PUTRAJAYA: The Court of Appeal has acquitted and discharged a 25-year-old man on a charge of stealing a mobile phone at Low Yat Plaza in 2015.
A three-man panel comprising Justices Mohtarudin Baki, Yaacob Md Sam and Abdul Karim Abdul Jalil allowed Shahrul Anuar Abdul Aziz’s appeal to set aside his conviction and the four months’ imprisonment and RM1,000 fine imposed on him by a magistrate’s court.
Justice Mohtarudin, who chaired the panel, said it was the court’s view that Shahrul Anuar’s appeal had merits as the Court of Appeal found that the magistrate had committed a serious misdirection of law tantamount to a miscarriage of justice.
“If you have done it, you should repent and if you did not, it’s a test from God,” Justice Mohtarudin told Shahrul Anuar.
He said the prosecution’s cross-appeal against the inadequacy of the jail sentence was also nullified since Shahrul Anuar’s appeal had been allowed.
On May 24, 2016, Shahrul Anuar was found guilty by a magistrate’s court and was sentenced to four months’ jail and fined RM1,000 for stealing the phone which was under the care of shopkeeper See Ming Ho at Techasia Boutique, Low Yat Plaza in Bukit Bintang, Kuala Lumpur.
His appeal against conviction and sentence was dismissed by the High Court on April 5, last year.
Shahrul Anuar’s lawyer Datuk Shaharudin Ali told the court that his client had nothing to do with the purported commotion at Low Yat Plaza, adding that the incident was created by a different person and his client was caught in between.

Youth in Low Yat phone theft case loses appeal

KUALA LUMPUR: A youth who was found guilty of stealing a RM800 smartphone at Low Yat Plaza two years ago, failed in his appeal to set aside his conviction for theft.
High Court Judicial Commissioner Ab Karim Ab Rahman ruled that the Magistrate’s Court did not make any error in finding Shahrul Anuar Abdul Aziz guilty of stealing the phone.
“The accused had failed to raise a reasonable doubt to the prosecution’s case.
“Therefore, the court finds him guilty under Section 379 of the Penal Code for theft instead of Section 380, which was the original charge,” he said.
Shahrul initially claimed trial on July 14, 2015, under Section 380 for phone theft.
Section 380 relates to any theft committed inside a building premise.
Karim also dismissed the prosecution’s appeal to increase Shahrul’s 4-month jail sentence.
“The Magistrate’s decision to impose a jail term of four months is sufficient,” he added.
Karim allowed lawyer Shaharudin Ali, representing Shahrul, a stay of execution on the jail sentence pending his final appeal at the Court of Appeal.
The case had originated from the Magistrate’s Court, and the final avenue for Shahrul to beat his charge will be at the appeals court.
Last year, he was jailed four months and fined RM1,000 by the Magistrate’s Court for stealing a Lenovo smartphone at Low Yat Plaza.
Shahrul paid his RM1,000 fine.

On May 24, Shahrul Anuar was jailed for four months and fined RM1,000 by the Magistrate’s Court in Kuala Lumpur after being found guilty of stealing a mobile phone at Low Yat Plaza.
However, the court allowed a stay of execution pending appeal at the High Court.
Shahrul Anuar was also fined RM2,000 by the Magistrate’s Court on Feb 12 after pleading guilty to using methamphetamine on July 12 last year.

Low Yat phone thief gets discharge for assault
An unemployed man who was previously jailed and fined for stealing a mobile phone at Low Yat Plaza, was today, together with a friend, given a discharge not amounting to acquittal by the Magistrate’s Court to a charge of injuring a mechanic in February this year.
Magistrate Nur’Aminahtul Mardiah Md Nor made the decision after the prosecution’s second witness, Hamizan Hamzah, the victim, decided not to pursue the case against Shahrul Anuar Abdul Aziz, 23, and his friend Muhammad Shameer Zaidi, 19.
The victim, a mechanic, who was supposed to testify on the second day of the trial, told the court today that he decided against giving evidence and wanted to stop pursuing the case.
“I don’t want to face the hassle of attending court (for trial) and bothering my family and no one forced me to change my mind on testifying today,” he said.
Deputy public prosecutor Siti Hajar Mohd Ashif said the prosecution was ready to proceed with the trial, but it was up to the court’s discretion to decide.

