Federal Territories Minister Tengku Adnan Tengku Mansor “misled” the Dewan Rakyat in saying there is a court order allowing the demolition of Kuala Lumpur’s Sri Muneswarar Kaliyamman Temple, Subang MP R Sivarasa said.
He said that this was because the court itself had stressed that there is no order for the temple’s demolition.
In his May 30, 2013, judgment, Justice VT Singham said that the July 5, 2012 judgment “does not include any order of demolition of the wall of the temple building and it is also not an eviction order”.
“Tengku Adnan misled the House but the question is, did he do so knowingly?
“If yes, it is contempt of the House and should be referred to the rights and privileges committee.
“If he did so unknowingly, he has to explain which officer misled him into believing there was a court order and what actions will be taken against that officer,” Sivarasa said.

The demolition order on the Sri Muneswarar Kaliyaman Hindu temple at Jalan P. Ramlee earlier this month came from Federal Territories Minister Datuk Seri Tengku Adnan Tengku Mansor, his deputy Datuk J. Loga Balan Mohan said.
At a closed-door meeting with the temple management at the City Hall headquarters in Kuala Lumpur today, Loga Balan said the order did not come from him but was instead a directive from his boss.
“The power to demolish lies with the minister,” he said, maintaining, however, that the temple was not demolished
“The temple is still there,” Loga Balan said at the meeting which was also attended by Batu MP Tian Chua, Malaysia Hindu Sangam (MHS) president Datuk R.S. Mohan Shan and several members of media.
This caused an irate member of the temple’s legal team, G. Sivamalar, to rebut Loga Balan’s claim.
“Deities were remove… how can you say the temple was not demolished?” Sivamalar said.
When Loga Balan insisted that it was Tengku Adnan who had “veto” power in the matter, the temple management committee demanded to meet Tengku Adnan and told Loga Balan he was of no use to the discussion as he did not have the power to execute any effective action in the matter.

If Federal Territories Minister Tengku Adnan Tengku Mansor’s definition of temples is anything to go by, not a single Hindu temple could have been built in Malaysia, said the Malaysian Hindu Sangam.
“Because to build a temple according to our religion’s rules, we will need at least five acres of land for all aspects (of the temple) to be considered,” said its president RS Mohan Shan.
He said this is to accommodate requirements such as ponds, halls, and the temple itself, however, the government does not allocate land for this.
“The government is not allocating us any land for Hindu temples. Most of our temples are illegally built because we do not get proper land for these thing,” he claimed when contacted.
Mohan was asked to comment on Tengku Adnan’s insistence that the 101-year old Sri Muneswarar Kaliyamman temple, which was partially demolished on Sunday, was actually a “shrine”.

Mohan said that while the Hindu Sangam recognises that many Hindu temples are not up to specifications, the federal minister should not have the final word on Hindu affairs.
“I welcome it because he learnt about Hinduism as a Muslim and it is good, but he should not be the authority to decide anything on Hindu rites.
“The decision board should be Hindu Sangam or any (Hindu) religious body,” he said, referring to Tengku Adnan’s claim to have knowledge of Hindu religion.

Federal Territories Minister Tengku Adnan Tengku Mansor has refused to be drawn into an argument with Deputy Minister in the Prime Minister’s Department P Waythamoorthy over Umno minister’s interpretation of Hinduism.
“Why you want to pitch me against him? He is a cabinet member. I wouldn’t like to be pit against one another,” Tengku Adnan told reporters at the Parliament lobby today.
Pressed further on this, Tengku Adnan skirted the question and stressed that there were people who would take advantage of religion, such as PAS and the Shiite sect, for non-religious motives.

