In a surprising turn of events, businessperson Tan Boon Eng, who was charged with giving a bribe of RM1 million to former minister Tengku Adnan Tengku Mansor, has pleaded guilty to an alternative charge today.
The process was done in camera, where the media were not allowed to cover the court proceeding earlier today.
The Kuala Lumpur High Court fined Tan RM1.5 million after he pleaded guilty to the alternative charge under Section 165 of Penal Code for abetting Tengku Adnan in committing the offence.
Justice Mohd Nazlan Mohd Ghazali said Tan will be sentenced to one year in prison if he fails to pay by tomorrow.
Meanwhile, deputy public prosecutor Julia Ibrahim said Tan will be made one of the witnesses in the corruption trial against the former federal territories minister.
In November last year, Tan was charged under Section 16(b)(A) of the Malaysian Anti-Corruption Act 2009 with bribing Tengku Adnan via a Public Bank cheque belonging to Pekan Nenas Industries Sdn Bhd, which was deposited into the former minister’s CIMB account.
The alleged payment, made on Dec 27, 2013, was for Tengku Adnan, who is widely referred to as Ku Nan, for giving approval to the company’s application to increase the plot ratio for land on Jalan Semarak, Kuala Lumpur.
Tan also faces an alternative charge under Section 165 of Penal Code for abetting Tengku Adnan in committing the offence, and punishable under Section of 109 of Penal Code.

Businessman fined RM1.5 mil over RM1 mil bribe for Ku Nan

KUALA LUMPUR: The High Court today fined a property developer RM1.5 million after he pleaded guilty to abetting in giving a RM1 miilion bribe to former Federal Territories minister Tengku Adnan Tengku Mansor over land deals involving Kuala Lumpur City Hall.
Judge Mohd Nazlan Mohd Ghazali said Tan Eng Boon must pay the fine by tomorrow.
“I took into account public interest and the interest of the accused in imposing the sentence,” the judge said.
Tan, 70, pleaded guilty to an amended charge under Section 165 of the Penal Code which carries a two-year jail term or a fine or both upon conviction.

On Nov 15, Tan, who is a company director, pleaded not guilty to a charge of offering a bribe in the form of RM1 million though a Public Bank cheque belonging to Pekan Nenas Industries Sdn Bhd which was deposited into a CIMB Bank account belonging to Tengku Adnan.
Tan, 70, was alleged to have given the bribe as an inducement to Tengku Adnan for approving an application by Nucleus Properties Sdn Bhd (now known as Paragon City Development Sdn Bhd) to raise the ratio plot for development at Lot 228, Jalan Semarak, Kuala Lumpur.

KUALA LUMPUR: The prosecution in the case of a businessman charged with giving a bribe of RM1 million to former federal territories minister Tengku Adnan Tengku Mansor will file an application to transfer the case from the Sessions Court to the High Court here.
Deputy public prosecutor Lailawati Ali informed the court of this when the case, involving Tan Eng Boon, came up for mention before Sessions Court judge Azura Alwi today.
“The prosecution will apply for the case to be transferred to the High Court and will also file an application for it to be jointly tried with a case facing Tengku Adnan as both cases involve the same issue and transaction,” she said.
She also told the court that the case involving Tengku Adnan had been transferred to the High Court here after judge Collin Lawrence Sequerah allowed an application by the Putrajaya MP on the matter last Friday.
Lawyer Cheow Wee, representing Tan, said the defence had taken note of the latest development and requested time to obtain further instructions from their client.
Azura then set Jan 7 for mention.

3.40pm – Over at another court, businessperson Tan Eng Boon is charged with abetting Tengku Adnan in committing graft.

Tan, 70, is accused of handing an RM1 million cheque on Dec 27, 2013 to Tengku Adnan. An interpreter reads the charge in Mandarin, following which Tan claims trial.
A lengthy argument took place during the bail process, with prosecutors demanding that the court sets bail at RM3 million on grounds that he is a flight risk because he goes to Singapore regularly for business.
Tan’s lawyer Faisal Moideen argues that the amount sought by the prosecution was punitive in nature because the subject matter involves RM1 million and the accused is cooperative with the authorities.
Faisal also points out that his client appeared at the dock today without being arrested and that his client did not abscond from another trial in Johor Bharu, where he handed over RM700,000 in bail money.
DPP Ahmad Akram Gharib argues that this case is different.
“Now, he is facing (a maximum) 20 years jail sentence. For a 70-year-old, who is listening to a charge that can send him to jail for the rest of his life, it is a different situation,” says Ahmad.
Eventually, Judge Azura Alwi sets bail at RM700,000 and demands that Tan reports to the nearest MACC’s to his residence every month and provide his travel itinerary for all international travels, except for Singapore, one week before departure.

KUALA LUMPUR, Nov 15 — Real estate developer Datuk Tan Eng Boon was today charged with bribing former Federal Territories minister Datuk Seri Tengku Adnan Tengku Mansor with RM1 million.
Tan claimed trial to the charge under the Malaysian Anti-Corruption Commission Act 2009 which was read out to him in Mandarin by the court interpreter.
Tan, 70, was charged with committing the offence at CIMB Bank’s Pusat Dagangan Dunia branch on Jalan Tun Ismail, where he allegedly handed over the RM1 million cheque to Tengku Adnan.
The court heard that the cheque was issued by Tan under Pekan Nenas Industries Sdn Bhd for increasing the density of a plot of land in Jalan Semarak for development by Nucleus Properties Sdn Bhd (now known as Paragon City Development Sdn Bhd), which had an official deal with Tengku Adnan’s ministry.
Judge Azura ordered Tan to report to the nearest Malaysian Anti-Corruption Commission (MACC) office every month and inform the court seven days prior to leaving the country for anywhere other than Singapore since he travels there often for business and medical reasons.
Tan paid the bail and his two bailors are his son and nephew.
Tan, who has been referred to in past news reports as a “real estate tycoon”, is also the chairman of ceramic products company, Goh Ban Huat Bhd (GBH).
Tan is a shareholder of NipponKey Sdn Bhd with his two sons, Edwin Tan Pei Seng and Goodwin Tan Pei Poh, holding a 40 and 30 per cent stake respectively.

That same man, Datuk Tan Eng Boon, was charged with corruption in relation to the sale of several plots of land owned by Kuala Lumpur City Hall (DBKL) today.
Tan first made ripples in the corporate sector when his sons — through their company Paragon Adventure — conducted a successful takeover of public-listed Goh Ban Huat last year.
Paragon Adventure is owned by Datuk Seri Edwin Tan and Datuk Seri Godwin Tan, and is involved in property developments in Johor.
Tan founded the Joland Group, a private property developer incorporated in 1990, and is seen as among the leading players in the sector.
Joland Group has over the years diversified into property development of high rise and luxury serviced apartments, factories, township developments, retail investments and hospitality and leisure, according to the company’s website.
It currently aims to grow under the brand “Paragon” and is currently developing five ongoing projects in Johor, namely the Paragon Residences @ Straits View, Paragon Suites @ CIQ, Skudai Bizhub, the Paragon Square, a shopping neighbourhood mall at Jalan Tampoi, Johor and Pekan Nenas Industrial Park-Phase II.
