Minister: ‘Sex offenders registry’ has 102 names

The register has been ready since January, but there has been no request from any individual or institution to check the register so far.

PETALING JAYA: The so-called “sex offenders registry” which many have been demanding for is now available under the purview of the women, family and community development ministry, with 102 names compiled so far.

This was revealed by its minister, Rohani Abdul Karim, who said that the database known as “Register of Children”, is compiled and updated continuously as and when a suspect is convicted for any offence against a child, TheSun reported.

“Interested parties like employers in the childcare or education sectors may apply to the department to screen individuals who intend to work with them.

“The screening is to ensure the individuals are free from any criminal record, where a child is a victim,” she was quoted as saying by the daily.

She added that the register, which will be managed and maintained by the social welfare department, contains the names and information on 102 individuals who have been convicted of a crime against a child, including sexual abuse.

Though the register has been ready since January, according to ministry records, there has been no request from any individual or institution to check the register todate.

“The database will be updated continuously as and when a suspect is convicted for any offence against a child with the department constantly engaging the police and the Attorney-General’s Chambers on the content of the register,” she was quoted as saying by TheSun.

PETALING JAYA: Nur Jazlan Mohamed says the public needs to refer to the police and the women, family and community development ministry on their respective sex offenders list, as a national registry on the same has been delayed, The Star reported today.

The deputy home minister attributed the delay in the setting up of a national sex offenders registry to the concerns raised by the Attorney-General’s Chambers over the infringement of rights of those on the list.

“There is an unofficial sex offenders list kept by the police but not made public.

“What I am saying is, if the list is under the police, then any information of the whereabouts of any offender can be obtained at the local police station for the community to check,” Nur Jazlan was quoted as saying by the daily.

He added however, that the ministry’s list only contained information on the conviction, including the name of the sex offender and his/her crime, and nothing more.

“In a way, this list is already available to the public. Their court conviction is already public record but there is no follow-up on the offenders’ whereabouts after the conviction,” Nur Jazlan said.

According to British media last week, Nur Fitri, who was studying on a Mara scholarship in the Imperial College of London, one of the world’s top universities, was found to be in possession of over 30,000 videos and photographs of child pornography.

Police who raided his home in London found the 23-year-old sitting beside a life-sized mannequin of a young boy. He reportedly possessed 601 “Category A” videos and images, which depicted abuse involving penetrative sexual acts with children.

What is currently available in Malaysia is the registration of certain offenders under the Registration of Criminals and Undesirable Persons Act 1969.

These include, among others, those convicted of rape, buggery with animals and carnal intercourse against the order of nature (oral and anal sex by consent). Those convicted of committing oral and anal sex without consent or against another person’s will, were not subject to registration.

Police pushing for sex offenders’ registry under standalone law, says source

KUALA LUMPUR, June 4 — Bukit Aman is reportedly pushing to introduce a sex offenders’ registry separate from existing laws that will also empower them to keep a constant watch on predators.

The government has already created a watchlist under the Child’s Act, but The Star daily reported today the police want a separate legislation to facilitate investigations.

“Under the Registration of Criminals and Undesirable Persons, or Act 7, it will only register an offender without giving the power to authorities to monitor him or her,” the newspaper quoted an unnamed source as saying.

“We want severe punishment against these predators.”

Calls for a sexual predators watchlist were revived following the conviction this week of Richard Huckle who confessed to 71 charges of raping and molesting 22 Malaysian children of both genders as young as six months’ old and 12 from 2006 to 2014. He also admitted to sexually abusing a Cambodian child.

Twenty-two children are reportedly from mainly impoverished Christian communities in Kuala Lumpur, where he posed as an English teacher and Christian philanthropist, while one is Cambodian.

Putrajaya won’t intercede for kiddie porn convict, Anifah says

KUALA LUMPUR, May 7 — The federal government will not intervene in the case of the Malaysian convicted of child pornography in the United Kingdom, said Foreign Affairs Minister Datuk Seri Anifah Aman.

Anifah said that people should not confuse the preservation of basic human rights and consular services with the right to be saved after committing a “serious and inhumane crime” such as that which landed Nur Fitri Azmeer Nordin in a UK prison.

“I wish to state unequivocally that the government of Malaysia views this matter gravely. We do not condone these acts, particularly as they are considered a crime against young children.

“Under no circumstances should our Malaysians abroad imagine that the government of Malaysia would step in to save them if they commit crimes abroad,” he said in a Facebook post today.

The minister also added his voice to growing calls for a sex offenders’ list in the country, particularly those involving crimes against children.

“As a committed member of the international community, I think that it is high time that Malaysia consider establishing a register of convicted paedophiles that would be made publicly known so that parents and communities with young children will feel safer,” he said, adding that it will be a strong deterrent against the crime.

Set up sex offender registry, says DAP lawmaker

Putrajaya should establish a sex offenders’ registry to protect children, said a federal lawmaker, following the furore surrounding Majlis Amanah Rakyat’s (Mara) decision to give a student convicted of child porn in London a “second chance” to resume his studies when he returns home.

While agreeing that people should be given second chances and that he was not against any rehabilitation efforts, DAP’s Bukit Bendera MP Zairil Khir Johari, nevertheless, said there should be a mechanism to keep track of sexual offenders and prevent them from committing sexual crimes again.

“I believe it is time the government considered setting up a sex offender registry in order to allow law enforcement agencies to monitor and restrict known sex offenders,” he said in a statement today.

Paedophiles tend to reoffend, lawyers say in pushing for registry

KUALA LUMPUR, May 7 — Paedophiles are likely to repeat their crimes, lawyers say in pushing for a sex offender registry amid a high-profile child pornography case.

