Suhakam halts inquiry into Pastor Koh’s disappearance on IGP’s request

KUALA LUMPUR: The Human Rights Commission of Malaysia (Suhakam) has put an abrupt halt to its public inquiry into the disappearance of Pastor Raymond Koh (pic) after receiving a letter from the police to cease the inquiry.
Commissioner Datuk Mah Weng Kwai revealed that Suhakam received a letter from Inspector-General of Police Tan Sri Mohamad Fuzi Harun at 3pm on Monday (Jan 15) asking it to stop as there was a court case pending.
According to the letter, part-time driver Lam Chang Nam, who claimed trial to extorting Koh’s son last year, had been charged under Section 365 of the Penal Code for kidnapping or abducting on Monday (Jan 15).
It added that Lam was arrested on Jan 12 and appeared in court on Jan 15.
However, no details were given on whether the suspect was on remand or out on bail.
“Given the circumstances and the developments yesterday (Jan 15), we have decided that we will immediately cease the inquiry until further notice,” said Mah on Tuesday.
He cited Section 12(3) of the Human Rights Commission of Malaysia Act that states that it should “immediately cease” an inquiry if the allegation becomes the subject matter of any court proceedings.
However, Mah said that Suhakam would proceed with the inquiry into the disappearance of social activist Amri Che Mat, Pastor Joshua Hilmi and his wife, Ruth Sitepu.

Ex-Uber driver now charged with kidnapping pastor Koh
Former part-time Uber driver Lam Chang Nam, 31, was charged at the Petaling Jaya Magistrate’s Court yesterday with kidnapping pastor Raymond Koh.
According to the charge sheet, prosecutors claimed that Lam, along with seven others who are still at large, had committed that act in Petaling Jaya at approximately 10.25am on Feb 13 last year.
If found guilty, Lam could be jailed up to seven years and fined.
Lam was charged last March with extorting RM30,000 from Koh’s family, who was told that he could secure the latter’s release.
The kidnapping charge against Lam came amidst intensifying scrutiny on Koh’s…..disappearance, along with three others, by the Suhakam public inquiry.

Although the public inquiry has been proceeding since October last year, Lam was never mentioned in the testimonies by any other police witnesses.
One witness told the public inquiry that he had “no idea” if Koh was still alive.
The police have revealed few little details about developments regarding Koh’s case.
In June last year, the police claimed that they found pastor Koh’s vehicle license plate – ST 5515 D – after a raid in Kampung Weng Dalam, Kedah.
Several suspects were arrested in connection with the case. There have been no public announcements of developments since, other than to suggest Koh’s abduction was linked to groups based in southern Thailand.
Koh was abducted by a group of men in broad daylight in what one cop told the Suhakam public inquiry resembled a “police operation“.

SUHAKAM INQUIRY | Pastor Raymond Koh’s family is shocked by the abrupt suspension of an ongoing Suhakam inquiry into his disappearance.
“It is shocking to us as the family, for we had no idea this was going to happen.
“Our hope when we came to Suhakam was to find some answers to the many questions we had about his abduction,” his wife Susana Liew…..told reporters after the decision was announced by Suhakam inquiry panel chairperson Mah Weng Kwai at the commission’s headquarters in Kuala Lumpur.

Koh’s family lawyer, Gurdial Singh Nijhar, meanwhile, questioned the move by the police to charge someone whom they previously stated was not involved in the kidnapping.
In particular, Gurdial referred to comments made by Selangor Criminal Investigation Department chief Fadzil Ahmat, that Uber driver Lam Chang Nam, who was charged under Section 365 of the Penal Code for alleged kidnapping, ‘had nothing to do with the case’.
“Fadzil, who was the eleventh witness in the inquiry, had publicly declared that Lam had nothing to do with kidnapping Pastor Koh.
“Fadzil, who also heads the task force looking into the abduction of Koh, had said in March last year that their investigations showed that Lam was not involved in the abduction,” he said.
Gurdial…..quoted Fadzil’s comments reported on March 14 last year, one day before Lam claimed trial to the charge of allegedly extorting RM30,000 from Jonathan Koh Szu Hao, 33 – who is Koh’s son – over information related to Koh’s disappearance.
“So the public might ask what is the game plan of the police at this late hour.
“It can be construed by the public that this is a deliberate attempt to derail the conclusion of this inquiry,” Gurdial said.
