‘Only two out of 284 custodial deaths due to injury by cops’
Only two out of 284 custodial death in the last 16 years were due to injuries inflicted by the police, claims the government.
This is according to statistics provided by Home Minister Ahmad Zahid Hamidi in a parliamentary written reply to Ipoh Barat MP M Kulasegaran.
Kulasegaran had asked about the number of deaths that happened while in police custody, the causes and whether any police officers faced disciplinary actions for them.
According to the data provided, of the 284 custodial deaths between 2000 and 2016, 117 were Malays, 63 Indians, 53 Chinese, nine of other races and 36 were foreigners.
In the same period, only two custodial deaths were due to police-inflicted injury, which happened in 2009 and 2013.
The other cause of deaths were HIV (36), asthma (seven), heart attack (23), other diseases such as liver, heart, ulcer, lungs, throat (166), brain haemorrhage (16), suicide by hanging (32) and fight with inmates (two).
In terms of action, Zahid said of the 284 cases, there were seven prosecutions.
Of the prosecuted cases two saw convictions, two acquittals, one a discharge not amounting to acquittal, while two more are still pending.
The status of the remaining cases are as follow: inquest in progress (11), inquest completed (92), no inquest (110), referred to deputy public prosecutor (26), under investigation (22) and no further action (one).

Six deaths in custody renew demands for IPCMC
The suspicious circumstances behind a man’s death in prison sounds another clarion call for the establishment of the Independent Police Complaint and Misconduct Commission (IPCMC), human rights NGO Suaram said today.
The police had said N Harirajan, 34, had “died of AIDS” last Thursday, just three months into a six-year jail sentence in Kajang prison for robbery.
He was found dead in a gruesome state and his family said they were unaware that he had AIDS, even as a preliminary post-mortem diagnosed this.
Suaram said Harirajan was the sixth death in custody in the last three months.
“Harirajan faced similar injuries with bruises on chest, head, stitches above his right eye and bleeding from both ears. His eyes were still wide open while in the mortuary.
“Suaram demands an explanation over the condition of this young man in the hospital mortuary.
“How does he end up with blood stains on his body if the prison authorities claimed that he died of HIV?” Suaram coordinator R Thevarajan said in a statement.

This is the fifth custodial death in a Penang police lock-up.
37-year-old labourer Murugan Muniandy died at the Seberang Jaya Hospital.
Photos taken of him by a family friend after 10 days allegedly showed that he had visible bruises on his chest, right arm, shoulder, thigh and ribs.
The family saw bruises and injury markings on his back, right shoulder, arm, thigh and chest when they cleaned his body for funeral rites.

Police detainee dies with severe bruises

Penang police are under scrutiny again after yet another custodial death. In the latest incident, 37-year-old labourer Murugan Muniandy died at the Seberang Jaya Hospital, from severe sepsis secondary to pneumonia two days ago.
The father of three, who lives with his mother in Teluk Indah, Prai, was arrested for suspected drug possession at his house at 1.30pm on March 31.
The next day, he was sent to the Bukit Mertajam Hospital and was warded for five days before being sent to the Seberang Jaya Hospital.
Photos taken of him by a family friend after 10 days allegedly showed that he had visible bruises on his chest, right arm, shoulder, thigh and ribs.
However, his body was cremated on Sunday, as the family feared police may come for other family members.

DAP leader calls Zahid, IGP ‘thugs’ after latest death in police custody

A fifth custodial death in a Penang police lock-up has led a DAP lawmaker to accuse the Home Minister and the Inspector-General of Police of acting like “thugs”.
Deputy Chief Minister II Dr P. Ramasamy blasted Datuk Seri Ahmad Zahid Hamidi and Tan Sri Khalid Abu Bakar following the latest death in custody.
M. Murugan, 37, died at the Seberang Jaya Hospital on Saturday while in police custody.

*An interesting development!
On 11 April:
9.30am: the postmortem started.
10.00am: Jabatan Agama Islam Kajang came and informed the deceased family that Harirajan is a muslim.
The family was shocked but Harirajan’s sister, Siti Hajah Kavitha, a muslim, asked JAIM when Harirajan had “sunat” and sat for the “Khrusus masuk Islam”. She asked for proof of convert ID.
JAIM had no answers and left.
3.00pm: JAIM came again and informed the deceased family that JAIM had no proof of conversion and the family could take the body.

The deceased family requested the pathologist for the post-mortem report which he refused to give and the family refused to take the body until they get the post-mortem report.

Family wants answers over death in prison

The family of N Harirajan’s want answers after the 34-year-old was found dead in Kajang Prison.
PKR legal bureau deputy chief S Jayathas who took up the matter for the family said they were informed on Thursday by prison authorities that Harirajan had died of AIDS.
However, Jayathas said the condition of Harirajan’s body raised suspicion for his family when they saw his body at Kajang Hospital.
When the family saw the body, they were shocked to see bruises at the chest, head, stitches above the right eye and both ears (were) bleeding,” he told Malaysiakini when contacted.
Jayathas said the family were asked to sign the release forms to claim the body.
Harirajan’s brother, N Harikrishnan, 31, refused to sign the documents, insisting on a post-mortem to determine the cause of death, said Jayathas.
Harikrishnan had since also lodged a police report at the Kajang district police headquarters.
Jayathas said a post-mortem was subsequently conducted the following day but the report had yet to be available.
