Sessions Court rules Rayer’s ‘celaka’ remark not seditious

The Sessions Court in Penang has freed Seri Delima assemblyperson RSN Rayer from one of the two sedition charges filed against him.

Sessions judge Roslan Hamid ruled that the prosecution was not able to prove that Rayer’s ‘celaka’ remark made during a ceramah has the tendency of sedition.

GEORGE TOWN: The Sessions Court today has acquitted and discharged Seri Delima assemblyman RSN Rayer (pix) over the sedition charge on “celaka Umno” remark.

When delivering the judgement, Sessions Court Judge Tuan Roslan Hamid said the prosecution failed to prove prima facie against Rayer.

He said the prosecution could not  prove any seditious element as Umno is a political entity and not a racial group.

He also said prosecution failed to prove prima facie on Rayer over an alternative charge of Section 504 of the Penal Code for intentional insult with intent to provoke a breach of the peace.

AMPANG, June 28 — The gruesome act of leaving a severed cow head at a DAP man’s house this morning was irresponsible as it could spark unnecessary racial tension, MCA president Datuk Seri Liow Tiong Lai said today.

“We call this irresponsible act. We condemn this kind of act because this would create tension among races.

“We feel that this country is a multiracial country so we have to be sensitive to other races,” the newly appointed transport minister told reporters after attending an event here.

Hindu Sangam: Cow head incident ‘scaring’ everyone, disrespecting Hindu religion

KUALA LUMPUR, June 28 ― The dumping of a severed cow head outside Penang lawmaker RSN Rayer’s house is disrespectful of the Hindu religion and intimidates Malaysians,  the Malaysia Hindu Sangam said today.

Datuk R. S. Mohan Shan, the president of the group representing all Hindu believers in the country, explained that the “cow is a holy thing for Hindus” as they worship it.

“How can they do this and just throw in front of somebody’s house?

“This is making everybody scared, this is making [people from] other religions scared and we feel the security of the country is shaken up,” he told The Malay Mail Online when contacted today, urging the police and government to probe this morning’s incident and take action.

Criticising those who threw the cow’s head this morning, Mohan said that “they didn’t respect the Hindu religion”, adding: “It’s not good for the country and especially for Hindus, our sentiments and our religion have been questioned.”

Pakatan MP: Zahid response to cow head incident ‘irresponsible’

KUALA LUMPUR, June 28 ― A DAP lawmaker criticised Datuk Seri Ahmad Zahid Hamidi today for saying the severed cow head incident at at RSN Rayer’s house was the result of the Penang lawmaker being a “loose cannon”.

Bukit Bendera MP Zairil Khir Johari said the Home Minister’s remark was “irresponsible” as such an act of “sacrilege” was unjustifiable.

“Would Zahid say Ibrahim Ali deserved it if someone threw a pig’s head at his house for threatening to burn bibles?” Zairil said in a text message to The Malay Mail Online, referring to the president of Malay rights group Perkasa.

He added that Zahid should retract his remark and apologise.

Penang cops to investigate cow head case for ‘causing disharmony’

GEORGE TOWN, June 28 — Penang police confirmed today they are investigating the cow head incident at state lawmaker RSN Rayer’s house for “causing disharmony” under the Penal Code.

Northeast district police chief said the case has been classified under Section 298A of the Penal Code for “causing disharmony, disunity, or feelings of enmity, hatred or ill-will, or prejudicing, etc, the maintenance of harmony or unity, on grounds of religion”.

“A team of policemen arrived at his house at about 7.30am to investigate the case and we have also obtained the CCTV recordings from Rayer for our investigations,” Mior said when contacted.

Mior was also at Rayer’s house along with the investigation team this morning.

In an immediate response to the incident, Bukit Gelugor MP Ramkarpal Singh Deo said the incident should be taken seriously.

“It has the potential of ugly consequences as it is a very sensitive issue,” he said in a press conference in Air Itam.

He expressed hope that the police will act quickly on the matter.

“This is a very blatant insensitive act and police must be seen to be tough and proactive but if they are seen as inactive, this is what happens,” he said.

GEORGETOWN: Police have recorded a statement from DAP’s Seri Delima assemblyman R.S.N Rayer over the severed cow-head found in front of his house in Tingkat Tembaga here early Saturday.