Criminal lawyer Datuk Geethan Ram Vincent said studies have shown that most sex offenders, especially those who prey on children, have a tendency to reoffend.

“The registry is a form of deterrence because the offender knows his whereabouts is known by the police,” Geethan, a former deputy public prosecutor, told Malay Mail Online when contacted yesterday.

He said this database should be updated with the latest addresses of convicted sexual offenders, noting that Malaysia currently only has a general registry of the criminal records kept in the federal police headquarters with addresses that may not be updated.

No law to deal with Nur Fitri if he views kiddie porn here, lawyers say

What would happen if Malaysian student Nur Fitri Azmeer Nordin were to resume his consumption of child pornography upon his return to Malaysia after serving his sentence in the UK?

There appears to be no laws in the country to tackle possession of porn if the scholarship holder or anyone else here were to view obscene material, lawyers say.

This is because while Section 292 of the Penal Code deals with sale and distribution of obscene material, and Section 233 of the Communications and Multimedia Act (CMA) deal with the making, creating and transmitting of such material, they do not touch the issue of possession and viewing, lawyers said.

Criminal lawyer Amer Hamzah Arshad said there appeared to be limited context on using the Internet for disseminating obscene materials under Section 233 of the CMA.

As for Section 292 of the Penal Code, he said it was more targeted towards preventing distribution of obscene material or selling for profit.

“Section 233 seems to be limited in its application. There is nothing on having possession. There seems to be a loophole there.

“So it appears as though there is nothing to deal with this specific situation,” he told The Malaysian Insider.

Given the poser about the lack of laws to deal with Nur Fitri if he repeats his offence upon returning to Malaysia, Amer said supported the idea that there should be specific legislation to deal with this type of crimes.

“I’m all for it because it’s for the protection of minors, we cannot allow any activity that would encourage or allow for minors to be exploited,” he added.

Inspector-General of Police Tan Sri Khalid Abu Bakar:

“Paedophilia is not that evident yet in Malaysia, but we are always vigilant and we will take action if there are any signs,” he told a press conference at the Central Seberang Prai police district headquarters here.

He also said there was no law that required for a sexual offenders registry accessible to the public, but said it could be a possibility in the future.

    How could our government be so impotent in dealing with the Brits who have convicted and jailed one of our prized student citizens over a crime of possessing some immoral, though disgustingly tasteless pornographic pictures and video clips. Yes the stupid possession did include some 30,000 pictures of such visual garbage, but were any of those digital rubbish his creation and were any of those child victims subjected to such dehumanising disposition by Nur Fitri ? Yes, a human-sized doll was also found among his kinky collections but were those the reasons for branding young Nur Fitri a paedophile and thus condemned him to be sentenced to a jail which may be filled with even worse sex perverts than we Malaysians can imagine ? Has our government secured a guarantee from the British authorities that no sexual and physical would come to Nur during the term of his sentence ? And had our Nur actually brought any physical or emotional damage to any child in Britain ? Why hasn’t the British authorities dug in deeper to get those who had been responsible for passing on those pornographic garbage to him, just like how they had managed to net every terrorist in Britain before they even have the chance to let out a fart in public! I simply wonder if those influential big wigs in the pornographic industry would ever be brought to justice ! There had been no record of Nur Fitri, a maths genius, been a sex pervert when he was still in Malaysia but how come he evolved to become one after just studying in UK for some years ? Shouldn’t the Malaysian authorities consider getting foreign experts to teach our malleable young men and women locally instead of allowing them to being slowly corrupted by the decadent expect of the western culture and environment. Some years ago we lost another great maths woman Oxford genius, Suffiah Yussof , who failed to resist the temptations and lure of the decadent culture in Britain and ended up as an expensive up-market prostitute. How many of our brains must be destroyed in the West before we take action? Hasn’t our leaders learned enough from such sad losses which could have been prevented if our young scholars were well care for spiritually and guided from self-destruction. What a waste of human resources as well as our brain pool !

      Perhaps, those who protest and are of the opinion that Nur Nordin is being treated unfairly do not comprehend or appreciate the gravity of what he has been convicted of. That it is more than just photos and videos.

      In the lowest and most extreme kind of smut, infants and babies are raped. Their mouths and barely formed vaginas and anuses are penetrated with penises or objects like pencils and sticks. Acts that are recorded, photographed, uploaded and shared. These are classified as Category A felonies (Indecent Images of Children) under the UK Sentencing Council’s Definitive Guideline on Sexual Offences.

      Those in Category B usually involve nudity with children placed in sexually explicit or suggestive poses and acts. There could be bondage and even torture.

      Finally, Category C tend to be predatory in nature. Photos of kids in playgrounds, schools and even cribs.

      These categories cover the offence of possessing, distributing and producing such images.

      Nur Nordin was found to have more than 30,000 indecent images and videos of children being abused. Child porn. In his possession were images and videos from all three Categories listed above.

      Detective Constable Sara Keane, of the Metropolitan Police’s Serious Crime Unit, was quoted as saying, “Nordin was involved in the making and sharing of some of the most extreme images that have ever been seen by officers that work in this field.”

      Involved in the making and sharing. It is important that we let that sink in, for a moment.

      Nur Nordin pleaded guilty and was convicted of the following:

      one count of possessing indecent videos (namely 124 Category A videos; 24 Category B videos; 87 Category A images);
      one count of possession of indecent images and videos of children (namely 477 Category A videos and images; 274 Category B images and videos; 170 Category C videos and images)
      five counts of making indecent photographs of a child;
      four counts of possession with intent to distribute indecent images of children; and
      two counts of making indecent images of a child.