…instead of rebuking DBKL, Federal Territories Minister Tengku Adnan Mansor defended the act, saying the DBKL was attempting to ‘beautify’ the sacred place.
The most mind boggling comment came from none other than the MIC president G Palanivel, who said only stalls at the vicinity were removed. But the entire episode has left several questions unanswered.
The main question is that why would Tenaga Nasional Berhad (TNB) and Syabas cut off power and water supply to the temple if it was an attempt to beautify the place?
On top of that, why would the Federal Territories Ministry choose to ‘beautify’ the temple at 7am on a weekend, with about 300 officers from five government agencies being present there.
The agencies involved on the day were from DBKL, Land and Mineral Department, TNB, Syabas and the police.
Now, can anyone recall when was the last time five government agencies got involved in a temple issue, unless a demolition is taking place?
The unusual thing about the whole ‘beautifying’ process is that the police cordoned all main roads leading to the temple, Jalan Raja Chulan, Jalan Sultan Ismail and Jalan P Ramlee, to ensure no one approached the area.

The legal adviser to the Sri Muneswarar Kaliyaman temple in Kuala Lumpur has rubbished Federal Territories Minister Tengku Adnan Mansor’s claims that the temple was used for shady activties and that hard liquor was found on site.
“People can plant whatever they want. We have been working closely with the temple committee and the chairperson is someone of high discipline,” M Manogaran said when contacted.
Manogaran, who was the DAP’s Teluk Intan MP, said even though the authorities have stated they will not touch the main temple hall, its wall is now damaged and at risk of collapse.
This was the result of the demolition of the annexures, which included the caretakers’ living quarters that is attached to the main temple located on Jalan P Ramlee.
Manogaran also said MIC chief G Palanivel is mistaken in claiming that the temple has not been demolished since the main structure is still standing.
“Parts of the areas that were demolished include altars with deities on them. So how can he say these are not part of the temple?” he asked.

Calling the temple along Jalan P Ramlee in Kuala Lumpur not a proper temple but a “shrine”, he alleged that illegal activities were being carried out there according to his ministry’s checks.
“Recently we sent a Hindu priest to the place, the priest wanted go the bathroom, he insisted to enter, and in the bathroom he found liquor and alcohol, whiskey.
“I hope they don’t abuse (the temple),” he said at a press conference today, adding that the priest was from India and was knowledgeable.
“I want to beautify it and make it a tourist attraction, I want to make it like the four-face Buddha in Thailand. That is what I hope,” he said.
“We will beautify the temple immediately, make sure it will be done quickly,” he added, saying the developer Hap Seng will come up with the quotation for the cost of the temple’s renovation.
The minister further said his ministry will maintain the temple after it is “beautified”.

Putrajaya reiterated its claim that the 101-year-old Sri Muneswarar Kaliyaman Hindu temple was a shrine and not a temple and that it only carried out yesterday’s demolition after consulting a Hindu priest.
Federal Territories Minister Datuk Seri Tengku Adnan Mansor said the priest visited the shrine prior to Deepavali and found only six worshippers.
“The priest went to the toilet, and he found hard liquor stored inside. The priest said that it’s a disgrace to his religion,” he said today.

By noon, only the temple’s prayer hall and its five-metre tall gopuram (a monument tower) in front of the hall remains standing, while the bulldozers shifted work to focus on loading rubble onto trucks for disposal.
Padang Serai MP N Surendran said the demolition works have gone beyond the additional eight feet of land that the developer had demanded.
“Suddenly they have gone on and effectively destroyed the temple,” he said.
He claimed that DBKL had arrived without warning at about 7am and proceeded with the demolition works.
He said the demolition was done in bad faith as retribution against the temple committee’s steadfast resistance to the developer’s demands.
This is because the demolition despite the temple committee had already fixed a meeting with the Federal Territories deputy minister Loga Bala Mohan Jayanathan, he said.

KUALA LUMPUR: The Sri Muneswarar Kaliyaman temple off Jalan P Ramlee was demolished this morning despite a meeting pending with the deputy minister of the Federal Territories Ministry later this month.
Temple president R.A. Balasubramaniam said the officers from Kuala Lumpur City Hall (DBKL) along with several policemen came to the temple as early as 7.30am.

By 11am, parts of the temple building had been torn down. A bystander, identified as Mohan said he was unsure if the main temple would be demolished today.
By 11.15am, several tractors were seen tearing down the main temple building, including the roof. City Hall officers were seen collecting household items and putting them at the side to be handed over to the temple committee.
A reporter from AFP was heard saying that City Hall officers came as early as 7am and went straight away about their jobs.
By 11.45am, only part of the main building and shrine was left undemolished.