Rayer also handed over CCTV footage of the incident to police officers who came to his house to record his statement.

A review of the CCTV footage showed a man arriving in front of Rayer’s house on a motorcycle, dumping the cow head and dancing in front of the CCTV camera before fleeing.

Meanwhile, Chief Minister Lim Guan Eng, who arrived at Rayer’s house, claimed it was a tactic used by those who supported Umno.

“Let me be clear that I’m not blaming Umno for this but what we have seen is that this was also done by pro-Umno forces in Selangor back in 2009.

KUALA KUBU BARU: This incident Saturday morning where a skinned cow’s head was found in front of R.S.N Rayer’s house in Penang is a result of the Seri Delima assemblyman’s big mouth, said Home Minister Datuk Seri Dr Ahmad Zahid Hamidi.

Dr Ahmad Zahid said this was the price Rayer had to pay for being a “mulut celupar”  (lose cannon).

Cow’s head found in front of Rayer’s house

GEORGE TOWN: A skinned and bloodied cow’s head was found in front of DAP’s Seri Delima assemblyman R.S.N Rayer’s house here early Saturday.

It is learnt that Rayer’s wife discovered the severed head around 7am.

Rayer posted a photograph on his Facebook page around 8am and wrote: “This morning I found a cow head at the front gate of my house ……”

Cops arrest 6 Umno Youth leaders over ‘burn DAP’ threat

KUALA LUMPUR, May 26 — Police arrested six Umno Youth leaders today over the party’s demonstration outside the DAP headquarters last Friday.

Those arrested include Federal Territories Umno Youth chief Mohd Razlan Muhammad Rafii, Cheras Umno Youth chief Johari Yazid, Federal Territories Umno information chief Ghulam Muzaffar and Bandar Tun Razak Umno Youth chief Datuk Rizalman Jaafar.

“We were told to appear at the Wangsa Maju police station at 2pm and when we showed up we were arrested,” Mohd Razlan told The Malay Mail Online when contacted.

The Umno man said that the police are investigating them under Section 506 of the Penal Code for criminal intimidation.

“All six of us have been released on bail as of 8.30pm. We don’t know when we will be charged the police say they will inform us once they are done with their investigations,” Mohd Razlan added

DAP has identified one of the men who barged into the Penang state assembly on Wednesday as an employee of Malaysia Airlines (MAS), and has called on the national carrier to take disciplinary action against its employee.

Jelutong MP Jeff Ooi at a ceramah in Island Glades last night said Penang Umno Youth deputy chief Jasmin Noordin, who had burst into the state assembly with 11 others, worked in the airline’s Human Resources Department.

“I found out that he is working for an airline that is almost bankrupt as a high-ranking officer,” he said.

Ooi said MAS should act against Jasmin for allegedly using company time to trespass the state assembly on Wednesday.

“How can an employee from a government-linked company be allowed to go out during work hours to tarnish the sanctity of the Dewan just for political reasons?” he asked.

“It is the people’s money that is going to waste as 75% of MAS is owned by Khazanah, which is funded by taxpayers.”

DAP’s Bukit Gelugor candidate Ramkarpal Singh also called on MAS to act against Jasmin.

“Unless and until he can provide an explanation as to why he was trespassing on public property and causing nuisance during work hours, disciplinary action should be taken against him,” he said.

“If he did indeed take leave, surely it is for the wrong reasons. He couldn’t have taken leave to send his son to school – we all know where he was. Obviously, that itself constitutes indiscipline.”

Far from condemning Umno Youth’s fiery protest outside the DAP headquarters yesterday, Deputy Prime Minister Muhyiddin Yassin described it as a “natural reaction”.

The Umno number two said it was natural for members to respond with anger when their party image is tainted.

Stating that there are laws in this country, Muhyiddin said the Umno Youth protest “would be given attention”.

Lawyers have ganged up against Datuk Seri Shahidan Kassim for urging the Attorney-General (A-G) to prosecute a DAP assemblyman under the controversial Sedition Act for his “Umno celaka” remark in the Penang state assembly earlier this week.

They said RSN Rayer, the Seri Delima assemblyman, enjoyed immunity as he did not question the rights of Malay Rulers and the Malays nor promote feelings of hostility among different races.