Youth in Low Yat phone theft case convicted, gets jail sentence

The Magistrate’s Court in Kuala Lumpur today convicted the 23-year-old youth who was charged with stealing a mobile phone at Low Yat Plaza last year.
Magistrate Nur A’minahtul Mardiah Md Nor delivered the decision against Shahrul Anuar Abdul Aziz and sentenced him to four months jail and RM1,000 fine.
In delivering her decision, the judge said she could not ignore the “manner in which the crime was committed”.
“I must take into consideration that during the course of the trial, he also pleaded guilty to another drug charge,” Nur A’minahtul said.
She said this in rejecting an earlier application from counsel Shaharudin Ali, who appeared for Shahrul Anuar, for the court to grant him a good behaviour bond under Section 294 of the Criminal Procedure Code.

KUALA LUMPUR, May 12 — The Magistrate’s Court here today fixed June 14 and 15 for the trial of Shahrul Anuar Abdul Aziz, 23, — previously charged for stealing a mobile phone from Low Yat Plaza — and his friend, on charges of injuring a mechanic, last February.
Magistrate Mohd Rehan Mohd Aris set the date after DPP Muhammad Farith Muhammad Faizal informed, that the representation petition filed to drop the charges by the defendants, Shahrul Anuar and his friend, Muhammad Shameer Zaidi, 19, was rejected by the Attorney-General’s Chambers.
The defendants submitted a letter of representation on April 4.
Shahrul Anuar, and Muhammad Shameer each pleaded not guilty to wounding Hafizuddin Hamzah, 27, with a machete, in front of the Mizan Racing Tuned workshop in Jalan Jelatek, here, at 3.30am, on Feb 20.

Man told to enter defence for allegedly stealing phone at Low Yat Plaza
KUALA LUMPUR: An unemployed man, who is believed to be at the centre of the incident that sparked off a brawl at Low Yat Plaza, has been instructed to enter defence by a magistrate’s court here for allegedly stealing a smartphone.
The order was given by Magistrate Nur’Aminahtul Mardiah Md Nor Friday after the prosecution had proved a prima facie case against Shahrul Anuar Abdul Aziz.

CCTV footage shows Low Yat accused running off with mobile phone
Anuar Abdul Aziz ran off with a mobile phone as soon as the salesman at Low Yat Plaza turned was showed to those present in the Magistrate’s Court in Kuala Lumpur today.
Police Training Centre (Pulapol) cadet inspector E. Denis Venoth said the CCTV footage showed that Shahrul Anuar was holding the Lenovo mobile phone in his right hand.
The 23-year-old unemployed man was accused of stealing the RM800 mobile phone at Techasia, Low Yat Plaza, Bukit Bintang, at 4.47pm, July 11, last year.
While pointing to the footage, Venoth said the theft occurred after much hard bargaining, when the salesman Eric Chan Weng turned around to give Shahrul Anuar a free gift.
When he turned back, Shahrul Anuar had run off with the mobile phone, said Venoth, who is the 10th and final prosecution witness, during the examination-in-chief by deputy public prosecutor, S. Malini Anne.
Venoth, who has served with the police force for 12 years, was the assistant investigating officer in the mobile phone theft case.
He said he was also responsible for obtaining the CCTV camera footage at the scene and copying the footage onto a computer.

Youth accused of stealing phone faces another charge today
The 23-year-old youth who was charged with stealing a mobile phone at Low Yat Plaza last year, faced another charge today of voluntarily causing hurt to a mechanic, four days ago.
Laundry workers Shahrul Anuar Abdul Aziz and Muhammad Shameer Zaidi, 19, claimed trial when the charge was read out to them before magistrate Mohd Rehan Mohd Aris.
They allegedly slashed Hafizuddin Hamzah, 27, on the head with a machete, with two other individuals still at large in front of a workshop, Mizan Racing Tuned in Jalan Jelatek in Kuala Lumpur at 3.30am on Feb 20.
Deputy public prosecutor Muhammad Farith Muhammad Faizal proposed a RM10,000 bail with one surety for each of the accused.
However, the judge did not grant bail as the duo’s bailors were not present in court today.
On July 14 last year, Shahrul Anuar claimed trial to stealing a mobile phone worth RM800 at Techasia Boutique, Low Yat Plaza, Bukit Bintang at 4.47pm on July 11, the same year.
On Feb 12 this year, he was fined RM2,000 by the Magistrate’s Court after pleading guilty to misuse of drugs on July 12, 2015.

