MonSpace owner sues MP over alleged illegal business claim

PETALING JAYA: The founder of an e-commerce firm has filed a lawsuit against Kepong MP Lim Lip Eng over alleged defamatory statements the DAP representative made against her and her company two years ago.

Businesswoman Jessy Lai claimed Lim had tarnished her reputation and that of her company MonSpace (M) Sdn Bhd by making statements that she was running an illegal business and had cheated Chinese investors.

She said the MP’s statements, published in the English and Chinese media, had implied that she was a dishonest person.

Lai said Lim had made the statements in May 2017 and November 2018 when he took a group of individuals, purportedly MonSpace’s investors, to her office and subsequently lodged police reports against her.

“My lawyers previously sent a letter of demand, asking him to apologise but he refused to do so,” Lai said in her suit.

She claimed that Lim’s statements had stirred up pressure from the authorities such as the police, Bank Negara Malaysia and the domestic trade and consumer affairs ministry to take action against her.

“His actions led to me being prosecuted in court on May 8 under the Direct Sales and Pyramid Scheme Act,” she said.

Lai is seeking an unspecified amount of general, aggravated, and specific damages from Lim.

She is also seeking an injunction to stop Lim from publishing further defamatory remarks against her.

Lawyer Andy Yong, representing Lai, said the High Court here had fixed June 26 for case mention.

Lai and her company made headlines in 2016 when an airlines group linked to them was found operating a commercial flight without a valid air service permit. The group was later fined RM380,000 after pleading guilty to the offence.

More than 70 Chinese nationals had lodged police reports on a “misleading” investment scheme run by MonSpace then. DAP MPs at the time had voiced concern over MonSpace and the supposed scheme.

Lai previously said 16 of her company’s premises had been raided by the domestic trade and consumer affairs ministry.

PETALING JAYA: The businesswoman behind Suasa Airlines has denied operating a flight without a permit.

Jessy Lai, the founder of MonSpace Group which owns the airline, was quoted in China Press as saying that the Department of Civil Aviation (DCA) had allowed the flight to take off from the Kuala Lumpur International Airport (KLIA) to Langkawi last Friday evening.

She had also reportedly posted on her Facebook page two letters from the DCA which purportedly allowed the airline to operate flights for 72 hours (from last Friday).

Yesterday, the Malaysian Aviation Commission (Mavcom) revealed that Suasa Airlines was under probe for operating a commercial flight without a valid Air Service Permit (ASP), and that it had on June 22, rejected an application from the airline to fly the KL-Langkawi route.

Meanwhile, Segambut MP Lim Lip Eng has asked the Government and the Chinese embassy here to probe whether Lai was carrying out a “Nanning” investment scam behind the facade of the airline.

He was quoted by the daily as saying that Lai was a former associate of China national Zhang Jian, who once proclaimed to be the “future richest man in the world” and ran the YSLM multi-level marketing scheme, which is said to have conned people in China and Malaysia of some RM900 million. The 26-year-old was arrested in Thailand in December 2014.

Transport minister says ‘perturbed’ licence-less airline took to skies

KUALA LUMPUR, July 25 — Transport Minister Datuk Seri Liow Tiong Lai today said Suasa Airlines should not have been allowed to fly.

“This is a very serious offence. How can you fly without a licence?” Star Online reported Liow as saying.

Earlier this evening, the Malaysian Aviation Commission (Mavcom) announced it would investigate Suasa Airlines for its July 22 flight from Kuala Lumpur to Langkawi, despite Mavcom’s rejection of its application.

Liow reportedly said Suasa Airlines had operated without obtaining an Air Service Permit (ASP) from Mavcom.

He added that although Suasa Airlines had received “technical approval” from the Department of Civil Aviation (DCA) in the form of an Air Operator’s Certificate (AOC), it did not give the company the authority to start flying.

“In view of this, I’m very perturbed by the way Suasa Airlines is using Monspace Airlines to fly.”

Liow said the action risked its AOC being revoked by DCA and he had directed Mavcom to investigate the matter and lodge a police report, adding that DCA will ask Suasa Airlines to explain.

To add to its troubles, Suasa Airlines will also be questioned by DCA to explain why it featured an unlicenced airline’s brand name on its aircraft.

Mavcom probing 2 airlines for operating without licences

Aviation authority advises consumers to refrain from making any flight arrangements with Suasa Airlines and Monspace Sky Airlines to ensure they do not face any inconvenience in their travels.

PETALING JAYA: The Malaysian Aviation Commission (Mavcom) is investigating Suasa Airlines for operating commercially without an Air Service Permit (ASP).

“In order for an entity to operate a commercial airline business, there is a requirement to have an ASP and an Air Operator Certificate (AOC),” the aviation authority said in a statement today.

Mavcom also said it had previously rejected an application by Suasa Airlines to operate a commercial flight from Kuala Lumpur to Langkawi on July 22, 2016.

However, according to Mavcom, Suasa Airlines continued to fly the said flight as a “demonstration flight”.

On a separate matter, Mavcom said it would lodge a police report against Monspace Sky Airlines for marketing themselves as an airline despite not holding an ASL or ASP.

Despite its star-studded launch yesterday, the transport ministry said it was unaware of MonSpace Sky Airline, with minister Liow Tiong Lai claiming that he had never heard of such an airline.

The airline is said to be operating from the Kuala Lumpur International Airport (KLIA).

Mavcom also advised consumers to refrain from making any flight arrangements with Suasa Airlines and Monspace Sky Airlines to ensure that they do not face any inconvenience in their travels.

KUALA LUMPUR — The Malaysian Aviation Commission (Mavcom) announced on Monday (July 25) an investigation against Suasa Airlines which flew to Langkawi last week without the necessary licence and approval.

The aviation regulator advised the public not to use the services of the company, which it said did not have the required Air Service Permit (ASP) to carry out commercial flights.

“As of today, Suasa Airlines does not possess a valid ASP and therefore cannot perform a commercial air service operation. In order for an entity to operate a commercial airline business, it is required to hold an ASP and an Air Operator Certificate (“AOC”),” the commission said in a statement.

MAVCOM investigates Suasa Airlines, lodges report against Monspace Sky Airlines

In the case of Suasa Airlines, MAVCOM said the company had applied to operate a commercial flight from Kuala Lumpur to Langkawi on July 22, but it was rejected.

“However, on the same day, Suasa Airlines continued to operate the flight as a ‘demonstration flight’ which was now being investigated by MAVCOM,” it said.

It said without a valid ASP, Suasa Airlines could not perform a commercial air service operation.

“MAVCOM would also like to advice consumers to refrain from making any flight arrangements with Suasa Airlines and Monspace Sky Airlines to ensure that they do not face any inconvenience in their travels,” it added.

Set up on March 1, 2016, MAVCOM is an independent body which regulates economic and commercial matters relating to civil aviation.

Meanwhile, Civil Aviation Department (DCA) Director-General Datuk Sri Azharuddin Abd Rahman clarified that Suasa received its provisional ASP on 15th December 2015.

“Following that, Suasa applied to DCA for an Air Operator Certificate (AOC) on 18th January 2016,” he said in a statement.

“After a thorough audit and inspection on Suasa’s technical ability, the DCA issued the AOC on 22nd July 2016.

“Subsequently, Suasa will have to pursue with MAVCOM to have its full ASP which until this media statement is released has not been issued,” he said.

Therefore, Azharuddin said, Suasa Airlines shall not conduct any commercial air transport operations without both of the AOC and ASP approvals.