The lawyers questioned why Shahidan who is the Minister in the Prime Minister’s Deparment, dragged the A-G Tan Sri Abdul Gani Patail into this debate as Rayer’s remark was targeted at Umno, a political party that did not exclusively represent the Malays.

The lawyers said there was nothing seditious as Umno was not a special entity to be protected under the Sedition Act as there are also Malays who are members of other political parties within the Barisan Nasional coalition and the opposition pact.

‘DAP wants public apology’ – Ong Kian Ming tells Khairy over property damage at party HQ

PETALING JAYA: DAP has refused to accept Umno Youth chief Khairy Jamaluddin’s apology, insisting that it should be made public.

“We want a public apology, a private message is not an indication of him taking responsibility for what happened,” DAP’s Serdang MP Ong Kian Ming said when contacted on Friday.

It was reported earlier that Khairy had apologised to Ong for damaged property caused by his members who protested outside the DAP headquarters on Thursday.

Confirming this, Ong said the Youth and Sports Minister conveyed his apologies to him via direct message on Twitter and had offered to pay for a replacement of the damaged signage.

“It is true, he private messaged me. It reads, ‘the lads got carried away. Apologies for the sign and I will have it replaced. Please inform your party’,” said Ong, reading the message.

“I give an example, if Khairy feels it is acceptable (to apologise privately), does that mean it is acceptable for DAP members to go to Umno headquarters to damage the Umno signage and later private message the prime minister?

“I don’t think he would think that is acceptable,” said Ong.

PUTRAJAYA: Umno Youth chief Khairy Jamaluddin has apologised to DAP’s Serdang MP Ong Kian Ming for damage to property caused by his members who protested outside the DAP headquarters on Thursday.

The DAP office in Kuantan has come under attack from a group claiming to be Umno Youth members and Malay NGOs today.

This incident took place despite Umno Youth chief Khairy Jamaluddin saying he has instructed the wing’s members to calm down.

According to DAP mouthpiece, Rocket, the protesters pelted the DAP office with rotten eggs as well as damaged the signboard and door.

Sporting red headbands, the protesters, waving  Pahang flags, also carried placards and banners, denouncing the DAP, with a few spelling mistakes, as “racist” and “celaka”.

Another banner warned DAP not to “play with fire by challenging the Malays”.

Minister wants DAP assemblyman charged with sedition for insulting Umno and Malays

While pressure is mounting on the government to repeal the Sedition Act, a minister in Datuk Seri Najib Razak’s Cabinet is calling on the Attorney-General to prosecute a Penang assemblyman under the law for insulting Umno.

Minister in the Prime Minister’s Department Datuk Seri Shahidan Kassim wants Tan Sri Abdul Gani Patail, who is also the public prosecutor, to frame charges against DAP’s Seri Delima assemblyman RSN Rayer for using the derogatory word “Umno celaka” during the state assembly proceedings.

Shahidan said Rayer’s act was not only against the law but was also an insult to Malays in general.

“Even if he withdraws the remark, that is not the end of the issue. The public prosecutor must investigate the matter under the Sedition Act,” he told The Malaysian Insider today.

Umno Youth members issued a fiery warning to DAP, threatening to torch the party headquarters in Kuala Lumpur if its elected representatives hurled insults again.

Angry shouts of “let’s burn it down” and “kill them” rang out at a protest outside the building when Federal Territory Umno Youth chief Mohd Razlan Mohd Rafii asked if submitting a memorandum was sufficient.

He then warned DAP that the next insult would invite a “catastrophic” response.

Seri Delima assemblyman R.S.N. Rayer, who sparked a massive protest by saying “celaka Umno” which saw the Penang legislative assembly being intruded for the first time in history yesterday, said “celaka” is a common word and should be taken in jest.

The lawyer from DAP said when he uttered the remark in the assembly on Tuesday, he wanted to say “damn it” but he could not use the expression in English.

He could only speak in Bahasa in the House so he used the Malay translation for it, which is “celaka”.

“Next time, I will just say ‘damn it’,” he told reporters.

His remark, however, caused a storm among Umno members who threatened to disrupt the assembly again today but was stopped by police.

The spillover effect from Rayer’s statement almost saw the DAP headquarters in Kuala Lumpur being set ablaze by an angry mob of about 50 Umno members.

