KUALA LUMPUR, Jan 14 — Sangeet Kaur Deo, the daughter of former DAP chairman Karpal Singh, has filed an application in the Kuala Lumpur High Courts against the Chief Justice of Malaysia Tan Sri Richard Malanjum.

She is seeking declarations on the latter’s position, due to his alleged failure to perform his duties involving two separate cases — Karpal’s appeal over sedition in the Court of Appeal, and Hindu mother M. Indira Ghandi’s case.

She said Malanjum had failed to investigate and complete investigations on two separate allegations of judicial interference in the said cases.

“I today filed an application in the Kuala Lumpur High Court through my solicitors, Messrs Karpal Singh & Co. against the Chief Justice of Malaysia, seeking declarations in relation to his duty as the Chief Justice in light of his failure thus far to investigate and complete investigations, relating to two very serious allegations of judicial interference within the Malaysian judiciary in the following cases, which have been widely publicised,” she said in the statement.

“It is hoped that the Malaysian Bar will also take a stand in this matter as such serious allegations attack the integrity and credibility of the Malaysian judiciary,” she added.

Last year, Sangeet filed a police report after a Facebook posting by lawyer Mohamed Haniff Khatri Abdulla claiming that a senior judge interfered with the outcome of the late DAP stalwart’s sedition appeal in 2016.

In September, Minister in the Prime Minister’s Department Datuk Liew Vui Keong said further action on allegations of the judicial interference will only be taken once the internal investigations by the Chief Justice’s office is completed.

Liew, who is in charge on matters of the law, said this when referring to the judicial meddling claims by senior judges in the unilateral conversion of M. Indira Gandhi’s children and the late parliamentarian Karpal Singh’s sedition trial.

Richard was previously reported saying that he had taken note of the allegations and that internal probes were being conducted after media statements on both the cases were issued.

Court of Appeal judge Hamid Sultan Abu Backer had last year revealed that he had been reprimanded by a top judge for writing a dissenting judgment two years ago in the case of the unilateral conversion of Indira’s children.

Hamid had written, among others, that the conversion of the children was illegal as the permission of the mother had not been obtained.

Hamid further alleged that as a result, he was not assigned to hear cases involving public interest and those related to the federal constitution.

PETALING JAYA: The lawyer who claimed that a senior judge had meddled in the late Karpal Singh’s sedition appeal in 2016 says he is only willing to identify the person if the claim is investigated by a Royal Commission of Inquiry (RCI).

Mohamed Haniff Khatri Abdulla had earlier created a sensation when he charged that Karpal’s sedition appeal (which went ahead after his death in 2014) two years ago was altered due to judicial interference by a senior judge.

His revelation led Karpal Singh’s daughter, Sangeet Kaur Deo, to lodge a police report on Aug 23 over the issue, urging the police to investigate Haniff’s allegation of judicial interference which resulted in Karpal’s sedition conviction.

Haniff said he had given his statement to the police on Thursday (Aug 30) following Sangeet’s police report.

In a Facebook post, Haniff said he did not reveal the identity of the judge or the source of information to the police when giving his statement as he believed the only appropriate forum to investigate the matter fairly was through an RCI.

“I also informed the police officer that I was prepared to name the source who gave me the information to a special task force prior to the establishment of the RCI, as well as during its proceedings when it is convened,” he said.

Haniff urged de facto law minister Datuk Liew Vui Keong to set up a special task force and an RCI accordingly.

My father’s appeal against his conviction for sedition was not allowed today. However, his appeal against his sentence of RM4,000.00 was allowed and reduced to RM1,800.00. This means that he would not be disqualified as MP for Bukit Gelugor if he was alive and that his widow, my mum, is entitled to his pension. Mr Karpal contributed immensely to Malaysia and her development. Even his enemies will agree. He is, and will always be, a towering Malaysian!

Appeals Court upholds sedition conviction of late Karpal Singh

GURMIT KAUR WILL APPEAL AGAINST THE CONVICTION OF KARPAL SINGH FOR SEDITION.

A three-member panel chaired by Justice Datuk Aziah Ali granted the application by Gurmit Kaur, who is also the administrator of her late husband’s estate, to act as substitute appellant.

The panel, which also comprised Justice Datuk Zakaria Sam and Datuk Abdul Rahman Sebli, set Jan 21 next year to hear the appeal.

Her lawyer and son, Ramkarpal Singh, said on Monday that the family wanted to pursue the appeal to clear his father’s name.

PUTRAJAYA: The Court of Appeal here today allowed the widow of the late Karpal Singh to proceed with his appeal against conviction for sedition and the RM4,000 fine imposed by the High Court.

Ram Karpal Singh said the family wanted to pursue the appeal to clear his father’s name.

Acting as counsel, he said if Gurmit Kaur succeeded in the appeal, she would have the right to receive her husband’s pension.

On Aug 21, his family filed the petition of appeal, stating among others, that the High Court judge who found Karpal Singh guilty of sedition failed to consider the latter’s defence that the ruler’s decision could be challenged. – Bernama

The Government may drop its appeal but Karpal’s wife and children won’t!

The deputy public prosecutor’s office has withdrawn its appeal over the sentencing of the sedition conviction on the late former Bukit Gelugor MP Karpal Singh.

However, the family will appeal the case under the name of his wife, Gurmit Kaur, who is the administrator of his estate.

Gov’t withdraws appeal for Karpal’s jailing

The deputy public prosecutor’s office has withdrawn its appeal over the sentencing of the sedition conviction on the late former Bukit Gelugor MP Karpal Singh.

A letter dated June 16 was sent to Karpal’s family by Putrajaya’s Court of Appeal deputy registrar Darmafikri Abu Adam.

“In line with the Rule 73(2) of the rules of the Court of Appeals in 1994, the appeal notice we filed on June 9 is deemed cancelled by the Court of Appeal and is taken off the court register,” read the letter.

Bukit Gelugor MP Ramkarpal Singh said the family remain clear and steadfast that Karpal should not be convicted in the first place.

“No doubt, Karpal is no longer here, but we will continue to appeal the case under the name of his wife and my mother Gurmit Kaur, who is the administrator of his estate,” Ramkarpal said.

“We will take the necessary steps to file the case. We need to replace Karpal’s name with Gurmit’s,” he added.

“If Karpal’s conviction stands, his estate which my mother administers will be deprived of his pension,” Ramkarpal said at a press conference in Air Itam today.

Karpal, 74, can be jailed for not more than three years or fined no more than RM5,000, or both. If this sentence is passed, he will automatically lose his parliamentary seat.

Turning to DAP adviser and long-time comrade Lim Kit Siang, Karpal smiled and said: “This is not the first time I’ve been convicted.”

Karpal guilty of sedition against Perak ruler

DAP chairperson Karpal Singh was found guilty by the High Court today of making seditious remarks against Sultan Azlan Shah’s removal of then Perak Menteri Besar Mohammad Nizar Jamaluddin five years ago.

The decision in the long-running case was delivered by Justice Azman Abdullah.

Mitigation for the sentencing will be held on March 7 to allow time for the defence to produce Karpal’s medical report.

Karpal, 74, can be jailed for not more than three years or fined no more than RM5,000, or both. If this sentence is passed, he will automatically lose his parliamentary seat.

Speaking to media, the Bukit Gelugor MP said he would appeal the conviction within two weeks.
