Bullied student wins RM616k in suit against assailants, teachers and gov’t

A bully victim who suffered permanent ear damage has been awarded RM616,634.20 by the Kuala Terengganu High Court.
The boy, now aged 17, had sued five of his bullies who are now 21 years old, over an incident at Sekolah Menengah Sains Sultan Mahmud four years ago.
He also named the school’s senior assistant for students’ affairs, then principal, the Education Ministry director-general and the Malaysian government as defendants.
High Court judge Zainal Azman, in his judgment, found that the school was negligent in allowing the bullying to happen in the prefect’s dormitory, according to a Harian Metro report.
“The school is seen to be negligent for not conducting patrols. It happened in the prefect’s dormitory, not by the drain or by the sidewalk.
“The warden’s roster was nicely arranged but it is useless if the duty is not carried out. It is better to resign and be an ordinary teacher.
“The sixth (senior assistant) and the seventh defendant (principal) were negligent in their duties to ensure the welfare of the school, particularly the safety of students,” he said.
In the April 26, 2015 incident, the victim was kicked and slapped by then Form Five students.
As a result, the boy, then in Form 2, had his eardrum rupture. He can no longer engage in water-based activities following the injury.
The report said the boy, who scored 5As in his UPSR examination in 2013, also suffered depression from the bullying and eventually transferred to another school in July 2015.
The boy’s mother Rusaila Abdullah, 43, said she is thankful for the court’s decision.
“We are not after money but justice for our son who until today is still traumatised and have lost his hearing due to the bullying,” he said.

KUALA TERENGGANU: Mahkamah Tinggi di sini, hari ini, memerintahkan sembilan pihak termasuk lima bekas pelajar Sekolah Menengah Sains Sultan Mahmud (SESMA) membayar tuntutan RM616,634.20 kepada seorang bekas pelajar sekolah itu yang menjadi mangsa buli, empat tahun lalu.
Hakim Datuk Zainal Azman Ab Aziz membuat keputusan itu selepas membenarkan tuntutan difailkan plaintif yang ketika kejadian berusia 14 tahun menerusi bapanya, Ahmad Fauzi Abdullah, 50, pada 2 April 2017.
Zainal Azman memerintahkan lima pembuli yang juga bekas pelajar sekolah itu selaku defendan pertama hingga lima yang kini berusia 21 tahun; Penolong Kanan Hal Ehwal Murid, Sulaiman Ngarif (defendan keenam), bekas pengetua SESMA, Meriam Jusoh (defendan ketujuh), Ketua Pengarah Kementerian Pendidikan Malaysia (defendan kelapan) dan kerajaan Malaysia (defendan kesembilan) membayar tuntutan itu.
Dalam penghakimannya Zainal Azman berkata, kejadian buli pada pada 26 April 2015 membabitkan plaintif yang ketika itu berusia 14 tahun menampakkan kecuaian pihak sekolah dan seperti dirancang kerana ia berlaku di bilik asrama ketua pengawas.

In the lawsuit made through Messrs Wan Azleana Wan Adnan and Associates, the victim claimed that he was bullied, his perpetrators holding him for three hours at the head prefect’s room in the school’s hostel. He suffered bodily injuries including a cut on his right ear and loss of hearing.
The incident happemed at Sekolah Menengah Sains Sultan Mahmud (SESMA), Wakaf Tembesu on 26 April 2015.

Student sues bullies, school for RM2mil in damages
KUALA TERENGGANU: A victim of school bullies today filed a RM2 million lawsuit against nine people, including five of the bullies, at the High Court here today.
The lawsuit was made through the 16-year-old student’s father, Ahmad Fauzi Abdullah, 46.
The legal action taken involved an incident which took place at the teenager’s school in Wakaf Tembusu on April 26 last year.
The student had claimed that the bullying had not only caused him physical injuries but emotional distress as well.
He filed the suit against five of his former seniors, the student affairs senior assistant, the former headmaster and two others.
Ahmad Fauzi said the lawsuit was to ensure that justice would prevail and those responsible for allowing the bullying culture to proliferate would be held accountable.

“As a result of the bullying, my son is unable to carry on with his life in a normal way as he is still traumatised by the incident.

Mangsa buli tuntut RM2 juta
Tuntutan pelajar berusia 16 tahun itu dibuat menerusi bapanya, Ahmad Fauzi Abdullah, 46, berkaitan kejadian buli di Sekolah Menengah Sains Sultan Mahmud (SESMA), Wakaf Tembesu pada 26 April 2015 hingga menyebabkannya mengalami kecederaan dan tekanan perasaan.
Selain saman terhadap lima pembulinya yang juga bekas pelajar seniornya, remaja berkenaan turut menamakan Penolong Kanan Hal Ehwal Murid SESMA, bekas Pengetua SESMA, Ketua Pengarah Kementerian Pendidikan Malaysia dan Kerajaan Malaysia dalam tuntutannya.
Ahmad Fauzi berkata, tuntutan itu dibuat untuk menyedarkan pihak yang bertanggungjawab dan masyarakat bahawa buli adalah budaya amat merbahaya jika dibiarkan serta kejadian berkenaan menyebabkan anaknya sakit dan berubah sikap.
