Malaysia’s (USM) Forensic Science Programme lecturer.

Dr Geshina said it was likely something had set the man off, resulting in him running “amok”, killing two people and injuring two others.

“From what I have gathered, he picked the victims at random. But the question is, what drove him to commit these attacks?” she said.

Kwan said Chun Tai, though only 25, managed four clothing retail stores in major shopping malls in the city and was a month away from graduating with his third degree.

KUALA LUMPUR – Two motorists were stabbed to death minutes apart when a knife-wielding cigarette delivery man ran amok and went on a spree attacking several people at Taman Melati, Gombak today.

A 60-year-old owner of a food booth at the Gombak LRT station and her 40-year-old pregnant employee who is a foreigner were also knifed by the man in the attack that began at 11.20am.

It took several bystanders who intervened to subdue and apprehend the 26-year-old suspect after he had killed his last victim, a 25-year-old man identified as Kuan Chun Tai, believed to be a student of a nearby college.

The other dead victim was a toy salesman identified as Lee Kha Ghee who was driving a van with a female passenger.

It is learnt that the man who was armed with a survival knife was handed over to the police at the scene and sent to the Kuala Lumpur Hospital (KLH) for the injuries he sustained while being disarmed by bystanders.