Accused in Low Yat theft fined RM2,000 for drug use
The man who allegedly stole a mobile phone at Low Yat Plaza was fined RM2,000 by the Magistrate’s Court here today when he pleaded guilty to drug abuse.
Magistrate Muhamad Faizal Ismail also ordered Shahrul Anuar Abdul Aziz, 22, to serve a month’s jail if he failed to pay the fine and undergo two years of police supervision.
Shahrul Anuar paid the fine.
He was charged with taking methamphetamine at the toilet of Narcotics Criminal Investigation Division office, Dang Wangi police headquarters, Kuala Lumpur, at 4.15pm, on July 12 last year.
The charge under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 15 of the same Act, carries a fine of not more than RM5,000 or not more than two years’ jail and not more than three years of police supervision.
During mitigation, the accused’s counsel Ihsan Busyro Zakaria asked for the court to just impose a fine on his client as he had to support his mute mother and deaf father.
Deputy public prosecutor S Malini Anne appeared for the prosecution.
Earlier, in the trial of the mobile phone theft case, the court was told that police did not make further investigations on the whereabouts of the phone after Shahrul Anuar was arrested at the plaza.
Investigating officer Shahril Mohamad, from the Dang Wangi police headquarters, said he had asked where the mobile phone was to two policemen but they said it was not with the accused at that time.
Shahril is the ninth prosecution witness to testify in the trial of Shahrul Anuar, who was charged with stealing a mobile phone worth RM800 at Techasia Boutique, Low Yat Plaza, Bukit Bintang, at 4.47pm last July 11.

Image in Low Yat theft footage resembles suspect, court told
The image of a man in dark sunglasses captured in compact disc footage is similar in likeness to the suspect, the Magistrate’s Court was told today in the Low Yat Plaza handphone theft case.
Audio-video analyst ASP Fauziah Che Mat, from the police forensics lab in Cheras, told the court, the finding was obtained after analysing five images of the 54 minutes 34 seconds duration CD recording on the theft incident.
“Based on the face in the image, I find it very similar to the individual who is in the dock,” she said during examination-in-chief by deputy public prosecutor S Malini Anne here today.
Fauziah is the eighth prosecution witness to testify in the trial of unemployed Shahrul Anuar Abdul Aziz, 22, who allegedly stole a mobile phone worth RM800 from Techasia Boutique in a shopping centre in Bukit Bintang at 4.47pm on July 11, last year.
Fauziah said she received orders to analyse the CD recording from Investigating Officer Inspector E Denis Venoth on July 13 last year, as the images of the suspect wearing sunglasses contained in the CD recording appeared clearer.
“I viewed the footage and found the images required by the investigating officer in the recording.
“I then ‘captured’ the images of five movements and used the ‘video investigator’ software to improve the quality of the image so that it was clearer,” she said.
There was no display of date and time on the CD recordings, she added.

Accused admitted stealing phone, says witness
Unemployed Shahrul Anuar, is alleged to have stolen a phone that subsequently sparked the riot at Low Yat Plaza.
KUALA LUMPUR: The Kuala Lumpur Magistrate’s Court was told that the accused who allegedly stole a mobile phone at Low Yat Plaza, admitted to the offence when questioned after the incident.
Chief security guard at Low Yat Plaza, Kamarudin Shariff, 55, said the accused, Shahrul Anuar Abdul Aziz, 22, who was caught by members of the public at the mall, admitted to stealing the mobile phone when interrogated in his office.
He said, he then ordered the accused to remove all items which were in his possession including the mobile phone allegedly stolen, but the phone was not with him.
“Instead, the accused only took out money amounting to RM1.60 from his pants pocket. He failed to produce his identity card on the grounds that he lost it when he was robbed the previous day,” he said during examination-in-chief by deputy public prosecutor, R Siamalah.

KUALA LUMPUR, Nov 30 — An employee of a telephone shop at the Low Yat Plaza told the Magistrate’s Court here today that he had turned his back to get a free gift for a customer when the later fled with a Lenovo handphone.
