KUALA LUMPUR – Malaysia’s notorious bloggers Alvin Tan and Vivian Lee are hoping for the best in the case launched against them by the government over a Ramadan greeting they had posted on Facebook that the authorities alleges insults Islam.

“Yes,” was Alvin’s response when pressed by reporters outside the court house on Friday.

Apart from that response, the couple who looked fit and cheerful refused to comment.

Their reticence is understandable given the readiness shown by many of the extreme Muslim groups that have mushroomed of late in Malaysia to jump on the case, and add further sizzle to their already heated situation.

Meanwhile, their lawyer Chong Joo Tian has filed a challenge to the charge under Section 298A of the Penal Code two days ago.

“This is based on constitutionality. If we win this, then Alvin and Vivian will only have to fight the other 2 charges,” Joo Tian told reporters.

If found guilty of all three charges, Alvivi face a maximum jail sentence of 15 years each.

AFRAID OF DETENTION REVELATIONS? Monitor Alvivi’s blog postings – minister tells public

KUALA TERENGGANU – Communication and Multimedia Deputy Minister Datuk Jailani Johari has urged members of the public to monitor controversial couple Alvin Tan and Vivian Lee’s blog for any possible seditious posts.

“I urge the public to help monitor the couple’s blog and social networking sites and report the same to the authorities,” he told reporters here today.

Commenting on their conditional release on bail yesterday, Jailani said stern action would be taken against the bloggers if they breached the court’s conditions.

Yesterday, High Court judge Datuk Mohd Azman Husin released them on RM30,000 bail in one surety each, with four conditions.

The conditions are, their passports compounded, they must report to the nearest police station once a month, are prohibited from posting obscene photographs, provocative comments or articles which touch on religious and racial sensitivities, and prohibited from using network communication devices for the same purpose.

Newly-released sex bloggers, Alvin Tan and Vivian Lee now have to watch their backs as many threats have been hurled at the controversial couple.

The threats have been rampant on social media networking sites, including Facebook, where a group has released the pair’s personal details such as addresses, IC numbers and their relatives’ details.

Their picture was also put up with a menacing caption – “KILL – If you hurt or kill this scum in front of me I will make like I didn’t see” – has been circulated widely.

The Star reported that the overwhelmed ‘Alvivi’ then tweeted “Mercy please” from their now-deactivated Twitter account.

As for the threats made against his clients, Chong said that they would lodge a police report and seek protection from the cops should there be any need.

KUALA LUMPUR: After spending a week in prison, sex bloggers Alvin Tan Jye Yee and Vivian Lee May Ling were finally granted bail. But they will have to spend yet another night behind bars and are likely to be allowed out today after they sign their bail bond.

The High Court here granted the two bail of RM30,000 in two sureties each yesterday.

KUALA LUMPUR -The Kuala Lumpur High Court has granted bail for Alvin Tan and Vivian Lee but impounded their passports and ordered them to report to the police station on the first day of every month pending their trial.

Nonetheless, the duo can go home as soon as the bail is settled by the families, said their lawyer Chong Joo Tian.

Chong also told the court that Alvin had been placed under isolated detention for a week by the prison authorities.

“This is vindictive and punitive. Even before he is tried, he is being punished,” said Chong.

Alvin’s mother, who was in court listened intently, nodding her head at this.

Later, when she was chased by reporters for her reaction to the granting of bail, she declined comment and scolded some of them for being “unethical” when they persisted and did indeed breach the unspoken line.

Judge Datuk Azman Husin granted Alvin Tan and Vivian Lee bail of RM30,000 bail with two sureties each, after allowing their revision application for three charges against them last week.

He also ordered their passports be impounded and prohibited them from uploading any offensive articles, comments or provocative and pornographic photographs that touches on racial and religious insensitivity.

The judge also prohibited the couple, who are popularly known by the name “Alvivi”, from using any network communication device such as smartphones for the purpose of inciting racial or religious tension.

Court allows bail for Alvivi but sets conditions

Sex bloggers Alvin Tan and Vivian Lee have been allowed total bail of RM30,000 each, with two sureties, by the High Court in Kuala Lumpur.

Bail was set at RM10,000 on each of the three charges Tan and Lee each face before the Sessions Court in Kuala Lumpur.

High Court judge Mohd Azman Husin, who allowed bail, imposed three strict conditions, including the impounding of their passports.

“The court allows the revision application based on Section 323 of the Criminal Procedure Code and Section 35 of the Courts of Judicature Act 2012,” Justice Azman said.

The court also ordered Tan and Lee not to upload materials or have access to smart network devices (smartphones) to upload materials that are provocative, pornographic and obscene and touch on religious and racial sensitivities.

Making the decision in chambers, Justice Azman also set another condition for the couple to report to the nearest police station on the first of every month.

This follows the couple’s application for a revision of the sessions court’s denial of bail to them.

Alvivi, as the duo are also known as, had posted on their Facebook page a photo of themselves eating bak kut teh (a herbal soup dish that is usually made with pork, but which can also be vegetarian or made with chicken or other meats) with the greeting Selamat Berbuka Puasa or Happy Breaking Fast.

They described their meal as “fragrant, delicious and appetising bak kut teh”, and also put at the corner of the photo a ‘halal’ or kosher logo.

“There has been quite a lot of talk about these 2, the young man and woman. They have purportedly been so insensitive during this fasting period to use ‘bak kut teh’ to break fast. But I heard it seems they did it in a ‘mamak’ (Indian Muslim) restaurant but there is no proof (of this talk),” MP for Wangsa Maju Tan Kee Kwong told Malaysia Chronicle.

“Whatever it is, if you follow the due process of the law they should be allowed bail. After all, they are not charged for murder or trying to blow up the country or something terrible like that and that is why the country is not happy. For certain people, you use the full weight of the law… (like) these people, they may not be so matured, they may be misguided and insensitive but they are still entitled to the full process of the law.”
