KUALA LUMPUR: Pakatan Harapan’s Rantau candidate Dr S. Streram’s (pic) suit against a returning officer and the Election Commission (EC) over alleged misuse of power is set to go to trial.
Dr Streram filed the RM7.6mil suit claiming misfeasance in public office and had named returning officer Amino Agos Suyub and the EC as the defendants.
High Court Judicial Commissioner Daryl Goon ordered a full trial after dismissing Amino Agos and the EC’s application to strike out the suit on grounds that the court was satisfied the legal action was filed separately from the election petition.
Dr Streram’s lawyer Mohamed Haniff Khatri Abdulla told reporters after proceedings in chambers yesterday that the court ruled that the present lawsuit was not related to an election petition filed by his client.
The election petition hearing is set to start on Sept 12 at the Seremban High Court.

GE14 | The controversy involving PKR candidate Dr S Streram at Dewan Undangan Negeri Rantau on nomination day for the 14th general election on Saturday was something that was pre-planned to sabotage the candidacy of BN’s nominee for the Rembau parliamentary seat, Khairy Jamaluddin, said caretaker Negeri Sembilan menteri besar Mohamad Hasan.
He said it was also staged to give a negative perception of the Election Commission besides trying to show to the world that politics in Malaysia was not fair.
Mohamad said Pakatan Harapan now was trying to confuse voters there that since he had won the Rantau state seat uncontested, they need not come out to vote on polling day on May 9.
“I urge voters in Rantau, locals and outstation voters alike to turn out in full force to support Khairy,” he told reporters after performing the groundbreaking for Masjid Baharu Gemas and handing over land titles to Felcra Bukit Jelai settlers in Gemas today.

‘Stage drama’ to show Indian barred from nomination centre, says caretaker MB
GE14 | Caretaker Negeri Sembilan Menteri Besar Mohamad Hassan has accused Pakatan Harapan of creating a “stage drama” targetted at Indian voters.
He was responding to PKR candidate Dr S Streram not being allowed to enter the nomination centre last Saturday for not wearing the Election Commission (EC) tag, resulting in Mohamad winning the Rantau state seat uncontested.
Speaking to Umno Online, the BN leader said Indian voters made up 27 percent of the electorate in Ranau.
He accused the opposition of exploiting the issue to incite Indian voters both in Ranau and nationwide.
“They made it (the issue) viral to show how Umno and BN did not allow an Indian candidate to enter (the nomination centre), when in fact, they don’t know that the candidate did not have a pass
“People would only see an Indian not allowed. This is their dirty tactic. (Dr) Mahathir (Mohamad) wore a pass, (caretaker prime minister) Najib (Abdul Razak) wore a pass.
“My wife who accompanied me could not enter (the nomination centre). I arrived 20 minutes early, and I was not allowed to stand in the shade next to the hall because it was not time (for the nomination process).
“To me this is just ‘stage drama’ to belittle and show how malicious BN is to the people and voters for not allowing an Indian candidate to enter. This is slander and they are good in this,” he added.
Mohamad pointed out that during elections, it is the EC which decides, and dismissed allegations that he had conspired with the commission to prevent Streram (photo) from entering the nomination centre.
The caretaker menteri besar said he was equally puzzled as to why the PKR candidate did not take his tag.
Mohamad also claimed that he was eager to contest in the election and was prepared to face his challenger.
“He (the PKR candidate) was chased out when he entered my kampung, ‘dia tidak laku’, not accepted by the people. So don’t make unwarranted allegations,” he added.

This is the culprit who did not allow Dr. Ram to submit his nomination. He is an active UMNO member. How could the Election Commission allow UMNO members to be Returning Officer? The EC Chairman should respond.

Khairy wants to ‘bury Rafizi once and for all’
KUALA LUMPUR: Khairy Jamaluddin will pursue his plans to sue Rafizi Ramli for defamation if the PKR vice-president refuses to retract an accusation that Barisan Nasional (BN) was responsible for barring a PKR candidate from contesting the 14th general election (GE14).
“I want to bury him once and for all because I can’t accept his lies, especially about my electoral integrity,” the Umno Youth chief said during a walkabout in Bangsar here.
BN’s Negeri Sembilan Menteri Besar Mohamad Hasan won the Rantau state seat uncontested after PKR’s Dr Streram Sinnasamy was disallowed from entering the nomination centre at the Seri Rembau Hall on Saturday because he did not have an EC pass.
Khairy, who is youth and sports minister, said the incident was not a “fiasco” as alleged because it had nothing to do with BN.
“The fiasco lies with Rafizi who has made unsubstantiated claims about the involvement of me and the MB,” said the incumbent MP of Rembau in Negeri Sembilan, who is defending his seat.
Earlier today, Rafizi said he would be more than happy to see Khairy in court.
He said Streram could have easily won if he was allowed to contest.
This was because Streram had worked the ground for the past two years in Rantau where support had since shifted to Pakatan Harapan (PH), he said.
He claimed Streram had been “purposely kicked out” as Mohamad and Khairy were “afraid to lose”.
Pakatan Harapan’s Rantau candidate Dr S Streram has given the Election Commission until 5pm on Wednesday to rectify the nomination day fiasco of not registering him as a candidate, failing which a petition on the tort of misfeasance in public office will be filed in court.
He stated this in a letter of demand issue to the EC today.
In addition, Streram also lodged two police reports against the returning officer and the EC under Section 124B and 124C of the Penal Code for disrupting the process of parliamentary democracy by not allowing him to be a candidate in Rantau.
His lawyer Mohd Haniff Khatri Abdulla said EC should rectify the mistakes they have created as the law appears to disallow a challenge on the disqualification.
“The problem is not created by Streram as he had fulfilled all his conditions by paying the deposit on Wednesday, before nomination day, and also filled the forms as required.
“The requirement of not wearing an EC tag does not warrant a disqualification. It is just a procedure and it does not disqualify one from contesting,” he said in a press conference held at his office in Kota Damansara.
Haniff stressed that his client was told that he could collect the EC pass at 8am.
However, he added, nothing was forthcoming and the authorities instead prevented him from entering the nomination centre.
The lawyer said the letter of demand was sent to the EC headquarters in Putrajaya and its office in Seremban.