When contacted today, temple secretary Nalini Nani confirmed news that lawyer and PKR leader S Jayathas has been detained at the temple site.

Datuk Seri Tengku Adnan Tengku Mansor stepped into a minefield when he “downgraded” a century-old Hindu temple into a shrine and then pointedly asked why the authorities “always had problems with temples and not churches, mosques or Chinese temples”.
The attitude of the Federal Territories minister to a sacred Hindu spot hit a raw nerve among other politicians and the head of the Malaysia Hindu Sangam, who responded strongly today.

KUALA LUMPUR – In comments that critics said reeked of racial prejudice and are bound to further upset the Indian community in Malaysia, Umno minister Tengku Adnan Mansor questioned why was it that Indian temples always gave the authorities “problems”, but not the Chinese temples, churches or mosques.
“Why do we always have problems with temples? Not with churches, mosques nor Chinese temples… why? Ask yourself, don’t ask me,” Malaysian Insider reported Tengku Adnan, or Ku Nan as he is often called, as saying on Monday.

“The way the DBKL officers did the demolition was also unbecoming of their posts, as they had disrespected the Hindu religion by walking into the place of worship with boots on,” he said.

KUALA LUMPUR: MIC Youth today took the Federal Territory ministry and Kuala Lumpur City Hall (DBKL) to task for false claims over a Hindu temple demolition at Jalan P Ramlee here on Sunday.
C Sivaraajh, the wing national secretary urged the minister Tengku Adnan Tengku Mansor and his special aid R Ramanan to be more careful when issuing statements on the demolition of the Sri Muniswarer Kaliyamman temple.
“Daily they make contradicting statements. First they said it will not be demolished. Then they admitted that part of the temple was demolished. Later both claimed that DBKL is merely repairing the road in front of the temple.”
In the latest development, Tengku Adnan said that the enforcement officers will only demolish a small portion of the canteen and an illegally erected restaurant within the temple vicinity. “So, who is telling the truth?” asked Sivaraajh during a press conference after meeting the temple committee.
“It is a temple. There is no restaurant inside or outside the temple,” he said.
“Being a minister, Tengku Adnan, and Ramanan who oversees the Indians’ issues in the Federal Territories ministry should be more accurate on this matter,” he added.
“Their false statements may tarnish the Federal Territories ministry and BN reputation in the public eye.”

Force unnecessary in removal of temple statues, says Hindu Sangam
Police and City Hall should have consulted with Muneswarar Kaliyaman temple officials before forcing their way in and removing statutes of deities without observing Hindu religious practices.
Malaysian Hindu Sangam president Datuk RS Mohan Shan said the authorities’ forceful removal of the deities by non-Hindus who do not know Hindu religious practices is a grave mistake.
“There is no excuse for such arrogant behaviour,” he said in a statement today.
Mohan Shan also criticised Datuk R. Ramanan, the special officer for the Federal Territories Minister Datuk Seri Tengku Adnan Tengku Mansor, for supporting the actions of the authorities.
“It is surprising that Datuk Ramanan is totally ignorant that all activities within the temple must be carried out in accordance with Hindu religious procedures,” he said.

Catholic Bishop Dr Paul Tan Chee Ing said he found it “incredible” that in the prevailing mood of hypersensitivity over religious matters, a longstanding Hindu temple in an upscale area of Kuala Lumpur could be subjected to acts of desecration that have riled devotees of the religion and all others who valued freedom of religion.
The head of the Catholic Church in the Malacca-Johor diocese said that what had happened on Sunday to parts of the 101-year-old Muneswarar kuil in Jalan P Ramlee in KL would “accentuate the existing mood of being embattled felt by religious minorities in this country.”