Malaysiakini reported that Federal Territory Umno Youth members staged a protest outside the DAP headquarters and threatened to burn the building but were stopped by the light strike force and the police.

The police also prevented the protesters from tearing down a billboard featuring the DAP’s Rocket logo.

GEORGE TOWN: Penang Umno Youth members continue with their protest outside the state assembly on Thursday as about 20 policemen stood guard at the gates.

The sitation got heated when a member of Solidariti Anak Muda (SAMM), who was in a group following the state assembly sitting, came out and went to a nearby stall for food.

A commotion ensured as the SAMM member claimed that the protesters stepped on his shoes and snatched his helmet.

The incident saw several policemen moving in to calm the down situation. The chaos caused a traffic congestion along Lebuh Light.

KUALA LUMPUR: The DAP has condemned the actions of a group of protesters who stormed into the Penang State Assembly yesterday.

DAP Chairman Gobind Singh Deo said these are the actions of people who do not respect the democratic process which operates on the strength of intellectual discourse by way of debate in the Dewan itself and not the use of external force on the Dewan to get their way.

“Elected representatives are entitled to an assurance that they can speak up in the Dewan without fear or favour.

“If there are matters which need clarification then questions or challenges can be posed to that effect in the Dewan itself,” said Gobind in a statement.

The Puchong Member of Parliament said, if there is misconduct on the part of any of the elected representative, complaints can be made and if it is found that he has abused his privileges as a representative, then the Dewan has the right to act against him.

Gobind said this when referring to the incident in which Seri Delima assemblyman RSN Rayer had allegedly uttered the words ‘UMNO celaka’ (UMNO be damned) in the State Legislative Assembly on May 20.

Man in black held for provoking Umno protesters

Once again, there was tension at the Penang state assembly leading to a man being arrested for allegedly attempting to provoke a group of Umno Youth protesters.

The man was dressed in black with the logo of Solidariti Anak Muda Malaysia (SAMM), a NGO linked to Pakatan Rakyat.

The unidentified man had made his way into the group of protesters gathered on the opposite side of the state assembly building.

GEORGE TOWN: Police have detained 12 people who were involved in breaking through the automatic gates and storming into the hall of the state legislative assembly building in Lebuh Light today.

Northeast district police chief ACP Mior Faridalatrash Wahid said those detained were aged between 32 and 55.

“We are still investigating the incident,” he told a press conference at the Northeast district police headquarters today.

Following the incidet, Mior said the state assembly security guard had lodged a police report at around 4.30pm.

Penang cops to arrest Umno members for storming state assembly building (VIDEO)

GEORGE TOWN, May 21 — The group of Umno members who forced their way into the state legislative assembly building this afternoon will be arrested, George Town OCPD Asst Comm Mior Faridalatrash Wahid said.

ACP Mior said the incident is now being investigated for “house trespass” under section 448 of the Penal Code.

“We are investigating this incident and those found to be involved will be detained for further investigation,” he said.

Section 448 stipulates that, “Whoever commits house-trespass shall be punished with imprisonment for a term which may extend to three years, or with fine, which may extend to five thousand ringgit, or with both.”

KJ: Intruding into Dewan wrong but demo justified

Umno Youth chief Khairy Jamaluddin said protestors today said that it was “wrong” for protestors to barge into the Penang state legislative assembly.

However, he said that the protest against DAP’s Seri Delima assemblyperson RSN Rayer’s remark that Umno is “celaka” (damned) is justified.

“They are clearly upset by the celaka (remark), and the reason why they went to demonstrate is justified,” he said before a walkabout with BN Teluk Intan candidate Mah Siew Keong this evening.

Protesters want Rayer’s blood over ‘celaka’ remark

There was a commotion at the Penang state assembly building, when protestors shouted and banged the gates over remarks made by a DAP assemblyperson.

Protestors, including Penang Perkasa youth chief Rizuad Azuddin and Umno Youth members, were angry at DAP’s Seri Delima assemblyperson RSN Rayer for saying that Umno is “celaka”(damned).

“If you (Rayer) have balls, say those remarks again,” they shouted.

Some even made it inside the inside the assembly building, while others called Rayer a “racist” from outside the gates.

The protestors also brought with them eggs to pelt at the assemblyperson.

They vowed to find him at his home if they they fail to haul him up at the assembly building.

Rayer in the state legislative assembly sitting yesterday had directed the “celaka” remark to BN’s Kepala Batas MP Reezal Naina Merican.

“Reezal Merican celaka! The Malays attended gathering themed ‘Upholding Islam and defending Malays’ in Sunway City, Seberang Jaya is celaka!” Rayer had roared.

Rayer was referring to the January event where Reezal, several Umno leaders and about 600 others gathered to condemn PKR’s Machang Bubuk assemblyperson Lee Khai Loon over Lee’s kangkungflash mob.

A group of angry protesters from Muslim NGOs slaughtered four chickens today and smeared blood from the birds on a cloth poster with the faces of representatives from DAP and PKR.

The group that dubbed itself Council of Islamic NGOs carried out the bloody act under the banner of ‘Protest against insult to Malay leadership, the Yang di-Pertuan Agong and Islam and Malay dignity by a splinter of politicians, leaders and Chinese chauvinists.’

The killing of the live chickens took place near the Puduraya bus terminal and government offices at Jalan Tun Perak in Kuala Lumpur this afternoon.

Lee, who gave his statement to the police this afternoon at his service centre in Alma near Bukit Mertajam, said he was interviewed by Seberang Perai Tengah senior investigation officer Hasan Mohd Salleh for 40 minutes.

Flash mob organiser won’t apologise

Machang Bubuk state assemblyperson Lee Khai Loon has rejected suggestions to apologise for organising a flash mob which mocked Prime Minister Najib Abdul Razak over his kangkung remark.
In a press release today, he thanked DAP veteran Lim Kit Siang for suggesting the apology, but insisted that his actions were justified.

DAP to flash mob leader: Consider apologising

DAP supremo Lim Kit Siang has urged PKR’s Machang Bubuk state assemblyperson Lee Khai Loon to consider apologising over his kangkung-themed flash mob targeting the prime minister on Jan 16.

“Lee should consider an apology especially as there are those who regard such protest action as excessive, offensive and insensitive,” he said in a statement today.

Lim said he too thought that the flash mob, which stuffed kangkung into the mouth of an effigy of Prime Minister Najib Abdul Razak, was excessive, offensive, and insensitive.

The apology should take into consideration the importance of not allowing irresponsible quarters to look for excuses in inciting racial and religious hatred, said Lim.

He was referring to two Umno-backed counter-protests against Lee over the weekend.

Lee’s parents not spared in kangkung strike back

Machang Bubuk state assemblyperson Lee Khai Loon who had organised a kangkung themed flash mob against Prime Minister Najib Abdul Razak, has found that not even his parents are spared in a strike back from government supporters.

After two counter-protests by Umno against Lee, including one in front of his office that turned violent, his office mobile number is now being bombarded by vulgar messages wishing his family ill.

“Woi, damn you… you are a pig. Is your mother a whore? Your father must be damned too. You and your whole family can die,” read one of the text messages.

When contacted, Lee said he received several such messages and will make a police report soon.

“We are in the processing of compiling all the messages including those on Facebook and Twitter and we will hand them to the police,” he told Malaysiakini.

Reezal: Lee brought this to himself

Umno supreme council members Reezal Merican Naina Merican today defended the actions of participants of a rally to condemn Machang Bubuk state assemblyperson Lee Khai Loon.
Reezal Merican, who was not at the event but agreed comment on it, said the rally reflected the feelings of the Malay community which cannot tolerate Lee’s “despicable” stunt last week.

Lee decries ‘provocation’ at pro-PM demo

After being targeted with protests yesterday and today, Machang Bubuk assemblyperson Lee Khai Loon decried the provocative manner in which the protest was mobilised and the violent manner it was done.

Among others, he claimed that a poster that contained an image of a man wielding two machetes and filled with provocative language was used to urge people to attend the protest this morning.

“I respect Umno and its supporters’ rights to assemble and hold demonstrations. However, their frequently violent and rough actions in their demonstrations are regretted,” he said in a statement today.

Lee said the protestors had also made personal attacks against Pakatan Rakyat leaders, as well racist and religiously insensitive statements and threatening a repeat of the May 13, 1969 riots.

I refer to the threat of another May 13 bloodshed by Umno members and elected reps in Penang on 18 January 2013. This action by Umno is dangerous, vicious and a blatantly criminal act.