“The authorities appear to have forgotten the episode of barely five years ago when the pulling down of a longstanding Hindu temple in Shah Alam battered the feelings of followers of the religion to such an extent that the action was said to have influenced their vote in the polls that followed not long afterwards,” remarked the bishop.
“One would have thought that that incident and its consequences would have been a chastening lesson for the authorities such that they would tread carefully henceforth,” mused the Jesuit-trained prelate.

Putrajaya has moved to placate Malaysia’s minority Hindus, assuring them today that a 101-year-old temple in the centre of Kuala Lumpur will not be demolished to make way for a pavement.
The attempted demolition yesterday attracted scores of worshippers to protect the temple, raising the temperature in Malaysia’s religious landscape and pitting the ruling Barisan Nasional (BN) government against politicians from its own coalition.
The location of non-Muslim houses of worship is a hot-button issue, with several incidents of temples being torn down or relocated due to development, especially in central Selangor.
The temple demolitions were among the factors that led to the ruling BN losing Selangor and its two-thirds super majority in parliament in the past two general elections.

The move by Kuala Lumpur City Hall to seize the land on which the Sri Muneswarar Kaliyaman Hindu temple sits in Jalan P. Ramlee is illegal, said a lawyer for the temple committee.
Legal adviser M. Manogaran said the committee will not concede to the land being taken away.
He added that it was state land under the purview of the Federal Land Commissioner, and it does not belong to the developer.
“The action was illegal. City Hall was not acting on a court order or a legal notice. Why is City Hall allowing itself to be used by a private developer who wants to get their hands on the land?” he questioned.

PETALING JAYA: A PKR MP was assaulted by gangsters when he tried to stop Kuala Lumpur City Hall (DBKL) officers from demolishing the 101-year old Sri Muneswarar Kaliyaman Hindu temple in Jalan P. Ramlee.
Padang Serai MP N Surendran claimed that the plainclothes thugs were hired by DBKL to rough up the protestors, and were directly receiving instructions from uniformed DBKL officers to assault him.
“It’s terrible because I had been aggressively assaulted by gangsters. They were in plainclothes, but were given instructions by DBKL,” he told FMT.
“Four of five men surrounded me and shouted that they’re going to whack me, then they pushed me in the chest. It was aggressively done… they didn’t care if I was an MP.

However, Raman Ramakrishnan, an aide to Deputy Federal and Urban Wellbeing Minister Tengku Adnan Tengku Mansor, told the temple officials later that DBKL was only trying to erect a retaining wall.
“It is not to demolish the temple,” he said, adding that the temple had encroached into government land and the wall will serve as a boundary.

MIC President G Palanivel said the demolition works at the site of the historic Golden Triangle Muneswarar Kuil at Jalan P Ramlee is okay as long as the temple is not touched.
When asked by reporters about the incident today after being re-elected as the president of MIC unopposed, Palanivel said he had written to Federal Territories and Urban Well-being Minister Tengku Adnan Mansor to stop him demolishing the temple.
“In the last cabinet meeting I wrote a letter to Tengku Adnan. They wanted to put out the existing temple in the city area, so I presented a paper and he agreed to keep it.
“So they wanted to demolish all the other shops and all that, but that is okay.

MIC Youth chief T. Mohan became the latest politician to be held by police in a protest to stop Kuala Lumpur City Hall from demolishing the 101-year-old Sri Muneswarar Kaliyaman Hindu temple in Jalan P. Ramlee in the capital city today.
Police have also arrested a few others in a commotion outside the temple as more supporters stream into the area to stop the demolition.
All those held were handcuffed and taken to the Dang Wangi district police headquarters.
This morning, police detained PKR’s S.Jayathas when he tried to stop the demolition to make way for a pedestrian walkway as temple lawyers negotiate with the authorities.

“These DBKL officers smashed three deities and took them out. We confronted them and asked for a negotiation but they continued to work until 10.30am until the cops came in and asked them to leave,” Surendran told The Malay Mail Online when contacted.

“It is illegal — that is my position as the temple’s lawyer,” he said.
Surendran said in the over two-hour long confrontation this morning, several men he labelled as “gangsters” taunted those who were attempting to call off the demolition.
The Padang Serai MP said the “gangsters” roughly pushed him around.