More shocking is that an Umno Member of Parliament Reezal Merican Naina Merican was part of this criminal Umno mob.

Is it the policy of Umno to instigate bloodshed and destroy the peace of the country?

The crimes they have committed by making this threat include incitement to violence, criminal intimidation( s.503 Penal Code ) and public mischief ( s.505 Penal Code).

More seriously, Umno Penang leaders and members have also committed activity detrimental to parliamentary democracy contrary to s.124B Penal Code and liable to imprisonment for up 20 years.

Despite the openly criminal nature of the 18/1 Umno mob, the IGP and Penang police chief took no action against against them. No one was arrested and there have have been no statements from the IGP that action will be taken against them despite the incident making national news.

This contrasts with the heavy-handed reaction by police against the opposition’s peaceful gatherings and flashmobs.

Tit-for-tat and violence at pro-PM rally

Penang Umno members and their allies today held a second rally to show their disgust at Machang Bubuk assemblyperson Lee Khai Loon for organising a kangkung-themed flash mob in Bukit Mertajam on Friday.

This time, the protesters burned a half-mannequin with Lee’s image, and spat, stomped and mooned over it as it went up in flames.

They also poured water over a poster with DAP leaders Lim Kit Siang and state Chief Minister Lim Guan Eng, with the words, “Guru yang ajar DAP biadap Melayu” (The teachers who teach DAP to be rude to Malays).

They carried various posters made out in manila card with words admonishing Lee and his party, PKR.

About 200 started the rally at the food court and pasar malam area in Alma, and after delivering several speeches, moved to Lee’s service centre nearby.

Passersby attacked

They pasted the posters on the shutters of a shop below Lee’s office, with some seen venting their anger at the shutters.

Two men who came by the area were attacked by the crowd. Police then stepped in and carted one of the men away. Later, some members of the crowd said, “Who asked him to say Melayu bodoh.”
The rally is in retaliation of the kangkung-theme flash mob held in Alma, Bukit Mertajam to protest against the recent price hike plaguing the country.

Umno members today burnt an effigy of Machang Bubuk assemblyman Lee Khai Loon, spitting and stepping on it in front of his service centre, for his role in a flash mob last week deriding Prime Minister Datuk Seri Najib Razak’s now famous ‘kangkung’ speech.

The mob of about 300 gathered at Lee’s service centre in Alma, Bukit Mertajam, bearing handwritten placards condemning him. One man was even seen mooning at Lee’s portrait.

Some of the placards were pasted on the shutters of an unused shoplot nearby, and the crowd vented their anger against DAP leaders Lim Kit Siang and his son Lim Guan Eng, the Penang Chief Minister.

A kangkung-theme flash mob by Machang Bubuk assemblyperson Lee Khai Loon has irked Umno members and their allies, prompting a rally in Seberang Jaya protesting Lee’s allegedly rude behaviour against the country’s top leader.

Around 600 people, including state Umno leaders, attended the rally, held in front of the Sunway Carnival Mall.

Earlier, the group, marched from a nearby futsal court, located 1km away from the mall, shouting “Allahu Akbar” and “Hidup Melayu” (Long live the Malays).

They also held banners carrying words such as ‘Insulting the PM is akin to insulting Malays’, ‘Penang Malays survive by eating kangkung’, ‘ABCD – Asal Bukan Cina DAP’ and ‘DAP is the enemy of Islam’.

Penang Umno today retaliated to the “kangkung flash mob” when a group of about 600 took to the streets of Seberang Jaya with provocative banners, including one asking if the state’s ruling coalition wanted another May 13.

One banner read “Because of DAP’s leaders mouth, May 13, 1969 happened… Want some more?”

Other banners had messages like “Insulting the PM is like insulting the Malays”, “Penang Malays survive by eating kangkung”, “ABCD – Asal Bukan Cina DAP” and “DAP is the enemy of Islam”.

State Umno leaders who were also part of the mob, condemned Lee in their speeches in front of the mall.

State Umno secretary Datuk Musa Sheikh Fadzir warned Lee and Pakatan Rakyat not to play with fire by undermining their leaders, Islam, the police and other Malay institutions.

“If we lose our patience, please don’t blame us.”
